Dear Simon,
My question relates to the extension of leaving outside of USA while holding the LPR. I hold the green card since two years (dv lottary winner) but have not yet settled in USA due to personal reasons. First entry in the border (jfk), not the one of status activation, I and my family was not told anything even being out of USA for around 11 months. However this time when we entred, the officer riprimanded us and noted that she could bring us before the judge. After the discussion we had with her explaining to her our reason, she finally stamped our passport. Though, this time besides the stamp and the A number she wrote ” 11 month out”.
What do you think this note serves?
I plan to settle in USA after a year and a half, if I visit USA in periods of six months till that time do you think I will have problems with immigration ?

Yes you are building up problems. You are abusing the terms of your Green Card status – and could easily be put in front of an immigration judge. You have made no effort at moving to the USA – and a judge will be very concerned about that.

Thanks for all the great advice. I have a bit of a tricky situation in regards to a child.
I just selected for the DV lottery. However I have also been told I may have a child in Ireland (I’m in Oceania), who was born well after my entry was submitted. Obviously I have not set up an interview yet either.
My question is I have no current proof this child is mine but wanted to get started on my DS-260 and am worried about time pressure to apply before the window of opportunity closes next year.
Am I required to list this child as mine on the form? The child would not come with me to the US. However I am wondering, if in the coming years I attempted to petition entry for this child, would I be disqualified from my green card on the basis it was born even though I did not include it on my form since I had no clear evidence the child was mine, or received this evidence after my interview was scheduled.
Or do I just treat the child as mine, list it and therefore “future-proof” my application and potentially my child’s if they wished to come to the US later? Obviously this is also difficult due to distances of child from me and ability to get medical appointment etc.

Clear up your relationship with the child. Then submit your DS260. There is no rush to submit the DS260. What is your case number?

A friend of mine had his interview in cairo on the 19th of march and he got accepted in the same day however his visa status still ready not issued yet since his interview and they kept his passport until now and when he mailed the embassy they said that the file is being reviewed, so do you know what’s going on? And he has travel plans and don’t know what to do his case not A.D or issued what is that mean to be ready all that time? I don’t know anything about his case. While on AP, all ghe can do is wait. He can ask for the passport, but that will cause some delay later.

Hi Simon ,
I’m the principal applicant , my wife name has one letter that appears differently on different documents , rest of the name match exactly , initial entry and DS260 are matching to her current passport , however her birth certificate and our marriage certificate shows the different spelling of her middle name which I’m suspecting is due to an old passport
Could this be an issue ? I’m trying to find the old passport to take it with me , I’m due for interview in a few days

They think it is a fraudulent document – so yes you need to give them concrete proof of your qualifications from an official source.

How can I prove it’s authentic if the paper I gave is actually authentic it’s from my high school and my high school is an American high school in my country , my interview is in Hungary but I am from Egypt the Hungarian employee said that she didn’t like my graduation certificate because it doesn’t look like what they get in Hungary , but that’s not my fault it’s a genuine certificate how can I prove it ? The consul saw all my paper and said they were okay but the Hungarian employee delayed my application and put on AP for no reason then after I kept asking what’s wrong she told me about that my school certificate isn’t not bona fide. Even though the American consul accepted all my papers.

Me and my family have just received DV2018 immigrant visas.
I would like to ask several questions related to the immigration process.
1. It so happened that as we resided in a third country in 2013-2016, some of our belongings (incl. furniture) are still at the warehouse in there. The questions are: -are we as new immigrants eligible to bring our belongings to the US free of customs fees? – can we also ship our third country based belongings? – where can i learn the detailed procedure? – is there any deadline to ship our belongings free of customs fees?
2. We would like to transfer our cash in the accounts in Home country banks to our new accounts that we’ll open in American bank after coming to the US. Are there any deadlines and specific restrictions?
3. How fast are Green card and SSI card issued after we enter USA? If it takes long enough, can we apply for job, enroll kids to school and rent a house just with the immigrant visas?
4. Is it important that our first point of entry to the US is in the same State that we indicated for Green card delivery? in our case the address we indicated is in California while we intend to fly-in through JFK airport in New York. So is it OK?
5. If I intend to enter the US alone, and later bring my family members (dependents), do i need to exit USA and re-enter with them, or they can enter the US without me accompanying?
6. Do i need to buy any special health insurance before coming to the US?
7. Our children were born in Spain, and the original birth certificates are issued by Spain in Spanish language. Where should i translate and apostillize (if needed) those documents – Spanish or US consulate in our home country (not Spain)?

3. It can take a few months to get the GC. Your SSN is faster (2 to 3 weeks normally). You can get a job, house etc with the SSN.

5. They can come to join you within their visa expiry date. (I assume you are the selected winner).

1. My first name and middle name is joined AAABBB in passport.
2. Passport issue year 2013 instead of 2016 in ds-260
3 address spelling mistake it should have been swathiaien( it’s in passport which I need to correct) but I have written sothiain( in ds-260). Later is correct btw.
4. In US Travel history review section I ticked No for visa refusal but I have been refused for study visa in year 2010.

I and my wife filed D.V lottery for 2019. I am not selected as winner but my wife is. But there was an error that occurred unknowingly in the original D.V application. She submitted the application mentioning that she is married to U.S citizen. She didn’t realize that she hit the wrong button. We are already in US. So, can we still proceed with further processing? I have been selected in lottery 2019. but in DV application I entered my name in 3 text boxes as known “first, middle, family” and my name is consisting of 5 names “first name, father name. grand father name, great grand father, family name”. I won the dv lottery .I have high school diploma 37 years old . I been working seasonal jobs in France and then going back to my home country for the rest of the year or travel. Do i have to put yeach year and adress and place for 7 years? That i was living 5 months france 5 months home country or I can just put i was in france for 7 years and skip going back to home country ? In total i will have 15 entries in this part (back and forward) .I was only working for 5 months a year at this period should i put that in work experiance each contract separate or i can just say i work there during those years and give phone numbers to my supervisor to confirm. Hi Simon, my number will be current in August and I’m residing in New York so I’m preparing for AOS.
1. I submitted ds 160 as soon as I found out i won last year and then I moved within the same area, so my i485 will be with the different address, should I notify them before I submit it?
2. I was wondering about when do I contact infopass? The official site said i should contact the local office on how to proceed next but some comments said that it’s a waste of time.
3. What are the right questions I should be asking them about the process if i go now?
4. I looked up the info here and it seems like the one time you contacted them was after submitting everything to kcc, paying the fee, receiving the receipt, and doing the biometrics ?
5. Will the receipt and other important letters be sent in by mail or e-mail? My address is unreliable since it’s an apartment building and sometimes mails get messed up and i can’t have it mailed to work either. What would you suggest me do?

3. You have nothing to ask.
4. Right – later. After you have filed.
5. You need to receive mail. I have no suggestions about that.
