I hear people asking – why is BritSimon telling us a way to get disqualified??
Well every year I get to hear similar stories about what people have done on their DV entry and how can I help fix it for them. It normally goes like this…
“My friends told me to apply as single even though I am married…”
“I was annoyed with my husband and we planned to divorce so I left him off the entry…”
“My child is away in another country so I left him off the form, how can I add my child…”
“I split up from my husband years ago, and although we never got divorced, I did not put him on my entry…”
In every case like that my answer will be the same. There is nothing you can do, you will be disqualified. Every time. Got that? Every time.
So – if you want an easy way to be certain to get disqualified – this is the most obvious and certain thing you can do. Leave a legal spouse or child off your eDV entry. Simple.
Am I making my point?
Now if you are about to enter the DV lottery and want to avoid the heartache, expense, and hassle of being disqualified, this is the single most important bit of advice I can give you.
INCLUDE your spouse, along with any child, adopted child or step child under 21 years old (who is not already a US citizen) on the entry.
It does not matter whether you intend to apply for a Green Card for them as your derivative. It does not matter if you are planning to get a divorce. It does not matter if you do not have custody of your child. IF you have any derivative family that would be an eligible derivative, they MUST be on your entry form.
Now, how about some answers to specific scenarios.
You are separated from your spouse, but do not have legal separation papers. You must include him/her on your entry. Don’t have a photo? Use an old photo or take a photo of a neighbor. If that spouse is not going to apply for a DV Green Card with you, the photo won’t matter. However, leaving him/her off your entry will get you disqualified.
Plan to take the kids at some later date? Put them on the entry. If you win, you don’t have to process their case, but again, leaving a child off your entry will get you disqualified.
Getting the picture?
Ok so the other question I get asked is how will they know. Surely someone could pass the interview and wait until later then bring the spouse/children later – perhaps after the winner is a US citizen. Well let us assume that because of bad record keeping in your country the US embassy does not find out you have a spouse or kids that you didn’t declare. Let’s say you have been living in the USA for over 5 years and now have citizenship. So – you apply to sponsor your children. You will be deported. Your citizenship will be taken away. Because you obtained the Green Card by fraudulent omission, your citizenship will be revoked. So – if you proceed with this and think you can sort things out later, you NEVER will be able to admit the existence of the spouse/child that you left off your eDV entry. Their existence proves your fraud.
So – good luck with your entry. Please don’t make this simple mistake. If you do, I cannot help you.

I made a big mistake! I filled in the wrong country. I know it sounds silly but i was filled in my details correctlyon page 1, went to page 2, went back to page one to check something,assumed everthing on oage 1 was still fine but it wasnt. The browser had entered my coutry if residence as by countrt of birth. I noticed it when i looking the printed form after submission. Can i do another application with the correct country?

I’m from Nepal but I work in Dubai right now and I expect to be in Nepal by the time the results are out. So, what should I put in “Where you live right now” section in the DV? I’ve decided to fill it up myself this time but I’m afraid the photo I’ve edited isn’t up to the standard. I took the photo on my phone and cropped it out using the official DV website photo tool. Should I use professional help for the photo or is that ok?

For “Where you live right now”, enter where you live RIGHT NOW. Really.
If the official photo tool accepts the photo it is probably ok.

Well I’ve sent my application but later on when I checked on Google Green Lottery Photo Validator it seems like my photo is not good… Even I done it in “professional” studio but it seems like all photo studios in my country are unprofessional… Is there any way I can edit my entrance or cancel it and enter again? Will I be disqualified because of this?

I’m sorry to bother you with my question, but I did search all over the Internet, read the all relevant sections of FAM, Act 101(b) and still not fully confident.
I’m legally married, and me and my wife have a natural child.
I never had any other legal/common-law relationship before.
And it’s the only natural child for both of us.
BUT It’s the second marriage for my wife.
She was married and divorced a man that was married before, and he had a child during his first marriage with another woman. And this man was married one more time after divorcing my wife.
My wife never had any relations/connection with his child (kid permanently lives with his father’s mother).
The “9 FAM 102.8-2(F) Stepchild” states that stepchild may continue to be entitled to immigration benefits from such marriage, even though the relationship between the natural parent and the stepparent has been terminated by divorce or by the death of the natural parent, PROVIDED the marriage was a valid marriage and the family relationship continues to exist as a matter of fact between the stepparent and stepchild.
And in case of my wife, “the family relationship between the stepparent and stepchild” never existed.

I submitted my entry with only one child.
This “stepchild relation” came out while we were preparing my wife’s entry…
Am I correct in my understanding the above-mentioned stepchild relationship no longer exists, and this kid is not an eligible child nor a dependent that should be included in my wife’s entry?
And if you still think that he has to be included, did I make a mistake in my entry including only one child and not including him as my STEP-STEPchild because instructions mentioned to include “your spouse’s children”?:-/

That is a complicated scenario – I cannot tell you the answer categorically. If I were in that position, I would not list the child for either of you – but it is your decision.

Here is my question I am hoping that you might be able to answer. After entering the Dvl 2019 i took a screen shot of my confirmation number but I did not know that once you submit your entry you are not able to change your information that you submitted so my question is I wanted to double check all the info I entered is there any way to retrieve that info somehow ? i thought it would be saved on the system ?

I have a handicapped daughter from ex-wife in a very bad situation, she can’t move any of her organs including hands or legs, and she is mentally disabled. She, from time to time, enters Intensive Care Unit (ICU) at the hospital and sometimes she was dying. It is impossible to get a picture of her, i asked her mother to provide a 5×5 picture with white background for her, she said that she never could do so because of her difficult circumstances and she is already considered disqualified because of her medical condition. I think there is an exception for such a humanitarian case. Besides, if necessary, i will never declare during interview if i’m selected and i will never declare that if immigrated to USA. Please note that she will die soon as per doctors and hospitals reports.

Hi, i have a very difficult situation and i am in a fix. i need your answer and possibly some solutions.
i am currently a green card holder through the dv lottery program. i have been here since June 2016. I want to file for my wife and her daughter but im troubled.
1, I married my wife four days before i came to the US meaning that i am still single in the USCIS and departments of home lands records because through out my documentation process i was single.
a, will there be issues if i file for her? we have marriage certificate and pictures to prove our marriage
b, USCIS requires that i submit two documents, that is the marriage certificate and any other documentation that we have a bona fide marriage. Unfortunately we only have the marriage certificate. what do we do?
2, My step daughter bares the same surname as me (just a coincidence) very common in the west and east Africa region. i share two names with her father as well ( that is we share the same surname and his first name is my middle name. he has a different middle name and i have a different first name). My wife was not married to him when my step daughter was conceived and sadly too he (baby daddy) wants nothing to do with her and my now wife. According to my wife they never met again since he got the news of the pregnancy. His family don’t know his were about and all that. Anyway, his name still ended up on the birth certificate of the little girl. Long story short, we moved in together when my step daughter was one and she has known me to be her father till date. My questions are
a, will there be issues when i put her on the I-130 as a derivative of my spouse since we share the same surname and i have two names in common with her father?
b, what options do i have? i am confuse.

The system doesn’t reject all double entries in the first place as you are assuming. Someone might have entered for you – even without your knowledge. The agents in Ghana are doing that. If you have been refused, it is over – there is no appeal process.

but why should they do that.
if someone does a double entry why dont you disqualify the person outrightly but but cruely make the person go through all this months of frustration and uncertainties and and finally do this?

If you think it is unfair, consider who is at fault here. It is either the entrants themselves that create the double entry OR it is because some agent has registered them (possibly with or without their permission). That can only happen if someone obtains a passport style photo of a person and knows their personal details. So – to avoid that, people people need to be more careful with their data and photos. Also – as long as agents get results they will stay around. So – when they enter someone without knowledge and later offer that person the winning details – that person needs to have the moral character to say NO. People in Ghana are not doing that, so Ghana is being badly affected. The people of Ghana could stop this tomorrow – but too many people are allowing and encouraging the agents with success.

Tnx bro for ur empathy it’s not easy for me and ma wife at all, for I Neva thought the could be a way like this to deny me visa, what pain me the most is that I first went for the interview on 23rd with ma wife but my Medicals was not ready so the consulor told me to bring the Medicals for the visa only to inform me on the 30th that I did double entry so they can’t give me the visa
It’s not easy for me and ma wife at the moment but I know God will give us strength to remain strong,
Now I only want to a lawyer to write to the consulor if they can give me evidence of the double entry claim they are saying, cos ma problem is the last time I did the lottery outside my on entry was around 2008 when I was in takoradi,
Since then I’ve only give ma info to my cousins who also went to the state through the lottery to apply for me.
Even as at the 2009, I was single and had not marry, I don’t even recall the person who did it for me as at that time

I would like to ask you some questions regarding green card lottery marital status! I would like to try this green card lottery..but I don’t know what marital status I should mention –
I am in process of divorce with my husband now, he is Armenian and lives in Yerevan, we broke up and I am not living with him any more for 4 months . Hi Brit. I greet u. My sis played as single that is bcz at that time our parents did not like her fiance so they later accepted and she got married in April. They later selected her in the dv in may. So she agreed with her husband not to change her statues so as to secure her chances of not loosing the opportunity or not being scheduled for interview at all.

I already entered the DV lottery as a spanish citizen (I have dual spanish-moroccan citizenship and I was born and raised in Morocco, never lived in spain). Now I’m afraid I might get disqualified because I read something about the country of birth being the only country you should claim eligibility for.

If selected, you will be disqualified because you should have used country of birth.

Your degree doesn’t help. If she does not meet the requirement (either by education OR work experience) then she will not be approved.

My sister entered the lottery as a single person in 2016 .She got married after she had been notified of her selection for further processing.
In filling the DS 260 form she included her spouse as her beneficiary and both of them have been scheduled to attend the interview in January next year.
The challenge is that, the husband’s passport is not ready now and may not be ready before the interview date. Also as we speak the husband hasn’t filled his DS 260 form cuz he does’t have his passport yet.
we want clarification on the following
1. can my sister review her DS 260 form to indicate that she’s immigrating to the US alone now that KCC has processed her case and submitted to the consulate
2. can she attend her interview now and schedule a later date for the husband
3. Must she leave the form as it is and attend the interview without the husband and explain to the CO that the husband’s passport isn’t ready so she wouldn’t be immigrating with him anymore.
4. please tell us her chances of securing the visa in each of the scenarios
5. Please what is their chance of securing the visa if the husband gets his passport before the interview date and joins her for the interview…I’m asking this because my sister got married after she won the lottery

Hi,please I answered the question no that I have no communicable disease but after sending my dear 260 for about a week or two then I went to the clinic to check only to find out that I have,so please what need to be done before the interview date.thanks

The physician will tell you what disease you have. Then check the FAQ for a list of diseases that can cause denial. If you have one of those you may decide not to proceed with the interview.

What exactly “communicable” disease do you have? I read on cdc website that ” only CLASS A” of those diseases causes denial. i.e TB Class A, syphilis Class A etc etc. Brits may correct me if I am wrong. And the good thing is all communicable diseases which cause denials are treatable and curable the only communicable disease which is not curable is HIV and HIV DOES NOT CAUSE DENIAL.(Simon will correct me if If wrong or miss something).
And as little as I know; either TB or syphilis can be cured in 6 months; so I advise you to not panic; talk to your doctor/physician and everything will be fine.

Hi, so I have my interview coming up and I have a question..I was married a few years ago in a Thailand legal office to my then gf….didn’t register the marriage in my home country and we have since divorced…..also in the same legal office in Thailand. I am applying as single but don’t have the papers to prove I was either previously married or divorced! Will this cause a problem?
