Hi Simon,
I’m Iranian student in US and have valid I-20 till Aug 2020. I also have a job offer that I have accepted that I can start any time between July to October.
My wife (also Iranian student in US with valid I-20 till 2021) has a case number 2020AS9500. We are planning to proceed with AOS. We have not yet submitted our DS260 due to the possible need for extending I20 or applying for OPT if our number does not become current (due to cap put on Iran).
Based on the trends, our number may become current in May or June, but as you mentioned in your last youtube video it may already be too late for Iranians.
1. Is the comment also valid for Iranian that are in US as well?
2. If so, would be best to be cautious and apply for OPT first then fill out the DS260?
3. Although I understand that DS260 processing time varies from person to person, is there a average for those in US?
Im asking these questions, because it is my understanding that if I fill out the DS260 (I have shown immigration intent) and if there is not enough processing time, I will loos my eligibility for OPT and I as of Oct 2020 (2 months after my I-20 expiration date) I have to leave US. Please let me know if there is something else to it that I’m not considering.

You do not need to complete the DS260 early. It is not part of AOS processing (although it is optional and useful).
So – you should however be ready to submit your I-485 as soon as your case is announced as current in the VB. That could be next month or the month after. You can expect some delay, but I cannot give you an average time. You need to go to the link below and learn more about the process and be ready for early submission.

Both – but be aware that you need to include the payment receipt with your I-485 – so you need to be ready – and as an Iranian, you want to gain all the time you can to allow for potential delays later.

A Green Card is not a visitors visa – it is for people who want to live and work in the USA. So – if you do not make any plan to start living in the USA – an immigration officer will, sooner or later, question why you are not living in the USA, and may refer you to an immigration judge. You can also lose your GC through not respecting your obligations such as filing tax and so on.

Thank you very much for your blog. Could you plese please give your opinion on my situation. I’m from Russia. I was born in USSR, in Russia. But i choosed my mother’s country of Birth as country of eligibility. She was born in Turkmenistan, i have her birth certificate to prove that. My father was born in Belarus. Back in the day both Turkmenistan and Belarus were part of Soviet Union, and now all three countries are independent. Both Russia and Turkmenistan are in EU region, both were eligible for DV2020. So i was selected, i guess that in March my case number will become current. DS-260 is done, and scanned documents are sent. What is your opinion on my chances during the interview?

You were not entitled to list Turkmenistan, but as it is within the same region they will probably forgive the error.

I took part in lottery since 2010, just heard that the chances are better for smaller countries. So i took my chances, in the entry form there wasnt any limitations, so I thought that it is not prohibited. Didn’t really expect to be selected this very time, because after 10 years I almost left any hope. Do you know if there were same cases like mine recently? What was the result?

You can unlock now, or change at the interview.
You will not get a 2NL until your DS260 is processed, your documents are process and your number is current.

A few month ago, I asked you a question that I won the dv lottery 2020 with my family together and because I had someone else filled the form for me. He didn’t add my biggest son who is under 21 years old and has been studying abroad for 2 years. And after we won the dv he said that if we don’t add him in DS-260 we will miss the chance. Since we didn’t have information, I told to call the kcc and the kcc said add him and be honest. And your response was disqualification is certain. And then I shared what you said with the one who is runs my dv case and he says that tell your interviewer all the problems. If doesn’t accept tell him/her to give you DNA check. Here is my new question sir. What he says is useful or not? Is disqualification is certain? If yes, is there any solutions? Should we pay for the interview? I am very poor I don’t even have the money to for the interview but I borrow that. So please guide me what to do and what not.

I am an Iranian- Canadian Citizen. And a winner of 2020 lottery. My case number is around “2020AS8600” and most probably, it will be current within April. I submitted my DS-260 form at the end of August and three weeks later, I received an email to upload my docs. But, I did not upload any doc. My documents are ready, except the police clearance certificate from Iran. I have already applied for it but the Embassy advised me it may take 3 to 4 months to receive it. Instead, they provided me with a letter mentioning that I have applied for it. And advised me to provide this if there would be a delay. I am wondering if I should upload all documents (including that letter) or I better wait for another month to see if I will receive that police clearance certificate from Iran.
Any advice in this regard is appreciated,

Excellent point – the reciprocity page makes it clear that they do not need the police cert.

You could speak to KCC and see if they would be satisfied with the proof that you applied, but of course your case will not be approved without that police cert.

my visa has been approved! I just had my interview last week and it was a Yes! 🙂 Thank you Mr. Simon for all your tremendous help, it really means a lot!
I’ve still got a couple of questions, though, hope it’s ok, sorry if they’ve been already answered:
1. The expiration date on my visa, let’s say it’s July 10. What does it mean for me precisely? I’m struggling to find an exact answer to this. Does it mean the maximum date I’m allowed to enter the US, or does it include any period of time after I enter the US in which I need to have my picture taken for the Green card and other administrative things?
2. Can I just enter on July 8 for example, or let’s say July 5? Or is that pushing it?
3. Is there a recommended period of time before the expiration date when I should enter the US? When would you suggest for me to enter if the expiration date is July 10?

1. It is the last date you can enter for the activation trip.
2. What if there is a flight delay or cancellation. Don’t risk such a late date – the date will not be extended for ANY reason.
3. 1 day before is technically fine – but again – don’t make travel plans like that – see answer 2.

Hi Brit, as your suggestion, I requested to unlock DS260 to update my travel history in the same language last time it was unlocked, i.e
“I found some mistakes in our DS-260s. I want to update information in all of our DS-260s.
Please kindly unlock our DS-260s.”
But this time they replied as-
“Please provide an explanation as to why the DS-260(s) need(s) to be unlocked. Once KCC has received this explanation, we can proceed to unlock the requested DS-260(s).”
If i explain only to update my ds260 for travel history, they have readymade answer as it is not needed……, as other said.
So, please suggest what to do now.

There is NO POINT in asking questions before you have been selected. Your chance of winning is very small.
You check your entry in May by going to the ESC site – which is at the same place you entered the lottery.

Our interview is in the process of getting scheduled, so want to just get all our documents ready in the meantime. I need my parents to supply a letter for financial support as well as a letter stating that they are gifting us with an amount of money. Do you possibly have a template for these letters, as i just want to make sure i use the correct wording, as i know that wording these letters correctly is very important.
I also have a friend in the USA who i will ask to fill in an I-134 as support as well, as I want to rather tick more boxes than needed.
please advise on a link for a template, as this would be much appreciated.

I (2020AS9XXX) have a doubt and I know you can guide me well. I (three all together, with my spouse and a son) have a sponsor in US, I have mentioned him while filling DS 260. Now I got the information that he has sponsored another guy of DV 2020 program and this guy has already been granted visa.
Can a single person in US sponsor two or more applicants in the same year? Does it make my case weak?
Please let me know. Hopefully my CN will go current in next VB. Still I have some more time to find another sponsor.

Sounds like it wasn’t unlocked in the first place. It gets locked when you resubmit it.

3 weeks is nothing. You have delayed for months – and now you need to be patient. In due course they will ask for documents. Your case number will be current in a month or two – but your delay probably means a later date for interview.

Hi Simon,
There is a misspelling name on original DV entry form but in ds260 is the same from birth certificate and passport. For example Abdulo instead of Abdullo, but I have heard with such a mistake CO has refused to issue visa reasontly. A mistake may be minor or grave. Minor mistake include omitting or adding additional letters yes? During the interview the CO just compares your DV entry form and if the name doesn’t match he refuses even minor mistake. So, passport, birth certificate diploma, bank account is not enough evidence? Do you have any advice what my credibility is? Should I contact to the embassy? These kind of cases are more common and most of the refusals are from american embassy in Almaty Kazakhistan

I am married selectee of 2020.and have 5month baby, when i was filling DV lottery. i was not serious about this but when i was randomly selected i regret all about what was done and filled DS260 form as Single because afraid about denial.I cant loose this opportunity anyhow. now i am like between the 2 serious problems.(1) If i include my family there was already mention single and(2) If i am not include them its not good about my family, This is the reality .

You broke the rules, so you will be disqualified. If you proceed by lying, that is a serious crime, and when they discover it you can be deported.

You should expect an email from KCC in the next 3-6 weeks. If you do not hear from KCC after 6 weeks, please contact [email protected] to confirm all of your documents have been received, and you are ready to be scheduled for an interview.

So you should have included both of them in your original entry. If you didn’t (as you said you didn’t) you are absolutely CERTAIN to be disqualified at interview. 100% certain, no way to fix it.

It is very simple. If you did not include your wife on the entry, the result is disqualification. There is no way to overcome that. You are free to ignore my information, and you can find out what happens at the interview once you have wasted the fees.

1. Yes. Once you are current.
2. YOU should not be completing the I-134 – the sponsor does that! There is space to add additional derivatives.

For initial filing, yes, BUT you MUST change that at the interview or POE because if they send the GC to the address you give (a hotel) you won’t get the GC and USCIS will charge you $500 to replace it because they sent it where you told them to send it.

Could you please take a look at my question? At the time when I was filling my DS-260 form I selected that I have been in the U.S. before (I was issued an ESTA). Because of that, I thought I needed to declare that I have been issued a U.S. Visa. There wasn’t ESTA among the options so I chose IMO the closest one – BUSINESS/PERSONAL (B1/B2).
Could this affect my GC issue process?

No – they will know you did not have a B1/B2, BUT if you have time to wait anyway (due to your number not being current) you should correct the error.

I have an interview next week and i want to know what do you think of my answer when they ask me what is my plan in USA or what i will do?
Well, and this the total truth by the way, i would say that “my main purpose is to seek a job in civil engineering since am an engineer and I understand that there is a certain procedure to practice engineering that i need to pass the FE exam for engineering and then i will be eligible to practice engineering. Meanwhile i will find a temporary job to cover my living expenses. Also My other main purpose is to study masters in engineering to enhance my skills and knowledge and be able to understand more about engineering in USA, and that i can do because i have good savings plus my father will support me all the way with no limitations.”
So what do you think? Is it a good answer ?
