Hello … I want to ask a question about random migration 2022 I have submitted an immigration application and in my data I did not mention that I have a 7-year-old child from my ex-wife because we had problems and we were not in contact with my ex-wife and she refused to give me the child’s data so I could not add The child to the first application form and now I want to fill out the form ds260 Do I add the child in the 260 DS and does that affect acceptance or rejection knowing that I do not want the boy to travel with me and I do not intend to travel for him later and I will travel alone

1. Maybe, yes. It is too early to know anything for DV2022. Wait.
2. You can’t change the location in the DS260 once you selected it. You can ask KCC to change it if there is a good reason – but you have a long time to wait – so wait.
3. It is far too soon to think about that – you won’t interview until mid 2022.

I’m a single DV2021 selectee, have my valid passport, have my birth certificate, have no criminal record (have all required police records), no military record, been completely honest on my forms (no issues with country of changeability, no issues with marriage/divorce certs, no health issues), I have $40,000 in savings/stocks ready, my aunt (US Citizen) is my host, I have an I134 from my uncle (Green card holder), have a Masters in Computer Science from a US University, and 5 years working experience as a software engineer, and all documents are translated to English just in case and a copy for the consular officer.
Three questions:
1. I’m trying to be completely prepared for the interview, in your opinion, is there any grounds for denial I am missing?
2. Just worried since I see the refusal rate close to 50% at my embassy… do they tell you why they are denying you?
3. If they deny you, and you feel it’s unjust, can you appeal?

If you read some of the questions and articles here you would see that this year is not going well. Not many cases are being scheduled, and those that are being scheduled are generally the lower case numbers where the ocuments have been processed and the embassy is open. So – watch the video/article I posted yesterday about the lawsuit. It may be your mom’s last hope.

Wonderful video about the lawsuit, Simon! Thanks so much for sharing the info. I truly appreciate Curtis and these guys are pushing for the issuance of visas. We need to be so grateful about what they are trying to do…I will register and be ready for June 6th. One last thing, my crac status indicates my case is at NVC, does it affects positively to my changes to get interviewed or still the chances remain almost impossible?

So 3 weeks ago (April 20 to be exact) I had my interview at the US Embassy in Bucharest, Romania. Since then, I have not received any documents, including my passport. I contacted the embassy and their answer was that on that day there was a technical problem and that the visa could not be processed, and every time I contact them he says to wait for it because everything will be resolved. A month is coming soon, and we are still waiting. Do you think it would be ok to contact NVC, or should I still wait for a response from them?

Hi Simon. I’ve just been going through some of your videos and something has just occurred to me. I have my 12+ years of education. From where I’m from I believe the high school equivalent is Advanced Level Studies. That I have (plus my bachelor’s degree). My issue is though that I was actually in the States for part of my elementary schooling. So I don’t have ‘records’ of a full 12 years. I have from a year into secondary education till my bachelors.
What I’m asking is will the graduation certificates from my secondary education and Advanced Level Studies (which would be high school) be enough to show that I have the required level of education? Or would they need to see from start to finish type thing? I have tried contacting the schools I previously attended in the States but don’t know it I will be able to obtain any records.
What are your thoughts?

If I presently have 2 official simultaneous addresses (1 permanent and 1 interim) do I need to enter them both in the address history? I used my present official interim address in the application entry form since that is my mailing address. My documents were processed and a ready to schedule notification sent to me since February, i have contacted an embassy with few Dv winners and asked them to take over my case.
They gave me a green light but said i should ask the embassy to transfer my case to them. My concern is on Save diversity visa page shows that embassy is not active.

Hi Simon, I’m Italian (dv2021), CN 29XX I finally received the interview but instead of Naples I was assigned to Paris, (I don’t know why, I had chosen Naples), I sent an email to Naples just to ask for information and they moved me in Naples, now I can see Naples in the Ceac.
My question is: when will my interview now be? will they follow my CN and insert me in July or will they forget about me?

If you were scheduled incorrectly you should contact KCC to move you, OR contact Paris to move you. You would also need to confirm with naples that they will accept you.

Hello Brit thank you very much for all the information you provide us, in our case we already submitted our DS260 but we’re having an issue to send the documents to KCC because we don’t have yet the passport of one of our child because the process to obtain it may last until Augost/September 2021, in the mail we received it states “If you cannot obtain a particular document, send an explanation of why you cannot obtain the document, as an attachment in .jpeg or .pdf format, to [email protected], with your case number in the subject line” so my question is does sending this mail with the explanation to KCC would be usefull for our case.

Hello Britsimon! We are a 2021 DV winners with low number in AF region 83xx. We have received ready för schedueling email from KCC many months ago. We do agree 100 % with you about joining the new lawsuit but my situation is like that, i am originally from Egypt and i live in Sweden. The US embassy on Egypt is schedueling very few cases every month while the embassy in Stockholm is not scheduling any DV cases, but as we have heard that Biden administration is planning to lift the Schengen ban soon as well Sweden is going well with the vaccination and that is why we thought we might have a bigger chance to be interviewed in Sweden than in Egypt. Anyhow, i have wrote an email to KCC and asked them that i would like to be schedueled in Sweden instead of Cairo,but until now i got no response of them. By the way i have send a separte email to KCC once before and asked them if i will be automatically interviewed in Sweden or as i chose from the beginning to be shedueled in Egypt and they answered and confirmed that my interview will be in Egypt.
Now my questions are :
1-Should i wait for aresponse from KCC before joining the lawsuit or i just can join it without waiting for their response?
2- Is there any difference later after joining the lawsuit if the interview post is in Egypt or Sweden?

My friends girlfriend and partner fr many years has been fortunate enough to also have now been selected as a DV22 winner. He intends to marry her – now sooner than later and to therefore be a part of the selection process.
He has 2 children – the girl is 15 but the boy is 18 going on to 19.
Is there an age limit so to speak for him to be able to add his son as a derivative ?

In the initial entry I did not add my two children because they are US citizen (as clearly stated on the DV application instructions that I am not required to include children if they are US Citizen).
Now on the DS-260, there is a question asking about if I have children and children information.

Hi Brit, I hope you’re well? I’m the Australian who got stuck in Mexico and had to do my DV 2021 interview here. I messaged you a few weeks back.
I’ve still not had any response from the Ciudad Juarez Consulate and it’s literally impossible to get through to them.
I’m wondering if you have any advice on how I should go about this from here or if I should just keep waiting? I had my interview on the 12th April and was verbally told I was approved but they were having problems with the system from the US end.
It’s now been 5 weeks since then and no response. I emailed the KCC and the US embassy and consulates in Mexico but everyone just tells me I have to go through the Ciudad Juarez Consulate.
I even posted on their fb page and within an hour they had deleted it, but not responded.
Whats more is that they still have my passport and documents.
Do you think I should be worried? I’m of course happy to wait but I’m worried that if I need to be taking action and I don’t then I could miss out on the lottery, become illegal in Mexico (as I am only on a 6 month tourist visa) and loose my passport?
Your advice would be so greatly appreciated, you are the only person who seems to want to help.

That is ridiculous. I know the reason is probably the visa printing problem (that has been reported by others) but surely they can do something. I would go to the consulate and ask to speak to someone in authority. Bombard them with emails. Tell them to come up with a plan.

You have a step daughter – so you have to include her. However, if you did NOT include her on the initial entry, you will be disqualified.

I’m just trying to understand the principle of 5 uninterrupted years after the Green Card with the purpose of qualifying for the US citizenship. There are many articles on this out there. But still, I’m curious about some nuances of what a Green Card holder’s life is like.
1. Are those 5 years considered “interrupted” if I, say, leave the USA for only a 1-2 week vacation like many normal individuals do?
2. Does any (even 2-week-holiday) departure from the States during the Green Card period automatically disqualify me from future citizenship? Or am I right in understanding that it only resets the starting point of those 5 years and I just start the count-down all over again?
3. If so, can I, for instance, spend my first Green Card year periodically travelling to Europe, Australia or elsewhere for a week or two, and then start those uninterrupted 5 years?
4. When travelling abroad from the USA as a Green Card holder, am I still considered a national of my home country and as such do I need to apply for visas like I used to? Or will I be viewed as an American resident, entitled to all the travelling rights, just like US citizens? Say, there are countries that are visa-free for Americans but require visas from nationals of my home country. As a Green Card holder, which category will I belong to, when travelling from the USA?

I am from Algeria and I lived my whole life there. I was born in Saudi Arabia where my father was working as an expat on a temporary basis (They don’t have permanent residency in Saudi Arabia), and we were going back and forth between Algeria and Saudi Arabia (Mostly for vacations). We settled down completely in Algeria when I was 8 years old, more than 20 years ago.
When I was filing my DV Lottery application, I opted to select the eligibility/chargeability option based on the birth place of my parents, which is Algeria, since it is the most sensible option as I don’t have any ties at all to Saudi Arabia. The FAQ of the official website is stating this “the country of birth of either of your
parents if you were born in a country in which neither parent was born, and in which your parents were not
resident at the time of your birth.”
My question is, what kind of documents do I need to provide to prove this statement (That my parents are in fact not residents of Saudi Arabia)? Which will be needed when/if my case number made it to the appointment, since it is a high number (2022AF00057XXX).

The rule for charging to the country of parents is normally only used when your country of birth is ineligible. Otherwise you are supposed to enter with your country of birth.
So – you will have some risk of denial.
However, I could see a CO not applying that rule by mistake, and allowing you to “elect” to choose the other country (Algeria in your case).
So – if you want to take the risk, some suggestions for the types of documentation would be:
1. A letter of employment showing that an employer asked your parents to work on a temporary basis in SA.
2. Any proof that they maintained ties back in Algeria (such as home ownership or something).
3. A formal declaration from your parents stating they were only in SA temporarily, never had residency and so on.

My recommendation would be to not proceed.
If you add your spouse and child to the DS260 you will certainly be disqualified. The instructions/rules were clear about that.
If you LIE and continue to claim you are single, then you would be committing immigration fraud, which is a serious offense. You would be likely to be caught, and as a minimum you would be banned for life from the USA. But let’s imagine that somehow they didn’t catch the fraud, you could NEVER bring your spouse and child to the USA because their existence reveals the lie – and would result in your deportation, and worse.
I don’t understand why you didn’t include your family – but really, the best advice I can give is to forget this selection and try again another year.

Hi Brit! Sorry for posting long sentence. I received e-mail below with a title “documents received” on May 11th.
Congratulations! Our records indicate that your case is ready to be scheduled for an interview when your case number becomes current and appointments are available. Interviews are scheduled numerically based on region and which case numbers have already been processed.
All DV 2021 interviews must be concluded by September 30, 2021. Please refer to the visa bulletin at travel.state.gov to locate the current numbers being processed. This bulletin is updated after the 15th day of each month. Once an interview date has been scheduled, you will receive notification via the email address listed on your DS-260 to check dvprogram.state.gov for details.
If your case becomes current and you have not received notification to check dvprogram.state.gov, you may contact [email protected] to confirm all of your documents have been received, and that you are ready to be scheduled for an interview. This notice does not necessarily confirm that all your documents have been received or are acceptable.
What confuses me is last sentence says “This notice does not necessarily confirm that all your documents have been received or are acceptable”.
1, With regard to last sentence, can I see this e-mail as my documents are accepted and processed?
2, Is this e-mail “ready for scheduling” that everyone talks about?
3, If this is “ready for scheduling” mail, Can I expect to receive 2NLs after May or June visa bulletin published?
(My interview location Tokyo, Japan is accepting and working for DV cases; and there are only 15 people waiting as status as “ready”. My case number is 2021AS00006xxx which is already current in April.)

You can ask every day if you want, but even in normal times there can be a delay after “ready for scheduling” because your case missed a batch by a day or two. But feel free to be the squeaky wheel.

Hello Dear Mr.Brit,
i am asking about my chance of winning the lottery, noting that i am selected on 8-May 2021 (2022 lottery).
But i am born in Saudi Arabia, while my i am Egyptian & my parents both born in Egypt and when they were in Saudi Arabia they were staying on a temporary basis.
i have selected Egypt to be the country of chargeability, assuming that Egypt to have better chances than Saudi Arabia.
do you think this setup will work, based on parents country of birth?

Hello Simon,
1. In my ds260 I only listed my current job in my home country as it’s the first “real” job in my profession after college here. When asked in my ds application “Were you previously employed” I said no.
After submitting my ds I realized I never listed the summer job in a restaurant where I worked at during 3 summers in USA as a J1 student.
Should I ask them to unlock my ds so I can update it?
2. Is EU19xxx considered a safe or unsafe number in terms of making it in time for an interview?

2. You must list the year to help me answer. I’ll assume 2022. The number doesn’t sound bad (although we don’t know anything about 2022 numbers yet) but of course there could be continued impact from Covid so I won’t say “safe”.

You don’t need to rush. Your case won’t be current for months, probably not in 2021 – so you can afford to wait a bit.

Hello Simon, im a 2022 winner from europe and my number is 9xxx. I have never been convicted but i have been falsely accused of a crime when i was 18, 13 years ago for burglary, i did not went to jail or prison and the charges were droped i never went on trial and they found who did that. Will this have negativ effect on my interview? have anyone been rejected for something similar and do i need any special documentation about that from the police?

My passport(that is actually travel document) has the following names – surname/given name(which is first name)/father’s name(which is actually a patronymic name) and no middle name.
The question is, how do I fill out the DS260 form?
I am confused by the fact that in the column Given Names it is written “Your given name includes any first name and any middle name that is listed in your passport or travel documentation. If your passport or travel documentation does not include a given name, please enter ‘FNU’ in Given Names.
Do I have to put my Father’s name in the Given Names column?
Can I enter Father’s Name under “Other names used” instead? Wouldn’t that be perceived as an error?
I couldn’t find any information about this.

Hi!
Case number Eu19xxx
Currently my spouse is holding a valid passport from Thailand (expiration July, 2022) – which still has her maiden name listed – but we are already in the process of the passport renewal which will eventually state her married name. This process should take about 4-6 weeks in our case.
Since we are taking every attempt to avoid unnecessarily delay throughout the immigrant visa application, we would like to inquire which case would be the most appropriate route to take to avoid lengthening processing time.
Either we should,
– Go ahead and complete the DS-260 form with the current passport information we have (which will be changed in the next month hence, the name change from maiden to married name) and update changes later throughout the consular processes.
or
– Wait until we have updated the passport information described above and then proceed to complete the DS-260 form – which would not cause any delay (we will be able to do in the next 4 to 6 weeks).
As it can be seen we are eligible and meet all the requirements already, our inquiry is simply aiming to exclude any chance of delay in case completion of DS-260 form would not happen right away after the ‘Entrant Status Check’ but rather 4-6 weeks after that.
Appreciate if you have a second for input!

Please list the year when you ask a question. I am guessing you are 2022.
You case number won’t be current until well into 2022. There is no need to rush the DS260 submission, you have to wait for your case number anyway. So – I suggest you wait for the renewed passport.
