A very common question that comes up about the DV lottery is about the requirement to prove you will not become a public charge (i.e. be in need of financial assistance from the government). Many people have a hard time accepting that is even a requirement. Well it is. For sure. Everywhere, for everyone. Got that? OK – let me explain…
For DV lottery there is a set of rules that frequently refer to the Immigration and Nationality Act. Essentially the DV lottery is operated within a framework of immigration law and there are standard aspects of the laws that apply to all immigration cases. The public charge requirement is one such example. The instructions for the DV lottery include information about this in their FAQ (Question 37 in DV2015 and DV2016 instructions). The notes say:-
37. If I receive a visa through the DV program, will the U.S. government pay for my airfare to the United States, help me find housing and employment, and/or provide healthcare or any subsidies until I am fully settled?
No. The U.S. government will not provide any of these services to you if you receive a visa through the DV program. If you are selected to apply for a DV, you will need to demonstrate that you will not become a public charge in the United States before being issued a visa. This evidence may be in the form of a combination of your personal assets, an Affidavit of Support (Form I-134) submitted by a relative or friend residing in the United States, an offer of employment from an employer in the United States, or other evidence.
OK, so it is required. OK???
So how do you prove that you will not become a public charge. The simplest way is to demonstrate that you have enough money/assets to support yourself. This can be in various ways, for example:-
- Bank/other financial statements
- Real Estate/Property
- Stocks/Bonds
- Income from business investments
The CO will be far more interested in “liquid” assets (such as savings in a bank account) than other non liquid assets.
If you intend to show the above you will need to show around $10,000 for each adult, and a bit less for children (for example $25,000 for a family of four, $10,000 for a single person). This can be from a combination of the above.
If you cannot show that level of personal finance a job offer can help, and of course someone already working in the USA on a temporary visa can show existing salary (payslips, tax records, job confirmation letters and so on).
If the selectee cannot provide the above, they may be advised obtaining an “affidavit of support” from a family member or friend already in the USA. The affidavit of support should be in the form of the I-134 which must be filled out by a US legal resident and supported by tax filing records, payslips and so on. The instructions for the I-134 are clear and helpful.
The selectee only needs to provide one I-134 to cover their case (it covers the principal and all derivatives). The income of the person filling out the I-134 should be greater than that shown on the Federal Poverty Guidelines for total number of family members for the sponsor/family AND the selectee/derivatives.
The original (or now scanned/emailed) signed I-134 plus supporting documents is presented by the selectee at the interview IF requested. Not all embassies request it as a matter of course, and some hardly ever request it. However, not providing it if requested can lead to AP/disqualification.
Supporting documents for the I-134 are the sponsors:
- 1040 (annual tax report – most recent copy)
- W2 (annual employee earnings statement if employed – most recent copy)
- Recent Payslips
- Photo ID
The I-134 should be sent to you prior to the interview by mail or scanned and the supporting documents can be photocopies or sent by email.
There are several African countries where the “host” system serves to satisfy the requirements. If the selectee is planning to stay with a host, they could be asked what is the relationship between host and selectee. If there is a good relationship (family, or close friend) the Consular Officer is allowed to use their discretion to take that as evidence that the selectee will not become a public charge.

Its David here. I got a call today from the US embassy. I was told that while trying to issue the visa, a discrepancy was found in the application. The lady who phoned said because I am from an ineligible country and my wife from an eligible country, that my wife should have been the principal applicant. I told her what was and is still in the application instructions is that you can claim eligibility based on your spouse’s country of birth and therefore apply as the principal applicant. The lady said she would seek clarification and call me back. Did i read the instructions wrong? I would appreciate your input. Thank you.

You did not read the instructions wrong – BUT they should have treated you BOTH as principals. So – they may ask for proof of your wife’s education.

Today, I called them and was told they were busy printing our visa. Checked the status online and it’s issued. Can you believe it? Two days before all ends. Can’t hide my joy. It’s David again and I promise this is my last question.
My wife is heavily pregnant and traveling at this point might be a challenge. We are still waiting for the Physician’s verdict.
My wife has proposed that I travel first to activate my visa and return. When the new baby is born, we all (myself, wife, daughter and new born) travel to the States together and then they activate their visas.
I am the principal applicant (born in Nigeria) but became eligible (cross chargeability) based on my wife’s country of birth (South Africa).
My visa shows DV1, my wife’s DV2 and my daughter’s DV3. The embassy never requested any documents from my wife, they processed the visas with my documents alone.
My questions:
1) Can I travel alone without my wife and daughter to activate my visa seeing I became eligible by claiming her country of birth?
2) Do I travel only with my sealed immigrant pack and leave my wife and daughter’s behind?

First, You must all enter the USA before the expiry date on each visa.
Second, there would normally be an annotation on your visa that points out the need to enter with your wife as your chargeability was to her country. Is that not there?
1. I would not recommend that since your chargeability was to her country. If they ever “realize” and figure out whether you entered with her or not, that could become important.
2. If you decide to travel on your own, yes.

We have been in the States a year now and God has been good to us.

My son was born and brought into the States on the 1st April 2019.
And guess what CBP lost all his documents. After many months of back and forth between CBP and USCIS, I had to take copies of his documents to CBP. They assigned him an A-number and forwarded his package to USCIS.
Today, a call centre agent of USCIS confirmed that my son is in their system, but that I have to file I-130 form for $535 and another I485 form for $1140.
Is this information correct? Myself and wife and daughter only paid $220 each for our green card.

Long time listener second time caller. I assume you don’t get much information from Japan but thought I’d ask anyway. Is a Japan known to approve base on host or do they require an I-134? Second question is I have no liquidity, 4 years into a 35 year mortgage (on a house), and 5 into a 6 year car loan. My assets and plan that I am formulating to liquidate might be enough to prove financial stability for a family of 3 but since I’m a worrier I have a few qualified sponsors that have agreed to sign the I-134 and provide the necessary documentation. He has a decent income to support as a sponsor. Unlike what you have written above regarding ‘supporting documents for the I-134’, I have been advised to present the sponsor’s tax return documents of 3 years (instead of just a recent one) along with I-134. Has the rule changed this year?

It’s me again….Common sense says that physical address of the beneficiary (I-134) has to match the US address on the DS 260. I just need reaffirmation on this so the I-134 does not become obsolete.

It normally needs to be booked. Other than that, the visa expiry date will be based on the medical date (plus 6 months), so by having the medical early you are reducing the validity time of the visa.

My friend (U.S Citizen) who I asked to fill I-134 for me just informed me:
“I’m working on the form 134. The directions say to send it directly to the government agency so I will be doing that.”
I beleived that he needs to send it to me so I can have it with me during my interview, but he said as above that he will send it to government agency directly! Which I think this direction only if I’m already in U.S but not like my case of immigration interview.
Could you please clarify to me where he has to send it or is it possible to send it to a government agency although I need it with me during the interview?

It is to be carried by you to the interview. It is only to be produced if the CO asks for it, or discusses financials. The form is not legally binding on the sponsor, so doesn’t need to be verified or witnessed or any such process.

A DV winner with HIV positive status with I-134 (sponsor income 80k-100k) is an alert for possible public charge?
Currently medicines are being paid with public charge status in original country by government and it is possible to keep that status lifetime so that person can fly out of the US and get 1 year supply of medications.
Is informing that plan is a red flag because the person is already a public charge but not telling that plan also brings a question how the person is going to afford medications.

It’s David again. Since the last time I sent them the link to the DV Chargeability rule, I have heard from them thrice. First was the reply to the email containing the rules. The reply stated that they are aware of the rule to which I refer and that they are currently seeking advise on the issuance process and will contact me shortly. Didn’t hear from them and I contacted them again when I needed my high school certificate (which they held) in order to register for Doctoral studies. The reply said the case is still being processed and do not know when it will be finalised. I have since emailed them twice requesting that they return my certificate because it’s needed for academic and work purposes – the last email was yesterday. They read my email on both occasions as reflected in the case status date update but didn’t reply to indicate when my certificate will be returned.
I do not want to pester them to a point of irritation but at the same time I need the certificate. The consular only said she wanted to make a coloured scan so she could use it as a reference for future applicants with the same certificate.
Please do you have any idea on how I should request the return of my certificate?

1. Assets are only considered at 20% of their value – and you have to get into valuations etc – hard to do. So – focus on INCOME.
2. People only have a W2 if they are employees. So – a 1040 is good for a business owner.

1- The person I know who suppose to fill I-134 for me is hesitating and he told me that he want to apply the form online by agent, and he said then if it is needed by any then they can access the form, is there a way to apply it online in USA instead of having it as hard copy during my interview?
2- The other option he said he can send it to me but he will cross out his social security number, will this make the form useless?
3- In general, If I submit I-134 during my interview, Am I becomes NOT qualified to apply for any government assistance in the future because theoritically I have a sponsor un USA?

I need to clarify small problem. Should the sponsor fill the form and send it to the government bodies to register prior to my interview or filled form with signature is enough to me without registration from the government bodies.

Thanks for your support and effort : My interview is scheduled this month in Riyadh , my sponsor sent me the I-134,for 1040 & W2 he sent Doc for 2016 and I asked him to send 2017 but he said this is last one he filled it, and he used to fill the tax late because he has his own Business and he ask me to explain to Co so:-
1- is that normal to fill the tax in august or is it considered against the rule .
2- is this may lead to reject me .

Im edv winner, and faced to interview, but conslor officer said to need some documents , I-134 form, and IRS tax documents, my sponser sent I-134 form and IRS tex copy (2014,2015 and 2016) but he late to fill tax 2017.
1. is it compulsory to tax 2017 ?

immigrant visa applicant we had our interview on 2nd of july everything was ok except the tax docs and affidavit of support for which we was given 221g CO said ur sponsor have already sponsored 25 families how can he sponsor u they told us to provide new affidavit of support but when i checked with my sponsored he said he didn sponsor any families for past 6 to 7 years and the families which he sponsored previously its been already passed 5 years dat means they automatically are removed frm his sponsorship so what u suggest us to do in this case should we find new sponsor or email nvc regarding this pls support

sir this is F4 category visa where siblings under age 21 are eligible but as per cspa act im also eligible when my mom received notification for interview my name was not there in the list how ever when i chkd online it was showing my name i was confused what need to be done so when my parents went for interview they handed over a paper on my name saying ur visa case is ready for final processings pls follow the instructions like grtting medical finger prints etc so my question here is that as my parents got 221g shall i wait until their visa is stamped or shall i start my process like filling ds 260 n all etc kindly advise

My sponser sent me today the i 134 but he hided the starting of him SSN IN the form and also in the Tax return. Is it issue? He said its secret .
He didnt sent him passport also and told me they will not need it !
Please advise me as i got tierd of thinking and searching and my interview in next August.

My interview on tomorrow in srilanka.
My sponsor sent I-134 original documents filled in ink pen. My question
1. Part 2 (beneficiary) details some wrong. I asked sponsor, he said type print out and annex only part 2nd page,it is correct Brit. If ask about CO I will tell true and see the original mistake page.
2.my sponsor is 69 age retired. His income is good. But he said didn’t need IRS. If you asked CO about the matters please give my contact number I will explain . Is it possible Brit ?
