Mehta will not make a decision before the government make their plans clear. So – the scenario you describe will not happen. Mehta also is well aware of the issue – and will avoid causing harm. Relax.

Hi Simon,
Could you please clarify that I’m understanding today’s news correctly? A DV 2020 visa holder with a March activation deadline can now travel (as long as no other travel restrictions are in place) and activate their Green Card starting on 4/1/2021 unless PP10014 is rescinded before then? And they will have 6 additional months from either of those respective dates?
Lastly, Judge Mehta’s final decision on Gomez has no effect on this category of individuals besides perhaps extending the 6 month activation period out even further if the decision comes after the expiration of PP10014?

No, I dont think you have that correct. First, we are probably going to see some relief from the government either by revocation of 10014 or NIEs for visas already issued. That should be your first choice. However if anything goes wrong with that, then the order from Mehta is the back up plan, but we have to wait to see how that gets implemented. But plan a should be your first choice.

Hello Simon, I have been following your twitter and video updates, and I read the NIE given to those with expiring DV Visas between 17/2 and 28/2. In the article, https://www.law360.com/articles/1356671/lottery-winners-visas-at-risk-without-injunction-judge-fears, it states that Judge Mehta “can order a visa extension under his equity powers.’ Under the premise that PP10014 may not be revoked, would that potentially all for DV visa holders expiring in March to extend their Visa validity beyond March? As mentioned previously, that would be the best scenario for me personally, as I would not need to rush to pre-prepare for the March 17th deadline and the HK hotel quarantine when I return. You Re about to become free to travel. Mehta has issued his order, but there is a remaining risk that we don’t win the final judgement. So you should not gamble on that, travel by the expiry date if you can.

I know that Mehta has granted relief for us meaning that our visa will now not expire on the 10th but if and when 10014 is revoked.
But my family and I do not want to be waiting any longer as we need to get started on our New Life?
since the state department has granted those with visas from the 17-28th of Feb an NIE. Do you think there’s a possibility if they don’t rescind the ban next week that they’ll continue to do NIE’s for the rest of us?
And if yes, it wouldn’t be a problem for us with valid visas after the 2/28 & approved NIE (if so) to travel?

1. It will still be acceptable.
2. Maybe – you will have to wait for the outcome of the Gomez case. However, as you are in category 5 (not ready for scheduling), you will be at greater risk than other cases if the visas granted stays at 9095.

Hi Simon. I’m a DV 2020 visa holder from Turkey. I’m currently in Mexico as my wife is a Mexican citizen. I would like to learn that if you know that how NIEs are issued? If they are handed out by embassy or being sent as mail or email. As you mentioned someone from The Netherlands got it, I’m assuming you know about it. In case they are given by embassies we may need to go back to Turkey to obtain them. And for entering the embassy you need to be present in Turkish soil for last 10 days. Have been working in Afghanistan for over 7 years giving direct support to the US military and currently I cant travel home because we have been told if you go home it’s almost sure I will not come back to work.. Since this is a difficult year I don’t want to risk my job because my family depends on it..
Is it OK if I send a letter of authorization from the US army instead of my police clearance and tel them I will get the police clearance as soon as I get home.. We undergoe I thorough security scrutiny all the time.

Hello Brit, DV2021 winner here. Thank you for your reply previously. I do aware that My Case number is high at AS28XXX. However, I’d really like to know, as I read a lot of questions here some of them have received their Submission documents calling,but I don’t. Anyway my Case Chargebility location is Indonesia which is only 317 Winners from here.
We won DV2002 with AS17XXX before, but it was long ago and due to emergency at that time we were unable to go for the interview. And now, we won again for a second chance , We’re so hoping and waiting also praying a lot that hope they will at least ask us to submit the documents to them, since we have filled our DS260 since June 10 2020 ,
▪But till now, we have not received any call to submit additional documents either. Does this mean we won’t even have this chance? Because it is Almost end of February 2021 already.
We are so waiting and hoping for a bright spot to appear.

So, maybe I’m wrong, but now we can clearly affirm that in all this mess DV2021 is the most affected, Right? even if the pp10014 is lifted, no visa issued, no interview scheduled and if the PP is lifted up now, probably we will see something in May, only 5 months but as always happens KCC in July will start treating dv2022 cases. It’s, really frustrating.

You would be very unwise to submit at this point. Your number is almost impossibly high. There are only 8600 visas and well over 22000 people in front of your case.

I have a plan to reside in California (San Diego). I also gave an address there to receive the Greencard. But, I have decided to enter the USA through crossing the border by car from Canada(Toronto) at the time being and stay in Buffalo for only 1-2 days and then come back to Canada. l will go back to SanDiego later during summer. In this case, I won’t encounter some COVID restrictions. I am wondering if it will be an issue from USCIS point of view. Doesn’t CBP ask me why I have entered the US through Buffalo, while planning to reside in California. Can I apply for Social insurance card there or I need to wait to go to California.

Hi Simon. If we do get the blanket NIE for DV2020 and I’m optimistic we might – we have to travel right away before our visas expire right?
What I really wanted to ask is whether I should be applying for the I-131 to re-enter the US together with the AOS I-485? Since I plan to come to my home country and sort somethings out before fully residing in the US.
I’m rather quite confused since my research shows thats is only for non-immigrants? Or is it for everyone awaiting a green card?

We asked the consulate if we can qualify for a NIE and they said to send them the child birth certificate. We did and we are still waiting for their response. What happens if they give all DV2020 visa holders a blanket NIE? Will we have to enter by our original expiry date as shown on our visa? Or will we be able to get that 6 months extension (treated as issued as of whatever future date)?
I understand there is a risk in that, and we should just travel as soon as we get a chance. However, I live in Australia and so if I leave now, I probably won’t be able to come back to conclude my affairs until 2022, and it will not be practical to do that that in such a short notice.
Frankly, if there is no extension, it is already too late for my family.
What’s your opinion/advice?

Because the Australian borders are closed, and the only way out is if you file a statutory declaration saying that you’re not intending to come back.

I’m yet to resign from my current job so I was planning a quick round trip so I can get back and properly resign , take a month vacation before I make the permanent move. I am the main and only applicant. My spouse is already LPR in the US.
While filling eDV and DS260, under spouse name, I have used her full name. Assuming the full name is A B C, under given name I have put A B, and C in the surname.
Her green card and passport does not mention C i.e. A is the given name and B is the surname. However, in my marriage certificate provided to KCC, it shows the father’s surname (entire family name) to be C. So basically, this whole thing is a situation of “over-information” where it wasn’t really necessary.
1) Should I unlock the DS260 to remove the name C? Considering I am current, ready for scheduling, and that my spouse will not be immigrating with me?
2) What do you think Judge Seeborg is waiting for? At this time or near future, should I keep an eye out for PP to be removed?
I believe the AD embassy is operating just fine since Covid is pretty much contained over here.

Or is this one of those “use your own judgment” situations?

I do understand the severity/consequences of name fraud and so on, but since my spouse is not immigrating with me, I don’t know of any other docs to be presented about her in the interview other than marriage certificate, and anyhow I haven’t committed to any lies in the form…just over-information.
Bottomline is, I am freaking out at the moment, and I don’t want to waste any more time in getting the 2NL..
If asked in the interview, maybe I can tell the CO about it?

1. Aside from the Sealed Envelope, X-ray images and our Visas, is there anything else that we have missed out or additional items that you would recommend we show the officer

Thanks for all the hard work you do. I am 2021 DV visa recipient.
When I submitted my DS260 form I selected Vancouver as my interview location city, as that is where I reside.
I recently looked online and it seems that Vancouver does not process immigrant visas and the only location in Canada this can be done is Montreal.
I have no issue with flying to Montreal for the interview if needed, but I am concerned that when (if) DV visa interviews begin, my interview location being Vancouver could cause issues and delays. I have a question regarding DS260. Documents are already sent but afterwards I requested unlocking the DS form.
After making the correction in the DSform and submitting it again, I should resend all documents again?
I should write a new mail to kcc or I need to follow up on the first mail where i have sent the docs for the first time?
Do I explain what is the correction in DS and in the documents when sending them again?

Yes, the documents will be changed too.
So I should send a brand new mail to kcc with the new documents after submitting the new DSform or I should follow up on the first mail?

So you will need to resend the WHOLE package again. What email you use or explanations – doesn’t matter – you can decide.
