Hello,
I have had my AOS interview on August 23rd. The interview went pretty well, better than I expected. And at the end of the interview the Officer said that I am initially approved but she needs to contact Department of State to retrieve something.
Do you think she means that she needs to contact KCC to retrieve my file? Or is it another process? When I asked how long it takes, all they said was “its just an email” but I still did not hear back.
NOTE: My case status still says “Fingerprint fees were received” and that was dated May 17th. From what I understood from the officer, I was being processed faster than other cases due to the deadline which is why they did not update the case status online.
So, I did a quick research using the spreadsheet in the forums and compared everyone who did AOS at my Field Office. I noticed that usually they get the CPO around the begining of the next month (or more if its in the early months of the fiscal year). Do you think this is maybe just the process? They would update the case status online begining of next month?
1) What’s your advice on this?
2) Do I need to contact KCC about anything?
3) Should I just wait?

You cannot change the DS260 now. You simply have to discuss with the CO at interview.

Hello Brit. I was called this afternoon by the embassy on my father’s line and he was told that I should return to the embassy tomorrow with my passport and a renewed medical report. I was confused about the call especially when I went for queries at the Davidson Nicol medical centre, I was told that I should redo my medical next week Tuesday and the embassy is requesting for it tomorrow from the said call made today.
When I went to the embassy today for some queries concerning the call, I was told that unless I’ve a letter of appointment before I can be allowed even when I told them about the call made to my dad from the embassy.

Has anyone used airbnb to find longer term rentals in the US before? We’re arriving in Seattle in Nov 2016, and probably need to lay over there for 2 months whilst looking for employment. We’re not to fussy where we end up, just no tornadoes, earthquakes, wildfires, hurricanes, tsunamis or meteorites please.

While preparing the supporting documents I have noticed some discrepancy with the info I had provided in the DS-260
1) Place where I have lived
I stayed in the army for 2 and a half year. Accomplish all my service in France never been abroad
I kept all the payslip and informed the address I have lived based on the payslip.
I recently received my military record and a statement of military service , in the later document the dates of the military assignments do not exactly match the payslip. Offset of 1 to 3 months.
I reckon that the dates in the statement of military service are the administrative assignment and does not reflect necessarily the date when I physically moved from one assignment to another.
I remember for instance that when I finished my training and received my first assignment, my colleagues and I had to stay 2 or 3 more weeks waiting for room availability in our new assignment.
So there an offset between administration assignment and the date when I physically moved.
There is an assignment that could be problematic as I did not put it in the DS-260 for the reason that I had physically be present less than a month there, and my payslip does not reflect it so itโs why I did not put it.
Explication : I had been assigned for a course for a new specialization , moved to a new place, did the medical check and was declared unfit due to back injury , so I basically stay 2 or 3 weeks then went home sick leave + pay leave and never get back there.
Problem is that the statement of military service state that I was assigned there for 3 months โadministrativelyโ while physically I had stay maybe 2 -3 weeks and my payslips during this period informed another address.
So I wonder If I should re-open the DS-260 to make this adjustment. It would not change anything regarding background check such as criminal record as is France the criminal record are national and centralized in one place.
Also doc requirement ask for military record and does not ask for Statement of military service
-I Have received a โlivret Militaireโ and the word to word translation is Military record , this page only state โname ,starting date , ending date ,length of the service Military ID, specialty and military rank
-The other document is called โrelevรฉ des รฉtats de servicesโ the word to word translation is Statement of military service and that second one describe the different courses , certificate received and assignment
So maybe I should leave it quiet and present only the military record that does not go that deep into details
What do you thing ?

It is stated in the DS 260 to put ACADEMIC or Vocational for the high school course of study.
So for my High school diploma I put
Course of study ACADEMIC
Degree , Diploma certificate receive : Diploma
But now I reckon if I had interpreted well what they were expected, It seems a bit light in information , Should I not have written High school diploma somewhere ?
Other Education level
After high school , I had earn 2 vocational title
I had put degrees in the field โDegree , Diploma certificate received โ as the equivalent informed in the French national directory of professional certifications give a equivalency BAC+ 3 License which is the equivalent of the bachelor degree.
Problem is that it is written certificate in the docs I have received from my school.
So should I reopen to put certificate instead of Degree ?
3) Re-opening.
I case re-opening is in my best interest , what would be the best timing to avoid delay based on the fact that I have summited the 15 of June and are expecting to be current in November of more likely December ( Case number EU100XX)
Is it better to wait for my case to be proceed and re-open before receiving the interview date.

I should re-open asap .

Hello, I have three questions.
1. I have already completed my DS260, but something’s come up and I need to delay my interview, in order to delay the deadline for my entry to the US as well. I haven’t received my DS260. I can email the embassy and delay once when they’ll have scheduled an appointment, right? So that I will be able to enter the US at a later date, given the six months limit.
2. The official instructions (on the downloadable PDF for Naples’s embassy) seem to say that I need to have an affidavit of financial support signed by a relative or friend who is already in the US. This is just not possible for me, but it strikes me as weird. I do have enough money, as per your suggestions (more than $10000), I don’t see why an affidavit would be needed in every case?
3. One section of the DS260 states that I can have the green card itself mailed to an address other than the one I indicate as where I will reside. Since my address is very uncertain, it might be best for me to have it mailed to a friend, but I have currently put on the form that I want the card mailed to the same address as the one I will reside in, since this friend will be moving within the next few months. Can I change this option at the interview, saying that I will want the card mailed to a different address than my own?

1. You can do that, although I would also recommend unlocking to see if that stops processing of the DS260.
2. It isn’t normally needed in every case – but it is up to the embassy. You can argue with them if you like ๐

You answered me this before some days back…My husband s Dv got approvedโฆ. But they denied me coz I tried some time back and was denied visa based on that info of 2007 they said that am ineligible to go USโฆand that my husband can apply for a waiver for me once he is there for me to join themโฆ..

1.Does he need to be a a US citizen or can start the process immediately for me to join them?

1. He can start once he is resident.
2. He can leave the first time for up to 1 year. After that, he must reside in the USA and absences should not be longer than 6 months. He can apply for a re-entry permit for a specific reason to be out of the country for up to 2 years – but sooner or later he must demonstrate that he is living in the USA.
3. No. He will lose his GC if he does that. See 2.

In the SSA Office, the officer did not find enough space on the computer to write our names
in the same field on the application
so he decided to merge (ibram and yosef ) with no space between them
so my name had become ” Jack Ibramhanna ” as the first name, ” Hanna ” as the last name, and they extract a social security number for me but with wrong name i can not use for any processing like opening bank account or having a driver license because it does not match the data we have on Passports or Birth certificates or other civil documents
For my wife, He did the same
Now We can not do any thing in the country
Because our Data in the Department Home land Security are not match the data we have on Passports or Birth certificates or other civil documents
So We have a SERIOUS PROBLEM here
and when i come back to see the sealed package photocopy i found that My first name
is the wrong one ” Jack Ibram Yosef ” and the last name is ” Hanna ”
So, what is your suggestions and what is the best solution ?

I don’t really have a magic solution. You will need to visit one or both the agencies (USCIS and SSA) and get it corrected. That will be frustrating and time consuming – and I don’t know a “good” way to do it. Good luck.

I was selected for 2017, expecting to get number current around May. My husband and I are working in US on H1Bs. I already filled our DS 260 and we will be doing the AOS. We are traveling back home in September and we need new H1B stamps in our passports, so I applied for an interview in US embassy (DS 160). Is this going to be a problem, having 2 applications (one nonimmigrant one immigrant) at the same time?

No. The H1B is known as a “dual intent” visa – meaning they accept that someone may have intentions to seek perm residency whilst on H1.

I am a DV 2017 selectee, and I am in the US on an F1 visa. My CN will become current sometime in April/May/June. My concern is that I have to travel abroad (not home country) for a conference in May. I heard that they might deny me at the port of entry if I try to enter on F1 while my DV case is in progress. Is it true? If it is, what is the safest way to travel without endangering my DV process? Can I apply for any special travel approval document or so?

I’m a DV 2016 selectee and had submitted paper work for an AOS. We (me and wife) already had our biometrics done a month and half back. In mid August we did an Infopass and the officer told us that the case is ready for scheduling, and we told the officer that DV based AOS are time critical and she immediately took down our case numbers and met with the scheduling supervisor and alerted that our case is time sensitive. She also told us to come back at the end of August if we do not hear from USCIS. Now my problem is we are almost at the end of August, and we have not received an interview letter from USCIS. And I was looking to schedule an Infopass as suggested by the officer. But the problem is there aren’t any appointments available for the specific field office that our case is with. Is it ok if I schedule an infopass with another field office? Also is there anything else we can do get an interview?

I am Maher from Yemen. I got married in March, 2016 (after the application ) and I have all the documents related to my marriage. I added a spouse in my DS-260 form but has not started filling it yet. When I told her about immigration to the US, she told me that she was not ready to immigrate with me next year and I already added a spouse in my DS-260 application. I submitted my DS-260 alone (without my wife’s DS-260). I received no reply from Kintacky.
Will my application be considered and processed? Please let me know.

Hi Brit,
I got my temporary visa for six months, in July. My wife is pregnant and we are planning to have a visit for 1 week in October, and come again to Sri Lanka for the delivery.
1) Do we have to go to the state where our sponsor is there (Chicago)? or can we go to another state (California) and get the entry stamped on the visa ?
2) Are the green card and SSN will be sent to the the Sponsor address, since it’s on the DS-260, and how time time will it consume to get the SSN and the Green Card ?
3) Can we go again before September 2017? (I read some articles and you have mentioned we can have around 1 year to settle things after the first entry, is this still valid ?)
4) Can we return and go again again without the green card since we will be there for a short period of time, on our first visit ?

My husband has won the Green Card lottery (2017EU00007xxx), we are both currently in the US on non-immigrant visas (he’s J2, I’m J1), and we are thinking of what’s the best way to proceed with the GC. Some questions:
1) We are worried we may be already late on timelines… Is there a deadline as for when to start the post-winning-the-lottery processes? When should we submit our DS260?
2) Can we apply via Adjustment of Status? In the official site I’ve read this option is only available for people on immigrant visas (which the Js are not), but I’ve also read comments from people who seem to have done AoS while on Js or Fs.
3) If we submitted our DS260 today, when could we expect to get our Green Cards if we do AoS? How does this compare to CP timelines? What would you recommend given our case number?
4) When do we have to select if we want to do AoS or CP? Is it at the time of submitting DS-260?

In 2009,my girl friend and i got married after she won green card. But we were denied visa-i think the co felt that we were not really married after all.Last year i went to same embassy to seek visiting visa,but was told am inadmissible to US because of that case of 2009! The consular said my sister in US to apply for my waiver from there,so that am now legible to apply for visa.
1.What kind of waiver can she apply in US on behalf of me? How long can it take?
2.What crime did i do in 2009 making me inadmissible?
3.How can i know the exact crime so that my sis in US can apply for the appropriate waiver
4.Will she still need to file for form 130 ? If yes how long can it take?
5.Where in Michigan can she file for me all these?
6.When filing,how can we make the process run faster or be treated an urgent!!

2. It sounds like immigration fraud which is very serious. You might be an for life. Are you still married to the girlfriend? If not, are you divorced and how long after 2009 did that happen?

Dv2016 winner hade interviewed in the past month June 15,2016 .
Consular not told me whether am aproved or refused.
All decuments and passport with consular at the embassy .
They hade gave me pink sheet letter
To provide sponsors Form I-134 affidavit of support ,income tax,iD
I submitted my sponsor decuments with in a month of my interview.
Until now 2 months past.
My status shows Administrative processing from interview date until now.
Consular section yesterday calling me and emailing message like this :-
Thank you for your interest in traveling to the United States.Reference is made to decuments provided ; kindly be advised that sponsor’s documents showed that his income is not Sufficient to support you and the consular officer is requesting that you provide a new sponsor with complete I-134 accompanied with his/her recent Tax record and copy of ID .

Until now I will have a chance to aproval of my DV-Visa?
2. I have 2 children not made interview ,not live with me, not filled own form Ds-260. In my form Ds-260 children later to join.
Now in order to get sufficient supporter sponsor form I-134
I left my children from
Filling Affidavit support form with me ,is there any problem?
Because only I will be travel to U.S .
Must be children register and filled their name on the form I-134?

Which embassy is this?
1. You need to hurry up and provide the new I-134. Make sure the new sponsor has enough income – https://britsimonsays.com/all-about-public-charge-affidavit-of-support-i-134/
2. The I-134 only mentions the main winner – but the income must cover all family members.
Do not make a mistake on this I-134, you won’t get another chance – there is no time and you have tested their patience.

At income tax included All family members means Me(main applicant) and all family member of my sponsor
But I told you on the above my 2 children not to travel to U.S .
So I leave them from filling of form I-134 . Only me and sponsors family ?

I said on the form later to join.
No filled own form Ds-260

Because they are no live with me. Currently I live in second country but my children are live wth their mother in my origin country .
There fore totally I would not fill in my sponsors form I-134 affidavit of support because into previous sponsor registered on the form I-134 but they will not travel ,I think add them in calculation in income tax becomes insufficient so also at the final year am

If they filled with me total family becomes 4+2= 6
Adult = 3×10,000=30,000

It’s very frustrating that you are not reading my replies buy simply keep asking the same question. So – I am going to try one last time.
The way you are calculating the income needed is not the right way. I already gave you a link that explains how the income will be judged. This is the ONLY method they will use. Not your method. You have already had one I-134 rejected. You won’t get a third chance. So if you want to get approved you will read the below link carefully. You should determine the combined family size including the family of the sponsor, you and ALL your derivatives (to be safe, include the children). That is not hard. Stop trying to beat the system. Just do that.
Then check the 2016 Federal Poverty guidelines for that number. The sponsor must have INCOME greater than that number. It’s that simple. Stop making it hard.

I would like to know something. Im married and im thinking playing the Green card again in October.
Well i did my junior level in A&M university, but i didnt start and finish the last level to have my bachelor degree. Im in Europe now with my husband, and i have been accepted in an university in their master program.
Bachelor in USA is 4 years, and in Europe is 3 years
Master is 1 year in USA and here in europe is 2 years.
So im going to start my first year of master degree here in Europe iN Chemical engineering.
When im going to feel the DV Lottery, what should i put in my level of Education? Im very confused.
I had a AAS diploma and a Associate degree diploma from a community college. Then i went to do my junior level in A&M university and i left.
So please help me, which level of education should i select?

What you put makes no differences to you chance of selection, so I suggest you stop worrying about it. Just choose a sensible level. If you meet the education standard (you do) then work experience proof is not required. However, if you win, you are likely to be questioned about public charge concerns to see that you will be able to support yourself. But it’s a lottery. You are very unlikely to win – so worry about that if the time comes.

the question::CAN YOU SPEAK AND/or READ LANGUAGES OTHER THAN YOUR NATIVE LANGUAGE?
I chose NO instead of YES.
I submitted my form on 3rd August and has unlocked twice.

I googled both secondary and high school
Secondary refers to grade 5 to 12
High school refers to grade 9 to 12
So it is a bit confusing , should I only consider grade 9-12 from high school or the full secondary 5-12
2) Should I translate the name of the institution or can I leave them in French ?
3) Did anyone assist you in filling out this application?
Both my wife and I speak english and we both filled individually our application , but we did exchange and consult each other .
Until what extend do they consider “assist you” , should we both declare that we assist each other filling out ?

1. on the ds-260 form, when i fill previous address i didn’t include the place where i learn my bsc degree or the university where i stay for three years, both for me and also my spouse case.i include the the years we spent there in our home city to a voide the gap. does it have a problem? can i correct it?
2. i am the principal applicant and there is a spelling error on my 10th grade certificate and transcript, it have a three spelling difference from my passport and ds-260? does it couse a problem on my visa process? can i try to cerrect my documents?

No, you won’t get a November interview if your case number is not current.
1. Correct it.
2. Do not “correct” your documents if they are already accurate. Make sure the DS260 matches the passport, that is the main thing. The educational document is not so important UNLESS you are interviewing in Accra or a similarly strict embassy.

in our country case i learn 1-8 elementary school, 9-10 high school and then 11-12 higher education /universtiy / preparatory school. and i learned all these in different schools.

1. At least grade 9 and up, and actually grade 5 or 6 and up makes more sense.

Hi,
My father made a mistake in military records and said he has no military record while he has. And our ds 260 is submitted and we are scheduled for interview in October. So we informed KCC by email that we made such mistake and we will bring our documents and inform the CO of Abu dhabi embassy about our mistake cause we can’t unlock ds260 anymore.
Will it make our visa refused?

Thank you again for all the useful information.I am an Albanian 2017 dv lottery winner and as I am living and studying in the Netherlands for the moment, I have the following questions regarding ds-260:
1.As I am doing an exchange study until December, should I fill my current address or my previous albanian address? As I’m staying for only 4 months, my current address is not registered in the city hall.
2.My fiancee and I got officially married before I left for my study.As we are not living together yet, will it be a problem if our respective addresses are different from each-other, when we fill the ds-260?
3.Should I list the current dutch university where I’m studying at the education section? As I’m doing just an exchange study, I’m not going to receive a diploma in the end of it, just a certificate.

1. I would list it, as it ties with current education and includes a foreign country.
2. It depends on customs in your area. In most places that would seem bizarre (to be married but not living together), so I would not be surprised if that makes the CO suspicious about the marriage.
