Ok, this is a slightly complex order. We won some things, and lost some things. Overall, I am THRILLED with this result. We asked for a lot, in part knowing we would not get everything.
First, 9095 visas have been set aside for after the September deadline. The lawyers will need some time to interpret the order in some aspects of that number.
The Gomez class (everyone represented by the 7 brave plaintiffs HAS been certified. That ensures relief can be given to more than just named plaintiffs.
The Aker class certification was denied. Again, I will need time and input from the lawyers to determine what impacts that has, if any. This was about visa re-issuances. Charles is asking for evidence for re-issuances granted that says you are subject to 10014 (which should not be the case if the visa was originally issued prior to April 23).
We need to sort out how the processing will happen, and how the government interprets and implements the order. The order does NOT dictate whether to issue by case number order, or which groups will be helped. So – that will be something to sort out next. It will take some DAYS to figure that out.

Judge Amit P Mehta’s order on the Mohammed, Fonjong, and Kennedy Plaintiffs all who were covered by Law Office of Curtis Morrison and The Law Office of Rafael Ureña. In the order issued hours ago the Judge has made the State department reserve 9,095 diversity visa numbers after September 30, 2020. This means that only the Plaintiffs (about 2500) who were covered in the case are going to receive the 2020 Diversity Visas after they win on merit. Earlier the State Department had issued only 14,636 of the 55,000 diversity visas allocated for Fiscal Year 2020. Cumulatively this will give a total of 23,731 diversity visas issued for 2020. The remaining group of non plaintiffs it will be the end of the road for DV2020. Therefore this is why their is an emphasis on reapplication of DV2022 even if you had earlier been selected.

Hi Simon- I admittedly have not read through the entire court judgement- however, from the summary, I understand that, due to the Aker class certification being denied, those of us who have done our due diligence and worked hard to obtain our DV Immigrant Visas could potentially lose our opportunity to immigrate to the U.S, under the premise that the Presidential Proclamation 10014 could be extended beyond December 31st, 2020(my Visa expires mid-March 2021)? On the other hand, other candidates who eventually have their Immigrant visas issued at a considerably later date could potentially successfully immigrate, insofar as the PP10014 expires before THEIR own Immigrant visas expire? Pardon for seemingly sounding negative, but that sounds very unfair indeed!

If it’s possible to just cancel the dv2022, they will cancel the whole dv program 2020,2021 and 2022. Dv program is a US congress program so everyear everyone can try his chance. No matter the winners got or not their visas. For 2020 and 2021 we should consider several factors among others the COVID crisis.
We should be thankful to the lawers and Judge Metha along with Mr Brit Simon. They did a great job and thanks them more than 13.000 visas will be issued after the Judge order. You can still try the dv2022.
