I went to the United States on 12/01/2017, I lived more than 4 months in New York, I returned to Morocco in May 2017, for family reasons (health, illness (mother)) I could not return to US territories.
Will I be able to go back to the United States without any problem?
If Yes, what should I do?

You must return within 12 months of absence – so exactly what date you left in May 2017 is important. Over 12 months you might be denied entry and they could start proceedings to take your GC.
A Green Card is hard to get – I don’t understand why you would risk it so casually.

What do you think how important in DS to put exact start date of your work? I am a teacher, when I was filling my work experience in one of the schools I worked I put start date as september 1st. This is the day when classes start.

There are two questions in the DS-260 that ask about past drug abuse or addiction and whether or not I have violated any laws which relate to them. While I was never an abuser and an addict but had casually, one-offs, and (never had any arrests or convictions or criminal record or whatever) used some in the past, would the answer be yes to both? If yes, what would be the best case to present them?
What are the implications of admissions when it comes to the Immigrant Information Sharing Act?
Will I be barred for life, even as a tourist?
Is there any leniency or waiver available?

What I was, perhaps a bit flippantly, trying to say was, that the DS260 is not a confession booth. No reason to incriminate oneself if not actually convicted of a crime. I think we agree there, right?

Again, it’s not “incriminating oneself”, because this is not a criminal case.
However, the law says that someone is innocent until proven guilty – so if someone has not been convicted of a crime, they should answer no because as far as they are concerned they have not been found guilty of committing a crime. Nothing to do with the fifth amendment, just applying a little common sense.

Trump can talk all he wants. The only way DV2019 would be cancelled is if the law was changed prior to October 1. Right now there is no credible attempt to change the law – and Trump cannot change or make laws.

On ds-260 applications Mailing and Permanent section you have to provide an address where you intend to live in US and an address where you want your green card mailed. What if you don’t know anybody in the US and don’t have an address in the US? How would you know the exact address you’re gonna live in yet? Is there any otherway to get the greencard? How about a random hotel and just go get it from there?

The safest way has always been to get a friend, or friend of a friend to allow you to use their address. If you don’t know someone on the day you submit your DS260 – use a “dummy” address (hotel etc) and change it later in the process (before the interview, at the interview, or at the POE).
Just recently USCIS have implemented something to improve the situation – but it is very new and may or may not work “as advertised”. Link below. When I get more feeling for how that will actually work I will post about it, but for now, go with the old method.

Hi, we got the immigratipn visa. We will travel to US for a week to activate our green cards in June. We are planning to move to US in January. I will give the address of my relatives in New Jersey to the Officer at the airport and they can receive the green cards via post. My relatives could bring our cards to my home country in August. Do I need a special document or written statement in order to get my relatives the cards via post if we are not in US? While the travel ban is in force, you cannot be approved unless you have dual citizenship, or qualify for an exception (such as living in the USA) or waiver (which are exceptionally rare). So basically, no, you cannot get a visa.

Thanks a lot in advance, I read a lot you blog and It was extremely helpful in our DV process.
My wife and me went to the US Embassy in Caracas on May 17th. Almost immediately the 2018SA9xx 02 CRS visa was issued. The number one stayed in AP. Yesterday the status changed to Issued! Was was pretty happy, but suddenly the case changed again to Ready. I told myself it was just a mistake, but the casi is now in AP, again!
1) Was my visa just un-issued?
2) Have you heard about anything like this happening?

• I am a female winner of the 2018; from Libya; my case is a bit high 2018AF42xxx.
• When I applied for the DV lottery on 2016, I was single but engaged. I applied as a single.
• My fiancé also applied as a single on the same day I have applied; I win the lottery but he did not.
• Later on September 2017 we get married.
• In addition to the official certificate and family adjusted status document, we have other stuff (issued well before I win the lottery like emails, facebook conversations, engagement party photos, etc) which could be help.
• Time is running out; only about three month’s for the dead line September 30 2018.
• Up to now I did not fill the DS-260 application.
• My family (parents, brother and sister) are green card holders and are resident in the USA.
The questions are:
1- Do you think that still there is a chance to get the second notification letter if I send the DS-260 ASAP.
2- I fell like in deep water; unfortunately!! Don’t know the best option for my case. I can’t lie and fill the DS-260 as a single and proceed for the interview because my marriage certificate will show that I was not single when later my status would be adjusted.
3- Should I fill the DS-260 as married and put the needed information for my husband in the application , OR instead I need to fill up TWO DS- 260 one for me and another for him using my case number and details, OR I have to write to KCC the whole story and follow their instructions before committing any mistake?????? It’s really confusing.

2019-er here. Just wondering if I am allowed to enter the US as a visitor while this process is going on? My bfs parents really want us to spend Christmas with them in the US but I’m not sure if 1. I can enter as a visitor 2. I am Oceania with a 300s number so could that be risky to book a trip as might clash with interview and 3. Say for example I’d already had my interview before Christmas, do I HAVE to activate the greencard on that trip or could I potentially go again in March and activate it then? Basically I want to buy as much time as possible before activating that visa as we have so many loose ends to tie up.

1. Yes
2 & 3. Once interviewed and approved you get a one time use immigrant visa in your passport. Your next entry to the USA activates your status, based on that visa. If you want to buy more time, delay the submission of your DS260 – you could delay submission for about 1 year from now with no issues, and then your activation deadline will be pushed to late 2019 or even early 2020.

In many countries a woman may take her husbands name, or perhaps changes her name some other way. So the question is trying to get the name, as it was at HER birth.

You’ve already helped me a lot, but I still need to clarify some things. I want to apologize if post is too long.
1. If I have enough money on my bank account (>$20k for two), I shouldn’t worry about not having job offer or I-134, because having this amount should be completely enough, right?
2. Should I give these documents (I mean, bank statements, I-134, job offer) at once with the other documents, or should I keep it and provide during the interview, but only if requested?
3. A year ago I decided to make a proposal this September. Now I have been selected, but I won’t change my plans. In this case we need to prove our relationship. We’ve had a long 2-3-year story of our relationship before I was selected. We can provide many photos together in different cities, and during several vacations, during different events, etc. We’re gonna tell only the truth, and we can say much about our relationship. We can also provide many postcards sent to each other. And many photos together with my/her parents. And also stamps in passports at the same day when we entered/leaved some resorts. I think, it has no sense to do the screenshots of any social network stuff, because it can be drawn easily. How do you think, are all the things I mentioned above + honest answers on any questions about our relationship enough to prove? Or you have some advice about additional things?
4. In my country we have patronymics, but we don’t use then for foreign documents. Even in passports patronymic are written only on the page in official language, but on English page we have only first and last names. It means that I shouldn’t use it in form, and I just skip middle name field, right? Because I’ve found some information on the US embassy in Russia (people in Russia have the same situation with patronymics as we do) it was told to transliterate it by yourself (it already sounds weird), and put it in middle name field or in first name field, near your name. I think, I shouldn’t do it.
5. My country has several official languages, but we use only one, and on the page of a passport where names are written in official languages, they are written in all languages, slash-separated, but only one combination is used in all the documents. Should I add all the combinations in “Other names used”?
6. I also wanted to ask about one field in 1NL. Foreign state of chargeability – it is clear, country of birth, but what is “Post” right near it? As for me, there’s a city in my current country where they do interviews for DV-selectees.
7. In my country we have 11-year school education, and after that you can apply to university for Bachelor’s. So, that’s the full course. It is called something like General Certificate of Secondary Education. What type of document should I fill in the field? Diploma (as far as I know, that’s how it’s called in the US, what High Schools give), Certificate, or even a full title written above?
8. I’ve finished my Bachelor’s and got a document. The issue is that my first year of education at the university was the first year when my country started using this Baccalaureate (4+2) system, and the documents we get are still of an old template. Even though I get a BS after 4 years of education, the document is named “Diploma”, and inside it’s only stated that I’ve “successfully finished full course of speciality X in university Y”, and not a single word about a degree. Should I write Degree or Diploma? And should I obtain some confirmation from the university that I am a BS?
9. Even though BS is provided by college in the US, I should write “university” anyway, because it’s a university, right?
10. If one of the companies I’ve worked in doesn’t exist anymore, and I don’t know any telephone number, is it a big issue?
11. I’ve changed a school after finishing primary education. Should I go there and get a confirmation that I was studying for several years here, or it’s redundant?
12. Should my wife take any documents about her education, or it’s only about me? And should be official (with a contract) internships listed in the list of employers?
And two simple questions about DS-260. I haven’t started it yet (don’t wan’t to do it until I have all the documents that are needed for it), so they can be stupid, because I don’t know how form works, but still:
13. To add a derivative I need a marriage certificate. Should I attach only an original one, or a translation to English, as well?
14. On DS-260 example (I’m not sure that it’s a DV-selectees case also) I’ve seen a “Petitioner information” page with a “Petitioner is my …” field. As I understand, in my form I select “Myself”, and in my wife’s form I select “spouse” (i.e., me). Right?

I’ve been selected in DV2019 and my documents are all OK . My wife have a college diploma and she have that certificate but the high school certificate have been lost long time ago and it hard to be issued a again or maybe impossible ! .. so in the interview will they require high school certificate ?what do u think she must have that certificate or not? … in the ENTRY i put my spouse’s education level as vocational degree no problem about that ? please guide, great thanks

It doesnt matter that I already put in the entry her eduction level as vocational(she has college diploma) ? in this case is also no need to prove education ? because some groups in FB saying that in this case she still must prove high school certificate .. so what do u think about that ? sorry to disturb u again 🙂

Hi Simmon, I am a DV lottery winner from Nepal. I have submitted the DS 260 form. Queries are:
1. Reading the instruction it does not talk about the Affidavit I-134 form from US friend. DO i need it during the interview, esle only the civil documents.
2. In education field in DS 260 form, i have only written the highest degree information as university degree and filled up the educational institution data, do i need to write all the imformation from scooling period?Is it ok writing only university degree educational institution data.
