Good evening mr.simon,
currently i’m at filling my DS260 immigrant application and i have come up with several confusions regarding the present and previous addresses. before my question please take a look at my present and previous information details.
Present address 1 in – Kathmandu, Nepal (since 2005/weekends)
Present address 2 in – Pokhara, Nepal (since 2010/weekdays)
No previous addresses from age of 16
Present address 1 is where i have living since my age of 16 it’s my home and it’s my permanent location(weekends) where i living with my parents. but present address 2 is a temporary location where i have living for weekdays due to traveling difficulties.
Q01 – Do i need to include both locations in DS260? because both locations are my present addresses.
Q02 – If answer is “add only address 01”, is it cause a problem to my case, if i got police clearance certificate by indicating both locations (Kathmandu/Pokhara)?

Hello Brit,
My friend interview has been scheduled but he has one problem to say.In his initial DV application for highest level of education completed he ticked on some university degree but at the time he only had high school certificate he was just about to start his bachelor after few weeks and in ds260 he has written high school for highest level of education completed and in primary occupation as STUDENT and also given his college name in which he is doing bachelor now.
1)can this cause him visa denial?
2)should he inform VO before his interview or only asked?
3) saying STUDENT in primary occupation means doing bachelor after writing high school diploma,isnt it?

This is how i understand the statement below:

I have heard a lot of rumors about the mechanism of winning the DV indicating that a form called self-sufficiency will be filled in accordance with recent amendments to US law and therefore everyone will be required to have at least $ 8,000 in their bank account before attending the embassy interview. Hello Simon.
I received an invitation for an interview on July 31st for September 4th. On August 16th (today) I went through a medical exam at IOM (in Moscow, Russia). To my surprise theu found a spot in my lungs. They said it most likely was not tuberculosis, but sent me to additional test. Unfortunately, the results of the test will be available only on October 23rd, so I will have to go to the interview without the medical information.
Am I screwed now? Is it even worth coming to the interview and paying the processing fee?
Thank you, your guidelines helped me a lot throughout the process, and I did everything on time. I just have a very high number. It’s 2019EU30xxx, so not surprisingly I did not have much time to act.

If you can’t get a cleared medical before September 30th, you cannot be approved. Check if there is any other way to get TB clearance that the panel physician would accept – otherwise, yes, the interview is a waste of time and money.

Slightly unusual questions but your input would be useful
As the ‘primary’ with 2 derivative children (aged 16 and 18 respectively) we will enter the US TOGETHER very soon and await issuance of our individual GC, SSN etc. in the usual expected way.
Query 1 – What is the treatment of derivative green card holders (the children) – are they completely “separate” and treated separately and are they their own “entity”
Reason for the question is I may decide to remain in the US or move AHEAD of the children who remain in England, but the children may follow 1-2 years or even 3 years later AFTER they finish their education
So we may not be together for a few years as a “family unit” which is fine – but they come after their education.
They will still frequent the US one or two times a year while I remain in the US of course as I am the “primary”
The US authorities will know they are derivative GC holders (DV3, DV4 etc) and they will see DV1 (the “primary”) is already resident in the US and has taken up residence – they are indirectly or directly “linked” to me – however aren’t the children their own, in their own right (here’s me confused)
Query 2 – Does that influence their thinking in terms of “trouble free admittance” eventually and is there such a “linkage” with the primary ?
As you are British yourself, you know our standard of education is very high and also MUCH MUCH cheaper (University) – I want my children to get a great British education at a much cheaper price and come and join me after

Once the GC is issued, it is not linked to the principal/parents.
THe only problem you may have is an IO determining that the kids are not “living” in the USA. So – for that I would suggest an I-131/frequent visits.

this is a weird question
It’s been a really hectic year following the procedures after I got my visa last month I started stressing out more and more cause I’m going to the unknown and have phobia from flights and I start having really uncontrolled anxiety and panic attacks and I went to psychiatrist and she prescribed me anti anxiety drug
The question is can I fly with them they are allowed at the airport?

I just sent a question to which you have replied – thank you for the reply
I have another new unrelated question (but related to your answer that it is not “linked” but is a new query entirely). This is a what if scenario based query as follows:-
If my son who is aged 17 doesn’t come with me to the U.S. because he wants to finish his education in the UK – he has his IV stamped already and we haven’t yet entered together
Or …
He either comes with me and we enter together and gets issued his Green Card as my derivative separately
But then he stays in the UK for such a prolonged period (inadvertently or not) where he may or does forfeit it eventually with an IO as he not linked to me and now I am in the US – Lets just say that may happen or does happen, so he loses it!
If he then separately applies for DV2021 or even DV2022 for example ……He will now apply in his own right and NO MINIMUM AGE TO ENTER AS YOU KNOW and is born in OC region and will by then have finished his UK A’levels so will meet minimum education requirement) for DV2021
If he then proceeded to win DV2021 but has but previously been given a derivative IV (AS IS THE CASE) and had a green card previously – how does that play / work?
2nd related Query – Am I right that OC region has the highest probable chance of winning of all regions ?

1. A green card can be relinquished. There is a process for that. Having had a GC before does not mean you cannot apply in the future.

Hmmm…not to sure with the use of the word relinquish, which of course I understand completely
I don’t think he would relinquish it but voluntarily, unless,…. as you suggested earlier, it may be confiscated from him eventually by an IO who wasn’t happy he wasn’t living there YET !
As you know, completing A’levels in this coming academic year + a further 3 yrs University (god forbid he chose 7 yrs medicine in the UK) – that would be 8 years of dragging it out – it is bound to get confiscated off him involuntarily I expect ! Don’t know! That’s the correct word – confiscated !
Hence if he then got in DV2021 for example as OC region has a good chance, would the CO cause him issues as he had his confiscated just a few years earlier, and actually say NO you didn’t take it earlier, so we are denying you.
As you know, I think all the “power” is in the CO and whether he / she does what they want – that’s my belief and I don’t know whether that is the truth
This came at an awkward time (for the kids I mean) – as we can’t afford US university education it will cripple me literally – I believe it is in the hundreds and thousands of $$$ meaning all my money will go on that, instead of buying a house in the US etc.
Whereas in UK it will be a fraction of that cost

Hello Sir, I’m MT from Liberia and scheduled for a September 3, 2019 interview. I have some mistakes on my DS-260 so I emailed the US embassy in Monrovia to rectify those mistakes. I did that yesterday, August 15, 2019. The reply was they would get back to me in a day or two accordingly. My question are:
1.Will that cause a problem with my case? I remembered you saying that at this stage we can write the embassy of interview directly or rectify mistakes at the interview. I decided to do it before the interview
2. I have two kids, a girl, 12; a boy, 3; different mothers. I played the DV alone with provision that my kids would join me later in the States. Does this seem selfish?

I included them on the entry but because they live with their mothers, I made it clear that they would be joining me at a later time in the future. Because I’m not married I believe taking them along with me would pose a serious problem of taking care of them. I can easily have them join me once I’m settled and in the position to take good care of them.

I hope you can help, a friend of mine was arrested few years ago and spent one year in jail, for something he didn’t do, now, under the algerian low, that attest that after 3 years he can fill a rehabilitation case to the justice to get his criminal records cleaned (empty) so he did. and now, when filling the DS, what can he answer for the question “have you ever been arrested or conviced for a crime…” knowing that when he will submit the documents his police certificate (criminal records) will be clean (empty)

Egypt (but the truth I moved to Kuwait from June 2018 )so the answer supposed to be kuwait not egypt . But when I won I clarified the truth in answering the current address ( kuwait from June 2018 ) , this can make the visa refused in the interview ?

A question for Brit or some other readers who may have experience:
I am the sponsor for the applicant. Can I scan and email the i-134 (signed) and supporting documents and have the applicant print them locally to take to the interview?
Or should I Fedex/DHL the documents (supporting documents are all electronic documents in any case), it’s just the I-134 that has a physical signature on it.

Many thanks for your help in advance. I am one of the 2019 DV winner and successfully finished the process with the help of your blog. I entered US with my husband and son on August 13. The POE was DC.
I have a plan to go back to my country with my son for about 10 to 11 months to tie up some things and come.back to US for good. I have learnt from your blog that this is possible. However, so many people seems they don’t have a clear idea about this. But, when I read FAQ under this subject it tells about a stamp. When I checked our passport there is no stamp at all just the visa and they wrote our Registration number by ink that is all. My question
1. Do I need to go somewhere to get stamped? ( I thought if they forgot to do that at the POE)
2. If yes which office do I need to communicate
3. If I go back to my country does this create any problem when I come after 11 month?
4. Do I need to fill out the travel document?

What fee? You don’t have to pay a fee to submit the DS260. Make sure you know what you are doing!

For June, immigrant numbers in the DV category are available to qualified DV-2019 applicants chargeable to all regions/eligible countries.
My visa number is available here in Africa am from Ethiopia I am leaving inside the united state I did all application the DS- 260 immigrant registration for ajustimment of States and they send to me a peyment recipt I paid a money orders in $330 already in may 6, but still I didn’t receive any email notification an interview date so do you think am a Chance to get an interview or not?

It is too late for a Consular processing application. Did you plan to process via adjustment of status? Have you submitted an I-485 application? If so – when? I am thinking you are about to mess this up.

OK – so you have misunderstood the process. You won’t get an interview in the USA from filing the DS260. You have to file an I485 and adjust status. If you start immediately, there might be time to file and clear up your case by the end of September – but you have to move fast.
Step 1. Go to the link below and study the linked spreadsheet from the first post. Learn about the steps involved then you will need to submit your I-485 asap.

You will NOT be able to get a DV Green Card because of this mistake. There is no way to fix that. Please do not submit the DS260 or I-485 – because those things could affect your non immigrant status.

Oh man. You should not have done that (it’s not even the right process).
When you next ask for a visa your application for immigrant visa may come up. Depending on your visa type, that may or may not be a problem which could reduce the chance of you being given a new visa. Just don’t go any further on the adjustment of status.

I gave a birth to the US in 2014 and my last one is a US citizen and since it is very difficult to return back in the US – our touristic visa has been refused twice – the consulate gave us the 214(b) form because the consulate think I have used a wrong visa for a birth. But we have paid all bills related to the birth. Do you think this could affect our immigrant visa? Your response will be much appreciated.

Just a quick question. Few months after i was selected for the DV2020 lottery i received my admission letter from a University i applied to in Italy to do my Masters. I now need to come to a decision between the two because they are all of importance to me. I taught of forfeiting the Admission and going in for the DV2020 lottery since that is a once in a life time opportunity.
I need your genuine advice on this. Do you think my case number will be current and i will be granted the visa?

we are winners of DV 2020, Africa 14xxx. My husband is the main applicant, while we were filling the DS260 form. They asked if i have even been to USA and what kind of visa and its date.
My parents when I was very young had immigrant visa and entered USA and obtained their green card, for some reason they didn’t continue living there. I couldn’t figure out from the drop box what kind of visas that was, and I entred the date stamped on their passports the day they entred USA, as the visa’s date. That was very long time ago and I was 1 year old. I don’t know if I had done the right thing regarding the date. Also, I asked them for a new social security number (my greencard was expired amd never been renewed. Thanks in advance.

First up I want to say thank you for the site you have created. My partner, myself and I all recently received our immigrant visas after a successful interview and could not of done it without this amazing resource. I do have one final question though.
As derivative beneficiaries do my wife and child have to come with me for this first visit within that six month period from the medical? Or is just me enough? We’re planning on doing the permanent move early next year.

Congratulations.
Each one of you has a visa with an expiry date. Each person has to enter the USA and activate their status before that expiry date. The derivatives cannot enter before the principal applicant.

If you have been out of the country more than 12 months your re-entry is at risk.
The correct procedure is to apply for an SB-1 visa at your local embassy and you will be expected to explain why you took so long to return.
Alternatively you can try and re-enter the USA. The IO will probably refer you to an immigration judge in the USA and you would get a chance to explain your reasons there. Generally speak the IOs try and convince people they have power to deny entry – they don’t. So – don’t sign anything that takes your rights away to be allowed to enter the USA as a tourist.

Hi Mr. Simon,
I’ve already filled out the DS-260 for DV2020, it was a couple of days after the draw in May, and have entered my current job details(company and position). Now I have a chance to switch companies, so if I do that:
1. Can it be a problem at the interview?
2. Should I reopen and modify the DS-260 and update the “current position” field?

What if instead of going to a different company, I decided to go freelance and work remotely from home? Can that hurt my chances in terms of them seeing it as “not having a real job”? I do have a sponsor who will file the Affidavit of Support btw
