If someone studies in a university since october 2019 but it’s not in the DS-260, do we have to bring any evidence of studying to the interview? Because there’s sometimes a question like “what do you do for living” like studying or working etc.

What do you mean by over preapering? The evidence of studying, student ID and I guess there are no more documents about it. It was a plan B if something goes wrong with the lottery but when I submitted my DS-260 in june I didn’t even know that I’ll be studying. I think that in march 2020 I even asked you if it’s necessary to add that.

Over preparing means if you think you MIGHT need a document – take it. Think about every aspect of what might be asked for – and make sure you have everything you need. Make sure you have FULLY read the instructions. There is no time for mistakes.

Of course we’re not going to ruin that if we ever get a chance. I have already all necessary documents except for the studying evidence and medical examination (we can’t arrange that if we don’t have the 2nd NL). I called KCC but the lady said they didn’t finish with the named plaintiffs and she doesn’t know when they will.

Here are some updates…..
Just hung up with KCC, they have no intention to schedule any DV2020 interviews, except for the plaintiffs.
Told them, they are only few cases and should always be done by now, they said that’s what we have to do, no time to schedule anything else!!!
I haven’t received my 2NL, although my documents were complete (confirmed by KCC) in February, and my number got current in April.
I’m an AF case, but my interview was set to Riyadh, as I live in KSA.
I got one friend who got his interview canceled on April, and the embassy of Riyadh has replied his inquiry email yesterday, and rescheduled his interview to “tomorrow”.
I’ve signed up on DV 3.0 Lawsuit, and that’s my only hope now.

My brother is a 2020 dv holder with a case number of 2020AS2664. He have filled up DS260 form and submitted on June 14,2020 but today when he called for asking the updates to KKC they are making an excuse saying we did not receive your DS260 form or did not review it. Why they are saying that?

The main mistake my brother made is he already receive 2nd letter on oct 2019 but he forget his email id password which he used to filled out lottery. He just saw 2nd letter last week and forwarded the additional document on last week. I dont know why KKC is saying they dont receive additional document.

i am sorry for confusing. I mean to say that my brother he got email asking to submit Ds 260 along with the the additional document on October 2019 but he checked his email on 2020 June only so as soon as he receive the email he forwarded DS 260 and additional document on June 2020 but when i called KKC today they are making excuse saying they did not receive any document and could not find my DS260 form. They told me i might be under group 5.
I did not get their point.

Hey Brit, I am scheduled for my interview at the Sydney consulate this Friday and have my medical for the following Monday. My question is, will this be an issue to not have the documents on the day?
Secondly, my Federal police clearance expired on 26th of August this year, i have applied for a new one but they are unsure where this can be done by sept 30th As they usually take 15 business days, they said they can email me a copy once it is processed, do you think it’s worth the gamble? If they only accept hard copies, I’m unsure whether I can get it to the consulate on time as I live in another state.

Don’t worry. The staff at the Sydney consulate is super nice and they are actually doing their best to help us.
The medicals can be done after the interview and won’t take more than a few business days to arrive.
The AFP police certificate must be sent to the consulate – there’s no way around that. They usually issue the certificate a couple of days after you apply, and then it may take a while for Australia post to deliver it to you – it depends on where you are. But once you have it at hand, you can either send it to the consulate with express mail or come in in person to hand it to them. I’m still waiting for mine too.

It’s not documented online because that is not correct. Various countries have their own idea of police cert validity, but the US government takes it as 1 year, and the visa validity does not get shortened by the police cert period.
So – who is telling you that, or where have you seen it documented?

In Sydney, that is what the consulate communicates to applicants via email:
“Please note the DV-2020 Program expires on September 30, 2020. This means the entire process must be completed, application approved, and visa issued on or before September 30, 2020. Also note that your visa validity is tied to the Australian Federal police certificate (valid for 12 months) and the medical exam expiration date; typically six months from the date the exam was conducted. As part of the in-person interview, the consular officer will ensure you have submitted all required forms, documents, application fees and determine your eligibility for the visa.”
And also in the very fine print on their website:

It caught many of us by surprise.

THe first date does not say the police cert would shorten the validity of the visa. The second statement does, but is written in such a grammatically bad way that it doesn’t make sense, and is not supported by any law that I know of that drives IV visa validity. It’s not the first time I’ve seen made up crap.

By the way – if they are TRYING to enforce that – please let the lawyers know. It’s exactly the type of random hurdle the government should not be making up on a whim.
The DoS instructions (such as pasted below) are clear that validity is at the time of interview, and that is the ONLY way I have ever seen it implemented.
“Important: Police certificates expire after one year, unless the certificate was issued from your country of previous residence and you have not returned there since the police certificate was issued. If at the time of your interview the following three items are all true, you must bring a new police certificate to your visa interview:
You are more than 16 years old;
The police certificate submitted to NVC was obtained more than one year ago; and
You still live in the country that issued the certificate.”

After few tries of contacting the KCC to get my case scheduled as a mission-critical, they’ve finally replied with the following:
“Thank you for your email regarding the scheduling of a Diversity Immigrant Visa interview appointment.
Consistent with the court order in Gomez v. Trump, the Department of State is making a good-faith effort to adjudicate as many Diversity Visa applications as possible notwithstanding Presidential Proclamation 10014. Please note, however, the DV-2020 Program expires on September 30, 2020 and, in accordance with law, diversity visas may no longer be issued after that date. The Department expects that, due to resource constraints, limitations due to the COVID-19 pandemic, and country conditions, we will not be able to adjudicate applications for all Diversity Visa selectees by that expiration date.
As ordered by the court, we are prioritizing individual named plaintiffs in the court case Gomez v. Trump and its companion cases who are applying for Diversity Visas. Beyond that, we have established priorities based on statutory standards and categories of cases most likely to result in timely issuances for eligible applicants. Accordingly, we are prioritizing applicants who have already been interviewed and who either have been determined eligible for a visa or may be determined eligible for a visa with additional information. So, it’s basically a soft no, which was expected at this point, to be fair. Dear Visa Applicant:
On September 4, 2020, the U.S. District Court in the District of Columbia ruled in Gomez v. Trump that the Department must make good-faith efforts to process expeditiously and adjudicate Diversity Visa 2020 (DV-2020) applications by September 30, 2020 notwithstanding Presidential Proclamation 10014. Therefore, embassies and consulates will prioritize the processing of DV-2020 applicants, where local health conditions and post resources allow.
Although DV-2020 applicants may be issued an immigrant visa under this court order, Presidential Proclamation 10014, which suspends entry into the United States of certain immigrants (including Diversity Visa applicants), remains in effect until December 31, 2020, and can be extended by the President. Therefore, unless a DV visa recipient also meets an exception to the Proclamation, that DV visa holder will be unable to travel to the United States on the issued visa while the Proclamation is in effect. In addition, the five Regional COVID Proclamations that suspend entry of immigrants who were physically present in China, Iran, the Schengen Area, the UK, Ireland, or Brazil within 14 days of entry into the United States are still in effect and not the subject of the Court’s order. Thus, while DV applicants subject to a regional COVID Proclamation (China, Iran, the Schengen Area, the UK, Ireland, or Brazil) may be interviewed and processed, applicants who have been physically present in the affected region during the preceding 14-day period will not be issued an immigrant visa, unless excepted under the relevant proclamation or until they have been outside the affected region for 14 days.
The Department expects that, due to resource constraints, limitations due to the COVID-19 pandemic, and country conditions, it will be unable to accommodate all DV applicants before September 30, 2020. U.S. Embassy Monrovia does not anticipate being able to accommodate DV applicants who have not already interviewed or DV applicants who were refused 221g for additional evidence. An applicant may request a transfer to another post. Applicants can request a transfer by contacting the desired post directly; however, we will not be able to accommodate all transfer requests.

They denied my case saying i was out of status in spring 2011. Which i wasn’t. Am currently on Engineering stem program with a 3 years work permit that was issued in 2018 and still varied. My current visa is still varied and the school has also provided information that i have kept my status all this time. I have traveled back home several times and has always renewed my visa without any problems.

I had my interview today. unfortunately the CO was not pleasant for me. My brother was currently live in US and he asks questions lot about him and noted down his name. He was with a pending asylum status and maintaining good lawful presence.
I did the medical interview but get the results on hand will take 8-10 days. they asked to submit the medical and did not say about the approved or refused. but CEAC status showed as refused. My question is can CO refuse my case because of my brother with pending asylum? I’m looking forward to hearing from you.

Don’t renew it right now. If you get the visa, you can renew later and keep the old passport with the visa in it.

Hi Brit,
A few days ago I received an email from the US Consulate in Frankfurt saying that the DV issuing process is restored and I can have an appointment, but they also write “We have advised you we may be unable to issue your DV before September 30 because your case is still subject to PP 9993.”
1) Does this “we may be unable” mean it is 100% impossible or is it a subject for the official’s decision?
They also scheduled an interview for September 16th 9 AM (tomorrow).
2) I will not manage to do the Medical test on such a short notice. –> Can the test be done after the interview?
3) I don’t see any reasons why any DV winner like myself would qualify for NIE to PP 9993 under the exceptions listed. –> Please correct me if I am wrong
All in all, does it make sense to attend the interview tomorrow / postpone to end of September to do the test / do not bother as it is impossible anyways?

My appointment is tomorrow at 9AM CET which is 3AM Eastern Time.
Isn’t there a huge risk that the Consulate will not be instructed by the Department of State by this time and I will get a rejection due to bad timing?
2) Regarding the Medical – you think it will be OK to come even without a Medical appointment confirmation (which doesn’t exist as such anyways) during the interview?
3) Should I just try to postpone my interview by a few days instead (without decreasing my chances)? This would help me with logistics as I don’t even have a photo in right format + I can get the medical, employment certificate etc.

1) Can you please re-send the link to the ruling? Your link does not work and I can’t find it via website search.
2) Are you sure about that? As on the Consulate website they state “It is your responsibility to schedule and attend a medical exam with one of the doctors listed below before your visa interview at the U.S. Consulate.” the word “before” is even underlined
3) Does it make sense to go to the interview without a photo and a employment certificate? As the suggested interview time is 9 AM there is no chance to get hem physically… I also have not confirmed the interview yet as they requested.

What is the worst than can happen if I come to the scheduled interview without a photo, an employment certificate and a Medical? Will they re-schedule or just invite me again on some other date?
And is re-scheduling of such interviews generally possible? E.g. if someone is physically not available on a particular date. I understand that in some countries it could be tough but Germany doesn’t seem to be a problem country in terms of too crowded Consulates?
Sorry for asking so many questions but as you see it’s quite an important decision in my life now to take. Coming without required documents might be risky, especially if re-scheduling by a few days is possible. Thanks!

It worked out well with all the documents and there was a photo booth inside to make the missing photos.
The Consular officer said that once I’ve passed the Medical AND the court decision is implemented by the Department of State and communicated to the embassies, the visa can be issued.
QUESTION: Is it inevitable that the Department of State instructs the embassies accordingly short-term or can something go wrong here?

Keep trying to contact the embassy. The CEAC updates may mean they are working on your case, but we can’t be sure what “working on” exactly means.

Dv2020, CN16XXX, we have been informed from our embassy for a interview date for today. (not able to do the medical exam. due to time)
We have done the interview and the officer told us that we need to make the medical exam. and after that should sent back to the embassy the passports.
After the interview we check to the ceac that our visa is Refused.
Please can you let me know if this mean that we are refused?

Have you heard anything about US Embassy in Russia issuing DV2020 visas? My brother in law should be in group 2, AP. He’s emailed them a few times since Sept. 4th hearing and no reply. When he called they tell him Administrative Processing. He even tried to schedule a new medical processing and wasn’t able to. The facility that does that in Moscow received a small list of people from the embassy and wouldn’t let anyone else to get scheduled at this time. It’s getting really close to Sept. 30.

Yeah I heard him say that and winced. He’s not exactly correct – but prior to this event wasn’t too clued up on DV – no surprise in that very few cases are handled by lawyers.
Public charge is still a part of normal immigration law and DV is not immune to it. That relates mainly to the I-134. So get that ready. Whether that is asked for or not depends on the case.
What was blocked is some of the stuff introduced in the DS5540. I would still recommend you complete that form and have it available if asked, but you should not have to prove medical insurance etc as I have explained in previous videos.

I am a DV-2020 winner and live in Australia. I have been here since I was little (originally from Burma). Long story short, I did make a huge mistake in my DV application. I was a bit confused by the way it was written. It says, “Are you claiming FSC based on the country you were born,” and there is a drop-down menu right next to that question. Well, I have been in Australia for more than 25 years and have no ties with Burma whatsoever. It would nice to have some sort of warning saying, “regardless of where you live or what your nationality is, your FSC must be the country you were born.” I consider myself Australian. So I hit NO to that FSC question and selected Australia instead. Now, the embassy is saying that I have made an error and am subject to be disqualified. I have seen your video explaining how the FSC works. Is there any way to remedy this issue? Thank you so much.

No – and the form/instructions are clear about that. If you were born in Burma you are chargeable to Burma. If married to an Australian at the time of entry that would be OK. But otherwise you are certain to be disqualified and you should be grateful the embassy is explaining that, because you would otherwise be wasting your time and money.

Hello mr Brit , i am also in group 4. I called kcc and the lady told me, they are working only on named plaintiffs and that if am a non named plaintiff then i might not have achance. My cn is AF48***
1) i wish to know if Dv2020 is now named versus non named plaintiffs? This is blc I called kcc and the lady asked if i am a named plaintiff and that they treat only named plaintiff.
2) help us talk to the AILA team, that we were counting on them to succeed but now only 7 plaintiffs were chosen leaving us out. That they should filed again for us so that if they would be an extension, then non named plaintiffs should have their place.
3) I contacted my embassy in yaounde – Cameroon and was told they are waiting on kcc, which means they have enough time slot for interviews.

I think it is possible, maybe even likely. But as long as Biden has won the election he would remove the ban within a few days after January 20.
The ban itself has been found lawful, as was the Travel ban before it. We are winning because the President gets the right to restrict ***ENTRY***, and they have used that to restrict ***processing and issuance***.

I am dv2021 winner I already submitted required documents. And in October Im starting college in a different country. At the time of filling in my ds260 I wasn’t accepted by that school yet so I didn’t provide that information since it wouldn’t be true at the time. My case number is EU8XXX
So my questions are
1.should I just mention to the CO that I became a student at the beginning of my interview and of course prepare as much documentation as I can?
2. At this point I can’t unlock ds-260 again am I right or is it still possible?
3. Would my change of status to student make my chances of getting visa smaller? If so I would consider not attending the school.

After watching your YouTube videos on the statistics of Oceania this year it’s not looking good for me but I just wanted to check if I did go ahead with my DS260 and I wasn’t successful, could it potentially have a negative impact if I was to apply for a US visa in the future? An 01 visa for example?

Yes it could have a negative impact. Filing a DS260 is considered a declaration of immigrant intent. That doesn’t automatically mean you can’t get a future non immigrant visa, but it can be a factor considered.

You can delay and see how things go. 2200 isn’t impossible – it’s borderline. But if more people than usual decide not to proces their cases, it could become current. Just delay – make a decision around about March.
