Hi Simon, hope all is going well with u. my worry is this:
1) when a principal applicant travels first to the US to work money inorder to bring his derivatives, is there a limited time that if these derivatives do not join him in the US their status as derivatives shall expire.
2) Incase the principal applicant has many children and a wife to sponsor, can he be permitted to work for sometime in the US inorder to sponsor these derivatives?

So you apply as married but you were just in couple and you marry after the results. Yes you will be questioned why you get marriage certificate after the results .

@Stephane. That really varies by country or region. Where fraud is more common they apply more scrutiny, but other embassies in other places would be less of a concern.

I will like to get you opinion on this. Even if interviews for 2021 starts in January, and the Judge orders the government to start issuing the 9095 visas for 2020. Will the 9months not be less to issue the visas for 2020 and 2021, considering the closure of some embassies, the pandemic and the fact that embassies will also have some other categories of visas example the family based visa to issue???

The family based visas is totally normal business (along with other visa work), so that’s not a valid point. BUT I have explained multiple times that 9 months is “technically possible”, but that certainly does not mean no risk!

This is a question on the time out of USA following activation.
Is it either:-
1. 12 months from arriving in the USA following visa issuance – aka “activation”
2. 12 months from DEPARTING the USA
Also, if you don’t have a record of when you departed the USA exactly, than what?
The US airport authorities DO NOT STAMP an exit date- is that normal? and what is the logic behind a lack of an exit stamp – as how are they expecting travelers to remember details – humans are humans and they forget exact dates and details which is what a passport is for – to look at exit and entry details

Regardless of whether you just activated or it is a later trip abroad, any trip abroad should be no longer than 12 months. BUT – read the FAQ for more precise detail.

We have submitted ds260 on July, but we have not received any email from kcc for requesting to send support docs, I used 2020 dv summitted photo for 2021 dv entry (we used photo tool to ‘save’ for both 2020 and 2021 before submission). No that is not the reason. Your case number is not going to be current soon, so they are prioritizing toward lower case numbers.

There are times when they don’t have a backlog of work, and at that time ANY case number could be processed. If they have a lot of work to do, they prioritize that work by case number order.

1- I filled out ds-260 form previously and submit it, recently the address of the host person in the United States have been changed (actually change only the apartment in which he lives and he stayed in the same building) Do I have to request to unlock ds-260 form to correct the address.
2- Do I have to send a non-conviction certificate or a criminal evidence journal certificate from any country in which I have resided in other than the country of nationality for more than 12 months since I was 16 years old and over, because this matter is very confusing to me?
3- If my CN is AS19xxx, what is your expectation for 2NL? Is it possible for us to have an interview at the embassy (middle East specifically) before September 2021? You already mentioned that this year is unusual and the Asian region has only 8,500 visas available and the CN numbers are big?

1. Correct it at the interview.
2. You need to read the instructions and be sure what applies to you. It is not confusing if you read it carefully.
3. I am not going to predict final cutoffs, especially in Asia where the removal of the Muslim ban will have such a huge impact. I have explained that impact in a video, specifically for Asia. You can click the archive link to see that.

It depends on what happens to the Schengen ban. You may have to go somewhere else first for 14 days prior to entering the USA.

You are confusing things. The Schengen ban was set by Trump, and does not automatically end on Dec 31. The other ban (the immigrant ban) ends on December 31, but Trump can extend that if he wants.
There is some talk of ending the Schengen ban, but until that happens you still need to go to some third country for 14 days.
It is important you remove your confusion, and pay attention to things going on.

You either process them as part of the DV case (paying all the fees and dealing with the 6 month expiry) OR you can bring them via a family sponsored case later (once you are in the USA), but that process is more complex, expensive (you’ll probably need to pay a lawyer), and slower (takes 2 years).
2. If attending on your own you don’t need to send the documents. So – you need to decide how you will process.

They accept police certificates up to 12 months old, and if you have not been back to that country they will accept the police certs for even longer time periods.

So literally I made a mistake writing the expiration date of my old passport on the description or in the text message where i wrote the explanation of changing my passport to a new one, and i sent that email to kcc,,, that is the only mistake(the date of expiry) because the scanned documents are all good without mistakes… Should I wait for their reply or Should i resend the documents again correcting also the date? thank you

Hello Brit! First of all, thank you for posting so many great videos and in-depth explanation of processes that stands behind the DV lottery. I have a short, concerning question, though:
I was born in Russia, but my father is originally from Latvia (my mother was born in Russia as well, though). We moved to Latvia when I was a baby and I had a Latvian citizenship since then.
I claimed my country of eligibility as Latvia, which is in the same region as Russia (EU). This year I won a green card with the number 2021EU00019XXX (upper 19′). Later I found out that I needed to put “Russia” as country of the eligibility.
I lived in the US for around 3 years (I was on E-2 visa, O-1 visa) and my daughter been born there as well. I’m a tech-worker and my salary is pretty high even for California state (BayArea). Never overstayed or broke neither local or federal laws.
I saw your video where you mentioned that the CO may forgive the error if it’s the same region. How likely you think the officer will just oversee that I made a mistake in “Country of Eligibility”? Will the above mentioned factors will play the role? Thank you!

In most countries it is not normal to change your passport when you change address – so you decide based on local procedures.

Hi Brit, I’m a DV2020 winner and got my visa in September (subject to PP 10014). I applied as a single person however my fiancé is American and we consider getting married – maybe even before me being able to enter the USA (in a 3rd country or proxy marriage). Could that negatively influence my immigrant visa anyhow, since it’s printed on it that I’m single? Or on the other hand could that help somehow in terms of me being able to enter the States? Those are just the thoughts for now and I’m not planning to make any sudden moves if not advised.

I am a DV-2020 winner and I already have the visa sticker in my passport. Visa’s expiry date is March 20th 2020.
In the context of the U.S. election – is it already 100% clear that immigration with DV will be possible starting January 1st? I mean – cannot Trump as a still-president prolongate the immigration ban / Schengen zone entry ban for 2021? Is it obvious that Biden will not do it (i.e. has he explicitly stated that)?
As moving to a different continent requires big logistical effort and some preparation time, it would be of course great to start the preparation process as early as possible also being sure there are no major roadblocks.

No it is not 100% certain. Trump could extend 10014. So – that would then require Biden to remove that ban as well as the Muslim ban he already plans to remove.
I have explained recently that the best advice is plan to travel after the 1st, but be able to change plans. If you don’t like that uncertainty you could wait until we see what Biden does and assume there will be no ban before your March 2021 date (I assume that was a typo).

I just checked the 2021 DV status this week and I’m selected for the 2021. I have a low number(7000). My 1st question is what is next after I submit the DS 260? Do I need to wait for the 2 NL before I submit my documents or I have to submit the documents before I get the 2nd notice.
Another question; I made a mistake at my marriage status at first and I said single. However, I was married and still now I’m just separated. I was married a US citizen and I was denied a visa and then we just separated. Since we live in a different country, we have not done the divorce. What should I do on the DS 260? Should I go a head and finish the divorce before I submit the DS 260 to say divorced or should I say legally separated and explain the reason at the embassy or what do you think is better? Thank you!

After you submit your DS260 they will contact you for documents in due course.
The second part of your question shows you lied about your marital status. That will most likely cause disqualification, although since your spouse does not need a Green Card you *might* be allowed to continue. It’s a very small chance though, so you might waste your time and the fees to get disqualified. Only the CO can decide. If you decide to proceed – honesty is the ONLY way you will be able to proceed – meaning you should apply as married (because you are) but make it clear that your spouse is a US citizen and the entry form said you did not have to include the US citizen spouse (and that choosing single was a mistake). You will need your marriage cert and possibly documents from your spouse.

Hi Brit, don’t you miss that Sept 4-Sept 31 period. What an adrenaline rush. So on to a question though, do you know whether any of the tax accountantant sites advertising services for green card holders are any good (maybe you use one)? Seems to be a number that offer good fixed price services, although I also need some initial planning advice before becoming a tax resident in the US.

Ha, I know what you mean. I am NOT enjoying this period of waiting for things to restart.
About taxes, no I just use a regular accountant here. I simplified my position before I left the UK, focussed mainly on removing investments that would not be understood by US tax law. For example, I had ISA’s in the UK which were growing tax free in the UK, but would not have been tax exempt from US tax law – so I cashed those in, but left UK pensions as they are recognized/explainable from a US perspective. I kept real estate (because it’s simple accounting). So with a little planning and proactive work you can easily get to the point where you can do your own tax filing or use a US accountant.

cheers Brit. I also want to keep real estate but limit capital gains if ever I sell (am not subject to capital gains tax currently). Apparently there is an option for a “check-the-box” election before becoming a tax resident, which adjusts the cost base, but I will pay for some advice to confirm the details. Otherwise I might be stuck with a property I can never sell just to avoid taxes (first world problem I know).

Yes that’s a consideration, depending on how you own the property, and also taking into account currency conversion to determine the original basis at the time of purchase compared to now. I was lucky in that the muppets that chose to Brexit devalued the currency so greatly that my original cost basis (in $) allowed a lot of profit to go untaxable.
Also, don’t underestimate the “power” of depreciation on real estate and the effect on US taxes.

We can’t predict how things will work under Biden. His many focus will be getting the virus under control, but that does not mean processing can’t continue in other countries where the virus is better controlled than here.

2NLs for January interviews would normally be sent before the end of this month. If they don’t send them it looks like we will lose January interviews as well.
