You seem to be saying your visa was valid as of April 23, and then renewed. Is that correct? If yes then you are NOT subject to the ban. If an annotation says you are, that is incorrect. You will probably have to speak to the embassy to get them to print some proof of your exception so that the airline will board you.

I (DV2021 applicant) am about to fill out the DS260 and just wondering – should I enter the info from the passport I used when I entered the lottery (at the time valid but expired a couple of weeks ago) or my new passport info.

We are DV2020 winner, and got the visas issued in Sep-2020. Our visas have this annotation: “upon endorsement serves as temporary I-551 evidencing permanent resident for 1 year”. Does the endorsement mean entry stamp to USA stamped by immigration officer at the port of entry. We do not have the actual Green Card.
We traveled to USA on 1st of January 2021 but need to temporarily leave USA for winding down our affairs in the current country of residence. Can we exit US and return back? Do we have one year or 6 months to return?

The entry stamp on the main DV winner is correct (01-Jan-2021) while on entry stamp on all the DV derivatives entry stamp is 01-Jan-2020. Remember that visa issuance is September 2020. So can we request deployment of logic during our re-entry to USA? Sorry for all these questions. Just panicking a bit. ZUK.

I do wish you had read what I suggested completely. The instructions say “Comments: Not available by mail. Post recommends that consular officers waive the general requirement to obtain police certificates unless the applicant lives in the UAE.”

This is regarding the DV 2020-Info Collection Form that you mentioned in your live stream on January 9 2021.
1) Should only the DV1 person (primary applicant) fill up the form? Or should the DV2 (derivative) submit another entry as well?
2) For the final question on: Are you a plaintiff in the Aker or Gomez case? Towards the end of your clarification, you mentioned that “This is specifically about people who gotten their visa either by reissuing or because they got their visa in the last 3 or 4 weeks of September. Right? This is about that. So are you a plaintiff?” In our case, my spouse and I were issued our visas in the final week of September 2020. We are not named plaintiffs in the Aker or Gomez case. Do we select yes or no?

In Iran for 2021 dv lottery 865.568 person and their derivatives applied. And Nepal 1.092.035 applicant with their derivatives participated for dv 2021. Iran and Nepal have always a lot of participants and because of that during the selection most of the first selectees come from these countries with more participants. In Europe, Russia, Ukraine, Albania…In Africa Egypt, Algeria, Sudan, Morocco, Democratic Republic of Congo, Cameroon, Ghana, Ethiopia…

If you put 20 red balls + 3 blue balls + 2 yellow balls + 1 white ball in one box. If you want randomly take a ball from the box you’ll probably tek a red ball because there is more red balls than others colors.I hope you understand why the first dv selectees with low case numbers come from countries with more applicants.

1. I’ve been taking your advice that because of my relatively-high case number, there was no point into rushing with the DS-260 submission. Do you think I should continue waiting to submit the form or just do it and be over with it?
2. Should I list my internships in the work part of the form? When I researched online, I saw people saying you should do it but I think that there is probably no benefit from that, just the potential delay in the processing of my DS-260 since I have interned in 3 different countries throughout my bachelor’s degree. (I’m a recent grad who has only started working full time September 2020)

1. I would wait a few weeks – we will learn a lot in that time and you are not risking anything with that delay.
2. No – internships are not important, although if they led to long periods of stays in other countries, that could be relevant.

My father is a winner of DV 2021. His case number is AF2XXX. It is current as indicated within the number shown on the October 2020 visa Bulletin. I am a beneficiary and my concern is about my age. My father submitted the DV entry on October 12 2019 when I was 19 years old going to 20yrs. He then submitted the DS-260 when I was 20 then going to 21 years. I was born in November 1999. The DV started October 3, 2019 and results given on June 6, 2020. From October 2019 to June 2020 is 243 days. Now that, I am 21 years old.
With the information and calculation above, I want you to please answer the following inquiries for me:
1. Do I stand a chance to get a visa?
2. Kindly show or determine what month/time I will age out for the visa?
3. Kindly provide me the memo or link that talks about “Child Status Protection Act” (CSPA) so that it could be shown to the CO in the event when this issue of age props out during interview.
4. Since indeed interviews are scheduled numerically based on case numbers that have completed processing, with this info, will interview be scheduled starting with case numbers in the October bulletin first, then November, December, January and so forth for the purpose of it being done in order?
5. With Biden`s win formally certified, what time do you think the first set of interview will be scheduled?

I’m really worried Biden won’t remove the PP10014 before our visas get expired. Although he did say he will remove the Muslim ban, but what if he meant for the tourist visas and other immigration categories.

If spouse is principal applicant and immigrant visa is approved (together with visa for its better half), but after entering the US, principal applicant decides to temporary leave US and return to home country to finish some private or other business (up to 12 months period), can its better half still stay in the US and start living / working etc.? Or they have to go together back to home country, and then return together?

I am from Egypt but live in an European country and I am a citizen of that country as well, but in my European passport I have different first and last names because I have changed it. Now I have two different citizenships, two different passports with two different names. I am the derivative and when we applied for the DV lottery in October 2019 I applied with my European passport with Egypt as a country of birth, but when I filled the DS260 and by the part of FULL NAME IN NATIVE ALPHABET I just wrote it as it is in my European passport. Do I need to unlock the DS260 and write it as it is in my Egyptian passport? But this will be wrong i guess. I do not know. What do you think?
Question nr 2:
We have submitted all the required documents to KCC including my both passports and the proof of name change from the country where we live and we get a positive response that our documents matches their requirements and we will be scheduled for interview when our case get current. Although KCC has accepted and confirmed that everything is fine with passports and name change, can that cause any kind of trouble for our case at the interview? By the way I have been to US in February 2020 and all my data is registered at the embassy and I had to fill in additional application and i showed them both passports and the proof of name change and everything went well and I received a 10 years valid visa. At the LAX airport I been asked extra questions regarding the name and that took them 3 minutes and then he smiled and wished me a nice stay. I am just trying to give you clear details and background to make it easier for you to help me answering my inquiries.
Question nr 3:
Egyptians are not required to apply the I134 form? (I know minimum 200 families from different places in Egypt who got the DV visa without the I134 form). I am just asking this question because if I remember rightly you have answered a person from Egypt and lives in France that he need a sponsor or he can show a proof of bank statement. I can show a bank statement with 30 000 USD plus proof that we own apartments and other things which value more than 500 000 USD. We are two adults and two children, do you think that is enough?

1. You should apply with your full legal name. Use the other names used section of the DS260 to list other names.
2. No trouble – just prepare well. Please try and be brief with questions.
3. It is not true to assume Egyptians have some sort of exemption. Your savings may be enough, an I-134 would be better.

I am a DV 2021 winner and my case number is AS14xxx. I have a question regarding filling in work experience section on the DS260 form. I have recently switched from a full-time job to freelancing. I currently have 4 freelancing jobs and they are of the same nature. They all need more than 2 years of trainings/ experience. But when I tried to update my present work experience on DS260, an error that says “Duplicate Occupations provided” will pop up and I couldn’t save the form. Could you advice what should I do? Should I still list all of the freelancing jobs (I have signed contracts)?

No. Assets are counted at 20% of their value, whilst income is counted at 100% – so income is far more powerful on an I-134.

I am a DV2020 selectee member of the Gomez certified class and a non plaintiff,whose interview was scheduled on May 5, at Tirana US Embassy in Albania,which means my visa status was Ready for an appointment.Today when checking my status at CEAC it resulted in no data of my CN,like it never existed.Checking with a few people I know they also resulted to have no data.
A while ago I asked Attorney Charles Kuck who said that he knew about the issue but didnt have a clue as to why is happening.
A friend of mine based on people he asked thinks that the DOS the Goverment or whoever has to do with this has deleted the principal applicant’s record.
We just thought of asking you or even let you know and hopefully you can have an answer or whatsoever..

You cannot exclude your wife. If you divorce you should say divorced and show the evidence to kcc and ambassy. If you are married you must say you are married. Otherwise after the selection you will be disqualified 100%.

Hi Brit am a dv lottery winner of 2021. Am in the US. Have work permit and ssn after filling for asylum in weeks after my arrival in 2018 April. My case is still at the USCIS and nothing yet. It is possible (but tricky) to adjust from asylum. But you can do that until your case number is current so I suggest you hold your decision for a month or two.

As we’re losing time there are a lot of lawsuits being filed one after another which obviously is a good thing, at least the plaintiffs have some hope of getting their DV 2021 issued at some point. At the same time this may also disappoint the non-plaintiffs as they could be deprived of getting the visas even with their low case numbers as they always say plaintiffs are given priority in such circumstances !!

Mr Curtis addressed that his case is also filing a class action but my question is there’s a lot of families participating would that harm the people who didn’t join? Since there would be a priority for plaintiffs would you think that would delay non plaintiffs if we got a class action

I have read a lot of people above talking about many lawsuits, plaintiffs , non plaintiffs , ….. So I am confused about these comments .
Sir PL could you tell us for the last time till now ,had we better participate in any lawsuit to preserve our right or we will have the opportunity to participate in a lawsuit later , in other way will we have time to participate in a lawsuit if our situation will worsen more?

There is no lawsuit you can get on right now to my knowledge, but really – that’s OK – there are ways you are being protected, and you don’t need to be on a lawsuit to benefit. So – relax and be patient.

If I got married to a lady who already have a child under age 21 after dv lottery entry but before the reaults are out, it’s advisable to mention the child as a stepchild in the DS-260 form.And can I take the child to the interview

Yes you must include the child on your own DS260, and your wife’s DS260 and if you want the child to get a greencard they will need a DS260 of their own. In that last case the child would then attend the interview.

It’s too soon to predict how things will go. The Jacob case has a judge assigned, but it could easily be re-assigned. Be patient and give it some time to avoid speculating based on early information.

Some DV winners in my country are applying as NIE through some lawyers. But there is a cost, which is almost 1000 $, if the lawyers apply for you.
1.Is there a possibility for me to apply by myself?
2. Is the visa guaranteed if the application is confirmed as NIE?

Dear Mr. Bithsimon;
I read the FAQ about the Child Status Protection Act” (CSPA) as advised by you but still need some clarification.
From October 1, 2019 (Registration eDV) to June 6, 2020 (Winners announced), a gap of 249 days. I was born November 22, 1999 and 21 years presently. Now, I added 249 days to November 22, and the result landed on July 29, 2021.
1. Does this mean that the case has to be current up to this date in order to stand a chance to get a visa? Or
2. Does this mean that interview has to be done before or on this date in order to stand a chance to get a visa?
3. If the case becomes current within this time or up to this date, can interview be done a month or two later?
4. Is this the age out date, meaning no interview hereafter?
The FAQ made mention of a policy regarding DV cases and the CSPA as described in a memo from 2003 that you advised that one should download, print and give same to the CO in the event where he/she (CO) is not acknowledge about this issue of CSPA. I tried accessing it by clicking on the memo as instructed but then this is what propped up:
Page Not Found: The requested page was not found Sorry! The page you are looking for may not exist, may have been removed or had its name changed, or is temporarily unavailable.
5. Kindly access this memo for me so that I can include it in my documentation so that when this issue comes up during the interview, then I can just show or handle it to the CO.
As I indicated earlier, my father is a winner of DV 2021. His case number is AF2XXX. I am a beneficiary. He submitted the DV entry on October 12 2019 when I was 19 years old going to 20yrs.
