Hello dear Simon,
I couldn’t figure out where to write my question and decided to reply to this. My father is a Dvlottery-2021 winner I completed and submitted his original entry as he does not understand English. The principal applicant’s (my father’s) and my mothers names are correct in the original entry but I made spelling mistakes while including my siblings first names. For example, instead of Laylokhon, I wrote Layloxon, and instead of Sukhrobjon, I included him as Suhrob.
Are these mistakes ( serious) “low risk” or “high risk”
Can they cause visa denial?
I have read your answer to spelling mistakes on FAQS section but I think they are about spelling mistakes in the names of principal applicants.

what is better for a DV lottery derivative living in the US whose principle applicant is outside the US? do follow to join and perform AOS or attend the CP outside of the US along with the principle application? which option is more succesful and the least risky?

Thanks Brit. I actually spoke with the US embassy where the principle applicant will be doing CP and they had mentioned there is a “follow to join process” (unless I am misunderstood them or your response). The derivative living in the US (on F1 foreign student currently) can do AOS within the US and does not have to travel to the US embassy where the principle applicant will be doing CP. Though the embassy mentioned the derivative can do AOS ONLY AFTER principle applicant is approved through CP. Once principle applicant’s immigrant visa is approved via CP, principle applicant needs to complete a form and send to USCIS for derivative. US Embassy mentioned only then the derivative can be called for a AOS interview.
The dilemma is if derivative goes the AOS route, will the derivative have sufficient time to be called for an AOS interview within the US at one of the field offices without forgoing the visa as it will be foregone after the fiscal year-end (e.g., September 30, 2021) given the AOS current processing timeline is at least 9 month. So principle applicant case number is EU20XXX and will likely be called for CP interview in the middle of 2021 (June or July 2021). If the principle applicant is approved then, the AOS process for derivative will start around that time and will take at least 9 month unless it gets fast-tracked by USCIS officer (which I am not sure if feasible) putting the AOS interview date at March or April 2022 which is well past the 2021 fiscal year.
Given the above understanding, would you suggest it is still the least riskiest and the smoothest route for derivative to leave the US and attend the US embassy along with the principle applicant to get the immigrant visa stamp?
I would appreciate your thoughts and if you had any experience for a situation like this or a similar situation like this.

Thanks for sharing the link. I went ahead and read the form I-824 and the instructions and would appreciate you confirming or correcting my understanding below.
So if I correctly understand the form, does it mean that FTJ works only when the principle applicant completed the AOS within the US (and not CP) and then afterwards wants the spouse and the children to follow to join him in the US by doing CP, correct?
so in my scenario the DV lottery derivative selectee is in the US under F1 student visa and the derivative has to do CP no matter what to get the immigrant visa. Derivative does not have the option of doing AOS in the US even if the person is legally residing in the US at the time of principle applicant winning the DV lottery from outside the US. Therefore, the derivative must leave the US to do CP at a US embassy if the person wants to get their greencard / immigrant visa, correct?

Anywho, what I was saying is US embassy mentioned the derivative can do AOS in the US only after the principle applicant CP immigrant visa stamp is provided. At that point, the principle applicant can then petition or complete a form to USCIS field office where the derivative applicant wants to do AOS interview to ask them to start the process. The problem with AOS for derivative is by the time the principle applicant (case number EU00020XXX) is approved, it will be middle of fiscal year (June / July 2021) at which point the DV can start the AOS process which per current AOS processing timeline is at least 9 months (unless it is fast-tracked by the USCIS interviewing officer). Therefore by the time the derivative goes for AOS interview, it will be past 2021 fiscal year (e.g., September 30, 2021) and by default the derivative will forego the DV visa.
Given the above understanding, the dilemma is should the derivative take the chances and do the AOS interview in the US hoping the interview will get fast-tracked or “NOT” take that chance and join the principle applicant at a US embassy outside of the US and both attend the CP interview at the same time?
Do you have any guidance or insight through your experience with the DV process you could suggest.

Hello, Simon, I have few questions about Public charge rule for new comers. Me and my family (wife and 5 years old son) just arrived to USA finally by DV visa on 3th of July. So far, we dont have ssn and green cards. We worry about medical insurance.
I did survey about medical insurance in New York state (Long island), where we stay for first months. Many companies suggest us to take Madicaid funded by state, due to the fact that we dont have income.
My question is – will this Medicaid usage affect to us in future as public charge rule? Or we should take VisitorsCoverage Patriot plan as you advice in FAQ?

If you expect to get a job where health insurance is included, then a bridging plan such as those offered by VisitorsCoverage may not be a bad idea. Relying on medicaid under current rules (and future direction if Trump wins the next election) would not be a great idea.

I am DV 2021 winner CN AS110XX. Currently, I am in the US on F1, my wife and two of my kids are on an F2 visa. I also have a US-born baby and we are expecting our fourth child in September 2020. My questions are:
1-Do I really need to submit a DS 260, or I will receive my 2NL without submitting DS260? IF it is highly recommended to submit when will be a good time to submit it (after our baby is born in September)? I think this way I do not have to unlock DS 260 to add our newborn baby if he must be added (Please correct me if I am wrong).
2-My son’s full name on his expired passport appears as xxxx yyyy zzzz (input in original DV entry). However, in his new passport due to printing limitations in the embassy, his name has been printed as xxxx y zzzz. Which one should I use on his DS 260, I-485, etc.? Should I use the new passport data on his files?
3-We will be a family of 6 at the time of our interview and my income is limited to the stipend I get from teacher assistantship i.e. less than $20000 in a year. I am a Ph.D. student in civil engineering and will graduate in 2021. I also have more than 6 years of work experience in my home country. Do I need to submit the form I-134?
4-My wife is also a DV winner 2021 AS27XXX and she will adjust her status as my dependent. Is there a problem ignoring her case?

I have made some mistakes in the dates of attendance of my high school in DS-260, because it was not mentioned in my high school diploma and I got it wrong. What should I do? Is the dates really matter? And there was a question that asked “have you used other emails other than the email that you have provided?” I said no but our university have provided us an email address that I did not mentioned. It is not really ours and it will expire when I graduate which it will be 2022. I would be grateful to help me out.

I have some thoughts about this…
1) I believe that AILA will probably break the ban and that Trump is aware of that, so now he wants to immediately prepare some new bans.
2) Is it possible that if AILA breaks the ban, Tramp will bring a new one that will block the DV program again.

Hi Brit,
I’m a PhD student on an F1 visa who won at the Green Card lottery ticket. I have a dual citizenship (Asian and European). My country of birth is in Asia so my country of eligibility is Asia. I’m currently living in the USA. I have a couple of questions:
– What do I risk if my green card application doesn’t go through ? Will I still be able to finish my PhD (and possibly do an OPT in the USA) ? Will I be deported ? (since F1 visas are not compatible with dual intent)
– For official documents (birth certificate, passport etc…), is it ok to use my European ones ? I have a European passport, on which I have my F1 visa but my Asian passport expired years ago and I’m not even sure I still have it. What about the birth certificate ?
More generally are there specific documents that have to come from my country of birth (Asia) but not from my country of citizenship (Europe) ?
– Do you recommend submitting a DS260 ? or is an Adjustment of Status enough ?

Question 1. I am Australian citizen but born in Hong Kong and currently only have certified copy of my birth certificate. Is it compulsory I have original birth certificate from place of birth as I’m not sure I can access this because I do not love in Hong Kong?

1. An replacement extract (longform showing both parents names) is OK.
2. Yes you will need police certs – you should read the instructions so you know what will be required.
3. That won’t be a problem, but you shuld expect to provide proof of substantial savings or get an I-134 from a sponsor.
4. You have to account for all the periods of time – so use your best recollection.

Good evening sir. I’ve come knocking on your door once again. By your experience I would appreciate if you could evaluate how likely or unlikely I could fall into the public charge net during interview.
I’m in my early 30s while my wife is in her late 20s. We’re both nurses with some years of experience in our home country. We do not however have any valuable assets and or have account balance up to $10,000 but we have a family friend who’s ready to fill the affidavit of support for us(a US registered nurse).

Hi Brit, my wife won the dv2021 AF56XXX and i am her derivative, we need some clarification please:
1- We are both from Togo but did our Bsc in Ghana, we only travel there on weekends to attend classes and return to Togo because it is just 2h30min drive, will KCC ask us to provide police certificate from Ghana? it will be difficult because we were not resident there and we need resident permit to apply for the police certificate which we never had. What do you advice in that case
2- Address system in very bad in togo so we do not have a house number nor a street name, just the name of the town and the Area will that be a problem for kcc to process our ds260?

Yes the ceremony and signing of marriage certificate took place in the morning around 11AM, then we had a brief refreshment with family and friends for about two hours ( we have pictures to prove) then we entered the dv lottery in the evening around 5PM. It that not allowed please?

Good evening how are you. I was born in Senegal after my birth my parents returned to Guinea without looking for a birth certificate. When I was 19 I returned to have a birth certificate but they refused to issue me a birth certificate for them I am not Senegalese and I cannot have Senegalese nationality. I played Dv 2021 stateless and am selected. And currently am in the process to obtain a birth certificate and Guinea nationality in addition to make me a passport because my parents are Guineans. if i present this passport i will be disqualified

People holding valid visas are exempt from the immigrant ban (although may not be able to travel because of other reasons). However, as I have explained before, if you are able to travel prior to your visa expiring you should do so, because there is a risk that what the embassy told you they would do is not possible at that time.

1. A TRO has immediate effect.
2. The supreme court only get involved after cases have gone through lower courts. Cases are argued, sometimes appealed, and appeals can then be raised to the supreme court if needed. That all takes time.

1. I am a DV winner from Nepal for 2021 and my case number is AS80##. Still i have not submitted DS 260 as my documents are not yet ready. Will it be very late if i plan to submit DS 260 by the end of September?? will this late submission impact my chances of getting interview??
2. Is my case number high for Asia Region especially for Nepal??

Good afternoon Brit, up till take my Dv visas is still valid and will expire next month, i have gone to two airlines to book my kids and I tickets here in Sierra Leone but the airline refusing to sell tickets to us.saying its because of the US government restrictions and their airline told them not to sell tickets to us. I explained to them that the Ban is not for us with valid visas they still insisting no.
I’m really confused i don’t know what else to do.Any Advise you can give me please ?

Ellen, I’m thinking cos the US is not accepting immigrants at the moment cos of Covid 19. The US is really not the place anyone should travel to at the moment if you value your life and livelihood. It’s a hot spot for the virus.

They might be saying that because of a transit stop for a non direct flight. You cannot travel through the countries that are banned such as the Schengen area in EU. So – you might have to find a flight in Africa that goes direct to the USA.

Hi Simon – I am a DV2020 winner from Cape Town, progressed up to final interview date in April, only to be disrupted by lockdown one week before. I had abandoned hope after an unequivocal response from the US Consulate. I have just read about the legal case here, and it’s ignited a glimmer of hope. Do you need any further plaintiffs, or has this call ended? I will monitor progress with cautious excitement – thanks!

Hello Simon,
I have an important question to ask. So I have a DV3 visa DV1 being my mom. I want to move to the US very soon but my mom doesn’t for another year or two. Me being a DV3 can I enter and live in the United States on my own without my mother. Does that danger our Green cards and if it does is there anyway I can turn my DV3 visa to a DV1 since I am about to be 21 very soon. Thank you for your help.
P.S.You helped me a lot to win the DV lottery a year ago so thank you very much.

The principal applicant (DV1) must enter before or with the derivatives. Once you have activated your status by entering the USA with your Mom – your own Greencard no longer depends on her – she can leave while you stay for instance.

Good day., Bithsimon. Your responses to most of the concerns raised relative to the DV lottery has been very helpful and encouraging. I have been trying to access the DS260 to fill in the form but received a feedback or error message that my case number does not match with KCC record. HI Birt I am a DV 2021 winner. My question is regarding DS 5440 they ask for the last 3 tax returns. If a send DS.260 now I will called for an interview probably before the end of this year. I will show 2017=zero, 2018=zero 2019=17k while if I wait the end of 2020 fiscal year I calculate a tax return over 30k so in that case I will show on the form 2018=zero , 2019=17k , 2020=30k….which it looks better. Should I wait to send DS 260 so that I delay the process in order to show a better standing?

No – just explain the trajectory. But honestly you should get an I-134 anyway.

Do you mean explaining at the interviewer the trajectory? I could get an I-134 but I honestly would like to avoid it. Also…it’s 20 years I am living in US, I forgot to mention it. Wouldn’t feel weird to get a I-134 in my case?

I’m filling out my ds260 form… In education section, I attended 6 Educational Institutions (secondary level or above). But I only have a degree/certification from 3 of them.
1- Do I have to list all of them or only the ones I have a degree from?
2- If yes, I attended one of them for only 3 months. Do I list it?
3- For the educational institutions that I attended without getting any degree or diploma. What do I put in “Degree, Diploma or Certificate Received”? > No degree?

Thank you always for your response and in advance for your advice on this question concerning public charge.
I know you feel strongly about the I134, but if a candidate do not have a strong sponsor what do you suggest?
The other factors relating to the candidate in terms of the evaluating criteria are as follows:-
– Family of 4
– Both primary and spouse are MBA qualified
– Both are 45 and under
– Spouse is currently permanently employed for a multinational company as a Lead Engineer in host country. Salary range between ($125K – 150K USD/year). Potential for transfer if a green card is issued. No job offer before.
– Primary applicant works as a consultant with earnings of approx. ($40K USD/year).
– Current cash savings of $100K USD and other short term investments of another $100K USD.
– Assets of approx. $400K USD.
– Zero loans or mortgages, only credit cards that are paid off monthly.
– Will obtain insurance quotes as per video
(1) Without a I134 can this candidate pass the public charge? I would certainly appreciate your professional opinion.
(2) Is the DS 4450 completed for the entire family, or per adult?
Food for thought, if someone is in the top 1-2% (earnings) of their country with limited opportunities why would they not survive in the land of opportunities?
