I’ve called to KCC to check out my documents and the lady told me that no DV2020 documents will be processed because of proclamation, so there is no sense to wait for confirmation. It was the first time that KCC mentioned not the virus, but the ban. Thanks for everything you’re doing ! You’re just an amazing person, really

Hello dear Simon. Hope all is well. I am bothering you regarding one question. So there is a section in DS 260 that they ask SSN number. I was in USA with J1 visa in 2012 just 5 days and that was a governmental project so the man who was reponsible for the project in the end gave us paper to fill for SSN but i never ever got SSN number I mean its never issued and that man died last year. My question is should I write in DS 260 I have applied for SSN but never issued number? Thanks for your advice in advance.

I suggest you say no on the ds260 to USCIS getting you an SSN – so that you can do that on your own behalf in the USA by visiting the SSA office.

1) Do you think we can also go beyond the Sept deadline since the dv results were postponed to June.?
2) i think it would also be the first of it’s kind in the history of dv to carry pending cases forward to the next fiscal years. Who knows, those laws were created by man and could still be changed.

I won the DV 2020 lottery, living in the US on a E2 visa and was originally applying through KCC because it is much easier than through USCIS. (my lawyer recommended)
However in light of what is happening I am thinking about transferring my application to USCIS, I already almost gathered all the additional documentation they ask for. I am just wondering if it is worth it considering they would have to process my application in 3 months and processing times are usually much higher.
Do you have any opinion/ advice / experience with adjustment of status within US with USCIS for DV lottery winners?
I really feel like my dream is being broken. I have been in the US 4 years on E2 visas underpaid and missing amazing job opportunities because I didn’t have a greencard and this was finally my chance to be able to plan a life here and now I feel devastated.

Unfortunately you made a bad decision to listen to that lawyer.
There is ample time to process an AOS case, even now. The processing times quoted do not apply to DV. But of course you have already wasted a lot of time. I suggest you take this into your own hands and get your application going now. The thread below is all you need.

Yes – the team at AILA have your details from the form you completed and have obviously identified your case as a potential class representative. The JAC and ILL are adding resources (lawyers) to help fight the case. Your relationship with them would be a normal “client/lawyer” relationship. Even though they won’t charge your legal fees, the service/representation is the same – and you need to treat them as your trusted legal advisor.

1. Your number is useless without a region. But you can start the DS260 as early as you like or delay it up to around April or even May of next year.
2. Again – no idea without the region – but in any case – we don’t have enough data right now and the latest ban is a big factor – so wait and see.

Good afternoon Simon, thanks for everything! My first question is regarding where the interview will be held?
1. I’m a Jordanian citizen but live and have been living in Italy for the past 23 years. My country of changeability (where i was born) is Saudi Arabia, even though I left there to Italy when I was just 3 years old.
My case number is 2021AS00013,*** … Does this mean that my interview will most likely be held in Saudi Arabia even though I put my residency down in the initial form as Italy? Is it possible to email KCC and ‘request’ to have my interview in Italy where I work and have been a resident for the past 23 years, as I even need to issue a visit visa to Saudi Arabia as i’m not it’s national.
2. My case number is AS-13*** … is it fine to delay submitting my DS-260 form until Sep-Oct? (as i’ll have a more stable full-time job by then to add to my DS-260)

Thank you for the reply. However he has a peculiar situation. He is an asylum seeker in USA. He applied for asylum in 2017. But there is no development in his process. He just has the working permit. He cannot get a new passport because of the political situation in his country. The embassy does not provide a new one and asks him to go to his country to get a new one! It does not make sense at all. He has no valid passport and will be imprisoned in his country if he goes. Considering all these cases, is it possible for him to continue in DV lottery process? If so, what should he do?

Then he should not be completing the DS260 anyway because that is not the process for adjustment of status.

No that is not normal. But then this year is not normal. There is a ban on immigrant visas, the embassies are closed. Chances for remaining cases are small, especially those that don’t have their documents processed yet. You can ask KCC directly about your documents.

Hello. My friend is in a similar situation. She has been waiting for 6 months for this confirmation email. I called kcc for her and they confirmed that her documents were complete. Later that same day she received the confirmation email from kcc. I reccomend calling them. It was very easy to reach them by telephone. Good luck to you!

This question is regarding previous addresses. My husband (who is the winner of lottery) Has been working in UAE for over a decade. During this time he was stationed in 2 other countries for one year. Though he was based in these countries, he were on visit/work visas and traveled back to UAE every 3 months as his resident visa was in UAE.
Can he mention the address of only UAE as It is very hard to obtain police clearance especially from Azerbaijan as we don;t have their embassy over here. Really appreciate your advise on this. Thank you in advance!

We don’t know how they operate yet. We have not been in a situation where the embassies are open but the ban is in place. So – they might cease scheduling, or they could schedule from January (meaning November 2NLs) or they could even schedule and hold interviews before the ban ends and leave cases on AP until the ban is lifted. THere are some more possibilities too – point is – wait and see.

I have 2 nationalities so 2 passports (albanian and greek). Given that the percentage of applicants in Greece is small (almost 3000 per year ) so the winners are few ( about 100-200 winners per fy). Contrary to albanian statistics which indicate more than 200.000 entry-applications per year and 3.500 visas holders would you recommend me to apply as a greek or albanian ??? Will I have more chances to be selected with greek passport due to small percentage of greek participants ???

1. Again, I wasn’t there at your birth – but yes you should only apply charging through your birth country.
2. Possibly. The chances for any person in the same region is identical EXCEPT that some countries have so many entries that their winners get “stopped” at some point. I have explained that in extensive detail in my “holes” articles. That could be a possibility for Albania, meaning a person born in Greece would have more chance of selection. However, if you choose the wrong country to get a benefit, your chance of selection will increase but your chance of disqualification goes to 100%. So you can decide, do you just want the thrill of being selected, or do you want a chance of getting a Green Card. If it’s the latter, follow the rules.

A record number of Americans want more immigration instead of less, according to a new Gallup poll.
This is the first time in the pollster’s decades of tracking the country’s thoughts on immigration that more people would favor more immigration compared to those who want to see less.
Of those surveyed, 34 percent said that they want to see the U.S.’s level of immigration increase, while 28 percent said they want to see it decreased. Thirty-six percent said that the country’s immigration rate should remain the same.
Conducted May 28-June 4, the survey was completed before the Trump administration stopped the issuing of any new H-1B and other visas through the end of the year. It also came before the Supreme Court ruled that the administration’s rollback of the Obama-era Deferred Action for Childhood Arrivals Act was illegal.
The results were split heavily among party lines.
Of those surveyed who identified as Democrats, 50 percent said that they wanted to see immigration increase and 34 percent of independents said the same. Both of those marked an increase from when Gallup last asked the question in 2018.
Just 13 percent of Republicans said they would welcome a boost in immigration, a decrease from 2018.
Overall, 77 percent of respondents said that immigration is a good thing for the U.S., while 19 percent said that it was a bad thing.

I have an 01 Visa but opted to go through the DV-Lottery process here in Australia as I was concerned that if I went down the Adjustment of Status route I would have to remain n the US for too long . Up until this point I have been using my 01 to go to LA for blocks of time as my husband remains in Australia and can’t leave his work for now.
My question is: Is it still an option for me to apply for an adjustment of status? Or has that ship sailed?
After entering the Lottery for 14+ years and finally winning I would kick myself if I didn’t explore all options!
In regards to my Greencard interview: The last news I heard is that we are on a waiting list (our interview was due in April) and we will be contacted as soon as things move forward. Obviously, every passing day makes that feel unlikely.

The O1 is not normally considered “dual intent”. That means if you enter the USA now with a plan to adjust status it could result in a denial since you broke the rules upon entering. Coupled with that that there is very little time left, the AOS ship is basically sailed.
So – your best hope is the AILA case AND reopened embassies.

May I ask what may seem like a RIDICULOUS question
You live in Australia – a fantastic, huge, beautiful country with a small population of ONLY, ONLY 25 million as opposed to 330 million in the USA for almost same land area
Australia is not like a 3rd world or worn torn country where many applicants for DV want to move from – are desperate to improve their “lot in life”
One guy recently wrote it was a life and death “thing” for him (a bit extreme I admit but he wants “out” of his lot and you can UNDERSTAND WHY?)
Australia is a fully developed 1st world country :-
– with superb weather and outdoor lifestyle
– with (best of all) ……. the British way of life / mindset / mentality / ways / method in “paradise” – not the awful British weather
Why, may I ask, are you trying for 14 years to leave Australia of all places ?
I think given the choice between Australia and the US, I would elect Australia personally.

Jen may answer, but I have had similar questions in the past. Everyone has different motivations. For us, the weather was a factor in the UK, although we kept a house in Spain for that reason. But also the opportunities in the USA are greater than other countries. I suspect that is the same for Aussies. So – they can have a nice life down under (just as we did in the UK and Europe), but there are limits to what you can accomplish compared to the US experience.

Yeah I’ve seen the petition. It’s pointless. It is asking the people that created than ban to lift the ban. If they wanted to do that they wouldn’t have created the ban.

My wife was selected for further processing of the dv2021 with a CN AF68xxx.
My questions are;
1. Do we both need to qualify for education and work experience or only my wife because she’s the principal applicant.
2. My educational qualification is high and I failed the final exam but I still have the certificate and transcript, will my failure cause a problem to our case ?
3. I’ve someone in the US to file i134, do we still need public charge ds5540?

Again, my mother’s name on my birth certificate is different from the one on her current documents, will it cause problems in my application & or have effects on my visa acquisition? Thank you.

Hi Simon. I’m filling my DS-260 application & I need clarification on some few issues. I’m currently unemployed though I’ve been trained as a teacher & processing my teaching appointment now. Do I need to include teaching as my occupation? And relating to the places I’ve lived after turning 16 years, do I have to include the city in which I schooled within the 4 years interval? Thank you.

Just answer the questions as you see them. Don’t try to guess what they want to see, just answer.

I was selected for the DV21, number in the 39000s. It’s going to be a while, for the interview and all, from what I read in the FAQ. I ‘ve completed the DS260 with in the first week of the results and I am waiting for the KCC to process and confirm.
I entered with GREEK chargability, and I registered the consulate in GREECE for my interview.The DS260 confirmation letter said that I won’t have to send and documents to the KCC, only present the documents to the consular officer at the interview.
So my questions:
+ Is my home address trivial information, or am I to expect correspondence from the KCC.
(I really need to change apartments, since it’s going to be at least one year before it;s time to go, if all goes well)
+ Do I send an email at the KCC, or just wait for the interview and update the information with the C.O.

I would like to know if there is any possibility to applying to B1 travel visa in the US Embassy and to enter the US with the purpose of getting DV 2020 immigrant visa and obtaining PR through adjustment of status ??

1. Embassies are closed, so if you don’t already have a B1 you cannot ask for one.
2. Entering the USA on a Non immigrant visa (non dual intent) with an intention to adjust status is considered fraudulent entry – and that can cause denial.
3. The ban terms don’t exclude someone who was not in the USA as the time the ban was introduced.

Appreciate if you can help me on the following questions:
1- if I was previously employed, shall I start with the job which I joined before the current one? Or I have to mention the current one first, if I have to mention the current one first, what shall I add as end date?!!
2- In case place of birth has more details in BC vs passport ( Ex: city & governorate in BC vs only governorate in passport), which one shall I follow?, shall I write all the full details as per BC?
3- If my spouse is the main applicant, but all financial support, coverage & proof is done by me, do my spouse has to have the financial support proof under her name @ interview?
4- Does a previously rejected B2 visa has an impact on DV approval, we were never communicated on the reason why we got rejected, however we believe we didn’t show enough tie to the country we live in / homeland & we don’t have a solid travel history as a family.

1. Current job goes in the current occupation, previous work history goes backwards in time from there.
2. No need – just what the form asks for.
3. You present joint assets and income but should also have an I-134 to cover the family.
4. That depends on the reason for the rejection.

Ones more thank you for the guidance you are giving to us FOR FREE. I have this suggestion which I will love to share and also proposing that you forward it to the AILA team. This is
my suggestion.
We are facing a situation which has never happened before and all measures taken now are immideat to solve the problem. All DV 2020 and 2021 applicants were ready to follow the normal process and obtain their Visas or be rejected as the case maybe and the staff at KCC and embassies/consulate were also ready to do their job. With the outbreak of the COVID 19, everything was suspended as a measure to prevent life which of cause is a wonderful idea and method implemented by the authorities. When the law governing the DV lottery prosse was enact, the authorities never knew that we shall face a situation like this. Therefore the law will certainly be revisited in future after the pandemic. But we should not pay the price because nobody wanted it that way. Now that this has happened I wish to submit and suggest that for exceptionally DV 2020 and 2021, DV 2020 should not have a limited date for Visas to be issue rather they should merge DV 2020 and 2021 and be scheduling and interviewing them together. This can be done this;
1- if before the end of the ban, and the economy is recovering, the KCC can start scheduling both cases together such that an embassy can have 20 candidate a day and of the 20 maybe 11 are for 2020 and 9 are for 2021visas.
2- if the number is more than the staff capacity, the KCC and embassies can recruit more staff because more candidate will still pay visas fees.
Please Brit if you can forward this suggestion to AILA or give me a means of contacting them or you in my box. Thank you one never knows maybe the KCC and AILA can look at this suggestion….

Once September 30th is passed, DV2020 winners can no longer get visas.
