Anyone in ANY region who was not selected in the May announcement should check the ESC site again. I’m sure the draw is a small amount of selectees, so the chances are small – but worth checking – and they will not contact you to inform you. No, you cannot interview before your case is current. If your case isn’t current before he ages out, you will not get a GC for him through the DV process and would have to sponsor him later.

No, there are no solutions. If he ages out, he can’t get the visa. This is a matter of law, the timing of the interviewed is controlled by law and the protection under the CSPA is controlled by law. The CSPA has to have some cutoff point.

The treatment of CSPA is different for DV lottery. It is addressed in the link below which says the following.
“Diversity Visa (DV) Applicants
Section 3 of the CSPA also applies to derivative DV applicants. Because the DV application and adjudication process differs substantially from the application and adjudication process for preference categories, the treatment of DV derivatives will also be somewhat different. For the purpose of determining the period during which the “petition is pending,” Service officers should use the period between the first day of the DV mail-in application period for the program year in which the principal alien has qualified and the date on the letter notifying the principal alien that his/her application has been selected (the congratulatory letter). That period should then be subtracted from the derivative alien’s age on the date the visa became available to the principal alien. ”
What that means (as my article on the subject explains) is that the time between the date the lottery opened for entries (October 2015) until you were notified (May 2016) is calculated and that is added to your childs age. Once that date is met, by the end of that month, your child will have aged out.

My case is similar to Mariem; My case No 2017AF00037XXX; my daughter turns 21 on 19-4-2017; and I did ask you Simon about this case. Your reply to me was very supportive; so I’ve felt a bit comfortable about the case as I understood (may be wrongly) from you: according to child protection law there is a chance to proceed, in addition there is a plenty of time that I might be interviewed before she turns 21 as I submitted DS 260 in earlier August 2016; and never unlock. But sorry to say that your reply to Mariem is not encouraging; it stressed me enough to a state that it pushes me to suspend or even to quit the program. I am a bit frustrated as this will certainly have a significant effect on my daughter. Any advise please?

Your case is NOT similar to Mariem. Your child turns 21 in April, meaning that she is protected by the CSPA until after the DV-2017 program has finished. Mariem has a different issue because her child turns 21 in September, and will therefore “age out” in April. Time for you to read and understand what I have written in the link below. Don’t get yourself confused reading other people’s cases without reading all of it.

I received an e-mail today, stating that I should check if I might be drawn now and…. I AM!! My 1NL letter is also dated May 3rd (which seems to be more of a formality, because I wasn’t selected back then).
It is very late in Asia already (where I am located at the moment), so I will calm down and do the DS260 as soon as I have gone through your guides and am in the right mind and won’t make mistakes 😉
This is all very surreal for now.

Yes, the cutoff for the first draw was probably around 23000 to 24000. The new numbers appear to be around 24000 to 30000 (roughly), which indicates the draw was quite large. I am waiting to figure out the new range for AF and AS regions…

OK so that makes sense. Uzbekistan is a limited country (like Ukraine, Nepal, Egypt and so on), so the 2nd draw numbers for that country will be lower than the overall numbers. That is perfectly understandable (at least to me). Nothing strange about it.

I was selected on a second draw for further processing. My case number is 2017EU29XXX. I completed my DS-260 on 09/08/2016. I am currently in US with B1 tourist visa valid until September 30, 2016.
Is there different processing for the winners in US on the valid non-immigrant visas?
Do I need to leave the country since my legal stay will expire by the time the application gets processed?

You must leave within the B1 stay period. Your interview for a DV visa is not going to happen for almost a year from now, and you must not be in the USA out of status in the meantime.

Like I said, you cannot process your case. You cannot adjust status until your case number is current – roughly a year from now (August or September). AOS from B1 is dangerous anyway – so your best option will be to process in your home country (CP – consular processing).

Got a selection in the second round! DV2017 OC…14xx, less than 1450. It seems high for OC, but I also noticed in your historical data there is no case in which they didn’t get to at least 1450 for Oceania, which seems promising.
I do have a question – I was thinking about not putting in my DS-260 immediately (possible marriage between now and interview) and I’m wondering if that’s likely to jeopardise my case? Reading over the advice on your website it looks like I’d have until maybe March or April at least before they even look at my application.

You have plenty of time. Your number means they won’t get to you until summer next year. Now, as you noticed, your number is high. They were rocking along nicely with a year where they selected few people and everyone was gonna be happy – then they seem to have conducted a LARGE second draw, which could mean the highest numbers don’t get interviews. This has happened in some previous years. You will have a nervous wait until next summer and I will have to do some number crunching to try to guess what the 2nd draw has done.

1. Once you are a US resident you can sponsor him, but it will take a long time (currently the wait is around 6 years). He must be unmarried to be sponsored.
2. Once activated (arriving in the USA) you can leave on the next flight. That first absence can be up to 1 year, subsequent absences should be less than 6 months. However, the Green Card is a residence permit, so you should be in the USA more than another country.

You can be absent from the USA for up to 1 year for the first time, 6 months thereafter. You can also apply for a re-entry permit for up to two years absence.
