Sir the government response on Jacob litigation was to give 11000 cases for DV2021,
1- was Jacob litigation a class action or for plaintiffs only?
2- do the plaintiffs have the priority from these numbers of cases?
3- can the judge increase the number of cases for dv 2021 after this response?
4- does this response from the government will be the same for other litigation, (goh,…..)?
5- will we consider that for Dv 2021 the maximum adjudicated cases will be as the government response 11000 cases?

Then in March 2021, i enquiry about when my interview Date will be, 3 days later KCC sent me this email on 18th March 2021(extract below)

Your case number is now current for interview processing. Once the interview date has been scheduled, you will receive notification via email to check https://dvprogram.state.gov. If you need to make changes to your DS-260 you should contact the consular section where you will be interviewed, or bring the information about your changes to your interview appointment. Because your case is ready to be scheduled, KCC can no longer unlock your application.
Sir, that’s more than a month and a half ago. the Nairobi, Kenya Embassy has been working since Oct-2020.
1) MIGHT YOU HAVE HEARD of anyone in Kenya who’s gotten their 2NL, because according to CEAC Data, there’re 44 Case Nos who are ready for interview/sent to Embassy
2) Roughly what is the RANGE of the 44 Cases (Lowest – Highest CN sent to NRB Embassy).
3) Which month will the NRB interviews be for the above Case Nos.

If the reason your embassy hasn’t scheduled you is because it is closed, then no amount of lawsuits will force them to interview you. However if you’re current, and your embassy is scheduling cases, then the lawsuit could help you. Which is your embassy?

I am from Nepal and my Case Number is AS14**.
Since, The embassy in Nepal currently is not operating for DV cases and I think won’t operate before September 30 because of the second wave of Covid-19.
I can arrange a work permit/ visa to few countries In Asia where cases are very low. In this case, Can I transfer my case to a different country? What are the process? I hope to get your reply soon.

A lot of people would like to do that, and in general they are being told “no”. All you can do is hope that the situation improves OR that a Judge orders visas reserved for issuance after September 30. Obviously, neither option is “safe”. You can join a lawsuit if you want.

Records indicate you have submitted a complete and valid DS-260 application for each family member, and you have provided all required documentation to the Kentucky Consular Center. Interviews are scheduled numerically based on case numbers that have completed processing.
As I understand, both of these emails are sent by KCC when one enquires about the their interview after documents are processed. But, What’s the difference besides wording?

This year is obviously going to be a mess. The lawsuits might achieve some help either for individuals, OR perhaps for more people. But honestly, it isn’t looking good.

My case is at NVC now.
I have tried several times but unfortunately up to now I didn’t receive any response from KCC to change my interview location.
My questions:
1. Is it possible to change the embassy now for KCC?
2. How can I convince KCC to do this?
3. Could Iranians who living in Iran, transfer their interviews from Ankara, Yerevan, or Abu Dhabi to non-Persian speaking embassies? Like Oman, Qatar or Canada?
4. Can I request KCC to transfer my interview location to Montreal, and I will go there with my tourist visa?

Submitting the DS260 is not a certain denial for an F1. However, you are probably aware there are significant problems this year so you may want to go for the F1.

On April 30, Travel.State.Gov released prioritization for Immigrant Visa applications. A tiered approach is used to triage immigrant visa applications (below) and unfortunately it asserts that lower priority group (tier Four) will face continued delays due to COVID-19 and the number of visas issued in diversity visa program likely will not approach the statutory ceiling in Fiscal Year 2021.
Tier One: Immediate relative intercountry adoption visas, age-out cases (cases where the applicant will soon no longer qualify due to their age), and certain Special Immigrant Visas (SQ and SI for Afghan and Iraqi nationals working with the U.S. government)
Tier Two: Immediate relative visas; fiancé(e) visas; and returning resident visas
Tier Three: Family preference immigrant visas and SE Special Immigrant Visas for certain employees of the U.S. government abroad
Tier Four: All other immigrant visas, including employment preference and diversity visas

Thank you for the work you do. I just watched your Youtube live a few minutes ago. I know you to be the most upbeat person on earth. I understand the frustration that happenings are causing you, and totally understand your posture today. We love and thank you for what you do for the DV community.
I am a named Goh plaintiff. Case number AF55K. Been ”ready for scheduling” since June 2020. Moved to France for work, updated DS260 and received second ”ready for scheduling” email in November 2020.
I contacted a consulate in West Africa, they were more than happy to interview me if I would send an email to KCC to send my files to them.
In the email I told them the truth. Because of the Shengen visa ban, I wanted to transfer my case.
”Sir,
You may send an email to NVC requesting that they forward your case to Post *** if it is possible.
Sincerely,
Consular Section
U.S. Embassy, *****”
That was their response to my request. I told KCC the truth. They wanted me to send an address and unlock DS260. Like I told KCC in the email, I was only going to travel to the country for the interview, and rent an airbnb to stay in. Seeing how time-pressed they’are, I do not want to gamble unlocking DS260 for the second time.

It’s anyone’s guess – I really can’t predict what will happen with your case – they seem to be moving in number order. However, if I were in your position I would give them an address in the African country.

Background:
I am a DV2021 applicant with an Interview location in Moscow. Case number 14000. I submitted DS-260 and sent to KCC my documents (by request) in December 2020. Recently, I requested KCC to changed my interview location from Moscow to Yerevan and they did it.
So my questions are:
1. Since I sent my Moscow police certificate and military records in Russian (because initially, I thought I will be interviewed in Moscow). Should I send my documents again with a translation of these documents?
As far as I concern If I do that it might delay (even more) the processing of my case.
2. In case of the interview scheduled in Yerevan (Armenia), should I bring with me any documents proving my new permanent residence in Yerevan?

I applied using a refugee travel document, issued from the UK, however 3 months ago I was granted British citizenship and the Home Office did take my travel document as I am not a refugee anymore.
The issue here is that I completed the D260 with the details of my travel document which I believe I will need to take with me to the interview.

I was just looking up the CEAC data (from xarthisius) for May for Sydney Consulate and found the following. In total, they’ve issued no visas and refused 12 (for OC numbers). In comparison, Auckland issued 12 and refused 3!
Is this just a coincidence or can it be explained somehow?

For some reason when a case is put in administrative processing, it is showing as ‘refused’ while actually it is awaiting further information. So I wouldn’t worry about that

Lately I got residence visa of UAE and I have also emmirate id. I just send kcc to transfer my case to Abu dhabi. Because I m residing in UAE.
1) I know that they can’t unlock my ds260 now… without updating ds260, May they change my interview location?
2) Should I send my transfer request to Abu dhabi consulate too?
3) If they can’t unlock my ds260, how and when can I update it with my new adress and phone number. Please explain it in easy way.

Hello! No 2nl for Ukraine – sad news for everyone! As far as I know, we cannot do anything to impact somehow. Both kcc and embassy answer the standard responses. Yesterday I’ve heard from a friend of mine, that her co-workers had a tourism b1/b2 visas this month in Kyiv (to visit an office in USA, but this was 100% a tourism visa), so apparently our embassy does every type of interviews except DV.
Why the dv interviews have so low priority? Can we somehow increase this priority? Even though I’m trying not to be this sad and depressed person, I’m trying not to be pissed off that some b1/b2 are more important for the consular staff then thousands of dv people(

EU13xxx here, living in a country with a working embassy, and we’re also Rai plaintiff (Morrison’s mandamus lawsuit). Still waiting for document confirmation (sent them at the beginning of March after receiving request for documents).
Just finished listening to yesterday’s livestream… and we’re frankly feeling down. We have paused all major life decisions in the past year (including turning down a job offer from another country) in the hope that our “US dream” would work out in the end.
Still, we had high hopes that being in a lawsuit would help in some ways, but after listening to your livestream it’s clear to us that KCC does not intend on proceeding with documents approval, so we’re out of luck.
Do you think we should just give up and move on?
Although you don’t “personally” know us, you’ve been indirectly supporting us through this journey and we just wanted to thank you and tell you how grateful we are for the work you continue doing everyday.

We’re in a similar situation and also in Rai. EU10k and waiting for a very long time for KCC to confirm our documents. We’ve also given up on jobs, investment opportunities, basically a whole year of important decisions wasted and lots of waiting around. We also have very clear now that KCC has no intention of rushing to our CN which is unfair because if there’s any possibiliy from the embassy it will be blocked by KCC’s slow processing. BUT I’d like to think that anything is possible until september 30th and, who knows, maybe the lawyers will be able to preserve visas.

US embassy in Bangkok is operating in full capacity. Is it good idea to change my interview location.
I need a suggestion, regarding medicine if I get appointment. Do I have to conduct medicine in the same country or medicine from authorized hospital in my country of previous location
Do I have to go to location prior to changing my interview location.
And most importantly is it possible to change my interview location.
Is it a good idea?
And how can I change my location?

KCC might change your interview location if you have moved. Ask them.

Indirectly, yes. Healthcare is stupidly expensive here. Cancer treatment regularly sends people into bankruptcy. So – your illness may cause concern that you will not be able to support yourself or pay for your healthcare without relying on public assistance.

Please don’t panic.
1. DS260 can only be updated when unlocked by the KCC. Just send KCC an email requesting to change interview location. Also request they unlock your ds260 and update it with your current location. (Abu Dhabi). They will respond and ask you to explain reasons for the change. Because of how things are panning out, also just include your new address in the email you will send. Kindly note that ”Post Office Boxes and mailing addresses in care of another person do not justify a change of interview location.”
2. If your case is still at KCC as most of us are, no need to send Abu Dhabi consulate for transfer.
3. I will leave this for Brit.

Good afternoon Simon, Firstly may I say thankyou for your very helpful website. I read your website long before I applied and knew what to do and when. My Family and I out of New Zealand were fortunate to a win the lottery for 2019 and then manage an interview 2nd to last week of September 2019 cutting close but we all were granted. If it wasn’t for your site giving instructions on all the facets of application and interview process I am quite sure I would of been completely lost. We departed NZ just two weeks prior to COVID19 so not the best timing and continue to survive and make this our new home in Bedford, New Hampshire 🙂 Sadly our two daughters have struggled school wise with remote learning and one has decided to take a break and go back to Australia as they are dual citizens for a small time period. My daughter well step daughter has her father back in Perth, Australia. My question is what form do we need to fill out so that she has a re entry permit that last longer than 1 year. I know without filling in a re entry permit she has one year approx. but also believe there is a form that we fill out prior to her departure that allows her to be out of the country for a longer period. I know this info is on your site just been struggling to find it that’s all

The re-entry permit is the I-131 form – but you need to file before leaving, and wait for the biometrics appointment.- that can take around 6 weeks.

1. Not everyone will be scheduled, there is not enough time or capacity.
2. I think some will be sent this week.
I review some questions – and they won’t appear before I have done so.
