There are people who for one reason or another have not yet submitted their DS260. AS I have posted before, the window to safely delay your submission is closing fast. It might be the case that processing times speed up, but so far we have not seen evidence of that. We might see some increase in the next batch of 2NLs, but I wanted to send this warning now, just in case times have not reduced.
IT is probably helpful to understand the current processing times.
So far each month that goes by they have bundled up another months worth of DS260s. So – most forms submitted up to the end of July got 2NLs in December (assuming they were current of course). Most forms submitted in August got 2NLs in January (March interviews). In a week or so we will start to hear from people who get February 2NLs. If those people are submissions only up to the end of September it will mean there has been no increase in speed. If however we see some October submissions in there it will show there has been a small increase in speed.
However, if we assume there is no increase in speed at all the table of DS260 submission date to interview date would look something like this (this is in general – there will be cases that are exceptions to this timeline).
Now this table includes pretty much all submissions in a given month. By now the majority of cases will have been processed – so I don’t think a reduction in the waiting time before processing starts is unreasonable – but that is common sense talking and KCC don’t seem to work under the laws of common sense. We know that KCC haven’t even been looking at DS260s for 3 to 4 weeks up until recently.
Then the last point is the complexity/speed of the DS260 processing. Not all DS260s process at exactly the same speed. A simple case of an unmarried person from a English speaking cooperative country with limited travel history is going to need less processing time than someone from somewhere such as Iran and with a spouse and 2 kids over 18.
So – as I mentioned before – submitting your DS260 is a gamble. I would expect to see an increase in speed soon – at least until the May 2016 influx of work BUT I would not want to bet my own case on that gamble!

I am a Dv 2016 winner, case number is AS49** , when i apply first for the DV lottry, my year of birth is 1986, i submitt my DS on 7th of August and cofirmed the same year of birth, taking in consideration that it is wrong year of birth, it was a mistake when the authorites issue my passport during emergency situation since long time, i did not correct it. My secondary diploma and my univerdity certificate has a different year of birth which is 1981.
So, i need your help whether i change my passport with the year of birth of 1981, and by this way the passport data conform with my qualifications data, and then unlock the Ds and update my data ? Or go ahead for the interview without unlocking my DS ?

Your documents (birth cert and passport) should match. So, correct that mistaje, then make sure your ds260 matches those documents.

The number is current already, so it should have been scheduled already, BUT the reason you have been delayed is because you sent the DS260 late. The processing takes around 3 months. I would expect you to be interviewed in March or April.

Why do you want to unlock?? You can’t add the baby until the baby is born – so there is no need to unlock now. Once the baby is born, there are procedures to add the child to the case if the birth happens before of after the interview. So for now, you just wait…

Well if you do it immediately they will unlock fast and you could have it corrected and resubmitted within a few days. The changes won’t require reprocessing – but you should do it fast as you will probably be announced as current in about 10 days time (April interview)

I haven’t got 2NL, but visa bulletin for April (under March bulletin) indicates that my interview will be in April, but I have got to unlock and make changes as follows:
1. Remove my “Other Name Used” because it’s not in my documets (the principal applicant), I haven’t legal document for such name.
2. My spouse wanna remove her “Other Name Used” as well for same reasons, and change her “Year of Graduation” from secondary school.
3. Change our Affidavit of Support info.
and
4. Update our current address.
Now, can these changes delay our interview?
Should we do them now, or wait till we receive our 2NL?
Having been successful in changing these info, will we still be questioned in the interview about those info that we remove???

You probably cannot unlock now – if you email KCC they will probably tell you the case has been scheduled.
For 1 & 2 I would not recommend a change. There was obviously some reason you listed these names – regardless of the documents you will present.
3 & 4 can be changed at the interview.

None of the 1NL letters come from the embassies. They are administered by KCC. Obviously you have delayed yourself with a VERY late submission, but hopefully they will process it quickly. If you are from Iran, however, you might take longer to process, and since there is a high chance of AP for Iranians, the delay you have caused was not a good thing.

Yes, I am from Iran and I actually delayed myself based on this very post of you which you have posted last year in these days and so I thought it would be safe to postpone submitting my DS-260. The main reason based on which I delayed my form was the fact that I have not finished my 12th year of high school until a week ago. And I remember few months back I read a thread somewhere in which a person was acknowledging the audience if they believe they don’t meet the requirement of DV program–e.g. successfully completing 12 years of high school–it’s best not to submit their DS-260 form because if they do and they go to the interview and they’d be rejected then they will be added to a blacklist based on which they’d loose their opportunity to get the US visa in other ways whatsoever! Anyway, sorry for the long comment, but as I am 23 years old, I didn’t work after high school and I was exempted from military service, do you see the possibility I can go through AP? and if so, is the end of September 2016 also the deadline for the administrative processing? Or if I get the interview, say on September, and I go through AP, can I have the chance to be clear few months after the September?

You could have submitted your DS260 before the completion of year 12 as long as you don’t interview before you have completed year 12 (or met the standard required) and have the evidence. It seems you misunderstood what I would have said on another case.
Chances for Iranians to go on AP are high. They are highest for people who have worked for the Iranian government or been in the Iranian military. If you have paperwork showing you were exempted, that will reduce your risk.
IF you were to be put on AP – that process (FOR IRANIANS) typically lasts about 4 months – so, for Iranians, it is wise to get an early interview if possible. Iranians starting AP in June/July onwards have a high risk of not completing the AP in time. So – hopefully you will get a May/June interview and hopefully will avoid AP.

I have won DVlottery 2015 and I am on F1. My case # is pretty good. My lawyer is doing everything for me. Since I am going to adjust my status here, do I still have to submit DS-260 form? I didnt submit that form when I found out I won. I simply went to an immigration lawyer and from the start ( beginning of May, 2015) she has been doing all the things for me. She told me that DS-260 is for those who are doing it outside of the US.

Firstly – you have been selected in DV2016.
Yes your lawyer is incorrect. Most lawyers don’t know enough about AoS for DV cases and make critical mistakes as a result. Your example is one of those. You should have submitted the DS260 – I would recommend you do that now, regardless of what your lawyer says. Toward the end of the AoS case the FO will apply to KCC for your file – the DS260 is what starts the file – so not having done that will cause a delay later. The DS260 needs almost no processing for an AoS case – so there is no downside of delays etc.
I have to say, it is a shame you went to a lawyer – you didn’t need to, since processing the DV process is easy – although I have seen lawyers make it more complicated in well over half of the cases where lawyers are involved.

I have paid the dvlottery fees, did medical exam and my lawyer sent the package with all the docs. My case #UE1600 and my lawyer send the docs in May, then we were told to resend after or on October 1, 2015. We did. I was surprised that she didnt know that dvlottery 2015 winners proccess starts feom October 1, 2015. We shipped on October 1 and got a letter on October 6 saying they recieved it on October 1,2015. Since then we recieved a letter about bio metrics date, I didnt bio metrics on November 17, 2015 I guess. Ever since we have been waiting.
On January 20, 2016 my lawyer contacted immigration and asked them to expedite. She got their response promising to schedule the interview in 30 days from that date. We are still waiting. My case number was like EU1600 ish, so I expected pretty fast proccess.

So your lawyer has shown her inexperience with DV matters in a few ways now. It was silly to try to submit the I-485 in May – there was no chance of acceptance. However, it could have been filed in August as you had been announced current. There is a “policy memo” that describes how early a case can be filed. That link below.
You can also use the same policy memo to “encourage” the FO to act fast. Frankly, the FOs don’t really know how to handle DV cases, so it helps if you are able to guide them through the process – unless you don’t mind waiting of course.
When you say your layer contacted immigration – do you mean the FO – or the main USCIS offices. If it’s the latter (which I suspect) they don’t control the scheduling of appointments at the FO. And in any case there are certain things that must be done in a DV case, one of which being obtaining the DV file as I mentioned earlier.
As for advice – well it’s a little late for that – your lawyer has already delayed things and cost you money you did not need to spend. At this point you just have to wait for the FO to schedule. You are probably pretty close to that now – as your case has already taken more than enough time. I would strongly suggest filing your DS260 – I do think it will help later – and can cause no harm.

If you marry and change your name you use that name on the DS260. You would also list your maiden name in the form. That is normal, and won’t cause a problem.

Me and my wife just learnt our case number (2016AS103XX) is in current for the interview in July this year. Nevertheless, our DS260 was submitted just few days ago (on 5/1). The reason of late DS260 submission is due to our plan of applying graduate schools in the US. If we submit DS260 without being interviewed, the record of DS260 submission might have a negative effect on student visa application. Therefore we decided to submit DS260 later when the case number approaching our one.
After read your post, we think we might do a wrong decision to submit DS260 late. We wonder if you know any case that was truly failed to be interviewed before the end of September due to the late submission. It will be a great help to keep us calm if you could kindly share your opinion / experience with us.
It’s actually our second time to become the selectee of the lottery. Last time (DV2015) we didn’t make it because of the high number and slow number progression in AS. Hopefully we can have a good luck this year.

Hi Simon, my brother just won DV lottery with CN 2017AS000032xx. I guess this is pretty low number, right? Does this imply a higher chance of getting green card?
He just graduated from HS outside US and he wants to apply for F1 visa really soon as he wants to attend college in the US starting this fall. So, should he wait submitting DS260 after he gets his F1 visa approved? He has a pretty low CN so submitting his DS260 in say July won’t put him in a disadvantage situation, right? I have read about dual intent issue and I am afraid that he will get his F1 application rejected if he submitted his DS260 now.
Say if he gets his F1 approved, should he do the “change of status” instead as he will probably be in the US when he is invited for the interview. My last question, will his F1 visa be cancelled before the GC interview? I heard someone said the officer will stamp any nonimmigrant visa with “cancelled without prejudice” even before the interview starts. In this case, he will be in trouble if he does not get his green card approved as his F1 is also cancelled. Please advise. Thank you!

I recently got selected (Oceania) for the DV-2017 lottery. I notice the DS-260 asks for your city of birth. My Australian passport lists my Place of Birth as ‘Perth’ (what I used in the initial entry), whereas my birth certificate lists my place of birth as the hospital in ‘Murdoch’ (a suburb of Perth). Using our local conventions, Perth is the City and Murdoch is the Suburb. Given the Americans use a different convention, do you think this could cause a problem in the application process?

Do you have any suggestion for him not getting his F1 cancelled before he is actually approved for green card at the interview? Should he go with the consular processing then? Or will it not make a difference? I am just concerned that if he is not approved for green card while his F1 is cancelled, then he will be forced to leave the US as he becomes out of status.

It is cancelled AT the intyerview. He switches from one to the other. No issue.

The processing time for the DS260 will be a few months. Then, your case will be scheduled based on the case number. Lower case numbers in each region go first, interviews starting in October.. Interviews will continue throughout the whole year – again – based on case number (which you have not mentioned).

The job offer is something you should get in writing – and if you have a genuine job offer it can help with the interview.
Regarding your son. His condition is not an automatic disqualification for either him or yourselves. However the CO will be aware that it will place an additional financial burden on you – and that may make the CO question the “public charge” aspects of your case.
Finally I would advise you that whilst health insurance will cover your son in the USA, that insurance and the deductibles for your son’s care etc will be expensive for you. Please understand your likely expenses in a country which is very expensive for healthcare.

Salary scales are published on O*Net but vary greatly by area. For instance, someone might earn (for example) $150k in San Francisco and won’t feel well paid, whilst the same person could earn $100k in Florida and be doing well. Check Glassdoor for salary levels.

Are your DV2017 – in that case you have many months (up to a year) to file your DS260. Delaying the DS260 will delay the interview of course, so your second question is in your own hands.

Hi Simon, My lawyer has been extremely passive with my application. The bulletin shows that my number will go current in July. I haven’t submitted my DS260 because my lawyer and I are going back-and-forth for the entire month. Noticed from your blog post that it usually takes few months for the DS 260 to be processed. Today is May 25th, 2016.. Am I at risk at all for not having my DS 260 processed in time? My DV number is AS 105**.

I assume (since you mention a lawyer) that you are doing adjustment of status. You need to take responsibility for your own case. Submit the DS260 asap. The processing time is short at the moment, and for AoS cases is minimal, but submit it anyway. Get it done.
Further, you could ALREADY have submitted your I-485 because of the early filing policy. Your lawyer is probably not aware of that early filing policy. So again. It is your case. Don’t let an inexperienced lawyer screw it up for you!

Is the form for a male of 26 years old or less? In that case the problem is that you need to review the selective service info by clicking the link on the last page. Once you have done that, the form should submit.

My case number is 2017SA0000014X. (South America). Personally, in my circumstances it would suit me well to be granted an interview as late as possible, since I have a lot of things to do in the meanwhile.
Questions:
– How much do you think I can delay my DS-260 submission so I still can be given an interview ?
– Is an arrest and DUI detention a risk for my application to be denied? (dropped charges so no background criminal record, as Chilean justice was very flexible 10 years ago regarding DUI policies)

You could delay submission until April or even early May of next year with no problems.
The arrest shouldn’t be a problem.
