HI. I have had a read over lots of your information and searched and can’t find an answer.
I am about to get married and then will fill my DS form in after. I was going to use my current passport that I originally entered with.
In a month or two I’m wanting to update my passport with my married name. Will I need to update my details with KCC when I get the new passport? Or just take it to the interview with me?
I’m assuming it won’t be a problem and I just take the old one with me as well?

I am a Brit with a philipino partner who was previously married to another Philipino. There is no divorce here and annulment is uncertain and takes years. I have both US and UK passports but am looking for guidance on how to get her and her two sons (13,16) into the UK, obtain divorce, and then marry. Out of country divorce legally has to be recognized in Philippines.
No luck in finding UK contacts. Obviously travel presently problematic.
Do you have contacts or ideas about how to proceed?

Well if you have any chance to travel you should do so, but if not it “should” be possible to extend the visa although it is still not 100% clear. It should be more clear in a couple of weeks.

1) Do you think the Given names in the DS 260 means first name only or first name with father name?
2) In my country high school is 12 years which the last three years are preparatory stage. In addition, the last year of the preparatory has a baccalaureate examination. Could you please explain how to add date of Attendance From .. Date of attendance to.. in the DS260; the last year needs to be added or the three years?
2) I have BSc and also passed high school 12 years. Regarding the institutions; Do I need to put down high school first and then in the second institution, University name or the other way round?

I didn’t see this discussed anywhere. Let’s say embassies reopen and schedule some DV2020 interviews in August and September, and issue some visas or resolve some AP cases. The visas are valid for 6 months after the medical exams – which means that potentially – IF the ban ends at the end of the year, 2020 visa holders can still enter the United States in January and February and even March of next year. So – not all hope is lost for DV2020 winners, correct?

Hi Brit, I called and emailed to our embassy and they confirmed they can not extend the visa unless otherwise the ban is challenged by a lawsuit. So finally I am traveling to activate my visa. Thanks for all the support ! I am gonna buy an insurance from the site you provided..!

The pricipal selectee can enter before or with the derivatives. Everyone, including derivatives must enter before the visa expiry date which is set as 6 months after the medical.

I did know I have to go to the US to activate my status and activate my GC, but I thought I could enter the US with the Visa they did put in my Passport. Embassy in Paris just leave you on a recorded voice message…

You need to start paying attention otherwise you will cost yourself your Greencard. Some simple points.
1. You are mixing things up. Yes you can enter with the visa you have in your passport.
2. Once you enter you will become a permanent US resident. (Green Card holder or “LPR”)
3. Until you enter you are not an LPR.
4. As you are not an LPR yet, you are affected by the ban on entry from the Schengen area. You cannot enter the USA if you have been in the Schengen area (or the UK and some other countries) in the 14 days previous to arrival.

Then you would have to take up residence in the USA and sponsor them while you are there and working. That process takes a couple of years – and could be difficult for your family to be separated.
Sebastien. You have been asking questions for a few days. Those are lost days, and you had already put your GC at risk by not taking proper concern for what you had to do, or studying travel restrictions. Stop wasting time. Investigate your options for travel and make it happen. I assume your visa expires in August (it is based on your medical date), so you don’t have much time. At this time there is no guarantee that you can get an expired visa re-issued – and even if you could, that would require new medicals and new interview fees which will be expensive for your family.

But as you mention in your Blog Serbia is over. Flights for Serbia from France are canceled because of the situation in Belgrade and around.
A friend was suppose to fly there in a week…

I called the French Consul in LA, same question, NO ANSWER.
Trust me I am not doing nothing, but you check Flight tickets and you see you will have 32hours flying with one 4 years old and one 1 year old daughters and you have a offers on tickets at 10K$, you cannot take a decision like you were by yourself…

I am from the 2019 allocation
I entered the US with the immigrant visa in November ’19… and returned 2 weeks later to my country to tie everything up before the final and permanent move.
I had planned and had a booked ticket this past March – well within the 12 month period as per your FAQ’S
However with COVID my flights were cancelled.
In addition no travel has been possible since March and the South African borders remain closed for the foreseeable future…. probably into November possibly even 2021.
(a) Is there anything I should do – can do- to mitigate my situation ?
(b) Logically I have a sound reason for being out the US … but do you think it may still be an issue with Immigration upon my eventual return?
I know this is unchartered territory – but your advice has always been excellent so I thought I would check with you and see if you had any advice for me
ps – I have received my Green Card.

You should start a conversation and perhaps application with your local US embassy. They may ask you to apply for a returning resident visa (for cases with over 12 months absence) – that is called an SB-1. Given the situation it is unlikely to be refused – and may even be waived.

I did as you advised and I tried to start a conversation with the US consulate where I had my interview.
Can’t say the consulate was very helpful.
this is all I received “ All routine visa processing has been suspended until 30 December 2020 due to the Presidential Proclamation for coronavirus. There are exceptions for IR1/IR2s, CR visas.
Please check the US EMBASSY website for repatriation flight for you to return back to the US, please check under ALERTS. We cannot confirm when the borders are open but South African government
In my email I did not ask them about completing an SB1… just what they advised I do.
The problem with repatriation flights are they are extremely expensive – approx $ 3000 – just 1 way
So I want to ask you for some further advice please :
1 – can I try leave it until end September ( taking into account I entered the US 1st week of November 2019) to see if the borders do re-open and there is some kind of normalisation on the cost ?
Alternatively if the situation has not changed by end Sept, I will then pay the exorbitant cost to fly out early October because I agree with you – the Green Card is a life changing thing
2- or should I ask to complete the SB1 now and therefore give myself time beyond the 12 month period to wait for border easing and hopefully cheaper flights out of South Africa

Their answer tells me they didn’t understand your question, or the context. It makes no sense at all.
I suggest you wait. Your 12 months absence won’t be up until late November, and a lot could change between now and then. The SB-1 is not something you apply for in advance like a re-entry permit. It’s a one time thing – so you use it when you are already OVER the 12 months and want to make plans to return.

The 7% cutoff for a country to be given visa is out of 50,000 visas or out of all the immigrant visas given in a year.
SO if its out of 50,000 then the max visa that can be given is 3500 for a country and if it is out of all the immigrant visas given in a year then that number would decrease substantially ? SO what is it pls could u explain brit. Thanks for all ur help

You are making this hard work and I am rapidly losing interest. I’m just too busy to waste my time, and you seem to be deliberately avoiding saying something. So – last chance.
Swindlers don’t get information from thin air. So I asked who did your ENTRY (lottery entry), noty the DS260, because that is the only way that the swindlers would have known your details. In that case – if someone entered for you they could have have errors in the entry form that could lead to problems. So think about that.

@BIH Yes it seems positive after sending all they requested I got a call from one of the Lawyers asking concerning the situation. Alot of question… After the phone exchange I was in JOY. Knowing that some expert were working to help us free of charge. They will use the informations for their documents. i am a winner of DV2021. I have been living in Cambodia for 1 year. I was staying there with 1 year viza multy entry. I have been working for a german company and they sent me there for work. the salary and all the resident document I kept them in my country (eligible for DV). Shall I declare Cambodia as my previous address, but I cant have any police certificate there as I was with visa, i only had two rent contracts for 6 months each.

Yes you shoud declare that address, and you should follow the reciprocity page instructions about police certs.

I have three addresses in total. However, I did not stay there more than 6 months in a row? I have been entering and exiting the country every 3-4 months due to business traveling. Is it necessary to declare and ask for the police certs?

Thanks for all ur valuable inputs.
We won DV 2021, we filled middle name in the original form as the father’s name ONLY. First & last names were correctly entered.
All family members have the same issue including the principle applicant. We have added all middle names in DS260 as requested under “given names”
Is the missing rest of middle names in the original application will disqualify us?

The 7% cutoff for a country to be given visa is out of 50,000 visas or out of all the immigrant visas given in a year.
SO if its out of 50,000 then the max visa that can be given is 3500 for a country and if it is out of all the immigrant visas given in a year then that number would decrease substantially ? SO what is it pls could u explain brit. Thanks for all ur help

I think your blog is like an endless fountain with everlasting drink that gives us sight of so much useful and valuable information. I have read a lot of your guides but I’m still uncertain about a few aspects of my mere existence, therefore I’ve reached an impasse regarding the following issues:
1. I was wondering if the embassy is actually checking previous employment for authenticity because I used to work for like 2 and a half years during my final years in University for one of my professors and he only paid me in cash at the end of each month for the work done. I never signed an actual job contract where taxes would get deducted. Can I include the information about this job I had as a student for the Previous work/education/training info section on the ds260?
2. I worked under a J1 visa in the US three summers in a row while I was still in college. Can I include the info about these summer jobs for the Previous work history section as well? The embassy already knows the history of my J1 doings and activities so I think it’s better to add all the info about it in the ds260. Not sure what to do.
2.1. Should I include the addresses where I lived (3 months each time) while I worked under this visa during each summer in the US for the ds260 section that is requiring us to mention all the addresses we have lived at from age 16 until present day?
3. I studied for a semester (5 months) under an Erasmus scholarship and student exchange program in another country. Can I include this info for previous education history?

Hi Brit,
I am filling out DS-260 for DV2021.
During sep 2017untill dec 2018 I have been traveling very often to Vietnam (5 times in total staying one to 4 months max) with 2 different business visa respectively 3 and 12 months. I did NOT have working permit only business visa. My residency did not change, I was just traveling because of a project but was entering very often in my home country during this period.
Should I ask for police certificates? As it is impossible to get this document online and I cant travel to Vietnam for it.

Hello dear Simon. Hope all is well. I have a question regarding email addresses. So in DS 260 in personal information section in additional email area I want to add my another email. I write it with small letters its how it should be but when i review DS 260 I see it appears with big letters. It only happens with additional email section. However main email i can write with small letters ( email I also mentioned in main DV aplication) . So my question is, is this gonna be problem? What do you suggest maybe I will not mention additional email anyway, because I use it only for registration for different web sites like youtube or so on. (gmail). Your advice is highly appreciated. have you ever been refused a U.S. visa,………………..
since i had a greencard when i was a child, and my old greencard, issued in 1979, was without expiration date, a few years ago, but after a very long time that i returned in Europe, actually I returned in Europe in 1981 after only 2 years when i still was a child, i asked if it was possible for me to apply for a returning resident visa SB-1 but the consulate refused my application for SB-1 visa so actually they don’t refused me the visa but only told me that i was not elegible for the process.
So what must be my answer at the question? YES with this explenation or must be NO since they don’t refused me the Visa?

I have been trying to fill up DS260- but every time I want to save on my address and phone section goes to error or/and when I want to add 4th address where I lived after I was 16 goes error under the same section ( phone and address).

Save your DS260 often. Make sure you don’t have lots of browser windows open. Change browsers perhaps.
