If they decide you are affected by the ban, your brothers citizenship wont help. So, you are probably wasting your money, but you probably want to try anyway.

Dear Simon,
I and my wife went current for July 2019, but we did not get an interview yet. We’ve sent all the documents they have asked for in their email on April 11th. I’ve followed your advice and sent an email to KCC few days ago and asked if there are any problems with the docs. I’ve received an email from them today that starts with “Collect and submit your documents promptly. Your case will not be scheduled for a visa interview at a U.S. embassy or consulate until KCC has received and processed all required documents.”
I am confused now, since they have not provided any details. I’ve checked everything, and our documents meet their requirements. I can resend them again, but I am afraid of getting the same answer. I do not want to waste precious time. What is the best course of action now? Could it be due to lack of a military record(I have never served in the military, so I could not provide them with a military document)?
I would appreciate your advice. Thank you for creating such a wonderful website.

The reason for denial was because he mentioned three different birth years . He initially filled out wrong year but corrected in his DS260 application. My question is:
How do they request for second interview or appeal the decision? Is there a way to ask for second chance?

There is no appeal process – and by the sound of it your brother created suspicion about his identity, so that would not be overcome. This is a simple process. Accuracy and honesty is critical.

Well OK, that seems like a reasonable excuse BUT they are used to the conversion differences in some embassies. I suspect there was more to the refusal than we are discussing, BUT if you want to try with a lawyer you can do so. However there is no guarantee the embassy will even agree to another conversation – they are certainly not obliged to do so.

I’ve a question, my case nr is 2020AFXXX29XXXXX
I played single because i was in a divorced process and separated.
On that day my statue was married because the divorced was on going, but as you know, if i choose married to respect the statue as of that day then i wouldn’t play because she will never give me her pictures and without a spouse picture it is impossible to play the dv as married.
Also, she had our 2 kids and she said she does not want them to live in the US.
So,i also could not play with the kids because she refused to let me take picture of them.
I then played single.
Now we are divorced with all legal papers from court.
On the DS-260, i do not need pictures to write my kids names, so i can just write their names.
My question is should i say no kids in DS-260 to be inline with the single and no kids statue i played last year?
Or
should i mention them?
We have 50-50 powers on the kids.

I’m pretty sure a dead person can’t pass the medical. Even if he did, how would he do in the interview? He would need an affidavit of support from a living person for sure.
A deaf person on the other hand would be OK, but may need to satisfy public charge concerns of coping with the disability.

My sponsor is in the process of filling I134 form and there is a section that she has to indicate whether she intends or do not intend to make specific contributions to the support of the beneficiary.
1, Should she select the “intend” option?
2. If the “intend” option is selected, she has to indicate the nature and duration of contributions which in my case is room and board, should she put a limit in terms of duration ?

When completing my DS-260, I entered my 3 undergraduate degrees all of which required completion of my 12 year schooling in South Africa. I however didn’t include my actual high school certificate in the DS-260. Is this going to be a problem? I will take it along with me and include when requested to submit supporting documentation, however only thought to include my 3 bachelor’s degrees in the DS-260.

So I remember you. Around mid May last year you were making a number of ridiculous sarcastic and childish comments talking about X and Y axis of a chart I had made, complaining about my article being incomplete, complaining about other people wanting their privacy and also complaining that the Canadian process was so much better than the American system. Quite frankly, in about 2 days you showed you were not a nice person and had nothing but complaints. Now it turns out you were refused in your interview because you left your wife off the original entry and added her on the DS260.
The CO correctly disqualified you.
In May of last year you were asking how to add your wife as a derivative but you were so busy complaining and insulting me I didn’t bother to ask you whether you had correctly completed the original entry. Someone that complains as much about everyone else as you do SURELY read the instructions and followed the instructions – right? Oh, it seems not.
Maybe you should have spent more time reading, and less complaining. I could not have saved your case, but I could have predicted your denial and saved you the fees.

No. It would not be like that. AGAIN, the case creation date is the date YOU entered the lottery. It’s that simple. There is NO connection between that date and a derivative. There is NO logic in your argument, and since you clearly added your spouse on the DS260 it is OBVIOUS that the allegation is correct.

Because that would be idiotic. The field is ***CASE*** ***CREATION***. THat is a one time event, that happened during the lottery entry and has absolutely NOTHING to do with case updates, derivative updates, anyone’s birthday and so on. It also has nothing to do with anything except the case of the principal applicant. Just the date the CASE was CREATED.

$29k is not a rule, it’s generally what is expected. They can decide the level required. So 14k might be OK, but an I-134 would be less risk.

Also, one follow up question please regarding educational institutions – would I include universities I attended but transferred from? I.e. did not receive a qualification from that institution. I attended a university and moved to another from which I received my degree. the question asks all institutions ATTENDED tho, so I’m unclear. The initial application must be made from within the USA, and then you have to wait for a biometrics appointment which can take up to 6 weeks. Once you do that you can leave the USA.

I would like to ask three questions, I’ll understand if you feel they’re redundant or inappropriate in any way:
1. My case number is 2020EU8xxx. I have already submitted the DS-260 form on May 9 this year, two days after the lottery results. Can you make any approximate guess about when I should expect the e-mail telling me I should collect and send the required documents?
2.From what I’ve read, until 2016 case numbers similar to mine were being interviewed as soon as October, but in the last two years it looks like January/February next year is more realistic. Do you think there’s any chance I’ll get an interview date this year?
3. I’m a single applicant, I do not have a sponsor for now but I do have ~$12,000 on my personal account. Dear Simon, I have a question concerning the sign and submit of the ds260. My wife has won in the DV2020 lottery, CN 2020EU00005xxx. We completed the DS260s. At the sign page as accompanies do we have to introduce our separate passport no. or the principal applicant’s passport no.? Thanks
