On my DS 260 I have submitted 2 passports (Italian and Moroccan).
The Moroccan one will expire soon but the italian is not yet to expire.
Do I need to renew the Moroccan passport so that both passports are unexpired for 6 months beyond? Or one valid is enough?

Hi Brit,
We got selected with my wife is the main applicant from Saudi Arabia/Asia. She lost her birth certificate (the one issued from Saudi Arabia). We only have a copy. We did apply for new one since last September and still unsuccessful to obtain it. She has the original certificate from our home country showing all correct details including country of birth being Saudi Arabia. I am afraid we might not be able to obtain the original Saudi Certificate before KCC asks to send the documents ( case# 2021AS00011xxx).
1) Do you think this might creates problem for our case.
2) can we use the copy we have (not original) for the birth certificate issued from Saudi.
Or
3) can we use the original one we have from our home country.

Hi Simon! I have a question about public charge and proof of financial stability. I am currently employed at a company as a contractor, but am planning to leave at the end of March, then receive unemployment insurance for a few months afterwards. Does this have any impact on my dv application, specifically in regards to the public charge concerns? The reason I am leaving is because my activities as an artist started to really take off recently and it is requiring a full time engagement. This is what I plan to do after moving to the US as well.
I am the primary applicant and my wife is an accompany, who is also a full time corporate professional but is leaving work soon (most likely she will find a new job in a few months). We have had consistent income here in Japan and my wife has about $250k in assets (about $200k in cash saving and $50k in stock). Would this be enough to satisfy the public charge concern for the two of us? We have no kids, at least not yet. 🙂

The job you have in the “old country” doesn’t matter directly as you’ll be leaving that job anyway.

Dear Brit,
I dont understand something.
1.The PP10014 ban the new immigrants cause the unemployment situation in USA.
During the economic recession of 2009-2011 the unemployment rate in USA was 11% but the Obama-Biden Administration did not posed a Ban for the immigrants. even that the economic situation was even worse ( now the unemployment is 6.7%) .
2.Regarding the Covid situation, they could easy ask for new immigrants to provide a negative PCR test, the situation in the world is different compared to April, June when was not so easy to provide a PCR test due to availably of the tests, laboratory centers, etc. Moreover they could ask for a self quarantine after the arrival and a new PCR test.
3.LEGAL IMMIGRANTS will take with them all their money, they are selling Houses, Cars, Business etc. All these money are going to be injected in the USA Economy. One Alien will bring roughly 10,000$ and for only the DV2021 the sum will be 550 milion USD, not including the Visa Fee, Medical Fee, Green card fee, Money spent to the Airlines etc.
As a conclusion there are a lot of choices but what I don’t understand is why they dont want to applicate this requirements. Why is so much fear to judge in a logical reason??
Sorry for my frustration but I would like only to find the Logic for more than 1 Year.

I’ve sent an email to KCC reg. my DV2021 status, and have received an answer saying that my forms have been received and are currently processing, and to allow several weeks for processing, and interviews are to be scheduled numerically based on CN that have completed processing, also, once KCC finishes processing DS 260 they will sent and e mail with instructions to complete in order for my case to continue processing…
Now,
1) is this an automatic reply not saying anything that we didn’t knew before ?
2) is a ”several weeks” also automatic time frame for usual processing (not crazy COVID year / bans etc..)
3) I’m from a EU country with only 30 selectees, and Embassy operating normally, CN 2021EU385**

I won the DV2020 and my schedule got cancelled due to corona in april
My interview was supposed to take place on the 16th of April
I red that the court decided to issue 9000 visas for people those whose interviewed was cancelled during that period..
It has been quite, i have not received any news neither from the US embassy nor from the KCC.
Now i am wondering if all is well on my side, or there is no more hope..

The only thing you need to do is learn how to explain properly to the airline. Contact the embassy and ask if they can help provide proof for the airline. Print the orders that explain you are not subject to the ban. You can sort this out yourself – so get focussed on it.

Do you think that, given the extraordinary circumstances, asking to increase VB numbers massively on the next bulletin would be a wise action? What do lawyers think?
Even if there is people in a position to actually be able to process the Green Card, there is a risk that their case will not be current or not in time. This issue is even more acute this this year 2021 when there are both a lot of selectees and few embassies working at full.

Yes, in the past we have seen cases that went current in the final month and still got completed in time. The IOs tend to prioritize DV cases over all other cases. Also, you can file early – meaning as soon as the VB announces your case number as becoming current. That gets you an extra 6 weeks advantage.

Generally you would just pick one of the cases based on case number and ability to meet the education requirement. Then you both process on that case. There is no advantage of processing both cases.

Well if you get selected, you will use the new passport but will have to prove you had the old one – so keep scans of it.

Hello HCAP, yes immediately after the submission I got the confirmation number, an email whit attached a pdf file which was included my name, Case number, date of submission, confirmation number and a two barcode (case number and confirmation number). The pdf must be printed and brought with all the documents at the interview.

The things I can say today are the same things as the week before. We are waiting for the embassies to open, the ban to be removed by Biden or the courts and so on. All you can do is be patient. It sucks, but that is all.

Hi Simon, I m a DV2021 winner and ready for interview but my sponsor of affidavit sent me his w2 and his federal tax returns . He and his wife filled together the Form 1040 Federal Individual Income Tax Return and all the documents he sent me show both of them. I think he sent me the incomes of both of them. The new order is a restriction on entering the USA. A 14 day quarantine period. So – no need to get worked up over that. However, the 10014 ban is far more impactful. So – we are fighting that right now and hope to get that removed. For now, wait.

My wife and I got married a month after we found out that I won the DV-2021 (EU14***). We sent out our DS-260’s and additional documents in October and have not gotten any response from the KCC yet. Ever since then, my wife has changed her last name to mine and she just received her new passport. Do you think we should contact KCC to update her last name in the DS-260 and send them a new police certificate with the updated last name or should we just bring both the new and the old passports to the interview and ask them to update her last name then?

I know that this year you are not predicting and I am not asking you to do so, but I have a conclusion and I want your opinion on it, which is that this year the rates of non-responders are very large compared to the years 2019 and 2018 as the monthly visa bulletin numbers were less than this year with a month or nearly two months delay, although in these years there were rejection rate participating monthly in the Visa Bulletin numbers calculation for the next month, and also the presence of winners from banned countries, which is a matter that leads to raise the values of the monthly Visa Bulletin numbers in those years .. On the other hand, this year there is no refusal rates till now due to not starting interviews, and Visa Bulletin numbers are higher .. Can’t we conceder this is an evidence of a high rate of non-responders this year?

No, there is no evidence whatsover to conclude that there is already evidence of a high rate of non responders this year.
There are some factors that lead to low non response, such as the economic downturn and general Covid climate, but that is just a hunch, nothing concrete.
Now, having said that, we have to wait for interviews to start to see what is going to happen about those cases, as it could increase denials, and perhaps non response cases. However, all that remains to be seen.

I know that the DV lottery winners and their derivatives must obtain the police certificates from the countries in which they lived for six months or more after turning 16 years of age.
I have lived in the U.S for several years.
Do I need to obtain any police certificates from any U.S departments? ( like the FBI background check or the State criminal history record or the local police certificate?)

It’s a high number and would be somewhat risky, even in a normal year. Because there has been delays with even starting interviews, there must be even more risk now. All you can do is wait and see.

My case number is low (AF8000’s). I got an email from KCC in November to inform me that my documents were received and KCC will contact me regarding the interview schedule. It’s been 2 months and I am concerned.
Additionally President Biden has just added my country (South Africa) to the travel ban list due to Covid.
Please guide me on the way forward. Any advise will help. I am a medical doctor and I am not even sure if that will enable me to get exempt.

Hey brit ,
I been a GC holder since 2017 currently am overseas due to family issues anyway I losty green card my wallet been stolen and now am frustrated I don’t know what to do however I know I should issue a replacement but in the meantime I want to go back to the states what should I do because the green card replacement take over 8 moths so they issue a new one and I have to be in the states .
My question is what should I do so I can go back without having my green card with me ???

Hello! I was issued an immigrant visa in September 2020, and due to order PP 1 0014, we can not travel.
Will this order be overturned by the current President?
Do we hope that we are equipped with a visa that we can travel before our visa expires?
And if our visa expires, can they provide us with a visa again?

There are two possibilities.
Biden might remove 10014. If he does, this Friday would be a likely date because they have said they are taking some actions on immigration on that date.
However, if he doesn’t, two court cases are challenging 10014, and we could hear about those in the coming weeks.
Also, there are efforts being made for re-issues as a backup plan.

Hi Brit! My husband I won DV lottery 2020 and managed to get to the US on March 10th 2020 just as the ‘ban’ came in so we just managed to get through and activate our Green Cards which was great. Our Green Cards arrived at the specified address a few weeks later. We had planned to move to CA before March 2021 but COVID has delayed a number of things on our side and made a move impossible for us before June/July 2021. This will mean we have been out of the United States for over 12 months (it will be closer to 15/16 months by the).
* Do we need to make a short trip over there before March 2021 (i.e. so we haven’t been away for a year + by the time we move)?
* Or, do you think they will accept that given the unusual circumstances of the state of the world we are living in and not be as stringent with the length of time that it will have taken us to move out there?
I guess we would prefer not to have to make an unnecessary trip over there with our 2 year old and risk COVID exposure etc.
Really appreciate your thoughts on this if you get a moment.

There is a process of applying for a returning resident visa at your local embassy when you have been absent for more than 12 months. That is the SB-1 process. It is used when circumstances beyond your control are in place, which would be the COVID crisis. However, acceptance is not guaranteed. So, you can either hope and try that process, or take the short trip. Perhaps you could ask the embassy about chances for the SB-1.

Incase KCC schedules interviews in April (Our case number is current) our daughter will be sitting for her exams will not be able to attend during this period.
Is it possible for KCC to reschedule for her interview as soon as possible say in May.

I’m a DV2021 winner and i have an inquiry about DS-260 as I’m confused about the interview location as I’m living in a country and my wife is in another country because of the pandemic so just wanted to know is there is any way that we can do split interviews in two different countries and when it comes to the question on DS-260( is your spouse immigrating to the U.S with you or is your spouse immigrating to the U.S at a later date to join you) which answer will allow me to do interview alone , please advise .
