We have just received our unabridged birth certificates from Home Affairs in South Africa. They made a mistake on my husband’s and stated that his mother’s place of birth incorrectly. Our DS260s have the correct place of birth for his mother.
1) Should we go to Home Affairs for a correction before our interview (which will probably only be later in 2018), or is it not necessary? Our Home Affairs is a bit of a pain to deal with and these certificates took around 6 months to be issued so we want to fix it ASAP if necessary

Hi Simon,
I’m wondering if you know how I could reschedule my DV2018 interview at the London Embassy. I’m an Australian living in London and am struggling to get my supporting documents in time for my December 6th interview and so was hoping to delay the interview. I’ve tried calling the Embassy but their automated menu leads me to the Immigrant Visa unit and they knew nothing about the DV visa and referred me to the USCIS website which is no help. I can’t find any info online about how to change the appointment and my letter simply says call my local embassy. Would you know of a number or email address for the DV Unit at the London Embassy?

Its okay to apply.. you will not be disqualified ,only two entry as a primary applicant will lead you to disqualification…… so it okay to apply one as a derivative and one as a primary enterant.

The Child Status Protection Act (CSPA) provides very specific guidelines for calculating the eligibility of a beneficiary who is older than 21 years old. In calculating their eligibility, the CSPA requires the adjudicating consular officer to consider only the Date Congratulatory Letter sent from Kentucky Consular Center (KCC), the date of birth of the beneficiary, and the date that the visa first became available.
The computation of age, for immigration purposes, is complicated. The Child Status Protection Act requires that the length of time that a DV case was awaiting approval be subtracted from the applicant’s age at the time that the case becomes current (when visa numbers are available). The first date of DV entry period was October 4, 2016, and the date the congratulatory letter sent by KCC was April 18, 2017, so the length of time that the case was awaiting approval (for a visa to become available) was 6 months and 14 days. Date visa will be available is on December 1, 2017. At this time xxxj is 21 years, 0 months, and 8 days old per CSPA.
The law specifically disallows children over the age of 21 from immigrating as derivatives on their parents’ petition. Unfortunately, because xxx is over 21 years old on December 1, 2017 according to CSPA formula, she cannot immigrate at this time.

It is interesting – they are obviously aware of the laws, BUT they have the calculation wrong. You are going to have to contact them and argue the case. So let me give you some ideas on how to prepare.
First you need to get the memo that describes the implementation of the rule. That memo is linked in my article on CSPA – here – https://britsimonsays.com/child-turn-21-can-heshe-get-visa/
Now – the days of extra time a child is given for DV2018 is from October 4th 2016 (which they correctly stated), to May 2, 2017 (they INCORRECTLY stated April 18, 2017). It is the date of the “selected” letter – May 2. So – that gives you a few extra days. 210 days to be exact.
So – you add 210 days to May 10th, 2017 (your daughter’s birthday), and she is covered until December 6th, 2017 – which means she CAN get the visa. So – you have to point out that they have incorrectly taken the congratulation letter date as April 18.
Argue the point by email, but then take the following to the interview.
1. The memo from 2003.
2. The copy of the 1NL (selected letter) showing May 2 as the date.
3. A calendar showing the number of days difference between Oct 4, 2016 and May 2, 2017.
4. The difference of 210 days added to your daughter’s 21st birthday.
The fact that the CSPA date is in December means that ALL of December is covered. DO NOT miss the interview!!!

Yes. The important date (read the memo) is not when they “sent” the letter – it is the DATE on the letter.

“Service officers should use the period between the first day of the DV mail-in application period
for the program year in which the principal alien has qualified and the date on the letter notifying
the principal alien that his/her application has been selected (the congratulatory letter). ”
It is VERY important you show them that this information came from their own memo, hosted on the USCIS site, and unless they have an updated policy, this should be the way the rule is applied. Send them the link and the quote. It would be worth copying in KCC.
Just to be clear of what is at stake. Sponsoring a child over 21 as an LPR is a slow and expensive process. This is your chance to avoid that hassle. Take your chance.

Their reply means they do not think they should give her the visa. They are wrong. You need to make the argument clear as I have suggested – ideally that would be a battle won before the interview, but it is also something you can do at the interview. This really is a matter of how well you argue your case. They are wrong, but won’t want to admit that – so you have to make absolutely clear why they are wrong.

My girlfriend completed the registerer for the DV Lottery-2019, but she missed the part of the instructions about not using a picture used in previous registrations, so she used the same picture she used for the registration in the DV Lottery 2018 (in which she was not pre-selected). Do you think they will really check pictures of previous years and discard her application at any point for this reason?

Hello,
My interview is on the 15th Jan 2018 and I have already issued the police certificate for my current residence country. In the FAQ of US immigration, it says that police certificate should cover the entire period at the current residence country, while it also says that the certificate validity is 12 months but I’m not 100% sure if that mean that they accept police certificates issued within the last 12 months before the interview or if the certificate validity must have validity of 12 months and must be issued just before the interview.
In other words, I want to know if this certificate that I’m issuing now, 2 months before the interview, will be accepted or not, or if I need to issue a certificate just before the interview.

My husband is an Sweden born Iranian, I’ve just read in a guideline for applicants of Turkish embassy that people who were born in a country other than their country of citizenship should bring a birth certificate from their country of birth. However, his parents never intended to stay in Sweden and they got his birth certificate in the Iranian embassy in Sweden (It is an Iranian birth certificate) and he came back to Iran in the age of 11. That is decided at the interview. If the birth cert states the location, that is fine. However, do you have an EU case number? He should NOT have an AS number, unless he is claiming chargeability to an Asian country through marriage.

OK – so your husband is “cross charging” to your country of birth. If the embassy handle that correctly (and some don’t) they should treat both you AND your husband as principal applicants – so be sure to take education documents for BOTH of you to the interview.

Today our DV visa being refused under section 212 (a) (5) (A) invalid petition and No waiver is available for the grounds of ineligibility.. Consular officer said that it’s because of double entry..
we are sure 1000% that we had only one entry ( other thing.. If we have had 2 entrants, we will not get 2NL by default) but she insisted that is the only cause.. Can we appeal or contact uscis?

There is no appeal possible, there is nothing you can do – and they don’t refuse DV cases without reason. Is it possible an agent entered on your behalf?

Hey Simon. Do we to submits our university grades at the interview? I don’t remember seeing that in the pre-interview checklist.
Kindly let me know as i would have to arrange that as i got my bachelors degree from US. I know requesting for final grades would take long.

Hello, if I am a winner in DV2018 and waiting for the date of the interview ( high cn), can I apply for DV2019, just in case? Will this affect something about getting the visa?

Dear Sir,
We are a bit confused about something in the GC process.
We will get our interview in February so medical exams in January. If successful, we plan to go the US to validate the 6 months temporary visa in May (we will go to the US for a few days in vacation).
Our temporary visas will expire 6 months after the medical exam so in July.
According to what I read, it takes 4 months to receive the permanent green card once your entered the US the first time.
So what if we want to move for good to the us after the expiration of our temporary visa but before we receive the real green card in the us. (A US friend will receive thel for us since we don’t have an address in the US yet)
I don’t know if I am clear but what if we decide to move for good to the US in August for instance ?
Our temporary visas will be expired and we probably won’t have received your green cards yet so will we be accepted at the airport?
Maybe our european passports will be enough as we can stay 3 months in the US thanks to the ESTA program?
Other important question; when we go to the US the first time, will we get something proving that we are now permanent residents? I mean if we want to apply to jobs, the companies will want a proof that we are permanent resident but we won’t have the GC as it takes 4 months to be sent.

When you enter for the activation trip, your temporary visa will be stamped (endorsed) and is then valid for up to 1 year. You can use that for showing your LPR status until you get the plastic GC.

To clarify – the visa starts with an expiry date of 6 months. Then you enter and that is when it becomes valid for a further 1 year.

I was not married on paper with my girlfriend. Only I was living with here. By her Advise I wrote married and put her name to DS 260. On paper I am not married to her. I am single always. Now in ds 260 i am married, Can I update ds 260 and make single? I won DV 2018

It was idiotic to lie on the DS260. That alone could get you disqualified. You cannot remove her – so you will have to explain to the CO why you lied.

Your DS260 should be accurate – but the risk of denial will remain because you lied not once, but twice.
