a) If you activated your visa in Dec 2019 and returned immediately and didn’t return to the US for up to a year (Lets say Dec 2020) as you are allowed up to a year – are there repercussions if you didn’t file any tax returns for 1 or even 2 years as you weren’t present or working in the US- let’s say you start your new life in the US in 2021 or 2022 as you will now be physically present and working in the US? What will be the repercussions if you hadn’t filed previously ?
b) What happens if you apply for a re-entry permit in January 2021, hypothetically, in respect of filing taxes ? Is applying for a re-entry permit in January 2021 possible to extend the time at which you eventually come across ?

Hi Mr. Britsimon,
I am following you on your youtube channel and I have saw the latest video you thankfuly posted. Now I want to share with you my case. I am from the latest number 54.445 and KCC sent me an email in OCT 19 to send my documents as fast as I could and I sent it folowing all their steps a requirements. I’ve recieved an automated reply that they will send me with in 3 to 6 weeks, however they didnot I sent them an email they told me I have to wait untill I am CURRENT. Due to covid 19 pandemic and all the delays thats happenin arround the world I am not current till now.
1. I am afraid to lose my chance of travelling so can I get a lawsuit as your advice in the latest video?
2. if i didnt win the case, are they going to do any harm to me? (blacklisting me, banning me…etc)
3. how long does the case take in court in US to get a reply?
4. if the ban is NOT extended and I applied for the lawsuit with a lawyer, and my case number got current are we going to wait for the reply of the case from the court or KCC are going to proceed normaly with my case.
5. According to the automated reply KCC sent first that they should reply with in 3 to 6 weeks and after that I had to wait for my case number to be current, Does that mean that I have a problem with my documents ?
6. From your opinion what are my chances to travel to US and my case to be proceeded.

4. You don’t seem to have watched or understood the video. The lawsuit would ideally cause faster action – a court date is not the goal.

My issue is that I registered for the dv 2021 in October 2019 before getting married in December 2019.
My husband, then my fiance, had already passed for an immigrant visa which was filed for him by his mom some months before our wedding.
My husband left for the US few weeks after our wedding. I would like to know whether it’s necessary to request for my case to be unlocked so as to update my marital status or I should just ignore since my husband is already in the US.
If it’s necessary to unlock my case for an update is it not too late since dv2021 results will be released in June next month?.

Hi Brit, Soon after our airport is opened we are planning to go get the visa stamped and come back the next day. Do you have any idea to what sort of quarantine process we will have to face in US ( in some countries, have to stay in a quarantine Centre or be self quarantined for 14 days)

It does seem that they’re processing in the order of when we filled up our DS-260 and submitted the required documentations.

After checking the status at CEAC it says that my case is at NVC. It also says that I should follow the 6 steps listed before NVC can schedule my interview, which includes submitting NVC fees, forms and documents. I have never received any information from NVC requiring fees or documents submission. I have only submitted documents to KCC. Could you please explain what this means?

That is the intent of the lawsuit – but given how the law is written that is very difficult to achieve. The best hope is to cause earlier processing of the cases joined on his lawsuit.

That might help – but the only way to know is to go for an interview and let the CO apply for a waiver. That process takes time – so there is a risk on not getting approved in time – then you lose your money.

Hi Brit, quick question: how does someone reschedule their appointment from one country to another. For example, my brother had an appointment scheduled in March for a DV lottery visa in Turkey from Iran and now that Turkey has closed its borders, I wanted to reschedule to another country that has open borders. The Turkish embassy site is not helpful with this process. I just wanted to know if that is even a possible option.

This is not in force yet, but it seems it will happen… I wonder why don’t Democrats do anything about this? Actually I think if Trump is going to extend the ban, he’d better do it not per 60 days, but with bigger time amount. Uncertainty is even worse. It’s better to know well in advance, rather than have false hopes.
And one more question, if applied through AOS at the end of June, do you think it’s feasible to meet the deadline? Is it possible to request emergency processing of the case, since it’s a time-based visa?

Dems didn’t keep silent, but you need to understand how government functions here. There is a difference between EOs and laws.
A bill is a suggestion to create or change a law – it must be passed by the house, by the senate and then signed by the president. The house is democrat controlled, the senate has a thin Republican majority and the president is a lunatic. So – passing new laws is hard because you need “bi partisan” agreement and the lunatic is pissing everyone off.
On the other hand a president has a certain amount of executive power – through EOs he can decide how to implement changes but only within the laws already existing.
So – if the president implements an EO that is not lawful, lawsuits can be bought by anyone with “standing” – meaning someone who can show they are harmed by the EO. Those lawsuits go through Federal courts (where some of Trumps EOs have been blocked) and then those arguments can be referred to the supreme court for final judgement. Sadly Trump had the opportunity to swing the makeup of the Supreme Court towards the political right – as there are now 5 Right leaning supreme court justices and 4 left leaning supreme court justices. That gives Trump an advantage unless someone can show an EO is very obviously flawed.

It’s nothing to do with “Democrats want to hurt him”. That’s, frankly, nonsense. If Trump were half the person he should be, we (the USA) would be in a better position on so many things. It’s not a question of wanting to hurt Trump, it’s a matter of wanting better for the country.
As for keeping things closed – most of our states son’t need to be closed. If there was adequate testing we could have sensible decisions area by area. There isn’t adequate testing – because we got a late start – why – because Trump denied this was even a real thing for way too long, so we got a late start. There are 30 countries that have had more testing per capita than us. 30! We spend about twice as much on healthcare as any other country in the world – and still we can’t get enough testing! It’s nuts.

Please my name is Tamakloe Mawuli and I applied for DV lottery last year(2019) with a passport that is yet to Expire in 2022 but to be on a safe side, I decided to apply for another passport since the old passport is going to expire in 2 years time (new passport will last for 10 years) now my new passport is ready and then my old passport is canceled do I have any problem with the States department assuming I win.
However, I still have the cancelled passport in my possession together with the new one Passport which I received just today!

Hi Brit,
I emailed sent my documents to KCC on 16th of February 2020 in two emails – my documents in one and those of my spouse in another (because of the attachment size limit). And I received the standard “received” automatic replies for both mails.
I sent them a email asking whether they are satisfied with the said documents yesterday and they had responded saying that my DS-260 has been processed without mentioning about the status of my documents.
Should I re-send my documents just to be sure or wouldn’t it matter?

I have this feeling that the Band could be extended but this time for 30 days and embassies would reopen and start rescheduling but most often will put people on AP until the band is uplifted.
Just how i see things moving. So I think our hopes should be that embassies should reopen to issue visas bfr dateline (sep 30) bc as for the band I don’t see Trump extending beyond July . Just a focus.
Once embassies in the State reopens in June (hopefully) I think it will be left for other embassies all around the world to reopen too depending on how the severity of the covid situation is at the level of each country where the embassy is found. . So candidates from countries with fewer cases of the virus could start expecting their 2nl as soon their embassy reopens taking into account that their documents had bn sent and it has bn processed .
Like I said it’s only my forecast.

Right now there’s multiple countries that are in a better shape then the US. They’re even planning to have tourists back opening movie theatres ect. in June. An embassy is a more controlled environment (social distancing wise) so I don’t see a reason to keep the embassies shut much longer. Out of SFO It’s announced that international flights to Europe start in June, so having the embassies open would be favorable for US citizens as well. It’s not just Visa applicants that are affected by that also US citizens living in European countries, so I’m sure DOS will make appropriate decisions, hopefully.

Thank you much. Maybe I did not explain it clearer. I mean that after selection my next step was to apply for the DS-260. And there were not such questions about affidavit of support or being a public charge or showing finances. I thought I would have to show them on the time of interview or the KCC would ask to provide such evidences. But now I cannot wait to the interview, as it may never come and I would like to know whether it is normal to send such documents to KCC if they have not asked to send? ?

I introduced a false fact. I had sent DS-260 in summer 2019 and sent my documents in November 2019 based on a request by KCC, and they never asked me to provide I-134 (if this can be decisive).

You present an I-134 at interview if the CO asks for it. If you read the link I gave you the reasoning should become more clear. It is nothing to do with changes to the DS260 and the I-134 is not listed as a required document (neither is a job offer), but the concern it is intended to combat (public charge) is part of normal immigration law. Hi Simon, unfortunately I found your site AFTER I paid a third party site to make an application on my behalf. I was very impressed with the information you provide. I would 1st like to know if the third party site I used was legitimate and have you heard of them ( green card immigrate ) I am in the process of trying to get them to refund some or all of the money I paid them. Just the fact that they are suggesting that stopping your application would result in a black mark tells you everything you need to know about this site. It’s a scam. They are assuming you are stupid enough to believe their lies. Of course there is no black mark – and this company have NO say in the process one way or the other.
The lottery process is free, random selection. There is no need to pay anyone (including me!) for entering the lottery. There are no black marks, other than those who try to commit some sort of fraud (such as multiple entries). The entry period is ONLY in October each year – so if you had planned to register with them for the next lottery, please make sure they will NOT enter your details so that you can do it yourself.
Out of curiosity, did they ask you for your passport number? There is no harm if they did (no chance of blacklisting) but since last year providing a valid passport number has been added as a new requirement. They cannot create a valid entry without it.

As per your advice, I added my new born baby’s DS260 after unlocking. I added it with my passport number as baby’s passport was not ready due to the current situation of the country. I will be able to collect it in 3 days. My questions are,
01. Do I have to unlock the DS260 again and change the passport number?
02. Will unlocking it be a reason to delay the process for my CN (As 28XXX)
03. If the answer to 02. is Yes, shall I send civil documents again with baby’s documents without unlocking DS260?

I hope you’re ok. My name is Rick and I’m from Peru. Since the DV results are so near, I started to rethread all my steps to see if I had filled the form correctly. And there’s this question:
“13. What is the highest level of education you have achieved, as of today?”
And I answered: “High School degree”
My educational story is a bit more complicated. I finished high school on 2015, and I started university on 2016, to study Laws. But to attend Law School you first have to take two years of General Studies (Kind of an European Baccalaurete) before even attending Law School. I dropped on 2018 without finishing General Studies because it got very expensive and I couldn’t afford it anymore.
The rest of the year I helped my parents at home and next year I started classes on another university (2019), but since the Peruvian educational system got reformed, I had to take General Studies (again). Applied last October and since then I’m waiting for the results to come. No classes so far since Corona has messed with the whole schedule.
I also have to mention that I got an US Tourism visa back in 2017 and I got it through my father. I remember the Embassy officer asking me what did I study and why I wanted to go to the US.
So, if I get elected, will this be a problem with my elegibility?

Hi Brit,
This is just to inform you an update.
I am from Sri Lanka and holding the visa in hand but unable to travel as our airport is not functioning. Today we got a call from embassy and informed they won’t be able to process or re-issue any immigrant visa so we would better to travel( as they said only few special flights are departing) . They insisted during the Imi ban they don’t process extensions.
What we wanted was once the airport is opened go get the visa stamped and come back But as arrivals are fully closed we can not do that. However, their answer was we can not help, if you want to protect your chance you have to fly.
Now I have less hope on extensions. I think they give this calls to get rid of the complaints and the requests they might receive in the future. It’s just a process from their end. they don’t consider the unemployment, the risk of infection etc. Even it’s hard to ask questions.
Please OTHERS if you have any related info from your embassies share here.

I have explained my assumption that embassies will not be able to extend visas during the immigration ban. So – the statement from SL should not be a surprise.
Now – at this point there is no sign (one way or another) that the ban will be extended. Obviously, if you can travel, you should, simply to avoid the risk that the ban is extended.

Brit, in my country people have their interviews at the beginning of June and general situation is very good. They also started rescheduling not to loose time. Do you think KCC will take it into account? I’m waiting for mine and nearly every person whose interviews were cancelled have already got their rescheduled dates. What do you think will happen? You need to be more clear. If you are saying you haven’t submitted your DS260 and documents yet – you have left it very late – possibly too late.
As for the certificate – you have to meet the education requirement so if you need the certificate to prove you meet the standard, then yes it could be a problem.

I only sent in what KCC asked for (police certificate, copy of bio page of my passport, and my birth certificate. I thought it would be fine to bring these Uni certificates to the interview. Hi Rio, I feel similar than you, I have a high CN EU52xxx, from a country with 99 selectees (Spain), although that´s the number of selectees and I am not sure if the number of people who chose that particular embassy for the interview will be similar to that. There are so many factors to pay attention to these days that it´s so uneasy to predict.

Nice to get to know you 🙂 I have EU44XXX, yea i have actually thought of that as well, but when i analyze the previous year’s data it seems obvious that not many people get interviewed in the embassy per year. I think of the rush that will happen in the countries like Turkey, Russia, Albania which may cause some selectees to lose the interview chance when they start scheduling, but in European union i do not think it will be a problem. Lets see what Brit says us from his experiences.

And 2 question:has anybody registered a new date of interview after the suspention? Because in Albania some people tried to reserve a new date but they found only in the end of July or Middle August..some others couldnt do anything and they said: they will wait the email from the embassy so they can reserve a new date for me ..
