…it affects DV winners (post activation)
A lot of post activation winners don’t come to the US immediately and some, for considerable time after activation and are “outside” and don’t know how to resolve this mandatory requirement “outside” of the US – in fact it can even be impossible in some countries / regions
I wish your site had a simple guide and advice on where exactly / and whom exactly one can approach
Is this something you can add to make your site even better and more comprehensive ?
(like a referrals section to whom / where / why? for cases as described above – as it’s a mind field )

You are now required to declare social media and all your social media handles
But, a lot of people have fictitious and / or anonymous handles on social media that they don’t link to THEMSELVES BY NAME …..because they are private or want not to be public
They don’t necessarily use it to blog or post or follow people but it can be a useful tool to use and still remain “anonymous” (un-findable if there is such a word) as every human has a right to be
Even if you did or did not declare it to the US authorities OR ANY AUTHORITY FOR THAT MATTER, how are they to know? as you haven’t got “your name all over it” and it can’t be correlated to you?
Because you are not lying, but you are – and you haven’t got anything to hide, but you do want to be hidden by being anonymous and un-findable
Do you see the dilemma in question?
What is your take on this from an intelligence gathering point of view? Someone that wants to be hidden can still be hidden ?

There should be no dilemma. You don’t have a right to a Green Card. The deal is you are to be fully honest and transparent. Their technology to connect data and build a picture of who you are is pretty powerful – so being anything less than 100% honest is a very dumb idea in my opinion.

Dear Simon I’m Cuba but I’m live on USA for 5 year, I’m permanent resident, I’m trying to do something to ask for help from uscis, Kcc or the same president if possible, to be able to extend the dlv 2020 time limit, my mom was selected from cuba and is still waiting for an interview, it hurts a lot to run out of options when you have not depended on it.

The time limit cannot be extended. If you are a permanent resident, wait to become a citizen, then you can get your mom a GC.

I had a question, I have been selected at random and at the time I applied, I was married. Since Jan 2020, my spouse and I have had a fall out, and we have decided to give each other some space, so no divorce proceedings has been official. I completed the DS260 as I was advised by KCC to apply still as a married person for both myself and my spouse. I am the principal applicant. How do I submit his documents ?
2. If I unlock and remove him, does this affect/ delay my application?
3. If we are not officially divorced by the time interview is scheduled (due to Covid in UK, this will be delayed till next year) I will be classed as married but my spouse will be removed.
4. If things work out, and I have removed him, can I add him back on without any hitch

1. You cannot remove his application once started, but you can process alone. The easiest way forward would be to submit documentation for BOTH of you, but once scheduled simply let the embassy know that only one will attend.

I am a winner of DV2021, OC677.
I have received my request to submit documents, with a relative low case number, should I hurry to submit the documents, or with the current ban in place i have a bit more time to help ensure my police check is still valid next year?
My 9 year old son was also approved in the lottery with me, he is the son of a US Citizen, however his father and I are not married, his father is living in Australia but is planning to move back to the US when our greencard is approved .My son also has other relatives, Grandparents, Aunties etc who are currently living in the US. If the ban is extended again, do you know if myself and my son could be exempt due to my son being Children of Permanent Residents and U.S. Citizens?

You can hurry if you want the fastest possible interview, but really there is no need to do that. The police cert will last 1 year.
Exemptions for family relationships tend to be case by case, but you would need to marry as a start. Frankly though it’s not looking good for Trump in the election, so unless something really unfortunate happens he will be gone in January and his idiotic decisions will most likely quickly be reversed.

1.So AILA will file the lawsuit on 13, July. I heard today that in US filing and hearing are not the same day. Hearing might be after 10 or more days. So practically we wont even have time to be scheduled for an interview. Do AILA know about the time limit, that within July we are supposed to get scheduled so we could have an interview in September?
2. Do you have any info from Curtis mandamus they filed it yesterday, what was decided when will be the hearing and are they hopeful for win?

1. No – the week commencing the 13th. Hearing time varies after filing. AILA know the urgency. Remember, we also need the embassies reopened – so even if the lawsuit is quickly won, we still have a problem with reopening. BUT the hope is to at least get some cases through. There is not time to save every case.

Hello Simon, I have a very critical question, and that is how long my money needs to be deposited in bank account?! In the case of filling the DS 5540 form, under the section “credit record” Does my money need to stay in my bank account more than 6 months or is it ok if I only fill it at the time and/or one week before my interview?!
As of today the value of Iranian rial has been diminishing so it is not logical to keep any amount of that as deposit!

No. You have an OC number I assume. Unless you are married to an Australian born spouse, you will be disqualified. That is 100% certain. There is no fix.

Based on what we have read kcc is working on processing our cases DV 2021 , in all regions .
1- Does kcc process DS 260 based on the number of the cases sent them by order from the low cases number to the high ?
2- what if for example a winner dv 2021As10xxx submit his DS260 on June and other winner with low case number AS 3xxx submit his DS260 on July , who will be processed first ?
3- what if I submit my (political , court )certificate and the interview will take place after 7 months
Should I renew my (political , court )certificate and take it to the embassy during the interview if by the instruction will be expired?
4- Who decide how many selectees will be selected in each regions ? Is it the sum of the cases selected or they put before their target of selectees and after this they select the cases?
Especially if they don’t put a target of the number may be by chosing a lot of cases as we see with high cases number ,they will get maybe 50000 selectees for example for ASIA.

1. Case SCHEDULING is according to case number. Processing varies depending on workload.
2. It doesn’t matter who is processed first. The 3XXX will be scheduled first.
3. You can do that, yes.
4. They select a number of selectees that are about what they need, or sometimes more than they need. If they have more than they need, then high case numbers are at risk.

But due to the pandemic situation i received a mail that all activities at the embassy are closed till further notice; and that we will be notified when activities will resume.
Since then i have not gotten any informartion.
I am scared and i dont know what is going to

And due to the new laws signed by the president Trump recently I dont know if the whole process of obtaining a visa has been cancelled or what is going to happen.

Unfortunately while the ban is in place they cannot issue your visa. The ban is being challenged on court, so if that challenge is successful it may give you some relief. So – wait and see what happens.

1. No. Your sponsor needs to meet the income requirement. If they do, that’s all you need. If they don’t, then their I-134 is useless.

Hello Sir. Appreciate your guidance/consultation/advice as to the best course of action for the following matter. My dad was selected for further processing as part of DV2021. He is the principal applicant and his case number is 2021EU20XXX. My sister who is below 21 and my mom were listed as derivatives under my dad’s name. Dad and mom are residing outside of the US and will therefore be doing counselor processing by attending a US embassy in Kazakhstan. My sister,however, has been in the US for the past couple years now and has been pursuing a bachelors degree under an F1 visa. I understand my sister has an option of doing Adjustment of Status or Counselor processing. The problem I see with theAOS is it’s currently taking 9 month to about 30 month for USCIS to do AOS GC interview from the time of I-485 application, by the time my dad will be doing his COunselor Processing and gets his immigrant visa stamp (given his case number and the ban for the rest of the year, I am thinking he will go for an interview with my mom late July or August of 2021 timeframe if that happens. I understand as part of follow to join procedures my dad has to have his immigrant visa stamp on his passport first as principal applicant before my sister can submit the AOS however if AOS route is taken given the 9-27 month current AOS processing timeline, it will be at least April 2022 before my sister will be asked to attend theUSCiS AOS interview which will be past the DV 2021 fiscal year ( e.g September 30,2021) and therefore there is a significantly increased risk my sister will forego her Dv lottery visa by default due to increased AOS processing timeline. Given the above circumstance, would you suggest for my sister to do a Counselor processing along with my dad and mom all together in Kazakhstan? Or would you rather she still try her chances and still do AOS within the US as USCIS May have a different processing timeline for DV derivatives ( I called USCIS and there is NOT a separate shorter processing timeline for DV but it appears to be at the discretion of a USCIS officer to push forward the DV AOS application however do not prefer to rely on that happening as the chances of that happening may be slim to none. Given the complicated dilemma my family/I am in above, I would greatly appreciate your advice and suggestion on what would make sense for my sister to successfully get her immigrant visa / green card : do AOS through follow to join or do counselor processing with my dad and mom altogether In Kazakhstan? AOS may sound cheaper and more convenient not involving trip obviously, but it seems really risky given my limited understand on the processes involved for CP versus AOS.

Have you heard of any DV cases in which the visa is re issued twice? So, we’re DV2020 OC 4** and got our visa in late January. We were Scheduled for our activation trip in March but couldn’t go due to travel bans. And we had a job lining up to start mid July. However due to a hiring freeze and covid, Australia seems to be a place to wait in just for now.
We have our new medical scheduled for August which will hopefully give us to Feb 2021 to activate. But have you ever heard of instances where the visa is reissued twice? And we redo the medical again in February and get another reissue?
I know it seems far fetched but perhaps because we already have an actual visa number granted their might be provision for this?

Hello dear Simon. Today I have read from news that immigration service could stop to work because of lack of finance. If this happen then maybe even DV 2021 is gone too?

Because of not having birth certificate i am not being able to fill up DS 260 as lockdown has to end to go and make my birth certificate .
So is it late for me to fill up DS260 as my case number is earlier ?

1- will it affect DV 2021 positively for Oct, Nov, Dec or only for Dv 2020 because for Dv 2020 is irreparable?

I read somewhere that if you are single when you entry dv lottery , but got married after winning and before filling the DS 260 form , it will need to upload the marriage certificate while filling the DS 260 form.
Is this correct ? If yes how to do that , i cant find any example how to do it .
