We had done a mistake because we have not written the third name in DS260 for the applicant , spouse and three children. I mean if the name is A, B, C, D. We had written A,B,D.. How we can resolve this problem.

There is nothing you can do now, except wait for the CO’s decision. Generally, this would not cause a problem – IF there was some explanation.

Thank you so much for your time and information you share here. There is an Iranian couple who their case has been effected by Travel Ban 3! They did their interview Dec 5th, and since that was the first hours after Supreme Court had let the Travel Ban goes fully effect, the officer took all their documents include their proofs of family relationship with me as a Green Card holder in U. And the case needs AP process since the winner is the guy who had to go for a 2 year mandatory military services in Iran. Now I am wondering if you can kindly give me your opinion whether they will have a chance of getting Visa after Supreme Court final ruling in late June or not. (of course in case they lift the Travel Ban) . And also tell me what should we do as fast as possible after the Van will be lifted?? Should they go to embassy and do their medical examination right away??

The travel ban is being heard before the supreme court this week. If the ban is lifted, they can contact the embassy, but no one has experience of this so they need to do whatever they can, as fast as they can (again *IF* the ban is lifted).

The draw will happen. Theoretically a change to the law could stop the process if that law were introduced before October 1 – but there is currently no plan to introduce such a law.

this friday will be exactly three weeks since i came to the states.
but by last week monday i still had not recieved my social security number.
i was worried so i quickly came to your site to screen through things.

Yes, the embassy might screw it up, BUT the biggest risk is that the visa is allocated (reserved) for you for the month of your original appointment. After that month, your embassy has to ask for a visa after your interview – and visas could be exhausted by then.

I know I am jumping ahead now… But my interview is in June. If I am approved and then do my first trip to US in September , then return to my old home and fly back again to the US in November. Will I have an issue if I move to the US in August 2019? I am not clear on the 1 year rule (where you could have POE issues) – is that 1 year from the first trip and then 6 months after each trip? So could I do 2 trips in 2018 but still move within a year of trip 1 even if it is >6 months from trip 2? I know it’s pedantic but I’m not clear on the rules… Thanks!!

Hi Brit- I did indeed read your FAQ…. But I’m not clear if you can enter the US (on multiple occasions) , in the year after first entry. So for example is it a problem to activate (first entry) in September, return again in November and then return (permanently in July- which is 8 months after July but still within 1 year of the first entry)

This has nothing to do with the medical or date of activation. It is about the length of ABSENCE – i.e. the date you left the USA to the day you return to the USA.

This is a really dumb situation, but, if a married applicant has a passport in their maiden name, can they get a new passport with their married name and then take both the old and new passports to the interview in order to have a visa & green card issued in the MARRIED name? Or is all of this more headache and processing risk than it is worth since all forms were filled out using the maiden name?
I honestly didn’t think we’d win the DV, so updating my passport before submitting the entry last year wasn’t at the forefront of my mind. But now I am stuck in a bit of a situation where my passport (and soon my visa & green card) won’t match the rest of my ID. It costs $500+ to get a name change on my green card after the fact.

I’ve got an appointment to do this tomorrow. Just want to make sure that:
1. The CO’s are able to make these sorts of major changes (Maiden to Married Name) last minute at the interview, and…
2. It’s no problem that ALL my forms and documentation including my medical (done today) are under my Maiden Name and old passport number. I did confirm I can get the old passport returned, so will still have that to show at the interview, but it will of course be invalidated.

There is no risk to the case – it’s just a silly thing to do. If you plan it early and marry you can both get visas easily, whereas doing it too late means a long and expensive process later.

I had my interview some 13 business days back in Addis and I was told during the interview that my visa is approved.However, my status is still on AP when I checked it in CEAC.
I just e-mailed the embassy and got the following response.
“At this time, our office is in the process of issuing the visa. You will soon receive a notification via email from DHL when the visa is ready for pick up.”
I just want to ask you what the above statement mean!

It means exactly what it says…. Visa is being printed in your passport. Once your passport is ready with the visa, you’ll be informed as to when and where to retrieve your documents so you just need to wait until you hear from them as your visa has indeed been approved and is being issued as we speak. You’re safe….

Hi Simon, I submitted DS-260 in mid-February and awaiting a response for the next step. DS-260 asks whether I have received vaccinations as required by the US law. I filled in with “No” and explanation “awaiting instructions”. I haven’t received any instructions so far. from what I have read from your site and the US state sites, I believe it may take more time to process.
Nevertheless, my questions are;
1. Does the KCC or the local embassy give such instructions to interviewees prior to the interviews, or do the applicants have to find out on required vaccinations and get them anyway?
2. Do they inform interviewees, prior to interviews, on the required medical tests ( and from where to get them done) ?

I am one of the selectee of DV-2018 and my number is 2018AF378*** and I filled the form DS-260 for mine and my son on July 2017, but on the late March 2018 I sent a request to open my DS-260 and correct some errors I made before and resubmitted within that date. Therefore, what I want to ask you is that:
1. Can I reopen my form again? Because I want to enter my son’s(accompany) passport ID. (My son is 5 years old and I got new passport right now but previously I enter mine password ID to my son’s form since mine and my sons Passport is in one).

Your previous bad credit history has nothing to do with immigration status. Just be careful with credit in the USA.

Do you know if a Biometrics Fee is required for each Applicant filing Form I-485 for AOS (for their DV), or only a single Biometrics Fee paid by the Primary Applicant is technically required (and that covers the cost of doing Biometrics for the Dependents as well)?

I did go through the list and it’s not specifically mentioned there about the Biometrics Fee for the Dependent(s). However, I then realized that the total fee amount ($1,225) basically covers both the AOS Fee and the Biometrics Fee, so in short, yes, every applicant needs to pay for this Biometrics Fee, as you’ve said earlier.

Maybe you have some insight into my issue! I had my interview in Dublin in March. I didn’t notice that the name on my birth certificate was spelled incorrectly as the english version of my name (Orla) and differs from my passport, my application and all of my documents (Orlaith). The embassy told me to get my passport annotated with the name Orla and to have background checks done in both names. I immediately went to the passport office but they advised me to have my birth certificate changed as it was a genuine mistake. I now have a birth certificate with the correct spelling which matches my passport but I’m still worried as this isn’t exactly what the embassy asked for.
I have just received my criminal check in the other name so I now have all documents and will be sending them tomorrow to the embassy. They told me that if I didn’t have my documents sent to them by the end of March I would lose my case number and they would have to ask for a new one from the KCC in April. What is the likelihood of a number being available?

Right now, there are visas available. The risk is that the embassy don’t ask for a new visa or that KCC are slow to respond. However, your embassy seem to understand the procedure, so perhaps this will get resolved soon. However, you should expect AT LEAST a couple of weeks delay after you give the documents to the embassy.

Dear Brit, I m raj from srilanka. My sponsor gave me form 1040,8880 and 4562 . But I read USA emigration ask W2 form. Form 1040 and W2 same or different? I think my sponsor is retirement now. Will he sponsor to us?

Anyone who expects the visa should have “completed” on their DS260. If they have not, it is because you have not submitted their forms. Do so immediately.
