I am in group 2 . I was called by the embassy i did my medicals today and sent the passports to embassy . But i was told that now my husband which is a dervitative accompany is now on system check AP and told me that they cant guarantee if he gets the visa before 30sept.
Do you have any opinion about this sir ?
Which are the options that my husband can join me and my children in USA later on if he fails to get the visa ?

Hi Brit, I’m a Venezuelan 2020 dv winner, the bogota embassy sent me a link in the email that if I was going to attend the appointment in just 3 days and that it could not be rescheduled, I am making every effort to attend but I have two children and the option Is it to cross the border illegally, in which case if I state that I cannot attend, does it affect me if a possible extension arises in the process?

Hello Brit! Once more, thank you for the work you are doing.
My questions are about family-based immigration related to DV. My spouse and I immigrated to the USA last year through DV 2019. We are now ready to petition for the rest of our children to follow us to the USA. All the children were included in the DV 2019 submission and details about those not coming with us submitted during the interview including copies of their birth certificates. I would like that you advise me on which form to use for the petition in the following cases:
1 – Child under 18 years
2 – Child over 21 years. Child was included in the DV but could not be processed under the DV category as child was already more than 21 by interview date
3- Adopted child over 21 years who was also included in the DV but could not be processed as child was already more than 21 years
4- Lastly, if the same form is needed for the petition, can one form be used for all of them at the same time or a separate petition must be submitted for each of them?

Hello. I have never had any resident status in other countries except mine. But I was traveling a lot. I have never stayed in any other country longer then 3 months in one period of time. But I suspect that I have been visiting many times some countries, and in summary I have more than 12 months stay in that country if I summarize all visits. But I’m not sure, I have no records and I changed my passport few years ago. So should I worry about it?

Probably not. If you want to be more confident, get a police cert from the countries where you stayed over 12 months in total.

My sponsor sent me a system generated page as a proof of his employment (not a signed letter from the employer only a print screen that includes his employment details) It contains his salary and his promotions since date of employment. Will that be sufficient or should I request him to send any other kind of employment proof?

I many times requested the embassy in Ethiopia to reschedule my appointment as Critical Mission/ Emergency. However, it has been four days since the embassy replied to me that
“As ordered by the court, we are prioritizing individual named plaintiffs in the court case Gomez v. Trump and its companion cases who are applying for Diversity Visas. Beyond that, we have established priorities based on statutory standards and categories of cases most likely to result in timely issuance for eligible applicants. Accordingly, we are prioritizing applicants who have already been interviewed and who either have been determined eligible for a visa or may be determined eligible for a visa with additional information. We will also prioritize applicants with appointments that were cancelled in March, April, or May due to the COVID-19 pandemic and worldwide suspension of routine processing. Diversity Visa Selectees who have heard from the Kentucky Consular Center (KCC) that they are documentarily qualified, but awaiting an interview date, will be scheduled in accordance with their rank order and post’s capacity, consistent with our standard processes.”
There is only the operator who can give me the answer when I called saying only “Just email us.”

I also had a one day trip to Ukraine and Belarus to renew my visa to Russia. We simply crossed the borders and went back. Should I include Ukraine and Belarus too in my application?

I’ll start with the good news, just had my interview today in Poland and got my visa granted! They told me though that I’m not allowed to travel on that visa to the USA till the end of the year because of the Schengen Area ban. My question is, if being out of the Schengen Area for 14 days would work in that case? The lady said that there will be something printed on the visa that won’t allow me to enter States as long as the proclamation is in place. I’m a bit confused now because I was planning to quarantine in the 3rd country and travel before the December 31st. Do you know anything about it? Thank you

The proclamation is due to expire on the 31st of Dec 2020 and can be extended.
Therefore you can not ENTER THE US. Just wait.

Assuming you did not have a visa prior to April 23, then you still cannot enter until after Dec 31. That is not the Schengen area ban, that is the immigrant ban.

Your status will show refused for a while while they get your medical and also ask KCC for a visa allocated. Be patient, there is time.

Meeting the public charge requirement is compulsory. An I-134 is one way of doing that, not the only way. Savings can be enough sometimes. And some embassies make an assumption/assessment based on the person sitting before them (work history, education and so on).

I’ve already summited the DS260 form on 23 June 2020.
I’ve read here, that people have already started received the email from KKC for submitting of documents, but I still haven’t received anything so far.
Is this the case to be preoccupied?
Would it be that I’ve already received the email as spam and it’s deleted automatically?
What happens in the case the email gets deleted, is there any other way to know if you’ve already have received the email from KCC?

It is impressive how KCC says that it will only work with plaintiffs, and it turns out that 2 days ago they called 10 people from Venezuela for an interview in Bogota on Monday and Tuesday (21 22), knowing that it is more difficult for them. while others do not want us to process the documents and do not call embassies without plaintiffs like Chile

I was wondering the same. Why some “good faith effort” scheduling people from Venezuela for interview at Bogota embassy when (I don’t know if they’re already in Bogota or not) probably these people are still in Venezuela and can’t fly to Colombia? I have checked and seen case numbers higher than mine scheduled for Bogota embassy just yesterday. Nothing against venezuelan people or jelous but why KCC not doing the same for consulate here in my country (Ecuador) when no named plaintiffs cases here, few cases to review and consulate here has enough capacity to do it. Consulate told me they wil do their best to review my case and they sounded willing to cooperate but it seems they are waiting KCC to do their part to continue with process and KCC replied to me the same email that has been sent to others that says “they are prioritizing named plaintiffs cases” and blah blah. Nothing seems to make sense at all.

Hi Simon. I have submitted DS-260 a week ago (2021 EU 9XXX), today I received an email requesting to send scanned documents. I now realize that with my DS260 and documents processed, my case will be ready for interview. The problem is that, I’ll have to travel to another country for interview, and that country is closed because of covid-19. Besides, my own country is also closed because of the pandemic, there are no flights out of my country or into that foreign country, where the interview is to be held. I was thinking, if I’ll soon receive the 2NL for interview (even after December), and the borders are closed, and I won’t be able to make it to the interview, will I blow my chance? Do you think I should hold sending the documents and so prolong my possible interview date, until everything is clear with pandemic and the borders are open? What do you suggest?

Hi Brit. I have a question about the activation trip. So you’ve got your Visa, you’re entering the States to activate your green card – can you enter the country by crossing the border by road, or do you have to fly into a port of entry?
If you have to enter by air, can you enter, activate, then cross the border into another country, wait for your GC to arrive at your US address, then reenter the States to pick it up?
Or once you enter again, that’s it, that’s your first reentry and now you can only be out if the US for 6 months, not 12, cause it’s not your first reentry anymore?

Since the court order on september 4 I am chasing KCC for my 2NL i am sending them email and calling them every dam day but they have same answer. Today as well I email and called up KCC regarding my 2NL they informed me that they are still working on scheduling appointments for plaintiff. It is almost 2 weeks since KCC receive the instructions from DoS and still they didn’t finalize the plaintiffs. I guess 2 weeks are more than enough for them to finish plaintiff and group 1,2,3 will be handled by the local embassy or consulate. Still why they didnot start group 4. I have as well send my declaration to Charles with the evidence of multiple email which I sent to KCC since 4 September and what I received was generic email about the priority plaintiff. I dont know what to do know. US embassy in riyadh still have appointments available but they can’t act until unless KCC send my file to the embassy.

1. Do I have to have an i134 if I have around 100K in my bank account?
2. I graduated with a Masters Degree from a top tier university in NY..can I just take the Degree and a copy of it? Or do I need my undergrad degree as well? (I can’t find it)
3. I know I told you I recently got married in August when the DV was still suspended, I didn’t add him to my Ds160, and I probably won’t, I don’t want to cause any delays or risk it (also he works in the US on an O1). Should I take all the marriage documents and explain?

1. what are our chance for pervious remaining april interview date peoples who were previously given interview date and canclled..some people from previous april 1 interviews are also not reshuduling.
2. When called to embassy they say they are randomly doing reschuduling does that mean its random chance.
3.it seems 3 days left for april interview reshuduling..
4.i think there might be lots of pending case from march 17 to april 6 or embassy is slowing doing their jobs.

Why the same previous interview date that was at april 6 people have different reschuduling date like one at sep 22 and other is sep 25..Any idea about the this process..can previous april 8/9 interview date people also may have been included in sep 24/25 reschudule as they said they have done reschudling randomly.

The visa is not certain until it is in your hand. Sept 29th is enough time if you go fully prepared.
