Hi Anna. The US border is closed right now to most countries because of corona virus. It’s not advisable to travel to the US now with this pandemic. We have a 10 year Visa and the last time we were in the US was September 2019. If you go to the US now, you will be forced to quarantine for 2 weeks in a hotel and you will be monitored. Then there is a huge winter storm in the US right now with electricity going out in states like texas. Do you really want to go to the US in the midst of a pandemic and horrible winter? Think about it seriously as you won’t be let in as their borders are closed.

Hi Brit,
I’m a DV2021 selectee. I have lived in over 6 countries since I was 16 for periods of over a year in each country. I have reached out to the local embassies of the countries that I have lived, to see if they can issue police certificates of good conduct. However, they have indicated that embassies don’t process police certificates.
I went on to consult with officers at Interpol and asked if one Interpol certificate would suffice (covering all countries I have lived in) for immigration purposes, but I was told that it wouldn’t.
It is not practical for me to move to all these 6 countries with my family to collect police certificates. The COVID-19 situation further adds to the logistical complications.
Kindly advise if there is a smart way out of this dilemma – from your experience.

1. Well – it’s a process that takes around 2 years – but yes – the end result is a Green Card.
2. You can still enter as normal. Your chance of being selected in the lottery is very low.

I am dv2020 visa holder and I am French citizen,my visa will expire 23 March I am currently under 10014 and Schengen ban. I order to enter to USA I need to spend 14 day abroad EU, so 23 March – 14 day my limit day to quit EU is 9 March. If any decision about 10014 will came between 9 March and 23 March (visa expires day), i don’t have enough time to spend 14 day abroad EU and enter USA.
So question is, will I lost my visa ones for all and I don’t have right to reissue or extend the new one visa,it is correct ?

my husband is CN AF13** and has already recieved his “ready to schedule interview” email. l have just noticed that on the ds 260 he filled in his year of high school as 2000-2001 on history of education. however he supplimented some of the subjects in 2002, though not in school. do we have to unlock the ds 260 to correct that or we can just submit the two certificates at the interview. (i wouldn’t want to unlock if it is minor as this might delay our case of an interview). NOTE: his first certificate, i.e the one for 2000-2001, he had a pass so it would still qualify him on educational grounds even without mentioning the second one.
2. if your answer is he should unlock, what does he enter in the section that asks for name of school, since he was not in a formal school when he supplimented the 2nd time.

In the open paragraph of the response from government the lawyer say the administration is actively reviewing PP10014 and will make a decision before the end of this month. The question now is which decision is positive or negative but we are here because we ie our lawyers and the court has always been thinking that the government will act like this and at the end she react the opposite. With the hearing that is scheduled for today, please tell the lawyers to asked the court that the court should at least do something to help those visas that are due to expire between today and the end of the month and March ending while waiting for the government to do the something she is planning to do by the end of this month…

Of course Mehta is on the side of dv winners but what transpired is he is suggesting that he lacks authority to grant entry for visa holders. I saw this coming based on his september order. I guess he will preserve dv2020 dream one way or other but this will probably means new medical exam fees and visa reissued later. That is not the best outcome for people waiting in third country due to 14 days quarantine rules. Wait and see.
At this point i think everybody should request NIE based on whatever reason you think you should come to US now.

Hi – I am DV2021AS14xxx Canadian citizen born in Iran. I filled DS260 in June and received an email to provide documents in August. Since mid August that I have sent the document, haven’t received a reply. I followed up twice with email and they sent me a generic reply that your DS260 is processed, you have received or soon will receive an email to send your documents.
1) How can I follow up and know if there is problems with my document or it is just not been processed?
2) Since I have submitted DS260 and according to their reply it is been processed. Let’s say eventually I don’t get DV visa, will I be banned for future visits, L or TN visa?
3) Can I cancel DS260 on Sep 30, 2021 to avoid future entry to US problem with temporary visa?

Hi Ivan,
If you are AOSer, I would advise to follow Sm1smom blog. If BritSimon is the king of DV consular processing, Sm1smom is definitely the queen of DV adjustment of status.
Plus, note that it very much depends on where you are doing your AOS. If you are in California or New York, the process goes much faster than in some smaller regions, where USCIS officers have little or no experience with DV cases. That was my experience and I was in Denver – it took about 4 months for me from start to finish.

My question is in regards to one of the possible decisions that Judge Metha could make. If he freezes the unexpired visas until the final rulement on Gomez, but meanwhile Gov lifts the ban, does it mean that people will not be able to enter?
This was pointed out by J. Mehta during the hearing. Also Nicollet Glazer said it in Twitter. At the same time Curtis says a federal judge cannot do this for unexpired visas. So I’m confused. What is your opinion?

My question is regarding National Interest Exceptions to Presidential Proclamations (10014 & 10052) for aging out child. My sister is a derivative under my dad’s DV2021 case and she turned 21 last October, 2020. I know that she is protected by the Child Act (CSPA) but the period of time that her age is frozen will be up soon. I noticed a section on the NIE exceptions for immigrants: “Applicants who are subject to aging out of their current immigrant visa classification before P.P. 10014 expires or within two weeks thereafter.”
Do you think I can request NIE interview because of this?
I cannot contact the NVC because I do not have an NVC number and its required to fill out their public inquiry form. Who should I contact?

It’s your choice – but adjustment of status will probably add some delay in your case. You have to wait at least 90 days after entering, and then the process takes longer. So – you could probably only file in June or July, and the process is not quick. On the other hand if your embassy is open, you are likely to get a CP interview in May or June – based on the ban ending and covid not being bad in your country.

Honestly waiting is all you can do at the moment. The Anunciato case seeks to cover all DV2021 cases as a class and they are applying as much pressure as can be applied. Hiring another lawyer is pointless.

No. Not all embassies will allow scheduling of DV cases. That is my point – and why I have asked the legal teams to press for emergency/mission critical designation for DV cases to give us the best chance possible under the diplomacy strong framework.

Just kind of a speculative question with regard to the lottery. Given the ongoing pandemic, do you think that would have increased applications, reduced them or would they remain the same?
Firstly, I know it’s speculation at this point, just curious to find out your assumption on the matter. I applied this year and I’m from Ireland and the winner rate is really low here with only 30ish ‘winners’per annum. So basically wondering whether my chances of winning have improved at all?

Probably less applications – but yeah – purely a guess. Your chance of winning is the same as anyone else in the EU region. Some countries get more winners, simply because they have more entries.

Some cases have been processed, yes – but none have been scheduled for interview.
Your case number is very high though, and therefore significantly at risk. They will not rush to work on your case, and because of the short time left and the quota you need to realize it is likely that you won’t get a visa. The quota is a bit over 8500 visas and there are at least 22,000 people ahead of your case number.

You are getting way ahead of yourself. Mehta will not make any decision next week. There won’t be any decision until after the government complete their review of 10014. If the review results in 10014 being revoked, then you will be able to enter before your visa expires. If not, we will push for NIEs similar to what was granted this week. But for now, relax and wait.
