hello everyone, it’s been 10 mounths that my embassy contact’s me to pay my affidavit of support, but as everyone sees that the payment bottom its not available. i called NVC so much times and they told me that there’s nothing to do in my case because my documents is in embassy Casablanca and it’s under their control. and also my embassy tell me that i have to fill the fees for the interview. i searched in the internet about this and i discovered that it’s an technical issue in NVC . but i didn’t know how to solve the problem .

Dear Mr.Brit Simon,
I’m a bit confused about the residency requirements and i’m looking to have your advice to clear it;
my family and I have activated our LPR status on the end of January 2020, we spent almost
2 weeks in the U.S and have returned back to where we came from,unfortunately the current pandemic is
preventing us from tying up loose ends,noting that the plastic green cards are in our possession,
but no information about the SSN cards, for now i have two scenarios.
1. I will continue to stay outside and visit the U.S before completing 360 days from the date of leaving
the U.S, noting that we are expecting clearing some of the old ties would be time consuming .This
would require us to apply for the re-entry permits for my family and I, is this scenario acceptable and will it not create any issues at the POE when we enter the U.S?
2. alternatively i’m thinking to visit the U.S for 3 days prior completing 180 days and leave again to complete
the clearances of the remaining ties and enter again within 6 months and apply for the re-entry
permits for my family and I. is this scenario acceptable and will it not create any issues at the POE
when we enter the U.S?

Hi, did you receive any information about extending visa for one month? Did anyone contact you and confirm that their embassy approved this? or extended them visas? My embassy didn’t give me any response, my visa expired 26 of July so if they gonna decide to extend it i will have only one month more so 26 of August and I need time to spend 14 days outside of schengen so do you know if they have already extended this medical period to anyone?

unfortunately my embassy refused to extend my visa for one month or issue a new one because of the proclamation from 22 June. How is it unfair, paid all the fees, got the visa and lost it because I wasnt able to activate my green card. I did it even had a chance.

accutaly I am, I gave them all the links and information that you provided with the exceptions that proofs that visa can be reissued for people that had a visa before 23 of April but it seems they each embassy has own informations and restrictions. Unfortunately mine is not the one that wants to extend the visas.

Well I suggest you go back to them (probably with a lawyer) and ask them to confirm that they think they have their own discretion over whether to follow the rules laid down by Department of State. Really – you have to fight this. If not your only remaining option would be if the lawsuit is won.

The number itself is meaningless. Neither you nor I know how many selectees there are before your 27XX number. So – you need to wait until we know the selectee numbers which will probably be released in the next Visa Bulletin. When we have more info – I will write about it.

Only certain specified occupations qualify for the diversity visa Program. 1) I am 2021AS with a low enough number to have had my interview in the first month (Oct) had the ban not been extended. My question is, if I submit the DS260 now (which is completely filled with no more to add) and all processes go as normal, can I postpone my interview once I’ve been assigned a date? This is considering the fact that I’ll have the interview on January if I submit DS260 now and wanting it on say February/March.

Well, that is what we would expect if the ban is blocked. But we have not heard about the ban being blocked yet – so I think it was speculation on the part of the embassy, or your colleague.

Hi Simon, there is a case of a couple that the boyfriend was the winner of the DV2021 and they are not married, he already sent his DS as a single, they have a relationship since 2015 and she is pregnant.
Should they get married and ask KCC to unlock the DS to include her?

Just so I saw Brit some time, I will answer.
-If they are not married, he should not mention her on the DS.
Since you say she is pregnant, I assume the relationship is genuine and real. What he should do is, get married ASAP with the girl (legally) have a marriage certificate, unlock and include her on the DS.
In the perfect world, if she is due soon, wait for the baby to be born, get a passport for the baby and include everyone in the DS.
Also, if he doesn’t want to get married now, he can leave the DS as single, and can sponsor her later, but the process is longer and it costs more money. (around 2 years),.
So, as a result, to be on the safe side, get legally married, prepare all the required documentation, unlock DS, include your family, and that’s it.

Mr. Simon, I’m from Sri Lanka and my case number is AS24*** and I have submitted the DS260. I got 2 questions for your kind attention.
1) Around 2 months have passed and I haven’t receive any email from a relevant party to upload my documents.
2) In DS 260, there was a field for vaccination documents of the applicant. As we currently haven’t got any documents to prove it, we put “NO”. We couldn’t find any records or documents to prove it because those are too old. Is this the reason for not getting any response from the relevant party?

You and each family member immigrating with you to the United States should collect the civil documents that are required to support your visa application.
Passport Biographic Page: You and each family member immigrating with you must submit a photocopy of the biographic data page of a currently valid passport. The biographic data page is the page with your photograph, name, date, and place of birth.
If the passport used by the principal applicant to enter the DV program differs from the one currently being submitted, you should also include a photocopy of the principal applicant’s passport listed on the DV entry with a written explanation for the change to KCC. The Department of State’s regulations provide for three limited exemptions from the passport requirement. These three exemptions include: individuals who are stateless; nationals of a Communist-controlled country who are unable to obtain a passport from the government of the Communist-controlled country; and beneficiaries of an individual waiver approved by the Secretary of Homeland Security and the Secretary of State, pursuant to 22 CFR 42.2(g)(2). If you selected one of these exemptions on your DV entry, you should provide an explanation of your qualifications for the exemption you requested.
Birth Certificate: You and each family member immigrating with you must submit a scan of an original birth certificate or certified copy.
Marriage Certificate: If you are married, you should submit a scan of your original marriage certificate or a certified copy. Submitting this document now, if applicable, could help to expedite visa processing; if you do not provide this document now, you may be asked to provide this at your visa interview.
Marriage Termination Documentation: If you were previously married, you should submit scanned evidence of the termination of EVERY prior marriage you have had. Your scanned evidence must be of an original or certified copy of one of the following documents: FINAL legal divorce decree, death certificate, or annulment papers. Submitting this document now, if applicable, could help to expedite visa processing; if you do not provide this document now, you may be asked to provide this at your visa interview.
Military Records: If you served in the military of any country, you must submit a scanned copy of your military record.
Police Certificates: If you are 16 years of age or older, you must submit a scanned copy of a police certificate from all countries you have lived. Please refer to travel.state.gov for more information.
Court Record: If you have been convicted of a crime, provide a certified copy of each court record and any prison record.
In order to continue processing your case, all documents should be submitted as attachments to your email to ensure they are properly received. We ask that you use the following method to name and attach your files:
• Your DV case number;
• The full name of the applicant whose document you scanned; and
• The document name or form number.

Please remember that the Kentucky Consular Center does not have the authority to tell you whether or not your specific case will be disqualified. Hi Simon, I’m a DV lottery winner (2021EU00021xxx). I’m currently residing in the US, but submitted the form for consular processing. I didn’t receive a request for supporting documents yet. Is it still too early to tell whether Adjustment of Status or Consular Processing will be the better path forward? I am not sure how official my documentation is, though – a lot of it is handwritten from when I was baby. Do I need to unlock my DS260 to correct this to No?

There are a number of reasons why that would be a bad idea. Among them
Entering the USA with preconceived intent to adjust status is considered fraud.
There is a ban on people entering the USA from the Schengen area.
There is too little time to adjust status.

I’m writing you because my brother got selected for dv 2021. his case number is 2021SA0000XXXX. I helped him to fill the dv.
He is married and has a child with his currently wife. They three are included in the original dv. However, My brother has other child in a previus marriage that He couldn’t include in the original dv because the child lives in other city and his mother didn´t want to give my brother a photo. They had a lot of problem in their separation and my brother has a lot of time without see this other boy.
So, We decided to submit the dv without the child because we didn’t have the photo and it is no fair if his ex-wife didn’t give him a photo… they didn’t have the opportunity to participate in the dv.
Now, when we reading all the information, we realize that include the other child is important even if he will not migrate with them.
My questions is: He must do the whole process to see what happen or we assume that he will be disqualified? that would be very unfair…

So, we (me and my friend I came with) were surprised when ICE decided t released us., then I got my worked permit ,ID card, SSN …etc. I start working for less than a sex months before my consulate issue my travel documents in Marsh 2010 and get Deported .my friend still live in Houston. I get back to Morocco and start a new life , and get married in 2015 .in this year I win a visa Lottery 2021 .now I remained the entire period ban which is 10 years outside USA is enough to file my DS260 or I should file any other waiver? As far as the ban goes it will have become a non issue after 10 years. However, you may want to discuss your case with a lawyer to make sure you did not create any other problems by your actions in 2009/2010.

I’m filling ds-260 form for winners in dv lottery (2021). I’m confused with question: “have you ever been issued a u.s. visa? Provide information about your last U.S Visa”. I have two citizenship (Russia and Lithuania) and I recevied my first U.S. visa in 2014 using my russian pasport (I had a trip to US with Russian pasport). In 2019, I visited U.S. with ESTA Visa Waiver Program (I had second visit to U.S. with Lithuania passport). What shoud I answer on the question in DS-260 about my last U.S. visa?

1.What can a Dv lottery 2020 winner do if their Dv visa has expired on June 2020, the 24th? They have no information from their embassy, since there’s no staff.
2. Is there a way to proceed, if their embassy won’t reopen and can’t re-issue the visa?
3. What can they do, if this situation will endure more than september, is there a way to make it possible to enter into the USA even after the fiscal year 2020 for DV Lottery?

1. The embassy is probably staffed, just not seeing the public. So – you need to continue to contact them.
2. You have to reach the embassy.
3. The embassy can re-issue DV2020 visas up to September 30th, and those visas will allow travel which can includes dates AFTER September 30th.

My issues on the DS260 form. Currently I am a student:
1. The question is ‘ Provide – Present/work/Education/Training(current). accompanied with (Primary
Occupation. Is the answer (student) right ?( because I don’t work)
2. ‘In which occupation do you intend to work in the US ?.
I intend to work as a cook beacuse I used to do this as a J1’s student for 4 seasons (Work and Travel), and I kept in touch with the manager, and all stuff.
Could be this a problem?
PS: if I bring a job offer to the interview, will it be a positive thing?

Hello Simons,
Please i need help, Please what does this message below mean when filling the DS-260 form for the DV lottery.
“The Case Number entered is currently unavailable. Please try again later or contact the Kentucky Consular Center (KCC) by email ([email protected]) or by phone (Public Inquiry Phone Number 606-526-7500 7:30 a.m. to 4:00 p.m. EDT Monday – Friday) for further assistance”
We contacted the KCC and because they ask for the applicant’s information first and he does not know what he has entered during the DV registration, KCC says that the birthday he is providing does not match the records and hence, they can not help or tell him what is correct birthday. We are kind of stuck in dead end here….
I am wondering if there is any possible workaround for this situation that experienced members of the forum are aware of.

As God could have it he perform a miracle and we enter the USA two days prior to the expiration date, August 4.Our visas got stamped and now we are permanent resident in Newyork.Thanks be to God ?

I’ve submitted my docs but forgot to submit a photo of my passport that I entered the lottery with (it’s now expired).
When I resend my documents to KCC should I have it read as:
2021AF00938653_John_Doe_Expired_Passport.pdf
And with my written explanation for the change, should I keep that in the email body or make it an attachment as well?

You should send it as an attachment i got the same issue. And it should be like case number _name _passport_ change_ explanation.pdf. actually you don’t need to send whole package so when I got the same issue i called them they told me that no need to send whole package just passport change explanation enough. Hello Mr. Simon. We got selected for DV2021 in the SA region. The country is Venezuela. The thing is that from 2019 the US embassy in Caracas has been closed, so all cases are being transferred to Bogota, Colombia. Our case was by default sent to the Bogota Embassy. Now, with the pandemic we are stuck in Madrid, Spain ( we came as tourists for the month of March) as Venezuela is closed for all national and international flights. Is there a possibility we could change the interview location to Madrid? The possibilities of Venezuela reopening are odd as well as travel to Colombia.

Yes you can ask to transfer to Spain as you are currently living there, BUT you need to figure out your case number and the likely timing of an interview because maybe you will be back home by then.

Thank you for your response. The reason that I lost my passport is that I was robbed. Which one should I consider on explanation, robbed or lost? In addition, since I have no access to my old passport, does presenting a simple copy of my old passport okay on the day of the interview or should I certify it somewhere? Thanks again for your help.
