Judge Mehta has release an order/opinion that is a very good win for DV2021 cases. Congratulations and thanks goes to the legal eagles that have fought this battle!
- He tells the government to do as many interviews as possible before September 30th.
- He blocks the prioritization (Tier 4 ) for DV2021 cases. That is VERY important.
- He is instruction the lawyers to give a joint status report on September 23
- He is considering preserving visas for issuance after the end of the fiscal year.
- He did not give priority to the named plaintiffs. This additional effort could apply to any case.
- Rosales and Goodluck cases are being combined.
The order itself can be seen here.
This could see some additional interviews being booked between now and the end of the month – but I think it will be hard to add many thousands of cases in such a short timeline. So – it is likely that the report due on September 23 will be used to determine how many visas should be preserved for later issuance.
There is much we don’t know at this point – so please be patient while things get worked out

Judge is saying he is not forcing any embassies which are in lockdown situation. In Srilanka , on August 11th they cancelled all DV interviews and country had a lock down bt most essential services worked. During the lockdown even embassy processed student visa interviews. And embassy was not totally closed. They had staff on roster basis… With judge’s order can Colombo embassy still refrain from doing interviews? we still have country lockdown at the moment

Hi Brit,
I am a named plaintiff in Goh case. After JM’s decision today, I received an email from Greg Siskind’s office about further course of action I should take. He has mentioned that if you are documentarily qualified do this if not do that. Everything is about being documentarily qualified or not. But, I don’t know what does documemtarily qualified mean. I searched everywhere on your website but could not find it’s definition.
In my case I submitted documents to KCC and received the acknowledgement email in few minutes from them and that’s it. I have not received any email from them.
So, please help me understand if I am documentarily qualified or not. Thanks!

No, you are not Documentarly qualified. unless you receive email from kcc telling u that you are ready for scheduling. So you need to check your email again and also ask kcc if they are satisfied with your sent documents. Btw when did u sent your document? And what did Greg Siskind’s office tells you to do if you are not documentarly qualified?

Yes it is a Win ! a win for everyone exept us Goh plaintiffs , We filed this lawsuit on April 9th , we paied high fees for it , we were waiting and following updates day and night since that day ! without us there would be no lawsuit no good calendar like this … no relief ..

-No i would be happy if Goh plaintiffs gets priority and other gets chances by reservation of visas , because we start the lawswit without us (and plaintiffs in genral) DV programme would be Over on Septembre 30th , Gomez plaintiffs had priority by Pi last year and most of the plaintiffs had their interviews
-And to answer to a point you mentionned on your live video , Watch videos of lawyers (each monday for impact team and each Wendsday for charles Kuck in his live session) from april to August they were always talking only about plaintiffs , that this is not a class action so we are fighting for our plaintiffs …. This is the logic of a mandamus action even on your previous videos from April you was thinking and telling pepole same thing !
other thing i’m not a selfish person i am 21 Years old i’m student i had to work hard to pay my fees at school and the fees of lawyer on that particular Goh case…. So no i’m not a selfish but this is a one life chance … so it is normal to try to maximize my chances and i make more efforts than a non plaintiffs to get benefit for everyone
And finally for the point 2 a really appreciate the work you do for DV winners for free , i’m also volonteer in 2 association to help pepole (not for DV or immigration) but i put lot of my time helping pepole

Keep trying to get the medical. You can provide the medical after the interview, but the deadline for that is still September 30th, so you need to be able to provide the medical a few days before that deadline.
