Hi Jose, no I haven’t received my 2NL. My understanding is that if I had, I would know which month my interview was scheduled for because it would be stated in the 2NL. Is this correct Simon?

Hi Simon, just wondering how much of a rush one should be in to submit DS-260 / documents when one has a high case number. My husband has been selected in the EU region this year, but has a very high case number (54XXX). I’m wondering if it makes any difference whether we submit our DS-260’s / send our documents asap, or in a few months time (ie. would sending them in a few months mean that, for example, people with higher case numbers who submitted their documents before us would be scheduled for interview before us? Or is it done purely by case numbers, and as long as we have submitted everything before his number goes current it doesn’t matter either way?). Any insight you can offer on this would be much appreciated.

Thanks for your response and yes totally understand – main reason I’m asking is because I’m wondering how many months’ processing time we should allow for our DS260 and the follow-up documents (to make sure we don’t end up being delayed for interview past when our case number might become current). What is the typical processing time after submission of documentation and when would be the latest it would be advisable for us to submit the DS-260’s? I’m asking because have been advised by an immigration lawyer that we can’t enter the USA on non-immigrant visas or visa waiver program once we have lodged the immigration paperwork, we’d have to wait until the green card application process was complete. So am trying to delay as long as I can without affecting our chances of getting an interview in a timely way once our number (hopefully) comes up.

The lawyer you spoke to was not an immigration lawyer. He/she is clueless.
If you have a valid visa (or ESTA) you absolutely CAN enter the USA after DS260 submission. However, you may not be able to adjust status from that visa to DV depending on the visa – but no problem if you plan to process CP anyway.
Time of processing varies, but there is no point at all submitting now or even this year. Your case will only get current in summer of 2020. So – submitting in Feb/March will be fine.

Hi Brit, Again, I’m AS18xxx for DV2020 from Sri Lanka. I have a doubt about addresses. There are four address types which I can find in DS260.
Present Address – The Address I’m currently living in Sri Lanka
Previous Address – Previously lived addresses in Sri Lanka
Mailing Address – US Address where one of my friends is living in US. This is the address I’m expecting to receive my green card.
Permanent Address – Same US address used for Mailing Address.
Please correct if my assumptions are wrong.

Hello, It’s not a question, just some general feedback. I can see that many DV2020 selectees with high numbers started to question, if anyone with case numbers like 45+ and higher in previous years got a chance to have an interview. For some reason it’s difficult to make them understand that even if there was a current call, nobody with case number 45+ could be called, because there was no such number at all (I mean in EU). More or less same number of selectees and high case numbers logically mean that this year they will have to call higher numbers. This is what I understand from the general information given. I hope I made myself clear and I hope I am right. Thanks for the attention.

“Sorry, I remember reading here that we don’t need to unlock in this situation, just take both the old and the new passport with you to the interview. My passport will also expire in 2020, possibly before my interview and I have already got a new one, but I thought I shouldn’t unlock the DS-260?”

Hello Good Day,
I had a question regarding travel into the US and back prior to scheduled interview for DV Lottery 2020.
If a person is selected as a DV lottery participant and has submitted the DS 260 application but the visa bulletin number is very low compared to the case number and also the KCC ( Kentucky Consular Center) is still reviewing the application and has not yet requested any supporting documents for the DV lottery 2020 application , is it then possible to continue any travel arrangements into the USA and back as a B1/B2 visa holder while the DS 260 is being reviewed still?
I am assuming an interview may occur until January 2020 based on the case number and visa bulletin. Travel arrangements would be scheduled for Sept to end of October and don’t want any issues upon entering the port of entry in the states.
Any assistance or advice provided will be greatly appreciated.

Case Number: 2020AS29xxx. I’m not sure if I’ll get the chance for an interview, and as such haven’t filled out the DS-260 yet. However, I was reviewing the documents that I might potentially need and I have an issue with my birth certificate (which is in Arabic). I was born in Saudi, but am not a Saudi citizen and don’t live there.
My birth certificate has separate fields for my first and last name, and while it lists my FirstName correctly, my dad’s MiddleName was used as my LastName. There is only a single field for the Father’s Name on the certificate and my dad’s name is written in the “LastName – FirstName – MiddleName” format. I think this is what caused the error.
There is no way for me to get this rectified now. All my other documents such as passport, high school certificate, degree certificate, etc., have the correct names. All my non-Saudi passports (ever since I was a kid) list Saudi as my place of birth and they also have my parents’ names.
How big of an issue is this? I presume that the birth certificate is quite critical for the DV process.

I can’t predict exactly what the CO’s reaction will be. Yes the birth cert is important, but you can add the birth name as another name used on the DS260.

I have similar issue in Saudi Arabia (DV2020 selectee). . My last name is not the same in my HS Diploma & Criminal Record too (different from passport). What I did is that I filled all possible “name sequence”s used as another names on DS260.

Hello Brit, I need your help with the following so I can complete DS 260 properly:
1-How to choose my previous country of previous nationality correctly if I was a Palestinian refugee with travel document from Lebanon and I never had any citizen rights from Lebanon, or any other country before I became Ukrainian citizen in 2016? (Note I am Not and was never recognized by Paletine Authority which the closest option is listed in countries of selection)
2-Also, I still have a valid travel document from Lebanon for Palestinian refugees, does this mean that I should answer ‘yes’ to the question that says I hold a passport from previous country?
3-As mentioned in a previous question, I used my spouse country of eligibility (Ukraine) when I submitted my DV Lottery application (according to 9 FAM form). Can you please clarify how can I include 9 FAM as you advised earlier when submitting my DS260 application?
4- I have been working on projects in Saudi Arabia and Dubai in the periods between (Saudi)February 2007 to November 2007; Dubai from Feb 2019 to March 2019 and Saudi Arabia from March 2019 till Jube 2019 in different cities, but I was never on resident visa in Saudi Arabia, never rent an apartment in Dubai or Saudi during these periods. Shall I include these location with time periods accordingly as places of residence in my DS260? Note that there are other locations that I have visited for a week or more (but not more than a month) for tourism puposes, do they also need to be mentioned in countries of residence?
5- If I don’t have currently relatives or friends living in the USA, Is it viable to choose a hotel address as a place of my residence in USA upon my arrival and make it the address where greencard should be shipped?

Available. The Certificato Generale del Casellario Giudiziale is a certified national record of final court convictions and decisions regarding mental incompetency and bankruptcy or a statement that no such record exists (Nulla).The Certificato dei Carichi Pendenti is a certified record of pending criminal charges, or a statement that no such charges exist, from the office of the Procura della Repubblica in the applicant’s place of residence. Both certificates are required from immigrant visa applicants residing in Italy.
Persons within Italy can obtain the Casellario Giudiziale by applying in person or by mail at any office of the Procura della Repubblica. The Carichi Pendenti must be obtained at the Procura della Repubblica in the area that the applicant resides. Such offices are located in all major cities and in many small cities and large towns. Those who apply in person must submit a written request, a photocopy of a photo ID and all fees; the certificates are usually provided the day of the request.
My question : ( I am confused ) – Which Certificate do i need to obtain ? Only this ? – Certified Record of Pending Charges ( Certificato dei Carichi Pendenti ) or both ?

I intend to fly befor and submit a reentery permit in order to be able to come back to my country and do some licensing exams (medical field) and apply for a job in the US while I’m working in my original country and a supporting my family.
Can that be a problem? Will they approve my request for re entery ? And how long (minimum) i need to stay in the US till i fill the re entery and give a finger print? Will 2 month be enough??

This topic of Public Charge – I don’t understand conceptually, so help me if you can
The U.S. is a pure capitalist society and there is no welfare and welfare benefits, the purest in its form – Its not like European countries that are mixed economies, part state, part private, welfare, socialist to varying degrees
What is public assistance or public charge when there is “nothing to take / receive” from the Government and they give nothing, as far as I know, but PLEASE tell me if I am wrong and where exactly I am wrong so I can learn
I have been to America a few times, and the homelessness and poverty in LA and even SF is like I have never seen in Western Europe
Obviously the US government are not helping their own – what help or public assistance do they give
Can you help me understand this genuinely – I have my visa already but this will help me understand what public assistance there is, even if I am not allowed to access it.
Maybe one day when I am a US citizen I will be entitled to any “public assistance” should I require it – BUT WHAT IS IT AS I DON’T SEE IT AND UNDERSTAND THAT AS A CAPITALIST STATE, THEY DON’T DO WELFARE?

Thank you for putting me right and telling me where my flaw was in the statement I made! I didn’t know there was public assistance that was “real” or “tangible” – honestly I didnt know – I thought the state (U.S. Government) does not support you whatsoever in that way! But then….
…Why is there so much bad poverty and homelessness in the U.S. then? – I have seen streets upon streets of tents on pavements (“sidewalks”) in downtown LA and homelessness in San Francisco is part of life, like sunrise and sunset
Unlike in Western Europe, poor is NOT poor – the living standards are still OK’ish and held up & supported by the European states.
Homelessness is there but very few in comparison to what I saw with my own eyes in downtown LA – it was a horrific sight frankly and I was stunned
The rich are very rich in the USA and the poor are very very poor to 3rd world standards, unlike in Western Europe

No – on homelessness you are correct. You are just missing the “details” – everything is not so “black and white”. Homelessness is mainly a factor of mental health and financial (although it is a complicated subject). Years ago, mental health institutions were closed in the USA – so today mentally ill people have to find some way to live – and often end up on the streets. They could get public assistance, BUT their illness means they are not able to cope with the paperwork that would be required to access those benefits, conforming to rules and so on. That same factor also happens in Europe. But there are more people on the streets in the USA – why – well partly it’s a factor of the weather. LA is a “good” place to be homeless because you don’t freeze to death in the winter.
Also as you mention, the other thing in the USA is a big difference between the poor and everyone else. In San Francisco for instance a small apartment is worth over a million bucks. So renting that apartment could mean $5k a month (and we are talking SMALL). That is a big target if you have a minimum wage job – so many people struggle while others are getting salaries of $200k for a young but smart software engineer. So – that is another factor. Again – in Europe that is less of a factor. The poor in EU are not so far behind the middle class.

I watched the video on public charge on your channel – excellent video, and videos generally – so thanks for that – I think your YouTube channel is so much better than reading the webpage – so the stuff you are doing now on your channel now, more recently, is so much more effective, in my opinion
But watching the video has raised a further query on Public Charge
I know you have to prove you will not be a Public Charge to the CO and in the overall DV process up until issuance and the sponsor’s form is not enforceable by the Government
But lets say you get through all that – either you have the cash to prove or the sponsor details
What happens in the unfortunate situation – MAYBE SOME YEARS DOWN THE LINE – lets say in year 3 or year 8 – you end up needing public assistance, or you become a public charge inadvertently ?
Luck has not been on your side, you lost your job, ill health, or, god forbid, all you lost all your savings or things JUST don’t go according to plan
As you know “that’s life” – good things happen and bad things happen
Can you access public assistance at that point ?
And how does that affect you as a DV émigré hypothetically as you say for the DV program, the sponsor is not bound by his / her support ?
What are the implications?

No immediate implications for the LPR or the sponsor in that scenario. Mostly public charge is a concern for people becoming an LPR. LPRs can access certain public assistance programs – and as you say – sometimes thing don’t work as planned.
However, the only other concern is if the LPR then applies for citizenship of the USA. Having accessed public assistance does not cause an automatic ineligibility BUT a CO could consider the moral character of someone that used such assistance as part of a deliberate and immediate plan. That would be dishonest. BUT in the scenario you paint, no one can see that far into the future, so that would not be a concern.

I am failing to understand your second paragraph completely and more confused by it, if anything, so please may you clarify or elaborate further as it is me probably that has failed to understand the point you are trying to make
If you are applying for citizenship it will potentially & most likely be between 6 – 7 years after you’ve been issued with an IV…. (allowing for time to move (activation etc.) and citizenship processing times of between 1-2 years after the minimum 5 years required continuous stay for citizenship
So where does the CO come in 6-7 years later? I’m confused by your paragraph, as that interaction with the CO has long time ago passed at just before being granted the IV.
Moreover, If you access certain type of public assistance programs NOT NECESSARILY immediately but at any time in the intervening 6-7 years described above (having been under the “LPR umbrella” during this intervening period) ……..does a subsequent application for Citizenship get :-
– barred
– rejected or
– re-postponed
because you had accessed those certain public assistance programs which you were initially assessed as not having to have become a public charge (you weren’t supposed to, and were assessed as not having to, but you did) ?
This is all hypothetical, but good to know where we stand if there are implications arising, and we should know in advance what those implications are

I have a bit of difficulty understanding the number 1 reason why people get disqualified, which is:
*Failure to include child/spouse on the original entry*
I included my kids on the original entry but stated that they were not immigrating with me now but at a later date, that is, in the future. This was made clear in the DS260.
Please, could you let me know if this falls into the Number 1 reason of disqualification or not? As I stated in an earlier comment, my decision was and is still based on the fact that I cannot take along two kids by myself because I’m not married. It’s better to get settled in and then file for them in another process.

As long as you understand that means only you will get the Green Card – that is fine. You simply don’t file DS260s for those family members.

Hello Simon and sorry to bother you again with a bit complicated situation i face.
So, im the DV winner for 2019, we all already received our visas, which mean myself,my wife and our newborn twins.
So the issue now is that my wife’s visa and mine expires 16DEC19, whilst our newborns visas expires in early February 2020, thats because our twins were born after our medical but before the intervieew,therefore i had to get their medicals which obviously took place much after ours.
The thing now is that by the expir6 of my wife and my visas, the newborns wont be vaccinanted against the Measles/Rubeola disease and according our country health regulation the vaccination can be done not earlier than 6 months old, whilst the usual procedure is at the age of 1 year.
We quite dont know what to do, as while the terrible outbreak of the disease now we for sure cant travel with the babies before they get their vaccination, and they will become 6 months old after my wife and my visa will expires.
Ive sent several emails to the local US embassy for advise,but no respond.
Maybe you can share some advises on how to handle this?

The reality is that your visas must be used before the expiry date. There is no way to extend that now. So – make your plan assuming you will travel before your expiry date.

If i wasnt clear. Due to the current worldwide outbreak ( especially in the US), health organiztions dont recommend travelling with unvaccinated babies. ( specifically for Measles)
But anyway, you answered my question that visa cant be extended.
Its a big mass for unfortunately.

A baby under 6 months still has antibodies from the mother – so as long as the mother was vaccinated the baby is fine. That is even more the case if the baby is breastfed.
New parents tend to worry about everything. I have 4 kids (and 5 grandkids). Haven’t lost one yet.
