a couple of questions for you which I couldn’t get answer for through US medial examiner.
I am a DV 2018 winner from EU region due an interview in December as I only have just missed out by few numbers the November interview.
I am EU citizen married to a non EU citizen and we have a US born daughter (under 21)who is obviously dual citizen (US + non EU).
She has lived in the EU whole life as a non EU citizen, but we have her original birth certificate, expired US passport, SSN card etc to prove she was born there.
I listed her on DS260 form as a child under 21, understanding from instructions that it is not necessary to register US citizen children, but it will not be penalised if they are registered and as she is dual citizen, not just US citizen, I listed her as my child to be sure.
1) Does she need to attend medical with myself and my wife? (US examiner didn’t know the answer to that, told us to speak to embassy, but no response from them yet)
2) I know she will need to be at the interview as we are all emigrating together, but will she need immigrant visa or will she just need to get her new US passport as old expired?

DV2017 visas appear to have run out – so it is very doubtful that you can get a visa.

Hi brit, when completing my ds 260 for the first time, one of the travel agents helped me because i didnt had any idea of how to fill that form. When i rechecked my ds 260, there were some mistakes. I told them 3 times to reopen and make the changes, and they did it.
After coming to your website and learnig about ds 260, i opened it myself for two more times and made changes myself to my final form. In prepareres information section of ds 260, i still wrote the travel agents name though they didnt helped me in submitting final copy of ds 260.
My question is will it create any problem, and im current for november interviews.

You were not clear about that. You *should* have unlocked and added the baby earlier. Now you can’t, so you must contact the embassy to ask them what to do.

OMG – yes that is what you needed to see. They must have pulls your visa numbers before the shutdown. I honestly don’t know what will happen about your son – but at least you could do a family sponsored case for him if needed. Fingers crossed maybe they can sort him out at the same time.

What’s the likelyhood he’s issued a visa before 9/30/17? And if it’s still listed as under admin processing on 9/30/17 does that mean it’s expired and he’s out of luck

HUH????? There is nowhere on the forms for house guests. The forms ask you to list YOUR children. If you list a child – you are representing that child as YOUR child!!! That is OBVIOUS!

Your explanation makes no sense – but that is unimportant. You lied, plain and simple. You entered children on the forms as if they were your children, and expected to get GCs for those children (which would have been fraud if you had managed it). There is no need to keep arguing that point with me. I don’t make the decisions. The CO does.
You can describe it as a “genuine mistake”, and perhaps the CO will accept that excuse. That might be a problem, it might not. I can’t predict the COs reaction to that. It is likely to be worse if you don’t take responsibility for the details you entered.

MY STATUS: I am 2017 dv lottery selectee, i have gotten my visa and will go to US next month (for first time), to apply for green card. currently i am medical student and will graduate after 10 months , i have few queries,
MY QUERIES
#query 1- when i entered to the US and applied for green card which option will be more safe A or B,
A- i wait till i get my GC and then i come to continue my studies or
B- i just apply for GC and then use my endorsed visa to come back and continue my study and let them later they mail my GC to the address which i have given.
in a nutshell i wanna know whats the difference between these two will both of them be considered same as absence or one will be more safe than the other for me?
#query 2- if i wait in US to get my GC in how long probably can i get it ?

1. Both are “safe”. THe GC sometimes takes months to arrive, so b is more realistic.
2. As I said – can take 3 or 4 months (sometimes much less).

If the DS260 entry is a male under the age of 26, you must click on link on the final page about selective service. Click, read, and then the form will submit.

In my interview,i met the consular officer and he told me “visas of you and your children are ok” and requested administrative processing for my wife.
At that day,the status were 3 persons READY and 1 person ADMINISTRATIVE PROCESSING.
I sent all data requested by officer on same day on email.
on the day after interview,i checked the website and found all 4 persons REFUSED on status visa.

That sounds odd – but the update of a case to refused is normally final. Could there have been some reason why your case was refused? Education or false documents?

That is certainly the reason. They probably studied the details more carefully after the interview and realized you broke the rules. I don’t understand why you attended the interview knowing refusal was certain.
Update. I just looked up your old questions. I told you several times you would be disqualified. I was clear the chance of disqualification was 100% certain. You just wasted your time and money attending the interviews because you chose not to believe me. Very strange.

Hello Brit, thanks for the support. I was reading through your blog and realised that on Work/Education, you did mention that Vocational studies does not qualify someone for education. I have Higher National Diploma which is Two years of Vocational studies that is GCE A level +2 years (16+). On the ds260 form I filled vocational studies because the other options such as “university degree” and “No university degree” are no applicable to me.
1.With the explanation above what are my chances to qualify with education?
2. Though I also qualify as a worker, who determines the way you qualify for a visa?
3.since both education and work qualify me, how will I compose my file when called for interview?

1. I don’t know how they will treat the HND.
2. Education is the easiest way to qualify because it is not subjective. If that doesn’t work, applicants can try to show they meet the requirements through work experience. But – that is somewhat subjective – and the applicant needs to prepare properly to PROVE they meet the requirement that way.
3. Prepare for both methods. Put some effort into your work experience (match to the O*net job, show proof of the roles performed, salary level and so on).

Thanks Brit, you third answer has recalled me of something important. I just look through the o* net job again and realise there is also”all occupation” which would have permitted me choose a more precise job related to my HND diploma like “logistician” or “transport” instead of “Management”.

1. I found a job related to my present job but it does not meet the zone and the SVP. What should I do?
2. High school completion is often goten at the age of 18 in most African countries. I will suggest you mention the years of studies than the age for those who to be qualified on education because it does not correspond to all.
3. I did my vocational studies at he age of 35 while I was already working with my GCE Advanced level certificate. It seem different from what I read on your blog. Could this still be a problem?

1. I don’t have a suggestion of what you can do.
2. It is not the number of years education that is important, it is that the level attained is the same as US “High School” – which in the USA is usually 18. It is the point at which someone can enter University.
3. The GCE Advanced level may qualify you. Check the embassy website.

A farmily friend wants to fill for me the affidavit of support but here is the problem her bank account is empty cuz she just engaged in something so her account dnt have enough money. But her monthly income is ok and she also has the tax return and pay slips.

I’ve a question:
I’m a DV2018 selectee SA9xx. I’m currently on a student visa (F1) and I live with my wife who is a permanent resident of the US. We both have lived in the US since 2016 when she started working and I started school.
We would like to start a family but don’t want to jeopardize my chances of being approved a green card via the DV program.
When I applied to the DV, I was the only person listed on the application as my wife was already a US permanent resident.
I know you said the SA region was over selected for DV2018 so I’m not sure if I have a real chance of getting an interview with my case number SA 9xx. With that said, should we proceed to start a family or wait the X number of months to see if I get interviewed?
Also, she submitted an i130 spousal application since December 2016 but as you know, these things take time. When I called the visa line, the person advised me these sort of applications take years when one is not a US citizen but rather a permanent resident…

Please note, I did indicate on the DS260 my wife’s name and our marital status as married. However, the section asking who will be joining you as a derivative, I just put myself as she is a permanent resident.

There is no risk to your case from the spouse or adding a family. Live your life.
The I-130 will take about 2 years. The DV might be a few months faster.

A personal and optimistic opinion
Reviewing the year 2015, I note that the assigned interview number was very low, with respect to the number of selected. That could be due to the fact that in 2015 they started with Ds260 applications online and not on paper,
this could generate some delay by adapting the new forms? Since 2014 were more than 140,000 selected and the number of appointments assigned was higher than 2015.
This analysis I did for my region SA

I’m not sure what you are getting at. In 2015 they achieved the global quota. AF region was cutoff too early – but other regions were about on target. DV2014 were over selected. DV2018 is also over selected. More efficient DS260 processing won’t help that.

Both would need to show the child. If that is already done, then only the principal to add the DS260 for the child.

My friend is a winner of DV2018. He already submitted all documents and waiting for Embassy calls for Visa . But he lost his password for the email he used to get intouch with the embassy. Hence, is it possible to provide alternative eamil address to know embassy notifications for Visa. If so which address should he use to inform them the new email address.

He doesn’t need to get the email. The email simply says to check the ESC site. When the 2NLs go out in a batch (when he expects his 2NL), he can check the ESC site to see his interview details.

Hi Simon,
I have an interview in October (DV2018).
I have prepared all documents, but I’m unclear ONLY at The Affidavit of Support (I-134 Form). My sponsor is preparing the Docs for me, but he will send the Docs without the Form signed by his wife.
He has a good salary that is more than Federal Poverty Level (includes all members of his family and my family).
1). Can be a risk at interview, if I deliver the Sponsor Documents, without the sign of his wife ?
2). Is it OBBLIGATORY to sign and the Spouse, when the Sponsor is married?
I’m asking for the Tirana Embassy.

Tirana has some “odd” requirements for the I-134. One of the odd requirements is a second I-134 signed by the spouse. So – not having that will probably cause a delay, and you will be asked to obtain the second I-134.

Hi Brit, my case number is eu38xx and resubmit 16 august. I’ve been confused about the 2NL chance of mine because of late submission. I’ve called the kcc to ask the chance to get 2NL in this month. The lady told me that most probably I’ll get the interview on November so the 2NL. What you think ?
