As the results for the DV 2025 lottery approach, and in case we are drawn, I wanted to ask whether it would be a better idea to stay in the USA [we have a non-immigrant work visa] or to book a visa appointment abroad. I also wondered if our work visa expires before a DV interview [assuming one gets to that stage] can USCIS grant you the ability to stay while you wait for this to happen.

The specifics on that would really depend on your case number, home embassy and so on. It’s best to wait until you’re selected, and then evaluate which way to process your case. I processed my own case via adjustment of status – so that is an option (with pros and cons versus Consular Processing).

The draw is performed in December/January, then they spend some months on screening out many of the entries for various reasons.

Do you know where I can see how many where selected for a certain year from a certain country? Do you have any stats on that here on your site? I would like to see the selection stats and how many of those selected who actually got the Green Card. I am very curious about Sweden. Also, I would of course like to see how many applied from a certain country as well. So applicants, selectees, and those that get to be the holders in the end. That is what I would like to see if possible.

Hi brit simon I have my interview on May 28 but I have a concern when registering for the dv lottery due to lack of concentration I made a mistake on the day of my birth I was born on May 24 but when registering I was due on the 25 May but by filling out the DS260 form I corrected the error and put the correct date which is May 24. My question is to know if this error could cause a disqualification of my application or cause me a problem on the day of the interview. Thank you

I have been getting bad sleep for a few days since I realized that the photo I uploaded for dv2025 is 10 pixels short on head size (it is 290px from chin to top of the hair). Am I disqualified already or are they flexible on this? At human sight, the picture looks good, good background, no smile and size is also correct…

Dear Brit, mine is not a question per say but actually a suggestion to help current and future winners. Please inform winners that the medical exam for the DV could take as long as 2 months if the panel physician suspects a TB. This is particularly so because of State Department Guidelines on TB Exams. By the time you get the results after two months you might not be able to obtain your visa for various reasons including the quota for your country being exhausted. This is a critical information and I suggest every winner get his medicals ready as soon as possible after getting the 2NL.

Well that wouldn’t be good advice for most people.
TB is only common in a few areas of the world, and in those areas the physicians should inform people. No one should book medicals before they get the 2NL, so there is a natural limit to how many weeks before the interview the medical can be scheduled.

You will get instructions when issued. But basically there is a fee that can be paid just before or after entering the USA. The fee being paid and your entering the USA is what causes the GC to be sent to the address in the DS260. They will do that regardless of how long you stay after the first entry.

On the Travel State Gov site, it tells us the following:
( Selected entrants are encouraged to complete the online DS-260 application immediately to schedule an interview appointment at the appropriate U.S. Embassy or Consulate. )

I have an ongoing appeal in the court after I got sentenced to 4 moths in prison, last year. It is dated 4th of June, I will get the whole sentence somewhere between 18th and June the 20th. Will there be a problem if I would wait till then to fill in the DS-260 form? I am asking because I don’t know yet if I will be acquitted in some of the offenses/violations, and thereof don’t know what to put in the crime section of the DS-260 form.
I live in Sweden.
Second question, do you think it would be a problem with this sentence if I would win? Everyone tells me my sentence will get reduced since it was my first crimes, I am indicted of 4 crimes, not so serious really, but still…
I’ve heard that if it is under 6 months, there is usually not a problem, but that can also depend on how long time ago it was or so?

Because the AS region number is (I assume) 16K (not 160K) out of 43K while 42.6K is out of 67K. Plus EU increased selectees by 25% over last year while AS increased by “only” 16%.

However, your chance of being selected is TINY. About 1 in every 200 years. So – no need to think about this further until you find you were selected.

1.Court documents associated with his deportation from USA.
2.Travel history

My husband overstayed his student visa in the US before but that was 13 years ago.The issue is ,he left the U.S voluntarily before his court date and no such documents where given to him .

Hi Brit! Many immigration websites are contradictory about whether or not you should include nicknames in the ”other names ever used” section of the DS260. Some say nicknames count as other names, others say it’s only about names that ever appeared on official documents and IDs.
Based on your experience, what is your take on it ? Is it more risky to include it or to omit it ?

If you have used a name in “public life” then it has become an alias, and you should list it. THat does not include nicknames that you are only called by immediate family/friends.

Yep – so that is not unexpected, you can go back to go back to them and explain again that you have moved, but it is likely that they won’t allow any changes as their response mentions.

Yes, we have seen EU get around 700 this month. I’d like to see them getting 1000 per month, but 700 – 800 might get to 30/31K. But it’s hard to be precise, so keep your fingers crossed.

Hi Brit, what is the worst thing that could happen when doing an embassy transfer? KCC confirmed interview scheduling on our new address, but we are considering interviewing back in our home country 🙂 Can our case get lost in the middle ? KCC are no longer involved after the 2NL is sent.
The worst thing is just some sort of confusion or lack of communication with the old or new embassies. Or the embassy accepts your case then schedules a very late interview because they don’t realize the urgency of a DV case.

Well there are two problems with that miracle. First we would need to see something like 1500+ interviews for each of the three remaining months. Second, that would mean scheduling about 25000 people in total (about 10/11k more than today) – which is just too many people for the visas available to the EU.
There are just no signs we will see anything like that.

DS260s are processed as soon as possible (based on their workload and processing times) but that doesn’t have to wait until the case is current. In fact it is better when the DS260s are processed beforew cases become current.
However, your whole idea that KCC have some criteria or ability to schedule an interview before the case number is current, is incorrect.

DV lottery 2020 applied back in 2018, and the 2021 , applied back in 2019, those years are completely over? Or have I missed something? What are the news or updates that you talk about and that some folks ask you about on Youtube?

There was a class action lawsuit for DV2020 that was won by the selectees side, but the government appealed it. If we win the appeal, then there will be about 9000 additional visas issued for that year. There was also some legal action in DV2021, but on that you cannot typically benefit unless you were part of the lawsuit.

So, now I’m in the United States under the Ukraine Humanitarian Parolee status. I just found out from you that DV2021 cases are awaiting a judge’s decision. I’m not part of the Goodlock Biden case. Given that it seems a lot of people for EU will be scheduled over the last three months July/August/September (anything between 21,000 to potentially 30,000 and over), does it mean that if we are scheduled in those months and placed in 221g for any reason, there’s a risk of the visas getting exhausted before we can get it ?

It is unlikely (but technically possible) that visas will be exhausted before the September 30th deadline. It happened last year – and that was the first time in a very long time.

Yes they process DS260 for all cases. This is valuable data for them – so they want to process the cases. Again, once more, there is NO reason to connect processing of a case with expectation of being current or not. And again, there is no “expedite” of scheduling a case that is not current.
If people that were not current could just send KCC some reason why they should be treated specially because they were in a hurry – that would not be fair or logical.

Could it be a good idea to do a “grounding video” the day before results come out, just to ease the hype a little.
Whilst winning is exciting, reinforcing people’s chances can help to give perspective.
It would be lovely to have some stats from the 2025 draw. I know not many are in the public domain atm but just something rough?
You mentioned that on occasion filling in a DS-260 can be a bad thing, can you expand on this?

I post a grounding video each year – but many people ignore that anyway and later claim not to have known there were risks… human nature I suppose.
There are no stats on DV2025 year. We find out more as the year progresses.
A DS260 is an application for an immigrant visa. That shows “intent” (desire) to emigrate to America. If someone doesn’t get the DV visa, and later needs to apply for a Non immigrant visa, the DS260 submission and immigrant intent can make the NIV application harder. Not impossible, but harder.

Hi Brit,
My host is filing form I-134 and has asked me to provide information on Beneficiary’s Income i.e Part 2, Item 13 and Beneficiary’s Assets i.e Part 2, Item 16.
For item 13, in the instructions states that “provide information on any income the beneficiary will receive. If the beneficiary will not receive any income, then type $0″.
For item 16, in the instructions states that ” provide information about any assets available to the beneficiary for the anticipated period of his or her stay. List only assets that can be converted into cash within 12 months and that will be used to support the beneficiary while the beneficiary is in USA”.
Do they mean my current income and assets? And what if I don’t have any income and assets worthy filing? Can that be a problem. How can I fill these two parts assuming I don’t have income and assets worthy mentioning?

Just be truthful. If you don’t have income or assets, that is not a problem as long as the sponsor has sufficient income.

My host has hesitated to send affidavit documents(i134,irs, biopage of pasport)
But I have found some one to send who have moved different places due to his job)so I couldn’t make him host.
Can I have my host and the one send documents be different.
