Hello Brit and thank you for your time!!
1. My boyfriend is in the process of filling out the 2020-2022 application and the fee is $99. Is this the minimal amount that the KCC and you are referring to?
In my opinion it is not a small fee or practically free?
2. I am also applying for the K-1 finance visa. How would this affect the winning of the lottery if I receive the K-1 first and then win the lottery?
3. Should he win the lottery, does he submit originals of his documents or printed copies. What if the originals get lost?
September 27, 2020 at 15:09
1. Your boyfriend is being scammed. There is no fee to enter the lottery at the official site. As to the minimal amount I have NEVER suggested that you have to pay to enter the lottery, neither have KCC – what are you talking about?
2. You could adjust status, but you are getting WAY ahead of yourself. It’s a LOTTERY
3. Again. Lottery. Not a plan.

Hi Simon
Thabks alot for your help during this time the dv 2020 loettery took. I am following ur blog since the result came out, my interview did not went well, even i cant say it was inteeview since i was reject with all my family based on a reason i never thought about it , i was over and over prepared but they told me that i made a mistake while entring country of birth at the time of apply , while i am so sure that i did it corectly but i dont have evidence except the confirmation number page which does not show such details.
Also all the information in DS260 was correctly made , i show to the person but they said no.
It took us alot of efforts physically and financially to reach this step via law suit.
Pls there is anything can i do to clarify this issue. Regardless for the outcome i really apperciate your assistance and advices during all these process.
Thanks
Sam
September 27, 2020 at 14:28
So what are the countries concerned? Be precise, where were you born? If married, where was your spouse born?
September 27, 2020 at 14:46
Living in UAE and born in Tunisia
The same for my wife living in UAE and born in Tunisia
September 27, 2020 at 15:17
So your denial was 100% predictable and correct. The CO had no choice but to deny you.
You have an AS number. You were in the AS regional lottery because you chose UAE to charge to – and that was incorrect. You should have been in the AF regional lottery with an AF number. It’s a shame you hadn’t realized this, but I have answered & explained this issue many many times on my site.
September 27, 2020 at 16:03
Yes, absolutely right it is a shame, but it is painful since we hadn’t realised and this lesson learned was costly , this it was happen based on a pure mistake i have nothing behind it. My last question does this mistake and denial will have any impact in any future dv program either for my slef or any of my family member if we want to apply in future.
Thanks for every answer and assistance you have given to us.
September 27, 2020 at 21:20
No it won’t impact any future DV program entry. People make mistakes, that is not held against you.
September 28, 2020 at 14:47
How I wish all those interested in entering the DV program would visit this space everyday. I’m so sorry for Sam. This was an elementary mistake which could have been avoided.
September 27, 2020 at 13:34
Hello mr Brit
Is it okey to send the passport to kcc in black and white?
September 27, 2020 at 15:10
Color is better
September 27, 2020 at 13:43
As my country of birth is not included in DV Lottery, is it possible to apply from another country?
September 27, 2020 at 15:11
No. It is based on country of birth.
September 27, 2020 at 14:26
Hello Brit. In the instructions of DV Lottery, it is mentioned whoever enters twice will be disqualified. During DV 2021 Entries, My Friend had registered twice. he was not disqualified. it is even selected.
I’m really amazed.
I remember Dv 2019 also a friend of mine had signed up twice by not using the same photo, he was selected and he is even in the USA.
Is the disqualification applied
September 27, 2020 at 14:33
Hi Simon,
Thank you for your information support. It’s really clear.
One question regarding the eligible country: I was born in Colombia (ineligible) in 1982 but adopted by a couple of French (eligible) in 1984.
1) Can I apply and go for the option “claim your parents country”, providing the necessary adoption docs/parents passports at the interview?
Thank you for your time
September 27, 2020 at 15:29
1. No.
If you are married to someone from an eligible country you can enter charging to their country. That is all.
September 28, 2020 at 17:38
1.but if not married can he charge with parent’s birth place showing passports and letter from their work place like a high commission stating that the parents were there working for government but let after their period was up and it was purely because of work he was given birth there?
i have someone with similar pls advice and it is Europe land of birth but parents from Africa and an illegible country
September 29, 2020 at 04:17
Stop confusing the conversation trying to jump on someone else’s scenario. If you have a question – ask it clearly.
September 29, 2020 at 09:30
Sorry Brit, I just assumed it because she kept asking about parents whenever you brought up marriage so i deducted she may be single and i read something like that as well.
September 29, 2020 at 14:03
Yeah understood. Sometimes it is hard to understand people.
September 28, 2020 at 17:45
Hi Simon, thank you for your answer. However I don’t understand why it doesn’t fall under the criteria “have parents who were born in eligible country and don’t belong to my country of birth and they never lived there”
Thank you for your time.
September 29, 2020 at 04:16
Because you did not have those parents at birth, and so your birth in that country was not as a result of a temporary visit to the country.
September 27, 2020 at 14:47
Hello Brit, happy Sunday from my end. I wish to inquire something from you. There is a form called form G-28 , to be more precise Urena g28 checks. Some plaintiffs of the Kennedy lawsuit have received email asking them to fill the form and sign ASAP.
1) i wish to ask if that applies even to non-plaintiffs. thanks
September 27, 2020 at 15:19
That form is to show representation by an attorney. If you are NOT represented by an attorney, you don’t use the form.
September 27, 2020 at 15:03
Hi mr. brit
i have completed 18 years of school and I’m a collage student currently. I will graduate next summer(2021) so what education level should I put in my application?
September 27, 2020 at 15:22
Just the option closest to the truth.
September 27, 2020 at 15:17
Hello Mr. Simon,
I wanted to ask you that there is a requirement for at least High School education. This is my last year (in US you call it Senior year) in High School. And I want to apply for a visa, I’ve applied last year, but me and my family didn’t get the visa, so we want to try again this year. And will my visa application be accepted or should I go as a child (if someone of my parents gets the visa)? And if 1 out of 4 people of my family gets the visa, can we use it to go as a family all together with one visa?
Kind regards, Viktor.
September 27, 2020 at 15:27
If your parents enter, they can include you. If they win, you can get a GC too.
If you meet the education standard (ready for university entry, normally around age 18) you can also enter, but if you are the winner you cannot take your parents and siblings.
September 27, 2020 at 15:32
I’m 18 years old and my brother is 22 years old, if any of my parents wins that means they can get us with them?
September 27, 2020 at 15:41
Not your brother, no. Unmarried children under 21
September 27, 2020 at 15:45
Good Morning Brit,
I have already posted this question but going back to check if you replied yet, I couldn’t find the question or the reply to it. This have happened to me several times in the past and I couldn’t ask the same questions again because I did not want to make you repeat yourself. Is there anyway that I could retrieve all the questions I asked before with their replies.
My question for today was about my younger brother who is going to be 17 years old by DV 2022. Although he will be below 18 years of age can he still apply for DV 2022 individually and also as a derivative on my father’s application. As he will have fulfilled the high school education requirement. Thanks
September 27, 2020 at 15:51
Make sure you turn on notifications to know when your question is answered. YOu couldn’t find it because even though you only asked 2.5 hours ago, I have been asked (and have answered) many other questions since then.

Hello sir,
I’m a 2021 winner and I submitted the ds260 since June,11 and I received nothing till now
Should I send the documents to kcc without their requesting email??
September 27, 2020 at 21:21
Region/case number?
September 28, 2020 at 18:24
No. Wait.
September 27, 2020 at 16:24
Hi Mr Simon I received 2nl on the 22 and was able to use it for medical on the 23.this show visa can’t be given without valid results.my interview is due for Tuesday 29.i have to carry the receipt to the interview.am asking if I am the one to be bame for the results of the medical
September 27, 2020 at 21:22
I don’t understand your question.
September 28, 2020 at 18:23
It doesn’t matter who is to blame. Unless there is an extension the deadline is the 30th.
September 27, 2020 at 16:31
Hi Simon,
I really learned a lot from your articles, thank you very much. I just have a very general question in mind: after VB goes “current,” will the KCC schedule interview strictly based on case number or every case becomes equal?
September 27, 2020 at 21:26
It’s more like each number is equal. Not exactly, but close.
September 27, 2020 at 16:48
Hi Brit, I hope you are doing well. Is there anyway to enter USA for some part of the world to activate my GC??? before end of this year?
Kind regards, John
September 27, 2020 at 17:34
Hi Simon, If you have already your VISA and a ban is instigated against your country, does it block you from entering the US or you are safe as you have already your VISA?
September 27, 2020 at 19:33
Hi Brit, thanks for unreserved support you are giving us, my case number is 2021AF10xxx and submitted DS260 in mid August, but I have not received email from KCC to submit supporting docs. October VB showing case numbers below 5900 to be schedules for November, seeing that I was expecting KCC email. When do i expect KCC email or is there a possibility KCC might not email at all?
September 28, 2020 at 18:26
You need to be patient. You submitted late, so there could be a delay.
September 27, 2020 at 19:38
Hi Simon
Sorry for the mess created at the end of your live session.
I heard your comment regarding the annotations that are written on the DV 2020 visas issued in the last days and your comment regarding some with such visa trying to get to the USA before the PP10014 expires or is put on hold by a judge ruling. You might be right that with a bit of luck you might be getting in with no issues, however, below is a lick to the US Custom website answering a similar question.
The link to that webpage is: “https://www.cbp.gov/travel/international-visitors/applying-admission-united-states?fbclid=IwAR1iUSMb3nVoQV60miNldmNNCPEE-NNOmYMmLpYPwCh2amgAmwEznQIO_6M”
Below you can see the last Q & A from that webpage:
“Q: What will happen if I am not found admissible?
A: If you are determined to be inadmissible you could, in certain circumstances, be placed into removal proceedings. In some circumstances an officer may, in his or her sole discretion, determine to permit you to withdraw your application for admission. A determination of inadmissibility may have an impact on your future admissibility and may result in the cancellation of your visa, if you have one.”
I just wanted to bring up the possible of losing your visa all together if someone is found of trying to get into the USA without being entitled to enter.
It was my attempt to share the information and to say thank you for your constant help.
Currently I am in Canada waiting with my DV 2020 visa that has one of this annotation on.
G.A.
September 28, 2020 at 03:36
Hi G.A, Thank you for providing the link, it is very helpful.
September 28, 2020 at 18:28
You are misunderstanding the term inadmissable. Don’t overthink this.
September 27, 2020 at 19:43
Sir, my case number is 2021eu1xxx and it’s current now. Can I request for an interview under national interest category? I’m a physician and have a valid cancer research offer from a professor in U.S medical school. Have you ever heard a dv winner who benefits from NIV? Note: I’m from Turkey and have a Us citizen child.
September 28, 2020 at 18:29
No, because your application is not based on that employment. Is there a need to rush?? Patience.
September 27, 2020 at 19:44
Hello,
I am doing my PhD in united states. I will file i-944 form and it is asking an evaluation of equivalency for foreign education. Since I am doing my PhD here, do I still need to do that for my BS and high school diploma? My university in my home country was ABET accredited which is the most valid one for engineering in world wide and my current university in the US accepted my BS degree so do I still need an evaluation? Thanks
September 28, 2020 at 18:33
Not for the US degree.
September 27, 2020 at 21:03
We are Cubans currently residing in Uruguay and we are waiting for the issuance of our DV2020 visa (2020SA187 *) Upon receiving our documentation and passports, can we fly to the USA before September 30?
In other words, can we get tickets and travel definitely without waiting for December?
September 28, 2020 at 18:34
No, not unless you previously had visas prior to April 23.
September 28, 2020 at 01:56
HI Simion,
I am in group 2 of DV 2020. Now i am waiting for my visa issues after i completed and submitted my new medical check. However, I still seeing my status in CEAC as “Refused” which is make concern on that. Brit, if Trump win the election, is it possible for him to extend the entry ban after 31 Dec? I know that getting visa is not 100% safe unless we are landing in US.
Thanks for your feedback!
September 28, 2020 at 18:36
CEAC will change in due course. Patience.
Yes Trump could extend.
September 28, 2020 at 03:41
Hi Brit,
I am selected for EDV-2021. I am from Nepal, currently in the US in F1 visa. Is it better to do the consular processing in Nepal or Adjustment of Status within the US (considering the current processing time for AOS and the COVID situation for consular processing in Nepal). Please let me know what you think is the better option. My case number is in 6000s. Thank you for your time and help.
September 28, 2020 at 18:37
Both ways have their own pros and cons. You have to decide for yourself.
September 28, 2020 at 04:44
Has dv 2020 september 30 deadline been extended?? What is its progress in the court?
September 28, 2020 at 18:39
Court hearing is today.

You can now apply for routine service and expect to receive a passport in 10-12 weeks. You also have the option of paying an additional $60 for expedited service to receive your passport in 4-6 weeks.
These processing times apply to applications submitted by mail and in-person at an acceptance facility in your community. Most acceptance facilities such as post offices, clerks of court, and libraries are open and accepting passport applications. We encourage you to apply by mail when possible because it is a safe, contactless option for certain services.
All of our agencies and centers are processing passport applications. To prevent the spread of COVID-19 and protect our workforce and customers, we currently are limiting in-person appointments at our agencies and centers to customers who are traveling internationally in the next 72 hours (3 business days) due to a life-or-death emergency.

Hi Brit,
I am 2020 winner and Today I had my interview, but the councilor informed me that if they have enough time they will issue my visa.
My question if the visa not issued by tomorrow I will lose the chance then ?
Thanks
September 28, 2020 at 18:46
The deadline currently is the 30th.
September 28, 2020 at 09:59

Hi Britsimon
Please what can I do to win 2020/2021 lottery because when I check it, I was not selected, please what can I do to win when I check it again.
September 28, 2020 at 12:29
Easy. Just play again.
September 28, 2020 at 18:52
Enter the next lottery.
September 28, 2020 at 13:18
Hi, Brit! Thanks for everything!
I have an email from the embassy with a list of required documents for my interview.
This list does not include financial documents (I-134) or health care quotes.
I have read a few articles about different forms (DS-5540 and I-134) in your blog.
Should I prepare any of this for my interview anyway?
Thank you.
September 28, 2020 at 18:52
Yes
September 28, 2020 at 18:56
Sasha, I can tell you this. My fiance just had her interview last week. Her interview lasted a full 30 minutes and much of this time was spent looking at both of these forms. They checked every detail in these forms. If we did not have them or even if there had been some small mistake, I am sure they would have rejected her. Like you, the embassy did not mention these forms in their “things to bring with you”. Good luck to you!
September 28, 2020 at 14:03
Helli Brit,
I have sent suppoting dcuments to KCC upon request, but by accident named my police certificate as a court record. Is it a problem by far? If it is, what would you suggest to do ti fix it.
Thank you in advance
September 28, 2020 at 18:53
Resend everything
September 28, 2020 at 14:16
Hi Brit , I am a winner 2020 and I got visa stamp last week , in case of ban extending after January what is the expected scenarios from you side as an expert ?
September 28, 2020 at 18:54
I don’t know. One step at a time.
September 28, 2020 at 14:16
Hello.
I have a couple of questions:
1. Can somebody apply with their eligible country of birth and use a different passport from the birth country. Example: Born in Venezuela, and owns a second nationality: Spain.
2. A DV winner 2021 can change the location of the interview to a third country? Even if they are not residents or nationals? Example: Assigned embassy: Bogota. Change to Embassy in Mexico?
3. For DV 2022 an US child is not required to be in their parents entry. However, ir says children 0. And it’s not accurate.
Thank you in advance.
September 28, 2020 at 18:56
1. Yes
2. Yes, normally only if they live in that third country, but exceptions are being made during these times.
3. So?
September 28, 2020 at 15:19
Mr. Britsimon,
I want to know will those cases whose numbers are included in Visa Bulletin for September 2020 have interview first before those listed in the November 2020?
OR will both be interview during the same month or time since indeed they current?
How does it work?
September visa bulletin listed case numbers in January 2021 and then November ones in February 2021?
Please enlighten me on this concern.
Thanks
September 28, 2020 at 19:00
Anyone current at that time will be treated the same as everyone else.
September 28, 2020 at 22:20
I assume that embassies will not have the capacity to process everyone current at the same time. How will they distinguish who to schedule first? Do you think they will select randomly or select those who sent in all the documents and was approved for scheduling earlier?
September 29, 2020 at 02:40
Various factors, including most importantly who is redy for scheduling, case number, and embassy availability.
September 28, 2020 at 15:20
Hi Mr Simon,I come back with the question that u didn’t understand well.my interview is scheduled for the 29september,and I received this mail on the 22 and did my medical on the 23 which shows the results can’t be out before the interview day.on my mail it is written visa can’t be offer without a valid medical results after the 30 of septSepte.the physician gave me a receipt of the medical to carry to the interview
Will it be a problem for visa refusal view the fact that the time I received the interview mail could not permit results to be out.thk
September 28, 2020 at 19:00
Unless the deadline is extended you need to meet the deadline.
September 28, 2020 at 16:19
Hi Brit, I have a question if you don’t mind. What will be the risk if someone has that annotation in his visa : “Exception to PP” and travels and gets denied entry to USA (inadmissible), could his visa be cancelled, could be placed in removal proceeding, and that will impact any future visa or entry.
September 28, 2020 at 16:58
In another word, what will be the loss if the entry gets denied beside to the financial loss?
September 28, 2020 at 19:02
No, that is not the meaning of inadmissable.
September 28, 2020 at 22:11
Thank you for your prompt reply!!! If someone has that annotation of exception on the visa and won’t enter to USA, the visa will not be cancelled. It is clear in the travel.state for DV 2020 who receives the visa under the court order and has exception can still enter. Another separate paragraph for the people who received their visa as of April 23 they have that exception automatically. in the Proclamation says: the embassy only at the interview can decide if you can get an exception to enter or not so that is why someone have that exception and other have subject to PP printed on their visa. Also it says : No valid visa will be revoked under this proclamation. The embassy know what they are doing and not confused. the two links are below:
https://travel.state.gov/content/travel/en/News/visas-news/diversity-visa-DV-2020-update.html
https://travel.state.gov/content/travel/en/News/visas-news/exceptions-to-p-p-10014-10052-suspending-entry-of-immigrants-non-immigrants-presenting-risk-to-us-labor-market-during-economic-recovery.html
The CBP officer cannot deny entry under the proclamation if someone who has valid visa and with exception written on it.
September 29, 2020 at 02:38
I think you may be confusing all sorts of issues there. There are some people who have wording about exceptions on their visas, and that might be because the visas were issued under an exception. But of course people, including yourself, are choosing that to mean they are entitled to an exception to be able to enter the USA, and that is a NOT what was meant to have happened. I think the wording is simply awful.
September 28, 2020 at 16:19
Hi, I got my diversity greencard last year in Sept 2019. As far as I know, I have to re-enter the US every year otherwise I would have to get a re-entry permit is that correct? Initially, I planned on going there this summer. But with the current situation this is not possible (and will most likely not be possible for a while). Do you know if I still have to apply for a re-entry permit? Many thanks for your help. Best regards, Meret
September 28, 2020 at 19:03
You cannot apply for a re-entry permit from outside the USA. So – if you go over 12 months you will have to apply for a SB-1 visa.
September 28, 2020 at 17:08
Hi Brit, I have a question – I am a DV2019 lottery winner, and this year I’d like to play it in behalf on my parents and brother. My brother is 20 years old. If I apply this year, lets say the results will come in May 2021. My brother turns 21 in September 2021. Since the interviews do not start till October 2021, will my brother be considered as “aged out” ?
Since the form for my parents says “list all children under 21” – I just wanted to figure out IF selected, will he be considered as aged out.
I know this is a “wait to get selected question” but I was just thinking of this, and I decided to ask you, if you have time to answer.
Thanks in advance!
September 29, 2020 at 04:19
1. No – he would get some temporary protection under the CSPA.
Yep – wait to get selected. 🙂
September 28, 2020 at 17:08
Note: All plaintiff names do not appear on docket because District Court for District of Columbia only makes us enter the names for the first 50 named plaintiffs. So if you don’t see your name on the docket, that does not mean anything. ?
September 28, 2020 at 17:41
Hi,
I won the lottery and have one other dependent who is no longer dependent (son turned is over 21). However on my home page I have his name as a dependent. As the principal applicant I submitted my own documents but didn’t submit anything for my son.
Would this affect my case? Would this be considered as if the principal applicants case is not submitted?
Thanks a lot.

Mr. Britsimon,
I want to know will those cases whose numbers are included in Visa Bulletin for September 2020 have interview first before those listed in the November 2020?
OR will both be interview during the same month or time since indeed they current?
How does it work?
September visa bulletin listed case numbers in January 2021 and then November ones in February 2021?
Please enlighten me on this concern.
Thanks

Whenever intyerviews start, all cases (ready for scheduling) under the bulletin number by that time will be able to be interviewed.

#DV2020 Preview of Judge Mehta’s hearing that begins 40 minutes. 2 issues up for discussion (from plaintiffs’ joint filing Friday):
1) Judge Mehta’s authority to carry-over visas beyond 9/30.
2) The government’s bad conduct that warrants that relief.

The lady I have got on the phone today is dam stupid (got it few times in the past), I asked her if they are satisfied with the document or should I get new up to date one but she says up to you. I was explaining that is there problem, I am ?%sure that my documents reached KCC doc mailbox in 2019 ( I included myself in CC) but she says blabla the issue is not from ourside we got them only in June 2020 an I can’t tell…. is up to you whether to send new ones or not. I said to her I have red all instructions on their website but couldn’t find infos this is why I am calling , and that they are the entity that can advise about the procedure but keeps saying up to you… one of the worst service that I have seen so far.
Angry, hope there is not much service alike in USA else no need to travel.

I get that you are frustrated, but try and be calm and respectful. She told you what they have been told to say. It’s not her fault.

Hello Brit …
I would like to ask you about something concerns my documents for the green card …
My Boyfriend won the lottery 2021 and we are in the process to getting married by next month so he can add me to his file
I was married and divorced 3 years ago .. and I had an agreement paper from the court between me and my x husband concerns my daughter that she will be living and staying with him not me.
My question is
Do green card documents requires these kind of papers or agreements from court ?
or just my divorce paper ?

Go prepared with everything.

Hi Brit,
Getting a visa at this point for a dv2020 winner is not a guarantee that he/she enters the US after December 31 (if Trump wins or the pandemic will worsen). Without entering before visa expires there will be no GC issued.
My silly question: may the winners of dv2020 (with visas on their hands) still participate in DV2022? I think I know the answer but would still like to have your opinion. Thank you in advance!

Anyone can participate in the lottery. Anyone.

Hi! I had my interview today. My son and me got our visas approved, but my husband’s visa is showing “refused” in the ceac website. They gave us form 221g because he is missing his medical. I thought that If you get form 221g your case was into AP, but I’m worried because is showing refused in the ceac website. If there is some relief for DV2020 do you think they will accept his medical and process his case as the 221g form states?

AP usually shows as refused these days.
