So just around 24 hours ago I published a form where people could provide their details in order that the legal team from the AILA could pick some representative plaintiffs in various countries, regions and stages of the process.
The response has been overwhelming – we have over 1100 cases who have offered to be plaintiffs – covering well over 2000 selectees with family. At this point I am going to close the form, because pretty much every scenario and region has been represented, and from many countries. Some of you decided to describe your circumstances, and what the lottery has meant to you and your families. The stories are heartbreaking, and I don’t believe any decent person could remain cold-hearted when reading these stories. I won’t be publishing any specifics from these stories to respect your privacy, but you have been heard, loud and clear.
The team of lawyers at AILA and the Justice Action Center wanted me to make sure that you all know they have heard you, they aren’t ignoring you, and they will do all they can to fight for you.
So what will happen next.
Well the lawyers have had realtime access to the data collected in the form. So they have all the names, case numbers family names and so on. They need to go through the list and pick (somewhat randomly) cases that “represent” a group of people. So – that means if they had 100 cases from a region all at the same stage, they would not need to list all 100 names as plaintiffs, but they would pick one or two of those names. In that way they will build a list of cases/names that represent all selectees in the same position. This is important because if they win, they win for ALL the selectees, whether you are named or not, whether you filled in your details or not. That is what they are trying to achieve.
Now – it is NOT possible to predict the outcome. These are an excellent team of lawyers and have been successful in challenging and blocking the government multiple times before. But there are no guarantees – it will be up to a federal judge to decide.
Some have asked when the court case will be filed and heard. I can’t predict that exactly, the lawyers need time to prepare a case, it is not something they should rush, but they are aware of the time sensitivity.
Some have asked will this go to the supreme court. Well – to get to the supreme court, a case must first be heard in a lower court – in our case a federal court. But it’s important to note that a federal court has the power to issue a TRO (Temporary Restraining Order) which could immediately block the Executive order. That court would consider doing that if people are being harmed by the EO (which of course, is clear). That is one possible outcome, though not guaranteed. The court would then set a date for a later hearing, but in the meantime the EO would be blocked. So – that would be a great outcome. There are perhaps other ways it could work out, but we will see in due course.
Of course, we STILL have the problem that the embassies are closed. Challenging the ban does NOT force the embassies to reopen. So – we much continue to monitor the opening strategies by the embassies. But the legal challenge, if successful, would at least give us the most time possible before the deadline of September 30th.
Regarding the deadline of September 30th – it cannot be extended. Once we are past that date, any remaining chances are gone. All we can do is hope the legal challenge works AND that the embassies reopen.

Hi Guys! I have seen some of the people who are extremely bothering. Why? I am the one also gonna lose this lottery but it doesn’t bother me b/c I am borned to live not only in US and you also. We don’t know also our futurities even we are at U.S meaning that we are not sure life will be ok at U.S. but I am not saying lossing a lottery has no a bit low feeling like other unwanted feelings.

As per the 2 links & snippet of the write up I have posted here, US Government/Administration has said that till date no any DV case is denied based on the grounds of EO/proclamation.
1. If this is true, does it mean that closed embassies due to COVID-19 is the only challenge we are facing here?
2. Proclamation specifically talks about VISA categories H1B, H2B, J and L but does not say anything about DV. So, is it possible by DV program is not affected by EO?

Both AILA and Curtis agree it is better to not duplicate names on both cases.
But there is a huge difference between the two types of action.
Curtis’ case can only benefit those named on his case.
The AILA suit would benefit all selectees, named or not.

Yes – that is my understanding. I don’t know many will be used – my understanding was that it would be a small number – and of course we did not expect so many responses. However, there was a suggestion of creating an amicus brief with some of the stories on the people not chosen as named plaintiffs.

1. It may be possible to re-issue the visa if it expires, but at the moment embassies are generally saying they cannot do that during the ban, so to be safe, find a way to travel.

I was not aware that adding our own personal story with DV would be welcome in the AILA form, so I will add it here:
I became an exchange student in the United States during my high school years. In order to afford the program, which was beyond my family’s financial means, I took a loan through my uncle at age 17. In the US I found a second family, which not only hosted me, but has been treating me like a son/grandson/brother/nephew to this day! Having grown up in Germany, I admired the diversity in American high school, with kids of so many different backgrounds and ways of self-expression, and a generally welcoming and open-hearted attitude. I found friendships there that are some of the closest I have to this date 16 years later, and I fly over to visit them regularly. What stands out to me, is my relationship to my host-mother. 64 years old at the time when she took me in, so from the first time we spoke she told me to just call her “Granny”. She became my third grandmother. Our relationship is testimony to the power of cultural exchange, as many of her religious or political views couldn’t be further opposed to mine. Yet all of our countless conversations while living together were carried by mutual respect and an open ear and open heart towards the other person’s views. We learned to look deeper and appreciate the fact that we actually shared the same core values when it comes to being a decent human being. These long talks at night in front of the TV are great memories for both of us. A few years ago, while I was visiting her in her retirement community in Florida, we sat down at breakfast and she told me without any context “You know Philip… someday you will become an American. I just know it.” She had postponed a doctors appointment until after my visit. A week after I left, she was diagnosed with cancer. Her first treatment began immediately. She was my first call when I won the DV2020. I called her in Skype, and you may figure how excited we both were. She knew I had been trying the lottery since 2009, and almost lost hope in it. I told her about the need for a local sponsor/recipient to receive the greencard by mail at the end of the process… and boy… that just meant so much to her! The fact that she would be the one handing me over my papers to become a resident in the United States… it is hard to put in words how much we anticipated that moment! And I think it gave her something to look forward to, almost like a duty. She’s been very impatient with the process since, always asking me if there’s a way to speed things up, if she should contact her Congressman, tell the KCC this and that… I just keep telling her we have to wait for the interview invitation. We don’t put it in words, but we are aware there’s not going to be a second chance for this. Her health has deteriorated further in recent months, to a point where she once texted me saying that she might not be around for much longer. She turned 80 in March and underwent surgery in which they amputated her ear, cheek, and parts of the neck to remove tumors. She is now in radiation therapy and still asks me if there’s any news about the greencard. What’s very ironic, is that she voted for Trump. I love her anyways.

I know this thread is meant for questions, but besides adding this to my AILA signup, I just wanted our story to be heard instead of simply vanishing like the greencard opportunity itself right now. I’ve been reading a lot of depressing comments on here lately and I think it shows that regardless of our national or economic background, the current attack on the DV lottery will hardly manage to present factual legitimization proportional to the amount of harm and hurt it is causing. I was scheduled for an interview on April 1 but unfortunately US embassy cancelled our interview.
The interview was cancelled by US embassy not by us so technically the one who had interview before the existence of first ban should not be bounded by the ban because they had to finish taking interview earlier than the first ban that came into existence.
( My opinion is just to those who had interview before first ban )

Hi Servique – EU31*** here. I sent form and documents at the start of May and still waiting on the “Documents complete” email (almost 8 weeks now). I sent emailed KCC after 6 weeks for confirmation but the got the standard “Your forms have been received and are currently processing…” email a few days later. It’s a bit of a black box as to how they’re going about it, but for me I think I’ve done all I can for now and the rest is in their hands so just have to wait and see from here.

Hi Hakou! There is only three things that can happen:
1. You receive no automatic reply > That means they didn’t receive your email and you might have made an error in address, file size, etc… in this case make sure you follow their instructions and there’s no error from your side.
2. You receive an automatic reply that says “The Kentucky Consular Center (KCC) has received your email; however our system could not detect any documents attached to the email.” > That means they received your email but there was no documents attached > Again, make sure there are no errors from your side
3. You receive an automatic reply that says “The Kentucky Consular Center (KCC) has received your email and is currently processing your documents.” > That means they received attachments and you have to wait until they contact you to either tell you the documents are complete, or they request more.
I don’t think sending documents over and over again is helpful to your or anybody else’s case, as it just increases the workload of emails they have to go through. Try to be patient.

I have filled the form by mentioning my below scenario. Hope AILA law suite will surely take care of that scenario? I’m asking this because, the applicants who are in below scenario may low.
1) Interview held at an embassy,
2) CO approved the case,
3) Embassy could not print the VISA (issue the VISA) on time (7 days from the CO approval) due to their closure due to pandemic,
4) Still they cannot issue the VISA due to EO.
Please be kind enough to highlight the above scenario as well as.

1- A child who was to reach the majority and received an emergency service
2-A person I think is old

I’ve emailed AILA again asking them to take my details off, but no response. Relax, Curtis and the AILA are in communication and YOU are the point of contact in both cases. So – if AILA were to pick you, you would simply mention that you are on the mandamus case.

I wrote to Curtis to find out about Mandamus case to decide whether to join the process or not. From the context of our communication with curtis it comes out that up to 50 dv 2020 cases are acting as plaintiff at the moment. Its not much. Do u think the 3 causes of action the curtis are telling to stress in the court are convincing enough?

the deadline to sign up for Curtis’s case is next week, so as many others I am trying to make a decision. Let’s expand on the diplomatic chess game you already wrote about so far:
Let’s assume the Mandamus is succesful, and KCC is ordered to dig out those client cases and process them to schedule for interview before October. Now Trump, as we know him, won’t allow himself to look weak or have his ego scratched. In response, couldn’t he just tell the institution responsible for overseas consulates (is it Department of State?) to keep all embassies closed until October or even beyond that, and just use the Corona threat as the official reason?
1. Is he or his staff able to directly decide on opening or closure of embassies?
2. Wouldn’t the same Trump move make a succesful AILA case useless?

I really don’t think the embassies being closed is anything that Trump has caused. It is for COVID. The embassies were closed before the ban, and that is consistent with common sense and other evidence.
So – yes, without the embassies being open, the lawsuits being won will be pretty much a hollow victory.

Maybe I didn’t bring it across right… No doubt it is for Covid right now, and no doubt it is reasonable at this time!
What I meant to point to, is that the Covid issue would be such an easy and pretty much bulletproof argument for Trump to just keep the embassies closed as he pleases beyond the deadline, and thereby making his defeat in court irrelevant! Regardless of the factual Covid threat at that time. Even if the situation eases, and embassies could start reopening based on local/national improvements in August or September, he could just say “Keep em closed! Not safe yet.” I mean the guy has always made his own reality.
So that to me, seems like his ultimate leverage… beat him in court, fine, then he’ll keep you out of the embassy… checkmate.

1. I don’t know.
2. The ban is one thing, embassies being open is another. We could win the lawsuit and still not get a chance. Obviously, I can’t predict that.

I pray that AILA is going to win the lawsuit. Main point is that we get salvation. The judges should come into accord to issue the entry permits since there is more visas left than actual winners. KEEP POSITIVE.
