The DV lottery instructions seem to confuse people about the main requirements for the DV lottery process. The first requirement is about country of eligibility which I will address in another post. The second requirement is education/work experience. So I would like to address some common misconceptions. The rules say this.
Requirement #2: In addition, to meet the education/work experience requirement of the DV program,
you must have either:
a high school education or its equivalent, defined as successful completion of a 12-year course of
elementary and secondary education;
OR
two years of work experience within the past five years in an occupation requiring at least two
years of training or experience to perform. The U.S. Department of Labor’s O*Net Online
database will be used to determine qualifying work experience.
I highlight the either/OR because that is the first misconception – You only need to qualify by one or the other, not both. If you meet the education requirement you do not have to worry about proving work experience.
The second misconception is that each adult (husband and wife) needs to meet the requirement #2. That is normally not the case (the exception being to do with cross charging which I will explain in another post). The principal selectee only needs to meet the requirement.
OK so let’s look at the two options. The first is the simplest and best way to qualify.
Education requirement
The intent of this requirement is to take in immigrants that have achieved an education equivalent to a USA High School education. Note the “USA” part. They are dealing with immigrants from all over the world and needed to establish some “level” in USA terms that can be compared to other countries. So – the level they chose is High school. This is the point at which an American child has graduated high school and is qualified to enter s US University (college).
The term High school is confusing. For instance, in the UK where I was educated, “High school” ended at 16 years old – and that would NOT be sufficient to meet the DV requirement. In UK terms a child would have to attend 2 further years of education beyond 16 years old (receiving “A levels”) to be qualified to enter a University – and that is the level required therefore. Other countries will have other standards – and each embassy is able to set the level required based on their understanding. This has led to some changes over the years that has caught people out. Some embassies publish specific and quite detailed information such as this information for DV2015 from the Kenyan US embassy or the information from the embassy in Sri Lanka. Sri Lanka by the way was a recent example of changing their standards and there are some sad stories about that on the internet.
There is a page which offers a listing for many countries here. However, be very careful with the information as it is not 100% accurate or up to date and some countries will have varied their requirements (again Sri Lanka is an example).
So – hopefully by now you have understood that there is a minimum requirement for your country. The various embassy websites are a good place to get information on the level required.
Does a higher education satisfy the education requirement???
Another common question I get asked is “I have a Bachelors degree/masters or whatever, surely I don’t have to show my High school A levels/High school diploma”. The answer is a bit of a grey area. It makes sense that someone having gained their masters or whatever must have met the requirements BUT there are some exceptions to that logic. For example, it is possible to obtain a Masters degree without having finished 12 years of elementary and secondary education and for that reason some Consular Officers will be “picky” about seeing the HIgh School level proof. There have been many reported cases where COs have insisted on this and I am sure there have been cases of denials based on this.
Vocational education
The rules specifically exclude vocational education as being used to qualify on education grounds. For example, if a selectee were to leave school at 16 and then immediately or later go into a vocational program such as teaching or nursing, the time spent in that vocational training/education could not be used to satisfy the educational requirement. In cases such as this, the selectee may need to consider whether their work experience is sufficient to meet the requirement #2.
Work Experience requirement
Ok let’s say you cannot qualify on education grounds. It is possible to base your eligibility on your work experience – although doing so is harder than education so you would only use this as a fallback method. Why is it harder, well with education you either do or you don’t meet the requirement. You present your proof and as long as you understood the standard correctly you are done. Work experience cases are “judged” by the CO based on the proof you can supply at the interview. They are subjective therefore – it is a matter of how well you can convince the CO that you meet the requirement.
So ok – what is the requirement? The instructions say it is 2 years experience, gained in the previous 5 years, in a job that meets the standard described in the O*Net database. The standard to be met is a job that is classified in job zone 4 or 5 with a SVP (Specific Vocational Preparation) rating of 7.0 or higher. Not all jobs will meet that criteria – it is generally jobs which require a higher level of education, or skills.
How do you check your job? Well you navigate to the O*Net database and enter your approximate job title in the Occupation Search field. You will get a list of similar jobs and you should find the one that is closest to your work by title. For example I typed in “teachers” and from there I chose “Kindergarten Teachers, Except Special Education“. Scroll down the page and find the section “Job Zone” as shown here:-
You can see that Kindergarten teachers is a job at the correct qualifying level. However if you look at a Teachers Assistant – then you can see that is NOT a qualifying job.
Sometimes of course your exact job title will not appear. You can choose a similar job that explains what you do and if necessary you might want to detail your job duties to show they align well with the skills, tasks and so on of the job you wish to use as proof.
How to present the case…
OK – you believe you have found the right job description in the O*Net database. You are soon to attend the interview – how do you prepare.
Well first of all, you have to understand that your credibility will come in to play. The CO has some latitude about how they approve these work experience cases, your task is to give them a good case to be able to approve you.
I would suggest preparing a well organized and professional looking file to include as much as possible of the following:-
- The print out from of the job to which you are aligning your experience.
- Employment letters such as job offers, promotion letters and so on.
- Letters (preferably notarized) from current and former managers, colleagues and so on.
- A description of your day to day duties in the roles covering a minimum of 2 years.
- Details of any vocational training or education that supports you in your job.
- Examples of work product if possible/applicable.
Make this as complete as possible. As I said your credibility counts, so look professional, have a professional demeanor and make sure what you present is well presented, free of typos etc. You generally should not need professional help in preparing this file – and if you think about it the use of a professional could cause the CO to question whether yuou are really at the level you are claiming.
It is worth spending some time on this point, if you fail to convince the CO and have not qualified on education you will be denied and there is no appeal process (if processing outside of the USA).

Simon, I was selected for further processing in DV 2021. I completed my high school in Bulgaria and went to college in the US. Hey Simon! I’m a SA selectee in 2021. Got a couple of questions. I’m not quite sure what to put in “Course of study” and “Degree, Diploma or Certificate Received”. I went to high school and got a degree that in my country is called bachillerato. And the US recognizes the bachillerato as the equivalent of the high school education. For that i’m calmed. But i don’t know exactly how to fill that part. As i’m applying trough the education requirement i want to be as accurate as possible. Plus, the thing about translating the documents would be for the ds260 form or for the interviews?

You probably meet the education requirements, but to be clear, having done a pilot course without having the actual work experience is not going to meet the requirement, especially as the job rating is too low.
Start with current occupation, then history is added starting with most recent.

Hello Simon.. I have been selected for further processing DV lottery 2021. Like you I have gone through the British educational system. Got 3 A/Levels and bachelors degree. To make matters more complicated I have changed my name, so the name on my A/levels diploma is not the same as the one I am using now. In terms of job experience I have been employees for the last 5 years, but based on the department of Labour website my job is categorized as Zone Two:

This is quite a long one but kindly bear with me. I have 3 questions.
1. Our high school terms and college semesters are such that we are housed in school and have breaks where we return home for about a month or two. In filling the “Previous Address”, am I to fill in the address for the term (i.e. school), the address for the break (i.e. home), the address for the previous term (i.e. school), the address for the previous break (i.e. home) repeatedly? This will make 18 of 2 same addresses being repeated just for high school since we have 3 terms and 3 breaks in high school each year and 12 of 2 same addresses being repeated for college.
2. I will have 2 years of work experience in August 2020 in a job classified as job zone four. My case number is 2021AF3xx. I will like to know if I can qualify based on work experience if I select that now and submit since the interviews will start months after August. What will you advise?
3. I started a job and quit a few days right after starting without taking any salary. Do I have to state that in my employment history as I will not be able to prove or show any documentation that I worked in that company?

Hi Simon, Thank you very much for your blog, it is very useful and convenient. I am from Kazakhstan and I also have couple of questions regarding the education section of DS 260 application form.
1. Is it necessary to include elementary school information?
2. In Kazakhstan when graduating 11 years of school, you receive diploma of graduation of “Secondary school” though actually it is equivalent of graduating high school in US. So is it okay to put “secondary school” to the name of institution section? will it be considered as graduating high school? or to be safe it is better put “High school”?

Can I apply for the DV lottery? if i only have IGCSE certificate, (which also allows me to apply to University in my country .) But i have not yet done my AS -level. May you please give me clarity on this because according to the DV lottery information about education level, I read it states if your education level permits you to apply for University, it is equivalent to the U.S. high school certificate. Seen my IGCSE certificate allows me to apply to University, can i apply for the DV lottery with it.A little background information about our education system in my country, Our government recently changed our curriculum, so we are getting Our grade 12 certificate, also known as the senior secondary school certificate or the IGCSE certificate, in grade 11.We can now either leave school at the 11th grade and apply to University or we can proceed to the 12th grade, which is known now as the AS-LEVEL. The only problem is that I wanna apply this year for the DV lottery. I am getting my senior secondary school certificate this year and my AS-level next year so if i win I would have to show my senior secondary school certificate for this year because I am only getting my AS-level certificate next year in November after the interviews. Can I apply for the DV lottery this year and show them my senior secondary school certificate for this year at the interview if i win cause won’t be able to show them my AS-level certificate at the time of the interview cause i am getting my AS level certificate in November or December.

Hello sir.
I have a high school certificate and then went on to complete 2 bachelors degrees. However my high school certificate is in a different name (my step dad’s name). It was never a legal name. Just a name I grew up with. Once I graduated high school I switched back to the name on my birth certificate. I don’t know how to prove that the high school certificate is mine. I do have year book photos, and a letter signed by my step dad, but I am nervous.
1. Could I just use the high school certificate and explain at the interview? (Along with the year books, letter and my university degree). Or should I just go with my work experience? (primary school teacher for the last 10 years).

I am a winner of Dv2021. I have completed my ds260 choosing the highest education level “university degree”. My big concern is that in the first application i choosed “master degree”. Is there any problem? Should i unlock the ds260? Can you advice me please

Sir me rajsu from Nepal DV 2021 winner case no AS70000, i already send required documents as per demand by KCC and it was completed 6 weeks I have only received auto reply no receive congratulations mail, then again after 6 weeks completed 1 week ago I again I send required documents but still there is no reply except auto reply please suggest me what can I do? Do I contact KCC or should I wait for more few days?

Take whatever documents you want to the interview. You just need to meet the education requirement. No extra points for exceeding it.

i do not have higher school diploma to meet the education requirement. if i go in work experience ground are they consider education requirement as well??? i have associate in IT and working in sales over 9 years.

This is well described in the article above. If you don’t meet the education requirement, they will evaluate your work experience. Sales would not typically meet the requirement – but read the article above to understand better.
