I submitted my DS-260 a month ago stating my (eligible) country of birth, plus my other citizenship that I acquired last year by naturalisation (UK), however, only about a week ago I got my (first) British passport, which I didn’t have at the time I was submitting my DS-260. High school, no degree 2. High school diploma 3. Vocational school 4. University, no degree 5. University degree 6. Advanced degree 7. Other
Meanwhile, my highest education is a 3 year Diploma obtained from a Nurses’ Training College.
1. Is it ok to select “other” and specify?
2. This is my education history; i.Nurses’ Training college ii. Senior High School. iii. Junior High School.
“Number of educational institutions attended” in my case could the answer be 3 or the junior high school is not considered here.

I happen to be one of those people holding a valid visa but could not travel due to travel restrictions. In my case, we are a family of five, and we couldn’t travel because borders are closed. Thanks to your email of 4th July, 2020, where you stated that “based on where you live, if your visa is still unexpired, the best thing to do is find a way to travel to the USA,” I managed to get out of my home country to a neighboring country where there were flights solely flying to the USA and caught a flight and now I’m in the US. Unfortunately, because I had to find alternate means of crossing the border to the neighboring country, I thought it was too dangerous to have exposed my wife and three kids in that expedition considering the security breaches etc. I am the Principal applicant in our case. Our visas were due to expire on the 8th of July but I arrived in the US on the 7th of July and was admitted. So as I write, the visas of my spouse and kids have expired. I am aware of DHS directives to open Embassies and the fact that embassies are still not open. I sent an email to the US embassy in my country inquiring on the possibility of a reissue of the expired visas. but received a response which looks automated but says we may have to go through the application process again as you’ve indicated earlier but that is subject to the opening of the embassy.
What i want to know is whether my being in the United States currently as Principal applicant makes any difference by way of assurance of a reissue of the visas of my spouse and kids? Do I have a special case since my LPR status and perhaps my case is activated?
Would there be any consideration whatsoever just in case embassies do not open before 30th September. I’m quite skeptical and somewhat confused about an outcome should there be a delay in the reopening of the embassy.

Your presence in the USA doesn’t help their reissuance on the DV visas, in fact it might make it harder. However, watch the lawsuits and be prepared to push for them.
Having said that, since you are now an LPR, you have secured the family’s future, since if the DV process fails, you can bring them all through a family based case. That will take much longer, but it could be done.

Per the reciprocity direction from the US Embassy in Accra, you need to take it from the CID Headquarters in Accra. I will advice you check from the regional headquarters in Kumasi first then you can come to Accra.

If you have had a child in your previous marriage and you are divorced almost 10 years, you have not seen this child for more than 12 years because the mother has moved country with another man to a destination you don’t know (and you do not have a current picture and information about your ex-wife and the child you had together), Is there a chance that you will be excused for not including this child as your child in your initial application but still mention this child when you fill the DS-260 form, or is it safe not to mention this child at all in the form
How are you supposed to include a photo of this child in the original application when you do not have it or do not even know what the child looks like?, Any solution to this problem?

Hello. Such situation. In the application checked as married, but at the time of filing were in a divorce by documents. But In real life, as we lived together before divorce and live together after, the divorce was rashly, all the time we live together as normal family with our child. We are simply did not sign marriage again, not attach importance to it. Our child is 12 years old. After winning we signed marriage and take new marriage certificate.
Now I don’t know what to do with filling ds-260. To write everything as it is, indicating the current spouse and previous spouse, two marriages, then attach a cover letter with an explanation and photos together, visas of joint travel with photos, and hoped for the mercy of the consul for an interview, or did a little trick and indicate only the first marriage and current spouse, without divorce. The fact is that the original of the first marriage certificate was not taken away from us and any natarius assures them with translation, what is required for an interview, an apostille is not needed.
On the one hand, there are cases in this thread when people got visas with similar cases without problems, on the other, people write in different forums that this was a long time ago and the rules were tightened, especially with dv2020.
Beginning with the DV2020 applications and thereafter, any applicant who included an individual on his or her DV entry who was not a spouse or child at the time of DV lottery entry is ineligible for a DV for failure to comply with regulations prescribed pursuant to INA 204 (a) (1) (I) (iii).

If you get your Greencard based on a deliberate misrepresentation, your residency could be taken away from you at any time in the future, INCLUDING after you obtain citizenship.
You are correct that the rules were tightened this year, but disqualification for including a derivative is not as 100% certain as the other way (NOT including an eligible derivative). In your case you had reason to do so – and you have since “corrected” the situation through re-marriage. Personally – I would answer truthfully and hope that the CO uses discretion based on the honesty and correction.

I played with a child that I had adopted before the entry. Immediately after our entry, the child left my home and nowhere to be seen and we are a proud winner of the DV2021. I also work at the US Embassy in my country and got employed in January of 2020. Since this run away child left my home, i didn’t hesitate to include that child on my beneficiary listing at my job and I am not able to locate the child at the moment. I also completed the DS260 for the child and indicated that the child will join us in the US at a later date. I am thinking the Counsellor may have some problems since the child may not be available when we are being interviewed and this could cause problems for me, what do I do or what could be your recommendation?

I suppose this is kind of a silly question, but I have gone through the FAQ and I can’t find it answered there…
If one year I made an entry and all info was strictly correct yet the pic was not according to standards I would naturally be disqualified, I know that.
My question is: as long as I never cheated on my applications, which I never did, if the pic wasn’t good (measurements and using the same pic), does that affect future applications? I don’t think it does but just to be sure.

1. Part 4.6, does gross income include those earned outside of the USA? I have never worked in the USA, never filed a federal tax return.
2. Part 4.8A, does compensation means salaries and wages earned from employment? I am a housewife and I do not have a job.
3. Part 4.8C, I have some passive income in the form of stock dividends. Should these be listed here instead of Part 4.8A above?

Theoretically, no. But the term “enough” is up to the CO and it is subjective. That is why an I-134 is safer/smarter.

1) How far out is it safe for someone with my case number to postpone the starting of the process?
2) Do you think it’s reasonable to expect some sort of bottleneck in the process around Jan-21 (people applying once the ban – hopefully – expires), so better getting the paperwork with KCC done before that?
3) Vaccinations. I’ve been told that any missing vaccine would be administered during the medical exam. Could you confirm that? Or should we plan on getting all the vaccinations done prior to the medical examination?

I am a DV 2021 selectee and F-1 student but I was outside the US temporarily(for the summer) when the results were announced. I learnt that there is a risk of denial of AOS due to “physical presence” requirement.
So, I want to play it safe and apply for CP. If the proclamation is extended further, what would be the “deadline” for changing to AOS? I mean the time when I can safely expect to finish the process before FY22. If I apply for CP now and try to switch to AOS in November, would I be hurting my chances of getting the process done in time too much? My case number is EU8###.
I know that COVID makes everything unpredictable, you can just tell what would be the case in a normal time.

There isn’t a deadline as such. You might be safer on AOS – but really it is too early to be sure.

Thanks for your answer. Two follow-ups on that:
1. Did you say that I might be safer on AOS because you don’t think my temporary absence would cause to much problem or was it something else?
2. I am still confused about switching. My case number is got current in December/January in recent years. If that is the case this year too, I won’t be filing for AOS before November anyway, right? So, does that mean between just filing for AOS and switching to AOS after the election, there won’t be much difference timeline-wise? Or does switching cause some additional delays?
Thanks again for your help. I wouldn’t be able to figure this out without someone to ask as I couldn’t find much recent information on switching.

1. Because AOS has more rights – and isn’t currently banned.
2. You need to make a plan. If you switch, you will want to make sure KCC knows that well before it happens – because if not you could introduce confusion/delays.

Under the Education section, I have completed the details of my university degree. However for the high school and below (until I reach the age 12+ mark), I’ve to fill two boxes which are “course of study” and “degree, diploma, or certificate received”.
I just need clarification on this. Suppose for my grade 10 education, what should be filled in the 2 boxes?

Hi Simon! Quick and weird question: I am a “member” of Venezuela’s ruling party which is socialist and dictatorial to the eyes of the US. I signed up years ago when I was a kid but I haven’t been involved in any political or government activity for the past 5 years. The reason I haven’t left the party is that you can’t really do IT, otherwise you don’t have access to food programs etc. I do oppose the regime now but I was wondering if this could bring me some problems and if I would need a waiver or something.
Anyway that’s why I was requesting your email but it’s okay, thanks for all your help. Hope your doggo is doing fine 🙂

Hi Simon. my case number is under 1000 for DV.2021 in Europe. One of the luckiest in term of timing. Having my case so low mean I can safely send the DS.260 in the year 2021 and still be process in time right? What do you think is my dateline in order to avoid being too late? I am asking you because , due to the T administration I want to be sure I will start a process that can be finished.

I CALLED KKC TO CHECK IF REQUIRED DOCUMENT (EXPLANATION LETTER) HAS BEEN RECEIVED SO MAN WHO PICKED PHONE SAID THAT HE CAN NOT FIND IT AND TOLD ME TO RESEND BUT I AM SURE I HAVE SENT IT LAST WEEK SO AFTER A FEW HOURS I CALLED BACK AGAIN AND THIS TIME LADY PICKED PHONE AND AFTER 10 MINUTES CHECK SHE SAID THAT ITS OK DOCUMENT HAS BEEN RECEIVED SO I AM JUST PUZZLED WHOM TO BELIEVE. WHAT DO YOU THINK SHOULD I CALL THEM AGAIN AFTER A FEW DAYS? OR JUST BELIEVE THAT LADY AND GO AHEAD? THANKS FOR YOUR ADVICE IN ADVANCE.

1. First this question is not addressed to you only Simon can write reply to all question in here.
2. As I understand you dont have anything to do so just following people comments you have some psychological problems go and check with your doctor.
3. Don’t put your long nose into somebodies business
4. How can you measure rudeness with capital letters? Do you have a brain to think?
So see this post with small letters and it looks very rude as you see.

I dont want to argue with you but its true that only Simón can answer questions here and everyone has a right to choose in which letters they want to write and this is nothing to do with rudness. So please if you want to get an information this is a great place but its not a place for teaching people how to write. I am sorry but first time i see the person that judges people charachter with capital letters. Good luck.

I suggest you wait some time. There is no need to rush, and it is better to let KCC focus on their work at the moment.
