Hi Brit,
Please help us with our green card situation.
We are the winners of the DV lottery 2020. We are from Belarus.
On March 10, 2020, we were interviewed in Warsaw, Poland. After which we were sent for an administrative check.
And on March 24, we were informed that the administrative processing was completed, but immigrant visas could not be issued until the travel restrictions were lifted.
Then there was no information, since everything was closed.
In July 2020 we moved from Belarus to Canada.
And on September 11, the Warsaw Embassy sent us a letter stating that they could get us the visas. If we agree, then they will have to make an administrative check one more time, and we will have to undergo medicine again (but only in Poland or Belarus). We agreed to a second check, but asked about the possibility of undergoing medicine in Canada and sending passports by courier. They said that this can only be done if we transfer our case to the Canadian embassy. On September 14, we wrote a letter to Montreal with a request to transfer our case from Poland to Canada. But on September 22 they refused, explaining that they are busy. We called the embassy in Poland and asked what to do, they said that they could not answer yet. Call later. On September 29, we contacted them again, they told us that they did not know what to do with us. Our case was the only one they had from DV2020 which passed the interview but did not receive a visa. Since then we write them letters every month but they still do not know what to do with us.
Please tell us if we have a chance to get a green card? After all, I heard that 5000 visas were allocated for the winners of 2020. And even those people who have not been interviewed received them.

It is unfortunate that you were not able to get that done in September. The Gomez won you a small window of time, and many people succeeded, but your move to Canada complicated it, and ruined your chance. There is no point contacting the embassy each month. As far as they are concerned, the DV2020 year is over. In a normal year there would be ZERO possibility of anything changing about that. In this year there is a chance that the Gomez lawsuit is won. We won’t have any news until May, and perhaps even later. So – pay attention to updates from me about that.

Good morning brits. I’m from africa with CN 52***. I filled in my ds 260 and submitted in July . I have waited for a mail from kcc requesting my documents to no avail so I decided to sent the documents to kcc and an authomatic responds was received confirming the reception of my document.So far, no mail has been received from them confirming that my documents are ok. I wish to know whether it is adviceable for me to sent the documents again? Also, can I call kcc to fine out if they actually received the document? .when do u think my case can become current since we are already on 34000 in the African region as can be seen on the vb of the month of may.my embassy of chargeability is yaounde and it seems they are not interviewing dv 2021 cases

I think you need to check your document status on the same DV website (check status) after you type your CN + Name+ DOB year only, here you will see kcc said we received your doc and satisfied with the doc.

That is not something I have seen before.
I have only ever seen two options on the ESC page. One is the original letter that says you have been selected, and the other is the 2NL which shows the interview date. Nothing in between. Are you saying there is another letter or notice shown there? That would be very important to a lot of people.

Hi!
I have a questions regarding documents needed for the interview. I have read that you need proof of either a job offer in the US or proof of funds in order for your green card to be approved. However, I can’t really find any of this information on the US government website.
I will not have a job offer if I, hopefully, get an interview when the Swedish embassy opens for visa interviews so I will have to show a proof of funds. How much money are they expected to see in my accounts? And do you know if there are any requirements on the document? My bank cannot provide me proof in dollars, do you think having a document from my bank in English in Swedish SEK would be good enough.

1) As “immigrant” we are , from the 8th of April exempted from the Schengen ban right? I can fly directly to US even if I was in Europe the day before my arrival or need to be in a “safe” country 14 days before my arrival in US?
2) If so should I inform the airline, to avoid any misunderstanding that I not under any travel ban?
3) Once I enter the US and they CBP stamp my DV1 visa it will become permanent and not valid for 6 months only right? So I can travel back and forth US as much as I want waiting for th I-551 to arrive right?

I have two questions on DS260 please
1. Addresses: I wasn’t a resident on any of my campus and rented addresses. I had residence in a different town than what I wqs working in? Do I still need to list all the addresses back from 1999? If I put only my registered address that might not be accurate but if I put all addresses I lived at there won’t be a record on it. Would that be an issue if I wasn’t a resident there? I lived with friends before buying my own appartment. What would be an accurate approach here?
2. I have a US vaccination record because I got additional vaccination when on an exchange visitor visa. On the other hand it does not have all vaccinations required for immigration. What is th w correct answer here? I think it should be yes but can you please confirm.

I hope all is well with you. I am a DV-2021 selectee in the US trying to proceed my case through AOS. Given the recent visa bulletin, all the regions went current except for Iran (my case), Nepal, and Egypt. However, many of the applicants from these nations are currently living in the US and wait for their case numbers to apply for the adjustment of status based on the DV program. The cut-off number for these three nations increases in small increments and we (as people living in the US with higher case numbers) will have less chance of reaching that cut-off threshold. Is there any solution for this? We know that this is something that probably have to be addressed by KCC, not Charlie Oppenheim, and not USCIS. I know you might have been asked a lot about this one and my apologies in advance.

In the reciprocity pages of some countries the general documents section has the text “All government issued documents may be authenticated by the Ministry of Foreign Affairs for submission to foreign authorities”. In some pages of other countries the general documents section is empty. In the latter mentioned countries, does that mean authentication from the Ministry of Foreign Affairs isn’t a must?

When I called US Consulate Lagos for my case, they told me that it is at NVC! Why is it at NVC? I thought it is only US Embassy/Consulate and KCC for DV services!

It means nothing. At NVC is simply the starting status for all cases, but NVC are not involved in DV cases.

Anything could happen. Numbers are not important anymore, unless they retroregress (go backwards) in subsequent VBs.

1. Why is KCC not pocessing cases by numerical order for current cases? Are there any administrative or logistic difficulties?
2. Injustice is against those low CN. Covid is indifferent to everyone, beyond anyone’s control. But administrative rearrangement is achievable. Lawsuits should be raised about this point.

Stop “thinking” and start “doing”. You can file AOS today, so you really should have got married already to apply as married. So the question is – how quick can you get married.

Hello,
Brit, we are getting married tomorrow. We set up an appointment to pick up the marriage license tomorrow at the clerk office; we will sign the license and file the day after. Here is the deal, after filing the marriage license, there is a period of up to 60 days to get the marriage certificate, which must be included on the AOS package. I will send a email to KCC tomorrow to get the DS-260 unlocked so I can change the status to married. Our plan for now is to get the AOS packages ready to be sent before May 15th. We will basically be limited by the time it takes the state of Florida to send our marriage certificate. Do you know if we can send the AOS packages without the marriage certificate, and send the certificate separately as soon as we get it. I read your FAQ on marriages, and we are basically in between scenario 2 and scenario 3.

See what options there are to get a copy of your marriage cert immediately. There will be something. It’s just a matter of asking what you can do in a case where you must have immediate proof of the marriage.

Make sure the rest of your AOS package is complete. You will need medicals, and have to pay the fees also and there is normally a delay while you wait for the receipt. You could ask Sm1smom for input on whether you can send the package without the fee receipt or not.

We already assembled our AOS packages last night. We are scheduled to do our medicals on Monday afternoon, hopefully we have the form 5-7 days later. The only thing limiting us after we get he medicals is the DS-260 payment receipt (I sent the payment yesterday around 6 PM as a postal money order). Who is Sm1smom? How do I ask them if it’s wise to send the AOS package without the payment receipt? Thank you so much for your help Simon. We are working at full speed thanks to you answering our annoying questions!

I’m DV21 winner and my case number is AS25k and i want to change my interview location to the country of eligibility(Qatar) which is my born country and I’m residence permit in this country but my wife is not with me and she’s in my home country (Egypt) and I’m unable to apply for her on visit visa because of the pandemic . There is any chance i can unlock the DS-260 and change it to ( she will immigrate to the U.S at a later date to join me ) and i will do the interview alone here in qatar , will that be possible or it will cause a problem for me if i went alone to the interview .

KDU has only accepted 18 interviews so far, and it is clear that it will be a mess unless there is a fast change. So I can’t predict your chance. Being on a lawsuit may help.

It does NOT mean single people have a higher selection. It is simply evidence of high volumes of fraud in Ghana because agents register as many people as possible hoping to charge fees to give the winner their winning case number.

Hoping you can help – I have seen some of the answers on each of these options but just wanted to get your opinion on what is the best option at the point in time.
My case number is 2021OC29XX and now that all case numbers have gone current (with backlogs and chaos) it makes my situation a little more difficult.
Current situation:
– I am currently living in Sydney Australia (my hometown) with DS260/Interview selected for Sydney Embassy (CP)
– I have submitted my documents (back in January) but I am still waiting for KCC to confirm and mark me as “Ready for Scheduling”
– I have just accepted a role based in the US and I have just obtained my L1-A visa and I will be relocating to the US in 4 weeks time (end of May)
In your opinion, what would be the best course of action at this point? At normal times, I would just travel back to Sydney once I got an interview (if I do) and then fly back to the US, but with Covid, limited flights into Australia and mandatory 2 week hotel quarantine it makes things a lot more difficult.
Potential options:
1. Keep my interview in Sydney as is, and if I am able (if I get an interview), then try and fly back to Sydney, do the 2 week quarantine and fly back to the States after?
2. Try and change my interview to a closer city with no travel restrictions (potentially Mexico City) and obtain my greencard that way – would this even be possible in your experience?
3. Can I change my processing to AoS quickly now and get my greencard that way since I will be residing in the states within the next 4 weeks – if so would it help to have an immigration lawyer to help with this in this climate, my company (a big international company) will support here?
Sorry for the essay, but I just do not want to go changing things around with excitement with every region going current and end up shooting myself in the foot.

1. would work, but is hard. 2 is a non starter.
3 is what I would do. Your company lawyer is almost guaranteed to F it up. Very few lawyers in the USA know anything about DV related AOS, and I would bet money your company lawyer has literally no clue about it. It is NOT the same as other AOS.
If I were you I would prepare to file the AOS myself, more or less immediately upon your arrival. L1 is a dual intent visa, so you are able to do that. Read the linked document from the first post in that thread, and then Sm1smom will help you with questions AFTER you do your homework.

Hi Elisabetta, Naples usually take 2-3 days to answer but they do. If you received the “interview and medical appointment email” from them, that’s all you need , you are set.

@Brit, I am of course showing up for the interview, no intention not to go there. I just wanted to make sure i did everything i could for my case, before they can blame anything on me, so in the last couple of weeks i have been pinging both KCC and the Consulate and, in case the Consulate won’t answer, next week i will call the clinic as well to make sure they will have an appointment for me on 10/12.
@DV2021, my interview is scheduled for May 13, so good luck as your turn will be before mine 🙂

HI Elisabetta I was not checking CEAC because I got the confirmation email from KCC, a week before my interview I wrote to the Consulate in Naples and they answer me with this email:
Dear Sir,
Beginning February 5, 2021, passports will no longer be available for collection at a DHL location in Italy. Passport pick-up at the U.S. Embassy or Consulate is not permitted. Immigrant visa applicants have the option to pay for home delivery through DHL via https://ais.usvisa-info.com/ The cost for DHL home delivery is currently 30 euros, which can be refunded if not used. DHL delivery generally takes 3-5 business days.

Is there any lawsuits people from Iran can join? Since we have to go to another country and e.g. Turkey is not scheduling any interviews. My case number is 3500 and have been current since February and submitted my documents and ds260 last June and also got the ready to be scheduled email.

There aren’t any that you can join as of now, however Charles Kuck & Greg Siskind have mentioned that they may potentially be able to add more plaintiffs onto GohvBlinken lawsuit but that’s not guaranteed. There is a waiting list you can enter if you’re interested.
I also believe Curtis Morrison has a waiting list on his website for a potential new litigation for DV2021 but that is yet to be announced. Just keep checking their Twitter accounts and websites for any news. Hope this helps.

Hi Brit ! Im plaintiff at Kennedy ,we are waiting for final judgment from judge Mehta but its taking so long our patience level fell on zero ,I am hardly sleeping waiting for decision ,the most confusing think is we dont know If Judge will want a hearing before ruling or he will give the judgment without ruling,according to your opinion when we should wait for final decision? Believe me when I say if i get through this nightmare I had since 2 years and get my visa ,nothing will put me down anymore like this .Kind regards Brit

I don’t know when the filing ruling will be given – assume its June. Whilst waiting is annoying and frustrating it is not legally important.

1- Will Kcc still send 2nls to lower case numbers, slowly going up ? or they won’t follow that logic?
exemple for Country X: Last 2nl sent was up to AF5095 for may. Will for june KCC start with inviting the number just after that one?

Hi Brit, after adding my newborn child in mine and my wife ds-260 form i clicked to add new derivate in the CEAC website but some problem happened and it now shows two ds-260 forms for my new born child. I wrote to KCC mail to remove one form so i could submit and sign only one ds-260 form for my new born child but no response from them. What do you advise should i fill both ds-260 forms for my new born child and explain in the embassy that it was problem with the ceac website or should i wait more time for response from KCC?

As I understand it now that the VB is current for all regions and numbers it has become a random lottery within a lottery and case numbers don’t have rank anymore. My question is..is this only for KCC documents processing or the actual scheduling of interviews for those who have completed processing?
My embassy is open for DV interviews and I’ve completed processing.

However, my partner recently returned from his trip and we got married. I would like to know if it is currently possible to add it to my Ds-260, since I am current and have already sent my documents to the KCC.

Good day Simon – I appreciate your efforts (and time) and would like to make some suggestions to the extent that you can propose same to lawyers/AILA or Charlie, or whoever else. AF25***
The entire commercial world has adjusted in the best way possible to minimise impact on Covid, government should too. I find it strange that government employees, the world over, hide behind Covid to do their jobs. They can go to the shops and socialize but don’t want to work. The CO’s and most of the staff already sit behind 2″ safety glass and they can take extra precautions with asking people to double mask and/or present neg. Covid results at the interview, or even do the interview using technology so widely used these days. Surely most of the background checks would have already been done by KCC?
A sensible solution could be:
– allow for extension of the DV21 and 2021 through a PP / executive order. it was suspended by one, can it not be save by another one? alternatively through the congressional process.
– delay processing of DV2022 to Jan 2022 and extend DV2021 until Dec, you have always said that little is being done in the first 3 months in any event, so a little loss for DV2022
– extend DV2022 also for another month or 2 into DV2023
– appoint additional staff to resolve the backlog, even it means the visa fee has to be increased . Doubling the cost will still make it worth it.
– remove the DQ requirement for DV2021
There is no perfect solution but we should find a way, whether through AILA or the lawyers in the various lawsuits to make practical suggestions to improve the current lack of a proper process. Suing them will only resolve the issue for the lucky few plaintiffs. Yes, I did join the Goh action.
As a parting thought. Yes it has only been 3 months, but the current presidency blamed the previous presidency for months about their poor policies and handling of Covid. Surely they had better policies in mind that could have been implemented on day 1. You cant criticize if you can’t contribute… that is why I am proposing that we become part of the solution.

all regions going current makes sense
– there ver few visa issued and out of 54000 there is 53700 visas still available
– KCC will likely have a lot of work to do however I do not believe it’s major effort since DS260 been sent long time ago and all background checks would have been completed by now anyway.
– KCC will get to fresh start in DV2022 as of May 8th – so gives them whole months to work on all DV2021 that go their way until results of 2022 are available again and set of new DS260s starts arriving.
it be chaotic a bit – but it already is – from KCC side they likely to see which embassy bench is empty and work on these cases rather than on embassy that has already 200 ready cases and nothing changes – at least that would make sense.

Yes – there are some advantages, but it is not the method described by law. And it is clearly unfair to some cases, and overly generous to others.
