Is it recommended to be a plaintiff of Siskind’s “IV Ban Litigation” lawsuit as a DV2020 VISA holders with PP10014 annotation? What’s your advice?
Thank you and always appreciate your help Brit!

Each person needs to decide for themselves. I have some recent articles/videos discussing it – please take a look.

I got my visa back today. But it seems that there is an error on the paper which is stuck on the sealed envelope (immigrant data summary). My city of birth and my city of residence have been reversed (one in place of the other).
1. Will this be a problem for me?
2. What is the action to take in this case?
3. By the way the CO said that I could travel tomorrow even if I want to but I should not go through France. Is it really possible?
October 17, 2020 at 1:50 pm
3. Only if the visa you have is a replacement of one issued prior to April 23. Otherwise, NO.

Hello Simon! I hope you are well! I spent my interview at the Yaoundé embassy with my wife and my newborn son. The consular agent put us in PA and asked me to go fill the ds260 of the newborn and to come back later he gives us the visa what we did and we came back he gave us the visa except that by asking us to do it he unlocked my ds260 for me and created my son’s without unlocking my wife’s ds260. He said to me “as it is you who are the main winner I unlock that your ds260 it will go like that” I went on the internet and I declared my child in my d260 and I filled his ds 260 to him and we came back he gave us the visa. My question is the following! As my wife did not declare my son in her ds 260 at the border police this will not be a problem for her as for me?

Please can September 30th Visa hollder book a flight, pick up December 31 from their Designation and arrive January 1th in the USA and will not be a problem?
October 18, 2020 at 4:32 am
That is obviously a risk.
October 18, 2020 at 7:04 am
Thanks for your understanding
October 18, 2020 at 4:46 pm
Brit, what kind of risk you mean?
October 18, 2020 at 11:17 pm
It’s just a silly gamble. There is much unknown, why not just wait for the election at least…
October 18, 2020 at 4:56 pm
By risk do you mean a possibility of the ban extension and potential lockdown because of covid, or there is something else we should consider in the scenario described baby E.G.
October 18, 2020 at 4:57 pm
October 18, 2020 at 11:18 pm
Lots of things unknown. COVID, election outcome, extension. People just need to wait…

Hi brits, I’m dv 2021 winner with relative high case number (af52 xxx ). It just came to my notice that was a law suit to be filed for dv 2021 winners and it is rather unfortunate that today is the dateline. What can I do to be part of this lawsuit and benefit from their decision if my case is not called for due to the trump band
October 18, 2020 at 11:15 pm
With a high case number there is little point in participating in the suit. Just be patient.

I am dv 2020 winner , case eu 228**
1.What do you think , how long will all this process take?
2.We are waiting for judge final decision?
3.Is there any chances for my case n ?
October 20, 2020 at 8:37 pm
1. Weeks to months.
3. I don’t know. It depends on your case status, the judges decision and so on.
October 20, 2020 at 11:03 am
Dear Mr Brit Simon,
Any update on DV 2020?. I am still hoping to be interviewed (:

October 20, 2020 at 12:18 pm
First of all thanks for your great effort for informing us with the latest news.
I’m a dv2020 winner but never get the email about whether they had scheduled my interview,
my question is if there any action i can do with my embassy to ask about my chances in the 9,095 diversity visas to be reserved. Also i need a solid lawsuit decision (my be online form) about Gomez case results so i can attach it in the email i attend to send.
Thanks in advance.
October 20, 2020 at 8:41 pm
No you cannot ask the embassy of KCC anything at the moment because no final judgement has been made. You need to wait.
October 21, 2020 at 2:09 pm
thanks sir but i mean the United State embassy in my country not the KCC one , sorry for the misunderstanding.

I would like to share my experience, it might help other people with similar case than me.
I am a dv2020 winner from Tunisia and I was in group 3 (interview in May cancelled). I got my visa on September 24th. The embassy agent told me that I could travel to the US as long as I go through Turkey or Qatar (not Europe).
I emailed the CBP to ask them if my case is allowed to enter the US and they were positive (I can forward their answer to your private email). So I booked a flight from Tunis to Chicago through Istanbul on October 18th. The procedure was smooth and I had no problem. They only asked me where I have been for the last 14 days. They never mentioned the Trump ban at all.
I believe dv2020 visa holders are allowed to enter the US even now as long as they don’t pass through a country mentioned in the ban (Schengen zone, Brazil, China, etc.)
I hope it will help
October 21, 2020 at 12:13 am
Thank you for sharing your experience. Could you please specify what CBP is? Also, do you have any inscription on your visa, smth like exception or anything else?
Thank you in advance!
October 21, 2020 at 12:41 am
CBP (US customs and border protection).
Yes there is an annotation: exception under PP on risk to labor market. This means that I have been issued a visa despite the COVID-19 ban. That has nothing to do whether you can the US the us or not.
October 21, 2020 at 1:02 am
Ok. Thank you for that! I’ll try to contact them too…
October 21, 2020 at 2:04 am
I’m from jordan , how can I contact you?
October 21, 2020 at 2:36 am
The best people that they can help you to answer your questions are the CBP https://help.cbp.gov/s/questions?language=en_US
In topic: put entering and exiting the us
In description: describe your case to them
They answered me within 10 days
October 21, 2020 at 5:17 am
Thank you Mahmoud and good luck, best wishes, congratulations, thank you for sharing your experience.
October 21, 2020 at 10:13 am
Mohamed thankyou for sharing your experience with Simon and us. I would like to ask you as you you said *exeption under PP* . Is it stated : Entry Subject to PP10014 to your visa or exeption under PP
Many thanks again.
October 21, 2020 at 10:53 am
No, it stated only: exception under pp on risk to labor market.
October 21, 2020 at 2:37 am
Thanks for that Mohamed, and yes please send the email to britsimon3 at gmail.
I think you were smart to ask CBP and I’m thrilled for you that you got in. However, I just want to add a dose of caution. When we started getting people being issued, I had stated my opinion that “some” people would get through because a) Airlines have no idea about the ban and b) CBP officers would not all understand that some people could hold visas, but still be affected by the ban.
Since then I have heard stories both ways – some cases that got turned away at the POE, and others that got through. There is certainly some risk, even if the CBP give you an email that suggests entry is OK. It is ultimately up to the CBP officer.
However, to be clear, I am 100% certain that the ban is *supposed* to stop someone entering the USA. But since we have created this “odd” situation – the “system” is not operating effectively which some people (such as yourself) will successfully exploit. But once in, there will be no further downsides.
Welcome to the USA!!
October 21, 2020 at 11:02 am
Hi Brit !
As Mohamed stated above on his visa was written **exception under PP** not **subject to PP100014**… I guess this is why he was allowed to enter US , right ?
On my visa is written **subject to PP100014** and the CO made it clear to me to not enter the US before 31.12.
October 21, 2020 at 11:12 am
But I just they are the same meaning unless Mohamed is qualified for one of the national interest exception.
October 21, 2020 at 12:11 pm
I agree. the annotation on Mohammed’s visa is giving him an exception to the proclamation as opposed to others that are “subject to the proclamation.”
Thats how i understood it
October 21, 2020 at 1:03 pm
No, the exception’s annotation means that the visa is issued as an exception during the COVID-19 ban. It is not equivalent to the national interest exception
October 21, 2020 at 3:55 pm
@Mohamed is correct. The annotation does NOT mean he was exempt from the ban. He was admitted because as far as “normal procedures” are concerned the CBP operate under the understanding that a valid visa means you can enter. That is exactly WHY the government had their no visa policy which the Judge found unlawful. They could not have changed their procedures overnight, and whilst some CBP officers would be aware of the ban restrictions they would not be expecting to turn away people holding visas. Only a very switched on officer would understand what was going on.
This chance (that some people would be able to enter) was predictable, and I had predicted it.
October 21, 2020 at 3:56 pm
To reiterate though – some people HAVE been turned away. So – unless you have money to burn on a flight, and don’t mind the chance of being turned away, don’t try it.
October 21, 2020 at 4:33 pm
Thanks for your clarification Simon. I am tempted to try my luck. Perhaps I will go through a blue state !
lets say that I was able to enter the US before the PP expiration, would USCIS still process and issue the green cards ?

October 21, 2020 at 9:40 pm
Dear Mohamed, hello.
I’m DV-2020 winner from Ukraine. We got our visas renewed on September 20th. But in the principal applicant Visa we have notice “entry subject to pp 10014”. And our Ukrainian embassy of the USA replied us that we don’t have permission to enter the USA before pp10014 ixpired expiration date.
So could you please tell if there in your immigrant visa you have the same notice (entry subject to pp 10014)? Is there any chance to get from you a private mail with screenshot of your mailing with your local US embassy where they confirm that you can enter the USA(if yes, we will send it to our local US embassy in Ukraine)?
October 21, 2020 at 11:37 pm
@Valetyn Your scenario is entirely different to the scenario Mohamed faced. In his case he should NOT have been able to enter, but was able to do so because the CBP are not well organized.
In your case if you hade a visa before April 23 you ARE entitled to enter before the end of the year, but the reply from CBP that Mohamed received would not directly prove that.
So – if you are in need of entering before the end of December – go ahead and try – as long as you understand the risk (wasted time and money).
October 21, 2020 at 5:16 am
If CBP turned us to go back , they will cancelled our visa or still we have it valid and we can still use it if the ban not extended.
October 21, 2020 at 2:14 pm
They would not cancel the visa.
October 21, 2020 at 3:03 pm
That’s looking good, So they will not stamp reject or denied on our visa or passports?
Thank you Simon

Try again later.

Hey Brit, my name is Robert and my case # is AF48xxx. Initially I was worried about my high #. But after watching ur video on how case #s are developed and all the processes thereafter, I hot hope that it doesn’t necessarily mean that there are 48,000 persons ahead of me. I just have to be patient and wait. Thanks a million.
