The hearing is in progress. I’m just going to take some rough notes and keep updating as the hearing progresses.
Some discussion of “standing” and the judge asks to simplify since there are hundreds of individuals on the Aker case (whereas the Gomez case is organized into representatives of each class).
Lawyers for plaintiffs describe the “categories” of affected individuals on the DV case.
Judge recognizes that time is short and that waiting for the government to clarify its position on how the proclamation is being implemented will be harmful to the plaintiffs.
Talking about scheduling. Charles Kuck making the point that every day is impactful, but recognizes that the DoJ need some time to respond.
Update fro Greg Siskind “There will be another hearing next week on 8/12 to discuss standing and administrative record issues in disagreement between plaintiffs and government.”

Speaking of Curtis Morrison- I just found out that his firm actually filled another, more recent lawsuit, a 2.0 Mandamus case, ‘FonjongvTrump.’ Had I known, I almost certainly would have opted to participate. Should have followed Curtis Morrison’s updates more often.

1. It’s not “priority” as such, but there are scenarios where his plaintiffs could get an advantage.
2. No – we cannot be certain of a decision in 5 days.
3. I think the judge is very fair and not afraid to rule against the government.

The litigation could be prolonged, yes of course. Don’t forget it affects DV2021 as well.

Well that will depend on a ruling and the wording of the judge’s instruction to the DoJ lawyers. If there is any ambiguity, we could theoretically see further delays from some embassies. Only time will tell.

You mean dv2021 winner? If yes. Playing without passport for dv2021 winner is considered as fraud since you didint respected the basics requirements. You may be disqualified.

The instructions were clear. A passport was required to enter unless you met one of a very few exceptions – which you obviously don’t. So – although we have not seen the new rule applied yet, I think it is likely you will be disqualified. I suggest you wait and see what happens for others in the same position.

1. Did you hear about any Embassy from Schengen zone who said that is going to reissue visa ?Embassy in my country refused me saying about Schengen travel ban( proclamation from 11th March which suspend entry to the US from Schengen area) even if I declared that I’m planning to travel to the US from outside of Schengen zone ,where I’ll spend no less than 14 days before I’ll enter to the US.
2. I was also wondering if lawsuit will help me if it will be successful because lawers are fighting against April’s and June’s ban but my Embassy is confirming that this 2 bans (from April and June) don’t affect to my case that is only Schengen travel ban who is not allowed reissue my visa.

I have the same problem: I should have reached the US in march but because of the travel restrictions in the Shengen area my flights were cancelled. The last week my visa expired, I contacted the embassy for the re-issuance (since DOS prolonged the validity of the medical examinations for an additional month) but they told me they can’t because the restrictions for the Shengen area are still in place. My intention is the same as yours, to stay in a non designated area for at least 14 days, but without the visa reissuance I have no hope.
I’m trying to find a solution or a lawyer to help me. If anyone has a suggestion about what to do I would be grateful ??

1. Some embassies outside the Schengen area have re-issued visas, others have said they cannot do that. The lawsuit currently progressing seeks to clarify that point among others.
2. Then explain your plan to spend time outside of the Schengen area before entering the USA. You need to fight. Engage a lawyer if you don’t know how to do that.

Like I said – you need to fight. They are clearly wrong, about the Schengen ban affecting re-issuance. So – you need to get a fight prepared in case the ban challenge is successful.

Hello Simon- if I may ask candidly- How come there was no update on this site about a 2nd Mandamus lawsuit that Curtis Morrison would file on August 5th, (Fonjong v Trump)? I understand that the onus is on us to check up on these things. However, I remember checking the Morrison lawfirm website for a few weeks with no relevant lawsuit updates, and I am not a Twitter user. I have already DM’d Curtis Morrison firm(there is that option!) for any options for someone like myself to be involved in another lawsuit as such. I just want to make sure that I have done every I could personally so I will have no regrets, regardless of outcome. Thank you for your attention.

Yes, the Fonjong v Trump lawsuit was produced very quickly indeed, it seems. I am currently reading through your lawsuit summary in more detail; Curtis messaged me back, stating, “We do not plan to file a 3rd case. Hopefully a judge will give a remedy that helps all.” Indeed.
