So I got an email “KCC DV” with an attached adjustment letter for my case. I got two attachments,
The first is the information for mailing my payment to the US Dept of State DV Program.
The other is pretty much saying thanks the notification of planning to apply for adjustment of status, that I can’t apply until a visa number is made available (which in the vis bulletin isn’t out yet for their fiscal year, and that the fee must be paid before my case can be sent to the USCIS.
So I guess my questions are am I supposed to send my payment now? Because I thought I’m supposed to pay after I do my interview which obviously can’t be scheduled yet. And do I have to do some other paperwork besides the DS-260 that I’ve already done.
Note: I have read information about the adjustment of status because I’m living here as an F1 status student but honestly the AOS information is not as straight forward as I hoped. Thanks.

AOS is not that complicated. You should read the spreadsheet linked from the first post on the thread below. Once you have donw that you will understand better how to handle your case.

I have a friend who is divorced and her ex husband has a son of his first marriage. She only know by pictures now she want to entry to dv2020. The question is: when she does the entry she will put her step son but she does not have contact with him like several years. If she does the entry with out the step son’s will be discualify?

Hello! If I’m correct the visa bulletin says that I’ll be able to do my interview in November (NA Region) however I want to schedule my interview in the beginning of next year instead (about January). Would that be a problem for me to do? I don’t think I’ll have my all my documents so soon. Thanks

If you have not sent in your DS260 yet, hold it back. Otherwise, rescheduling can be tricky and risky. If you have already submitted, email KCC and ask them not to schedule your interview until January.

I’ve already sent in my ds-260 and I got an email confirming I’ll be doing an AOS about a month ago. I don’t have an interview scheduled (which to my knowledge I’m suppose to schedule because its an AOS) I just noticed that the visa bulletin for November has my number available but I don’t want to do my interview in November.
Also, when I do my interview and I am approved from that moment is my status changed or is it not until I receive the physical green card? Yes, this last question was lazy of me because I’m sure I can search it but I’ll take a gamble and hope you answer it anyway 🙂

Grandparents can list the daughter, but not the grandson. So – the daughter should be listed as a derivative, but would not be able to take her son immediately (but could sponsor the child through a two year process). The daughter can enter herself and list her son (but could not take her parents).

You told them that you would emigrate “later”. So – it sounds like they did not process you, and they CANNOT process your case now. Ask the embassy if you want to be certain.

My friend is trying to fill out the application for dv lottery but is confused about his estranged kids. He has a pregnant 17 year old daughter and a 15 year old son whom he barely knows since birth. His name isn’t on their birth certificates and they won’t comply with taking photos for the process. Must he still list them even though there is no proof they are his own?

The rules are that he should list his children – and will need their photos. If he can’t do that then he should not enter.

My friend has submitted the DV2020 and he found that he mistakenly added extra letter to his family name after he submitted his application, so he then filled and submitted another application with the correct last name
1- Is this considered double entry?
2- If it is not double entry and he get selected with the case that has extra letter in his last name will he be able to correct that in the DS260 and proceed with his application without any problem and without being considered that he has double entry at the interview since he entered another application with the correct name?

You are the winner, and your husband is the derivative – correct? Well it sounds like they want to know some proof of what he does, either for security concerns to do with his profession OR from the point of view of public charge. However, there could be other reasons too – I don’t know for sure.

Simon, I would like to give an update about our case that might help others. My husband got on AP. He was requested to fill a DS 5535 form, a new process since 2017. The basically ask you information about the past 15 years travel history, phone numbers you have used, social media accounts. As I’ve read this process can take from weeks to several months to be completed. As per CEAC our visas (mine and my kids) are issued and we are waiting for our passports to be retuned, and my husband’s on AP status. If you have more information or know experiences about this process please share it with us. Thank you.

There isn’t much more to say than you already know. The time of AP varies. If I were you I would be prepared to move without your husband if necessary, because your visa expiry cannot be extended.

Hi there,
I am a DV lottery winner for 2019 in the OCEANIA with a number just above 950. My question is, I just renewed my 01 visa so Im am lawfully in the USA with a non immigrant visa valid till late 2021. I am yet to do a DS_160 yet but I am unsure about whether to do consulate processing of AOS as the numbers seem to be going very slowly and im worried as AOS takes longer that it will expire before i have the greencard. Is it safer and quicker to do consulate processing over AOS, I just want to do which ever one is more likely to get me the GC , whatever cost is and considering using a lawyer so i dont mess this up.

1. Using a lawyer will typically make things worse. There is no need, and no advantage because they do not know the DV process.
2. AOS can be a bit “scary” because you must not go past September 30th. However, most AOS cases can be processed before the end of the year, especially when someone takes advantage of early filing.
3. CP is more straightforward, but you must do the whole process in your home country (medicals, interview then wait for the passport) so being out of the USA for some weeks can be problematic.

I’m lawfully in the US with an F1 visa, I got selected for the DV 2019. My case number got current in November but due to some problems, I couldn’t file immediately. I was thinking for an adjustment but I just recently found that they can take really long so I’m considering changing that to CP instead. But the problem is, I’m taking classes this semester, one is online so I can handle that but the other one is in class. And I’m not sure about the interview dates and the amount of time that I’ll have to spend in my home country. Can you please suggest me something, or give me any ideas on how I might be able to work through this?

Also, I changed it to CP, so they changed my interview location. I had submitted my DS-260 right when the results were out. How long do you think will it take for the DS-260 to process? Like when will they send me the second letter.

It can take a month or two after you submit your DS260 and documents to be scheduled. And with CP you will have to be in your country for around 3 weeks as a minimum (enough to have the medical and then wait for your passport). If you get AP that delay after interview will be longer.

I was aware that I have to scan and send the documents but I didn’t know if it was before or after the interview was scheduled. Also the instruction on the official page said that kcc would send an email asking for the documents (scan copies) but I didn’t receive any such email. ?

I’m lawfully in the US with an F2 visa and my spouse with an F1 our daughter it’s a US Citizen and I got selected for the DV 2019.
My case number is 2019SA000010**, I filled out my DS 260 letting the KCC know that I would like to go for an adjustment of status (AOS), so I went to the ceac website to see my case number status and it says that the case its at the Nacional de Visas (NVC), but when I get into the visa center there are some instructions that say if you are applying for an AOS please notify the NVC and do not ay the fees for the visa center, so in your experience, Should I wait till I get my 2NL? or Should I contact the NVC?

There is kind of delay can see in AS region about document submission than last few months . Why is it stuck situation still now ….And this month any one doesnt receive mail for document submission why is that

People need to STOP focussing on the email. FORGET THE EMAIL. Just use some common sense and submit the documents at the appropriate time.

Hi Brit,
I am qualified for 2019 DV lottery and I have already submitted the DS260 forms for me and alliens. Is there any other documents to submit to KCC in addition of DS260? Also my case number is around AF208100 and till date my case number status is “at NVC”. I really need your help please
