I am a dv 2021 winner. My case number is 2021AS8XXX. I already submitted my DS260 form and my documents in August. I had to renew my passport recently therefore I asked KCC to unlock my DS260 form.
Thanks to your very recent live video on youtube, someone asked you about the same issue and you suggested him to update the DS260.
Today I updated my passport information on DS260 form and submitted the form again. My question is should I send my new passport picture and other documents right now or I have to wait for the email form KCC?

Hey Simon, so following your advice I travelled to the US during COVID not to lose my green card. I was trying to get a health insurance through the government market place they requested for a rejection letter from medicaid. I was told by medicaid I should apply online and I will automatically get rejected for not being eligible since I have not been in the country for 5 years. but I got approved and now I cannot get coverage through the marketplace. that would be a problem for citizenship application right? medicaid people said I got approved may be because of COVID situation. I don’t know what to do?

Be noted, I had sent it before all the required documents according to KCC request letter, and on July 8 I received KCC confirmation which indicate “Our records indicate that you have submitted all documentation required by KCC and are ready to be scheduled for an interview when your case number becomes current.”
1. What dose it mean?

Hi Mr. Simon, I am from Liberia, West Africa. Thank you for all of your good work. I just want to let you know that it was through one of your videos I got to know about the lawsuit for dv2020 winners. Notwithstanding, I contacted Curtis Morrison Law office and I was accepted to sign up. Everything went successfully and now I have my visa with me. Thank you so much. I hope to be in the US to have an interview with on one of these days. However, our biggest worry now is if Trump will sign another travel as the current comes to an end on December 31, 2020.

Can I apply for medical insurance (visitors coverage website) before I enter the USA or do I have to wait for my SSN in order to take on a policy? You don’t need an SSN for the visitors coverage policies, but would normally need one for an ACA plan.

Hi!
Please be so kind to assist. Here is my case:
I had an H2B visa until 15th of May this year (with no right to work for another employer) BUT in the meantime I was not making enough money SO I have started working second job (they were paying taxes also). At some point I was too busy and overwhelmed to handle working both places SO I quit my primary job in February and was working only the “second job” (until mid May) and they have payed us some Government money (PPP program)-due to the pandemic.
Meanwhile right before my H2B visa was about to expire (15th of May) I have applied for adjustment of status (B2- tourist visa) for the next 6 month (status now- “Case received”) I got sick (COVID) and in general COVID came to the US very rapidly & I was afraid to travel (was not able though) I left the US on 10th July.
Overall my questions are:
– should I fill in my “second” not so legal job (January-May)
– should I, at some point, fill in that I have applied for Tourist visa (and stayed after 15 th May waiting for response) with NO actual visa now
– I also have a drivers license from Florida- where I used to live (issued in December exp.date-15th May 2020) and a couple months after I also had one issued in Seattle, WA- where I was not living at all (until 2026-year) wondering if could be an issue
– is this situation so crucial as it seems

If you accrue more than 180 days unlawful presence you will be subject to a 3 year bar which will ruin your DV chance. I suggest you immediately talk to a lawyer to ascertain whether you are accruing unlawful presence right now and take action straight away.
Regarding the DS260 I only advise people to be truthful. Being truthful does not mean deciding how to answer questions based on what you think will be the reaction to the answers.

Hello BritSimon! First of all, huge thank your videos and feedback about the DV updates. I have a questions as well and it would mean a lot if you can help me out with this.
I am a DV21 selectee and I have finished and uploaded DS-260 in June and have not heard from KCC ever since.
However, as time passed, I realized there might be some changes that need to be done to it:
1) There is one question in the DS260 where it ask me about my education. I have finished my Master’s degree and have written everything about it. However I am now doing my PhD (started before I became a selectee) but I do not know if I have to fill out this in the form. Please have a look at the picture I have attached to this message:

Since I have not finished my studies yet, do you think I should write it here somewhere? What do I put in the date of attendance “From” and “To”? I think if you do not fill all the brackets it will not let me continue, so I have to fill in “something”. But then again, it also says “highest level of education completed” in another question so it is a bit confusing…
2) In the question “Have you traveled to any countries/regions within the last five years”, I have visited a few new countries Since June and I am guessing this needs to be added to the DS260 right? Do I ask KCC to open my form to write new countries or do I just mention them during the interview? Also, do I have to keep editing this form every time I travel somewhere else? My job will require me to travel a bit back and forth once the quarantine is lifted. Do I have to bother KCC every time with this?
Right now my DS260 form is locked and sent to KCC. Does asking them to open it so I can edit it somehow impact my case in negative way? Would it be considered as a “late DS260 submission” or something?

1. The education section is about education completed. The past tense is important which is why you have to give dates from/to. There is a place where you are asked your current occupation, and that is what you are doing now (full time student or whatever).
2. Make sure the travel is correct at the time of submission and update it IF you open the form for something else. You don’t need to update for every small subsequent change in travel history, work history and so on – UNLESS you consider that travel or work would cause a security concern at the interview. So – if you took a job as Nuclear weapons expert in Iran – that is not something you would want to come up in the interview without it being in the DS260. It would be a “material omission” – and you want to avoid that.

You are confusing two separate things.
One thing is entries and exits. Can easily be done by electronic methods (airlines).
The other thing is stamping your passport to show you have been admitted for a period of stay or whatever.

I have a question about the Education section of the DS260. I have attended 4 secondary institutions for degrees I have completed, and am currently attending one online that I will complete in February. I included ‘student’ and the institution as a current employment option, but only listed the previous 4 institutions under the education area (including writing 4 in the number of institutions attended, though technically it is 5, I just haven’t completed that one). The qualification I am currently studying is not a higher grade than my highest qualification received, so that will not be changed.
1) Should I unlock my DS260 to add the current education in, or is including it in employment enough?
2) If I do unlock, what date do I put in ‘attended to’ as you can’t enter future dates?
3) Similarly, should I put the qualification I will receive in the ‘Degree, Diploma or Certificate Received’ section, even though the question is phrased is past tense as though I have completed it?

Hi Brit. About the I-134. When I am at the interview I would like to be judged with all documents I have in order to be accepted without showing the I-134 unless I am asked. Do you think it is ok or doing this way just give my case less chances? Should show them everything I’ve got right away? THey will ask you for certain documents to start with – probably not including financials. Later they might ask for proof of financials ability, and if they do that is when you present the I-134.

No that is not the 2NL. It’s “ready for scheduling”. The 2NL is your notification that an interview has been scheduled (you could read the FAQ about that).

I have a few questions. I won the 2019 lottery and have gone to the US on May 2020 to activate my status and flee back to my home country the next day.
I changed the mailing address at POE.
The person at the mailing address still has not received the greencard nor the SSN.
My questions are:
When I change the mailing address with the officer at POE. Does that apply for both greencard and SSN?
Was there a delay because of greencards stopped being processed a while back?
Is there anyway we are able to track these items? I’ve been going through my email and google to see if I”ve missed a tracking number that could have been given to me.

First – had you paid the GC fee of $220? Paid online, not at the embassy.
There have been some delays, BUT your delay seems excessive. Certainly the SSN would have arrived sooner. You should check at the old address. It might have been sent their if someone didn’t register the change of address you made.
You may be able to ask USCIS about tracking.

Thank you for your inquiry.
Your DS-260 has been processed. You should have received, or will soon receive, an email from the Kentucky Consular Center giving you instructions to complete in order for your case to continue processing. Please follow the instructions in the email. Interviews are scheduled numerically based on case numbers that have completed processing. Please refer to the visa bulletin at travel.state.gov to locate the current numbers being processed. This bulletin is updated after the 15th day of each month. Once an interview date has been scheduled, you will receive notification via email to check dvlottery.state.gov.
After sending documents to [email protected], you will receive an automatic reply to your email. If there are no attachments, the auto reply explains there are no documents attached to the email. If there are attachments, the auto reply explains we received your email and are currently processing your documents. Please allow time for processing of your documents. Documents are processed in numerical order, based on lottery rank number. Once KCC has processed your documents, we will let you know if anything is missing or if we have received everything needed.
Scheduling for the DV 2021 program year has not yet begun. Please monitor Travel.State.gov for updates……

Hi Simon, just would like to check the following
– are there any disadvantages to arriving at a POE on a weekend? e.g. an Immigration officer needs to verify anything with another office or our home country and is unable to do so on a weekend
– From your FAQ, we should be able to leave the USA as soon as our visa is endorsed at the POE, just wanted to verify that this is still the case and is there any recommended duration of stay in the USA for this first entry if we wish to return to our home country for 5 months or more.
– is the endorsed immigrant visa still a valid document for re-entering the USA even after our green card has been issued?

You mean because of the ban? Yes there have been some people denied entry. There have also been some allowed to enter.

Between now and Jan 1 Trump could theoretically extend the ban, or even creat a new one. So – you could plan to travel between Jan 1 and Jan 20 with a changeable ticket, OR you could wait to see what Biden does after Jan 20. Personally I would take the Jan 1 to Jan 20 window.

And which window would you recommend to travelers from the Schengen zone? On this note have you heard of anyone who managed to enter without the 14 days quarantine or is this impossible?
Also if one in the family carries a US passport do you think it might be easier to enter (with or without quarantine)

I expect the airlines are pretty good at implementing the Schengen type bans – so don’t expect to beat that.
The US passport holder would not help the rest of the family for entry.

You can decide how to play that. There was talk about Trump removing the ban, but with cases increasing in EU, I doubt that will happen. I don’t know what Biden will do.

I have a few questions regarding the ‘age’ of the documents submitted to Kcc as well as i134 form:
1-the Moroccan police certificate is valid 3 months (written on top of it). Beside that, Moroccan embassy says if you are 16 and older, submitted the Police certificate more than a year ago etc you should apply for a new one. Does the 1 y rule stated on the MOROCCAN US website overrule the 3 months validity on the Moroccan police certificate?
2-the Moroccan embassy requires a celibacy certificate. I submitted one last summer when I received Kcc email. Given the delay for dv2021 interviews, is it okay to keep the same documents submitted to Kcc for the interview? or one shall obtain more recent ones? Exemption for the police certificate where if it is 1year old must be renewed.(I am still not married so my status hasn’t changed)
3-in my understanding you only advise to present form I 134 to CO and not the DS5540 public charge form. Is this correct ? Shall the sponsor also send me supporting documents to i134 such as pay slips and any other relevant documents ? If yes which ones?
4-is it advised to obtain health insurance before the interview ?

Dear Brit,
I’ve updated my passport and asked KCC to unlock my Ds-260 form. They did. But next their e-mail fairly quickly was this one:
“Beginning with entrants in DV2021, each DV entry must include the passport number, country or authority of issuance, and expiration date for the principal applicant’s valid, unexpired passport. If the passport used by the principal applicant to enter the DV program differs from the one currently being submitted, you should also include a photocopy of the principal applicant’s passport listed on the DV entry with a written explanation as an attachment in .jpeg or .pdf format, to [email protected], with your case number in the subject line. ”
I’ve completed edit for DS-260 and resubmitted it. Then I’ve sent an answer to that e-mail with scans docs:
1)scan Datapage of old passport (old pasport are taken from me when I update it in my country)
2)Notarized Copy of old passport (in English, I’ve made that so I would have additional proof that it was valid)
3)New passport
I hope I made everything right.

4) writte explanation that I am updating the passport because it is getting soon expired and became less than 6 month. U.S. Embassies require a valid passport more than 6 month otherwise they will ask you to provide a new one. I explained that my purpose was only to follow rules of U.S. Embassy and instruction which is require to have vaild passport which is more than 6 month

Hello Britsimon! I hope you are doing well! On June 24 has KCC asked us to submit our documents and we sent everything except one of the criminal record of my wife as a principal applicant since she lived in three different countries. Anyhow, we have recently got the latest criminal record and we did as you always say to send the whole package again which we did today. Now I have 3 questions:
1- Do you think the reason for not getting a response from them regarding the supporting documents is that one of the criminal records was not sent?
2- Should we send an email to them to remind them or to check with them if everything is OK and get a response regarding the documents which we sent to them?
3- Our case number is AF 84xx, should be expecting to have interview before June 2021?

Right now JFK does not have any of these requirements. But you should check with your airline as they may have some requirement for you to board the plane (from your home country). You can find some good information on JFK website https://www.jfkairport.com/ and they have a decent chat app at the bottom of the page. My wife is also coming to JFK on Jan 1st so we have been searching all the same questions. Good luck to you!!

I am currently living in Ethiopia. And I was born in Saudi Arabia. I left Saudi Arabia 6 years ago at the age of 18 but I never obtained a police certificate clearance before I left there. The U.S consulate requires me to obtain the police certificates from both countries. However I can only bring a police certificate from were I currently live which is Ethiopia. So my question is “Will I be denied a visa if I cannot provide a police certificate from Saudi Arabia ?”

You have probably seen me say “read the instructions”. You should have done that, and if you had, this question would be unnecessary.
The reciprocity page for Saudi Arabia says “Registration Criteria: Police clearances are available for Saudi citizens and resident third country nationals. Saudi citizens currently residing overseas must return in person to process the police clearance.”
So yes you must provide the police cert, and yes you can assume you will not be approved without following the instructions.
