Hello, Brit!
We suppose that the issuance of our visas today seems like a trick of the Department of State and let me explain why:
If I pass my medical exams in September so if I am issued visa in September I will be able to enter US before March 2021.
It could be OK but according the proclamation we can not enter US before 12/31/2020. If the proclamation prolongs for 60 days at minimum we lose the rights to immigrate again.
This is a critical problem for today! Can you say the lawyers (attorneys) about this?.
Of course we don’t know today whether the proclamation is prolonged but we know for sure that Mr Trump will still be in his presidential rights until January, 2021. And there is very high probability that he will prolong this Proclamation.
Please help tp spread the necessity of finding the decision of this future real problem on the hearing 25th of September because this can happen 100%. This will bring to nothing all our efforts!!! So the relief or the instructions should be clearly articulated before 30th of September.
It’s nonsense to have visas but be unable to enter! May be this is the reason why the defendants don’t appeal because they may clearly know TODAY that we shall not have opportunity to become legal immigrants!
Among the plaintiffs there will be people who will have additional medical exam. It means that they must enter the US in 3 months since the medical exam, not 6 months. So they are automatically losing chances to immigrated having issued visas!
On the web site of State Department https://travel.state.gov/content/travel/en/News/visas-news/diversity-visa-DV-2020-update.html (https://travel.state.gov/content/travel/en/News/visas-news/diversity-visa-DV-2020-update.html) is clearly written that 2020-DV applicants can not be issued a new visa after September 30, 2020.
So how can we protect ourselves from this risk of the factors described below and what would you advise us to do? What do you think?

1. People are not automatically losing their visas. They would have to travel in those three months.

Hello Sir,
We won the DV2021 as a Family. All my daughters names are written as one under the ‘NAME’ in her Passport and Birth Certificate , so there is no Given Name. When filling the DS260 form you are required to put ‘NAME’ and GIVEN name or the form will not go through , so I separated the names and filled the DS260 form. Is this going to limit our chances? and if so what can we do?

Hi Brit, there is an update on travel.state.gov webpage concerning DV2020. And it looks like that:
On September 4, 2020, the U.S. District Court in the District of Columbia ruled in Gomez v. Trump that the Department must make good-faith efforts to expeditiously process and adjudicate DV-2020 diversity visa applications by September 30, 2020. Therefore, DV-2020 applicants may be processed in embassies and consulates where local health conditions and post resources allow. In accordance with the requirements in the Immigration and Nationality Act and applicable regulations, applicants must be documentarily qualified, have paid all requisite application fees, be able to obtain the required medical exam by a panel physician, and demonstrate that they are eligible for a visa before visa issuance. DV-2020 applicants may be issued a visa through the end of the fiscal year, on or before September 30, 2020. Applicants are reminded that immigrant visas generally expire on the same date as the medical exam expiration; typically three or six months from the date of the exam. DV applicants whose medical exam has already been conducted but will expire prior to December 31, 2020, may opt to submit a new medical exam prior to visa issuance.
Although DV-2020 applicants may be issued an immigrant visa under this court order, Presidential Proclamation 10014, which suspends entry into the United States of certain immigrants (to include Diversity Visa applicants) remains in effect until December 31, 2020, and can be extended by the President. Therefore, unless a DV visa recipient also meets an exception to the Proclamation, that DV visa holder will be unable to travel to the United States on the issued visa while the Proclamation is in effect. The five Regional COVID Proclamations that suspend entry of immigrants who were physically present in China, Iran, the Schengen Area, the UK, Ireland, or Brazil within 14 days of entry into the United States are still in effect and not the subject of the Court’s order. Thus, while DV applicants subject to a regional COVID Proclamation (Brazil, Ireland, UK, Schengen Zone countries, Iran, and China) may be interviewed and processed, applicants who have been physically present in the affected region during the preceding 14-day period will not be issued an immigrant visa, unless excepted under the relevant proclamation or until they have been outside the affected region for 14 days.
DV-2020 applicants whose visas will expire before December 31, 2020 when Proclamation 10014 is currently due to expire, will be unable to immigrate on that visa, unless they are exempt from the Proclamation, and cannot be issued a new visa after September 30, 2020. DV applicants are reminded that if they were either in the United States, or held a valid immigrant visa on April 23, when Presidential Proclamation 10014 went into effect, they are exempt from the Proclamation. DV applicants who held valid DV visas on April 23 but were unable to travel and the visas have since expired, may be reissued a DV visa before September 30, 2020.
DV-2020 applicants whose cases were previously scheduled for interview appointment (even if cancelled) at a U.S. embassy or consulate overseas should reach out directly to that embassy or consulate for further information on their specific case. If a post is unable to process cases due to local health conditions and resource constraints, an applicant may request a transfer to another post. DV applicants can request a transfer by contacting the desired post directly; not all transfer requests will be able to be accommodated. DV applicants who have responded to requests for documents from the Kentucky Consular Center (KCC) and have been notified that their cases are documentarily qualified, but awaiting a visa interview date, will be scheduled in accordance with post’s scheduling capacity. The Department expects that, due to resource constraints, limitations due to the COVID-19 pandemic, and country conditions, it will be unable to accommodate all DV applicants before September 30, 2020.
Does that mean that all the selectees from the Schengen Area basically have no chance for the interview anyways? What are your thoughts on this?

2- i have send email to embassy but they have send an automatic email they said they will reply within up to 2 weeks time, should i continue send emails?
3- I tried to reach the medical center and the good thing they have not asked for an appointment they said you can come any day in the morning to do it and asked me for the required documents and they did not insist for the appointment letter since the DS260 confirmation is enough, So do you advice me to proceed for the medical to save time without knowing yet the interview schedule or should i wait for it?
4 Please what are the documents should be attched with spensor i134 for financial support?

I have posted before but still need a little guidance if possible.
I am currently on a E3 visa that will expire at the end of May 2021. My CN is OC 1350+. Based of previous years my CN will most likely not be available to apply until July/August.
This leaves me with a dilemma on what to do.
I applied for the Adjustment of Status when I submitted the DS260 form to Kentucky and have paid the $330.
Will I be able to still apply for Adjustment of Status when my E3 visa expires and I remain in the country as a tourist (visa waiver), my understanding is no.
or
Would I be better off to change back to Consular Processing and return to Australia after my E3 has expired and do the process there?
or
Am I able to pursue a E3 extension before handing in my AOS form so that I can continue to work? Or has the fact that I have already filled out a DS260 at KCC made that avenue unavailable?

The Sydney Consulate confirmed that they are getting ready to interview and process as many applicant as possible by the end of the month.
They will prioritise named plaintiffs and those most likely to result in a timely issuance, which means categories 1 and 2, and then category 3.
Category 4 will be scheduled according to their rank order (case number) and the “post’s capacity”.

You may also need a new police certificate from AFP – the visa expires a year after it was issued or 6 months after the medical (the sooner of the two). It seems like that’s the thing that will get in my way.

I am applying from Bosnia and Herzegovina, group 3, interview cancelled.
I called embassy Tuesday (2 days ago) and they were informed about the judges order etc, but did not have specifics from DOS (Wa D.C.) and they are expecting them ASAP. (Just as mr. Simon said in his last yt video). The consular officer I spoke to was extremely polite.
Today around 10am (CET) the embassy called me and scheduled an interview for Monday, September the 14th.
This is not bragging, just sharing an info that things are going according to judges order, and I think (and hope) everyone will experience the same.
I’ll post the results of the interview next Monday or Tuesday, and best of luck 2all You guys and girls.

DV2021 is not the subject of the order. The judge was more concerned on the immediately, and critically, impacted people – DV2020.

Info from the embassy in Poland I got today, after previous inquiries, is that unfortunately they are not allowed to grant visas under the Schengen Area travel restrictions. They just mentioned it may be possible for people who fall under the exceptions from the presidential proclamation. I graduated recently with the master in biotechnology and wonder if that could be taken as one of the exceptions: “For travel as a public health or healthcare professional, or researcher to alleviate the effects of the COVID-19 pandemic, or to conduct ongoing medical research in an area with a substantial public health benefit (e.g. cancer or communicable disease research). This includes those traveling to alleviate effects of the COVID-19 pandemic that may be a secondary effect of the pandemic (e.g., travel by a public health or healthcare professional, or researcher in an area of public health or healthcare that is not directly related to COVID-19, but which has been adversely impacted by the COVID-19 pandemic)”
Any thoughts on this? Or do you believe something can still be done with the Schengen Area restrictions in case of DV2020? Thank you

Personally I feel that DoS is not complying with the letter/spirit of the order – BUT it will take time to sort that out. So, for people affected by the covid bans, I strongly suggest getting out of the affected area immediately.

As I have explained in a number of recent posts and videos, you would be in my “group 5”, and therefore no lawyer can help you instantly and you will not get a visa unless the Judge grants an extension. The legal team will be asking for an extension, but it is unlikely to be granted. You can join the lawsuit asking for an extension if you like – read my recent articles.

Hi Simon, the local embassy in my country Cameroon (AF Region) have issued a statement saying they have resume DV interviews, and they will do their best to interview as many people as possible cause they know what DV means for them, however, September 30, still remains the dateline.
They stressed that people should not try to contact them to enquire about their cases cause it will instead slow the process. Thanks

I’m a DV 2021 selectee and I already submitted my ds260 as well as the supporting documents. But later realized that there’s a difference in spelling of my address in passport and other documents(Birth certificate and Police Clearance Certificate). A letter is missing in birth certificate and Police Clearance Certificate. Will it be an issue ?

I just called up KCC regarding my appointment and I have already received ready to schedule for appointment in march. They ask me whether I’m one of the plaintiffs of Gomez v trump. I have participated and filled the form which you ask for. I replyed to kcc yes I have participated with AILA but I am not sure I am the main plaintiffs. And as well informed that it’s only 7 main plaintiff for Gomez v trump KCC replyed no its many more and they are waiting for the list to receive from AILA first priority will them and and then rest and told me to call back next weekend. So my question here is how many people are main plaintiff with Gomez v trump and next week end mean we will have only 4 days remaining.

If you were not one of the 7 on the AILA cases and not named on the other cases (Charles Kuck/Curtis Morrison), then you are not one of the named plaintiffs.

Hello Brit, our case is AS2021-8xxx, I received email for submitting the Documents at the same time I unlocked our DS-260 for some revision and not resubmitted yet. I would like to have your opinion on below points.
1- our passports will expire on April 2021 (After 8 months from now). should I renew all the passports and resubmit the DS-260 with new passport ID and information ? it doesn’t have delay on our case ?
2- Is there any specific countries that its police certificate in not required for DV ? It means the citizens are not required to submit the policy certificate to KCC
3- should I submit the education documents to KCC ? If yes, should I submit just for principal or others ?

1. Yes renew.
2. There are some exceptions – read the instructions & reciprocity pages.
3. You show these at the interview. Just the principal.
Read the instructions! ALL three questions would have been answered if you had done so.

There is a FAQ answer about that. You are not clear whether you have been scheduled already or not. It can take a few days, and sometimes longer in normal circumstances, but these are not normal times.

I am a plaintiff from Curtis Morrison lawsuit, group 3. I am in the Schengen area and heard in your last stream about the the lawyers helping set up interviews in non-Schengen countries. I’ve been bombarding Curtis and his associates with messages to no avail, where can I find more information on that, is there really such an option?
