Just as an update regarding the AILA lawsuit that I was involved with, there is also another lawsuit filed this week, this time exclusively for DV lottery selectees.
The suit has 75 plaintiffs listed, with a brief summary of each one in the suit – which can be read here.
The filing makes some interesting points, although there are some factual errors about the program itself. Nevertheless, it is great to see another suit being filed to keep the pressure on the government and give another chance to win.

The DS260 does not expire. So – if you don’t get your GC, and then later apply for a non immigrant visa, they will be able to see you made an immigrant visa application.

My number got current and my interview is changed to India from Australia because of children who are in my hone country, but now go stuck in Australia. Neither I can go to India, nir they can be here. So, i am thunking kcc to change interview location back to Sydney and request to unlock ds260. And I am thinking to leave our children not attending interview Incase Sydney consulate reopen before the end of Dv2020. 1. Can it be late if i change my interview location back to Sydney? 2. Is it not late if i ask kcc to unlock ds260 to remove my children ds260 form because i don’t see any positive to go to india for interview nor they can be brought here? 3. As a follow-up- The only reason I can think of that the U.S. Consulate decided to restart visa processing now is 1)The date was decided beforehand months before and/or 2) Mike Pompeo feels some sympathy towards HK people due to the recent passing of Beijing’s ‘National Security Law’ here in Hong Kong. I am not taking sides on the Security Law- I am just stating Pompeo’s view of the Security Law as, in his words, an ‘affront to all nations.” In that regard, I am not sure whether, as a Hong Kong permanent resident, that political backdrop may help my Diversity visa be given priority processing, under the premise that Trump’s ban is overturned? Just a thought…..

I believe the timing of reopening (as a centralized decision) was coincidental, and nothing to do with the impending lawsuits. As for the case in HK, hopefully the spike is being isolated and managed, but if not, the embassy may react and re-close.

Brilliant! Another weapon with which to counter the Trump ban- many thanks to all those involved and of course to Simon for keeping us updated. The fact that the U.S. Consulate General Hong Kong and Macau just recently resumed “limited immigrant and nonimmigrant visa services” is perhaps a percursor that U.S. Consular staff is predicting that Trump’s ban may be successfully challenged by the courts? The timing is rather bizarre in that during the past week, Hong Kong has seen a very sudden and rather serious spike in COVID-19 cases, after more than 3 weeks of zero locally transmitted cases. Very disappointing and upsetting indeed. So, the timing of the U.S. Consulate’s decision here in Hong Kong to restart visa processing is rather head-scratching (hopefully not the ‘too-good-to-be-true scenario).

There are numerous errors. It’s almost 150 pages and there are errors where they talking about entry where they mean issuance, the 55k, addresses of the plaintiffs, misunderstanding of the process and so on. But the main mistake they have made is naming too many plaintiffs, which has, in itself led to inaccuracies, simply because they had a lot of details to capture. As it is a class action – that was unnecessary.

Hello dear Simon. I called KCC regarding renewed passport issue. So when i renewed my passport because pages were running out i filled ds 260 with new passport. Now they need written explanation for change I called them and the lady said that explanation should be send as an attachment not like email message. so is it ok to write explanation and convert it into PDF and then attach to email and send ? and is it ok to write like case number_name_surname_passport_change_explanation_pdf.?
