The DV lottery instructions seem to confuse people about the main requirements for the DV lottery process. The first requirement is about country of eligibility which I will address in another post. The second requirement is education/work experience. So I would like to address some common misconceptions. The rules say this.
Requirement #2: In addition, to meet the education/work experience requirement of the DV program,
you must have either:
a high school education or its equivalent, defined as successful completion of a 12-year course of
elementary and secondary education;
OR
two years of work experience within the past five years in an occupation requiring at least two
years of training or experience to perform. The U.S. Department of Labor’s O*Net Online
database will be used to determine qualifying work experience.
I highlight the either/OR because that is the first misconception – You only need to qualify by one or the other, not both. If you meet the education requirement you do not have to worry about proving work experience.
The second misconception is that each adult (husband and wife) needs to meet the requirement #2. That is normally not the case (the exception being to do with cross charging which I will explain in another post). The principal selectee only needs to meet the requirement.
OK so let’s look at the two options. The first is the simplest and best way to qualify.
Education requirement
The intent of this requirement is to take in immigrants that have achieved an education equivalent to a USA High School education. Note the “USA” part. They are dealing with immigrants from all over the world and needed to establish some “level” in USA terms that can be compared to other countries. So – the level they chose is High school. This is the point at which an American child has graduated high school and is qualified to enter s US University (college).
The term High school is confusing. For instance, in the UK where I was educated, “High school” ended at 16 years old – and that would NOT be sufficient to meet the DV requirement. In UK terms a child would have to attend 2 further years of education beyond 16 years old (receiving “A levels”) to be qualified to enter a University – and that is the level required therefore. Other countries will have other standards – and each embassy is able to set the level required based on their understanding. This has led to some changes over the years that has caught people out. Some embassies publish specific and quite detailed information such as this information for DV2015 from the Kenyan US embassy or the information from the embassy in Sri Lanka. Sri Lanka by the way was a recent example of changing their standards and there are some sad stories about that on the internet.
There is a page which offers a listing for many countries here. However, be very careful with the information as it is not 100% accurate or up to date and some countries will have varied their requirements (again Sri Lanka is an example).
So – hopefully by now you have understood that there is a minimum requirement for your country. The various embassy websites are a good place to get information on the level required.
Does a higher education satisfy the education requirement???
Another common question I get asked is “I have a Bachelors degree/masters or whatever, surely I don’t have to show my High school A levels/High school diploma”. The answer is a bit of a grey area. It makes sense that someone having gained their masters or whatever must have met the requirements BUT there are some exceptions to that logic. For example, it is possible to obtain a Masters degree without having finished 12 years of elementary and secondary education and for that reason some Consular Officers will be “picky” about seeing the HIgh School level proof. There have been many reported cases where COs have insisted on this and I am sure there have been cases of denials based on this.
Vocational education
The rules specifically exclude vocational education as being used to qualify on education grounds. For example, if a selectee were to leave school at 16 and then immediately or later go into a vocational program such as teaching or nursing, the time spent in that vocational training/education could not be used to satisfy the educational requirement. In cases such as this, the selectee may need to consider whether their work experience is sufficient to meet the requirement #2.
Work Experience requirement
Ok let’s say you cannot qualify on education grounds. It is possible to base your eligibility on your work experience – although doing so is harder than education so you would only use this as a fallback method. Why is it harder, well with education you either do or you don’t meet the requirement. You present your proof and as long as you understood the standard correctly you are done. Work experience cases are “judged” by the CO based on the proof you can supply at the interview. They are subjective therefore – it is a matter of how well you can convince the CO that you meet the requirement.
So ok – what is the requirement? The instructions say it is 2 years experience, gained in the previous 5 years, in a job that meets the standard described in the O*Net database. The standard to be met is a job that is classified in job zone 4 or 5 with a SVP (Specific Vocational Preparation) rating of 7.0 or higher. Not all jobs will meet that criteria – it is generally jobs which require a higher level of education, or skills.
How do you check your job? Well you navigate to the O*Net database and enter your approximate job title in the Occupation Search field. You will get a list of similar jobs and you should find the one that is closest to your work by title. For example I typed in “teachers” and from there I chose “Kindergarten Teachers, Except Special Education“. Scroll down the page and find the section “Job Zone” as shown here:-
You can see that Kindergarten teachers is a job at the correct qualifying level. However if you look at a Teachers Assistant – then you can see that is NOT a qualifying job.
Sometimes of course your exact job title will not appear. You can choose a similar job that explains what you do and if necessary you might want to detail your job duties to show they align well with the skills, tasks and so on of the job you wish to use as proof.
How to present the case…
OK – you believe you have found the right job description in the O*Net database. You are soon to attend the interview – how do you prepare.
Well first of all, you have to understand that your credibility will come in to play. The CO has some latitude about how they approve these work experience cases, your task is to give them a good case to be able to approve you.
I would suggest preparing a well organized and professional looking file to include as much as possible of the following:-
- The print out from of the job to which you are aligning your experience.
- Employment letters such as job offers, promotion letters and so on.
- Letters (preferably notarized) from current and former managers, colleagues and so on.
- A description of your day to day duties in the roles covering a minimum of 2 years.
- Details of any vocational training or education that supports you in your job.
- Examples of work product if possible/applicable.
Make this as complete as possible. As I said your credibility counts, so look professional, have a professional demeanor and make sure what you present is well presented, free of typos etc. You generally should not need professional help in preparing this file – and if you think about it the use of a professional could cause the CO to question whether yuou are really at the level you are claiming.
It is worth spending some time on this point, if you fail to convince the CO and have not qualified on education you will be denied and there is no appeal process (if processing outside of the USA).

I am in Zambia and I did Cambridge International Examination – GCE, on the American embassy website there is no information that can help to confirm if this O level qualification is equivalent to a USA High School education. It’s an international qualification and I have noticed that it’s acceptable for countries like Malawi/Ghana/Botswana – according to immihelp.com.
Seeing as it’s an international qualification and it’s acknowledged in other African countries is it safe to say that I can also use it here in Zambia?

Boateng, the O level alone will not meet the standard as one could not enter University with only the O level without the Advanced Level Cerificate. Remember the standard is that the completion of the secondary education that immediately qualifies you for entry into university. Hope this helps.

I am from Eritrea, East and Horn of Africa and I am one of the selectee of DV-2018 so my question is as follow:
1. Since I have filled details of both in DS 260, do I need to present evidence of what I put on the form to cover both? Hi Brit, could you please tell is it necessary to have all 12 years of secondary education?
For example, in Ukraine we should complete 11 years/grades to get full secondary education completed and to receive a certificate which allow to enter universities.
So that, we receive our certificate after 11 years/grades, but not 12 as in the U.S.
Could it be a problem to qualify for DV-visa via education requirement?

hello Brit, thanks for this wonderful site, i have got a lady with whom i have got a child with,i didnt include her on my initial application for the Dv because she had a contract with work at UAE but i included the child and we were selected. she is saying that she can terminate the contract come back join me when am called for my interview with the child,we are not officially married but staying together before she went for work.. she is saying i should also add her on the form 260.

It is the point at which American young adults can enter “college” (meaning University). Usually that is at 18 years old in the USA – and represents High School graduation (successfully graduating from year 12).

Follow up question Brit,if “at least” was added recently why should some CO not follow the rules because university certificate is also formal cause I believe in their own wisdom they know the reason of added at least. Example if you refuse someone on the basis of provided only above senior high certificate can that person sue that embassy for breach of contract because that person read the rules and regulation before he/she invested time and money and submitted the form. NO! You cannot sue for “breach of contract”! Immigration is not a right, it is a privilege. The COs are able to interpret the rules as they judge fit, based on their local knowledge.

thanks for the wonderful response Mr. Simon..there is another issue confusing me i need to be clarified about. i finished high school and never went to the college or university because i never had cash and my level of education ended there..but besides, my grades were low but i did not fail.. am worried about the embassy to be concerned about my low grades on finishing high school.. i am self employed with an internet cafe as an office where,i do computer repairs, update software, programming computers..my worry is am not a professional but i just learnt computer repair,programming etc from a friend and through the experience at work and learning on job,i have got to realize so many thing around computers and for sure, am more of a professional though not.. 1. if i dont qualify on education because my grades on finishing high school are low, can u please help me know how i can address the issue of work experience because am not a professional but i have and experience of 4 years in computer repairs and programming? thanks so much

Thank you for your post, I am DV 18 selectee and I have 2 questions:
1. I am qualified on high school equivalent education but I also work as a software engineer(without college degree) and I checked the “this job requires 2 or more years of experience…” option. As software development requires 2 years or more of experience(I am working as a developer for 2 years, in the last 10 months I work for a NASDAQ company and the rest as a freelancer), so my question is, was it the right thing to do to check the 2 years work option? can it make me disqualify although I qualify by education ? Should I ask KCC to unlock the form and change it?(though I don’t want any delays as the interview should be in around 3 months)
2. I have changed my address since I submitted the DV (end of contract), should I ask KCC to unlock the form and add the new address? Is it crucial?

please advice how is it correct to fill in information about education.
In Ukraine and major of the PostSoviet countries there is 11 years’ school, which consists of 11 grades and after completion graduate receive a certificate called ‘full general secondary education certificate’.
Usually 10th and 11th grades are considered as a high school.5-9- middle.1-4 primary.
I have studied all 11 years in ONE school and received a certificate about full secondary education, then entered university and received my Bachelor’s and Master’s degree.
Now I am confused how to enter all this in the DS-260 in a proper way.

1. Should I count my school, where I received full secondary education, as 1 institution, or I should enter it like 3 institutions with the same name but different levels of education (primary,middle, high school)

Education systems vary by country – and you haven’t told me your country. I also don’t know requirements for your embassy, and don’t track requirements by all the embassies. So – check your embassy to see if they say anything about the level of education required.

Work as a sales person won’t help you qualify, so it will depend on whether your education meets the requirement for the embassy. Pick the education level you feel is right – it doesn’t affect your chances of selection.
About your desire to win – don’t plan around winning the lottery. Your chance of winning is less than 1 time in 200 years of entering.

Hi Simon, thanks in advance for your advice. I’m In NZ and am having trouble with the educational options. I have a Diploma from University. Is this classified as vocational school or university degree. I know I don’t have a ‘degree’, but it was University grade study. So am unsure which to put as I don;t want to be disqualified if selected. The equivalent to my diploma is an associates degree in the US as far as I can find, and the ONET rating is job zone 5 SVP range 8.0 and above.

dear brit simon when i fill my ds260 form i only add my degree, but before a week ago i have unlocked my ds 260 form and add my highschool certificate but i have seen a minor error which is on a date of i start high school it should have been 2004 but i said 2003 i made a conversion error is it a big issue, shall i unlock my form again? thanks in advance for ur kind responses.
