Really great news – President Biden has stepped in and revoked PP10014. He even referred to DV2020 in the proclamation – which you can read here.
Also there is an important announcement from the State department explaining how things will work INCLUDING an NIE for the 14 day restrictions – so that is not a concern for the DV2020 visas issued cases.
How does this affect DV2020 cases?
For people with unexpired visas, and you are not subject to a travel restriction you can (and should) travel immediately.
If you are subject to a 14 day restriction – there is a blanket NIE granted as shown in the Dept of State announcement linked above.
People that had visas issued in September but that visa has expired, you should be covered by the recent order – so hang on for clarification. The lawyers will be asking for clarification for those cases. They are working on it. Patience.
For people that did not get a visa in September or had their interviews cancelled, you will have to wait for the outcome of the Gomez case (April, maybe even May).
The lawyers are still fighting to increase the number of visas in Gomez too – again – we need to wait for the final outcome.
How about DV2021 cases?
The revocation will help get DV2021 going and there is specific language in the Dept of State announcement that speaks to getting the embassies going.
The Anunciato case will continue to try and protect the 55k visas, and to force the government to act on the cases.

Good day sir.
I had paid flight for my family and I late December, hoping to travel early January when the band was to expire but couldn’t since Trump extended the band.
So I went to the airline agency and our tickets were deactivated and I was told to come back once everything was sorted out.
Yesterday I went there to reactivate the tickets and pick a travel date. The client attendant told me they are aware that the band has been removed but they have not yet received an official letter authorization them to board dv2020 passengers. Actually I am from Yemen ?? and my interview was 27-01-2020 so I got refused because of the Travel ban.
Whom I have to contact as KCC says The inquiry you are making is regarding a case number and/or program year that is closed. KCC cannot provide any further information regarding this matter.
September was the final month of the DV-2020 program year, which means that KCC will not be scheduling any further interviews for DV-2020. Diversity Visa numbers have already been allocated to accommodate those applicants who have already submitted applications and were scheduled for their DV appointments in September. No further allocations or appointments will be made.

The revocation of Proclamation 10014 is also great news for the 55,000 winners of the DV-2021 Green Card Lottery. US embassies and consulates may now resume granting interview appointments to Green Card winners.
As part of the ongoing “Anunciato v. Trump” court case, a decision will still be made on whether interview appointments of DV-2021 winners can take place beyond September 30th, 2021. On one hand, we have this statement in the announcement by the State department:
“The Secretary of State has granted a national interest exception for Diversity Visa (DV) applicants for the 2020 fiscal year (DV-2020) who hold a valid immigrant visa and are subject to the geographic COVID-19 Presidential Proclamations.”
But on the other hand we read the following in the same announcement:
“The geographic COVID-19-related P.P.s 9984, 9992, and 10143, which suspend entry into the United States of foreign nationals who have been physically present in the People’s Republic of China, Islamic Republic of Iran, Schengen Area, United Kingdom, Republic of Ireland, Brazil, and South Africa, in the 14-day period before seeking entry into the United States, remain in effect. Immigrant visa applicants who are spouses or children of U.S. citizens (IR/CR-1, IR/CR-2, IR/IH-3, and IR/IH-4), as well as spouses and minor children of LPRs (F2A), are excepted from the geographic COVID-19 P.P.s. 1. Do you think a lawsuit needs to be triggered to false embassies to process cases regardless of the shengen ban so that it remains the discretion of the visa holder to quarantine for 14days in a non ban country.

Hi Simon, thanks very much for your work. I am 2021OC03xx, with documents approved by KCC (the “Congratulations! Our records indicate that you have submitted all documentation required…” email) in August. Yesterday I wrote to the consulate I requested for the interview (Frankfurt, Germany) asking if an interview would be possible once they restarted visa services. I got this prompt reply:
“On February 24, 2021, President Biden lifted the Presidential Proclamation suspending Entry of Aliens Who Present a Risk to the U.S. Labor Market (PP 10014). PP 10014 prohibited the issuance of DV-2021 visas and entry into the U.S.
The president DID NOT LIFT the Presidential Proclamation on the Suspension of Entry for Nonimmigrants and Certain Additional Persons from the Schengen area Who Pose a Risk of Transmitting 2019 Novel Coronavirus (PP 10143, formerly known as PP 9993). DV-2021 applicants ARE STILL SUBJECT TO PP 10143 unless they are have an exemption or otherwise qualify for a National Interest Exception (NIE) from it.

Yes there have been similar responses from other embassies also. They have been told 5 times that not issuing visas for this reason is unlawful, but they pulled this same crap before – so we got a Judge to tell them to stop that – and we might need to do that again. We will know more in a few days.

Hi Mr Brit, so on this subject of the embassies not holding interviews due to shengen ban.
1. Could u please assist in getting kcc to clarify whether they will proceed with Scheduling interviews in the ban countries. This so that we can decide whether to start changing our interview locations.

A. On the day of submission of documents
B. after documents have been received and acknowledged by kcc or

Your police cert is valid for 12 months, however, if it’s easy enough to get a new one, do so when you get the 2NL.

I just watched Charles Kuck’s live on FB and just wanted to clarify something with you. The lawyers mentioned that they won’t be able to do anything about the embassies within the Schengen Area (+Brazil, UK, China, Iran & South Africa) if they don’t cooperate and don’t schedule interviews for DV 2021 based on the Schengen Area Ban.
In September of last year this is exactly what happened to DV 2020 and the judge told the embassies that their interpretation is wrong.
Why wouldn’t the lawyers be able to challenge that if this happens to DV 2021?
I appreciate that more than one judge has already pointed out to the embassies that they shouldn’t be doing this but there is still a very high chance they might continue with this practice.

I’ve seen that since the Presidential Proclamation was rescinded, some of the European embassies have already updated their websites stating that they won’t be scheduling interviews until PP10143 is still in place. I was wondering whether this could potentially cause issues for people intending to have their interviews in any of the banned countries. I’m assuming KCC won’t be sending 2NLs to those applicants which might mean we may lose the month of March too until we challenge their interpretation of the guidance.
Knowing what chaos this caused in September 2020, until judge Mehta ordered for their cases to be adjudicated. What are your thought on this?

I’m in the same boat as you with regards to point (1). Whilst Simon had confirmed that there won’t be any problem, I’m worried that there might be problem returning to the States without the Green Card. Page 15 of the document “A Guide for New Immigrants” says, “Permanent residents are issued a valid Permanent Resident Card (Form I-551) as proof of their legal status in the United States. Some people call this a “Green Card.” In addition, it says, “If you are a permanent resident who is 18 years old or older, you must carry proof of your immigration
status. You must show it to an immigration officer or law enforcement officer if asked for it”.
I hope the officials at CBP will allow re-entry on the basis of the activated LPR status on the visa in the passport without a physical Green Card.

That isn’t a problem at all (all described in my FAQ). The immigrant visa is stamped when you enter and serves as proof of LPR status for up to 1 year.

I would not delay any further than early May. Your number is not too bad, the question is really whether interviews start at all, but OC has very few interviews so I don’t see a capacity problem there.

However I just realised I will need to obtain a police cert from Germany where I was previously resident; I am concerned that this might not arrive back to me until later than May. By the grace of God I was able to booked my flight for March 6th, I am a 2020 DV Visa holder and having my Visa to expire on 14th March, want to know if will there be anything I will need to show at the border to CBP before entering or they are fully aware that the ban is revoked.

Hi Brit. I had my interview scheduled but it got cancelled, so I am a part of Gomez case. My medical is expiring at the end of March. Does it make sense to renew my medical now so I will have all my bases covered by the time we have a final decision?

Dear Brit, I want to do re medical because my medical was expired at 28 Feb 2021 but IOM Nepal don’t allow to do the re medical. As per them they only allow after US embassy nepal approval. I want to do medical and all documents ready before the out come of final Gomez order. Doing medical is on my owner risk. Why they make to complex doing the medical?

Dear Brit,
Our first US port of entry is not the final destination (due to no direct flight from place of departure to final destination) and we have to change to an internal flight to continue to the final destination. Kindly confirm that we have to hand over our visa package to the immigration at the port of entry. The transit time we have is about 3 hours from arrival to flight departure for final destination Is this transit-time sufficient to complete immigration procedures at port of entry?

I don’t know you, no. I was amazed that someone had contacted the court. That was completely inappropriate, and I am shocked you didn’t know that. I hope you will not try that again! What you don’t seem to understand is that during the hearings only the tip of the iceberg is discussed. Just because you don’t hear some point being discussed, that does not mean it is not in the filings or other communications. You have paid a lawyer, let them do their job.
In terms of whether there is anything to be happy about. Yes there is plenty to be happy about.
For thousands of DV2020 applicants that got their visas after a long legal battle in September were unbloced to use their visas.
Thousand more DV2020 cases are waiting for the final outcome of the Gomez case and the win shows a good sign for them.
For DV2021 there is a battle still, and if you pay attention to my comments you will see that I have been talking about that for months. I understand that at least as well you do or anyone else for that matter. And I am constantly raising that point with the legal teams. They are relatively new to the DV world, so they can’t perhaps see the looming issues, but I can assure you, I do, and as I said, I am communicating to them.

2021 eu 20k. I recieved the email from KCC to send documents back in November (which was pretty early for my case number) and sent the documents around mid November making sure to send them right (naming size etc). After contacting kcc, they replied with an email saying that if I got an automaric reply back then which states that the documents have been received I should be fine. My question is, should I send the documents again or should I just wait.

@Faith. The reason that interviews probably won’t start before May is because 2NLs that go out in March are for May interviews, just as normal. There is a chance that KCC do something a little faster, but because there needs to be some time allowed for medical and document prep, I suspect they will follow the normal procedures. I have explained this before many, many times in numerous articles and videos. I don’t know why Peter thinks he has some special insight.

Hello Simon, this is Jonathan again from Hong Kong. I am discussing with my family members and especially my mother, whom I have the caring responsibilities for. Besides the obvious risk that the Court Order could be modified, Curtis Morrison mentioned in a tweet that I may need to ‘spend nights at airport while you convince an airline.’ As a United Kingdom(Not BNO) passport holder, I could obviously enter the U.S. on a visa waiver, so would that nullify the risk of an airline refusing me to board? In all honesty, I cannot remember the last time I entered the U.S. on a visa waiver(the last time I entered the U.S. was on a student visa), so not much experience with visa waivers, per se. No you can’t do that. I’m not sure why he is so convinced that would be a problem, I suspect you might be able to get a travel pass from the embassy. But no, do not try and enter on an ESTA or other visa.

If the Gomez case is won, you might be able to get his case reconsidered. Or, as I already told you, you could sponsor him once you go to the USA.

For now the Schengen restrictions remain in force. We may see embassies refuse to interview based on that, but we have a bit of time to work on that. The issue is not being ignored. Wait.
