Dear Britsimon,
I have AoS questions:
1)Is it true AoS is impossible when ones enters on ESTA?
2) is it possible when one was not present in the US during the selection?
3) is it true one has to wait at least 60 days after the entry to apply for AoS?
You see where I am coming from:-) For some people this could be an option to avoid KCC and closed consulates & embassies.

I don’t consider myself an AOS expert – but I will take a stab.
1. Yes – impossible – I am certain.
2. It is possible, although I have known some rare denials for this reason.
3. DOS have a 90 day rule, so USCIS can deny based on violation of that 90 day rule. They may not always deny for that, but they can.

I have won the dv 2022. My number is 2022AF 10**** I submitted my ds260 on 13th of May and i printed it everything alright but then I didn’t receive any email to inform me with the documents they want , is that normal? And if yes how long should it take for them to respond ? If not what should i do and lastly my sponsor still is filling the I-134 affidavit support when he finish it should he send it to the NSCIS and send me a copy to take it with me in the interview or would i use it even before ? This isn’t generally a fast process, you need to learn some patience. In due course they will ask for documents.
It is far too soon to get an I-134 – you only present it at the interview.

I submited My DS 260 form and I’m worried that I didn’t make a mistake
1 in sign and submit section ( in last part )
I typed my case number without zeros as in the confirmation page that I printed now its looking something like this under the barcode (2022AS27000) please tell is it ok ?or I had to include zeros ?
2 in answer of the question ( do you have documentation to establish that you have recieved vaccination in accordance with US law ?)
I answered NO
Then it asked me for explanation so I wrote this : in childhood I got all necessary vaccinations such as polio , measles and etc but at the moment I dont have any documentation except a card which I got after Covid 19 vaccine .
Did I wrote correct ? Is it ok Or I had to write something else ?

I have entered the US over 2 months ago on DV1 visa (DV2020). To this day I haven’t received my green card. Called USCIS today they told me I have to do biometrics and they are scheduling an appointment for me.

i have a major issue in my application EDV
The first form i have submitted , my sur name as in passport and my name as in passport and i made a mistake i put in the middle name my father’s name since in our culture the middle name is the father name after being selected i have watched all your videos and found that i should have put in the middle name as not available .
now i have submitted the ds 260 correctly for me and for my wife and daughter . Will it be a problem and how can i solve it .
note that my university degree and my high school degree the name is written with a middle name ( my fathers name )

I’ve read your article on education vs. work experience as the two options of qualifying for the DV Lottery. Can I just ask additionally…
1. If I qualify on the basis of my education, will it matter (at any point during this process – DS-260, documents, the interview, etc.) whether I currently work full-time, or part-time or as a freelancer? Can my employment status affect my chances in this scenario?
2. Years ago, when I completed my pre-uni education in an ex-Soviet country, the elementary, secondary and high-school levels of education were all combined into the standard 10-year school programme, as opposed to the modern-day 12 years. So, I finished a 10-year school, then I studied at the local university for 5 years (Bachelor’s and Master’s degrees in one bundle), plus I took an extra Post Graduate course for additional 3 years. Thus, 18 years of state-based formal education. Can I be sure this will qualify me for the DV Lottery if I select the education option?

2. Yes. You don’t “select” the “education option”. You simply present your education documents, and if that were not sufficient they would then ask about work experience.

Defendants report that as of May 13,2021, a total of 13,475 cases ( 27,957 Applicants ) have been to be documentarily qualified. Defendants will provide additional summision due May 18.
US Embassy of Addis Ababa, they are stuck only on 7 Cases. Recently they posted on thier Facebook page that ” Diversity visas, it is unlikely that we will be able to provide visa Interviews to the majority of DV2021 selectees this year. ”
We are a lot of Documentarily qualified, but if Embassy doesn’t work, what is the importance of we are amongst 13,475 cases !?
My case number is below AF1600 and a plaintiff of Mandamus litigation !

Well the issues you point out are why you were wise to be on the mandamus lawsuits. However, since your case number is low, you have a better chance than most people.

As soon I arrive in US with the DV1 visa should I stay there until these biometrics are done , even tough they have been done already at the consulate and I should be fine or I can safely travel back and for until my Permanent Card arrive?

No – the NORMAL process does not require biometrics for people after they arrive in the USA. However, sometimes the biometrics need updating.

1. Impossible to say. A number is just an ordering. It does NOT tell us how many cases or people are in front of you – we will know more later.
2. You would use the new passport number, but when you send documents (and attend the interview) you present old and new passports.

It’s more helpful when you give case number (including year and region).
They won’t know. However if you do submit a DS260 you would have to be honest about that. If you plan to adjust status once in the USA, then certainly don’t submit the DS260 yet.

If you need to make changes to your DS-260 you should contact the consular section where you will be interviewed, or bring the information about your changes to your interview appointment. Because your case is ready to be scheduled, KCC can no longer unlock your application.

We’re EU10K. Our case still stuck at KCC. Plaintiffs in Curtis Rai v Biden. Our assigned embassy in Spain have just started scheduling interviews for June up to around EU8600.
Since KCC didn’t validate our documents yet, we are wondering if there’s anything else we can other than just wait. We’re worried they will keep scheduling and skip us at some point.

VD21 EU00014XXX, residing in Nigeria. KCC has already informed us that we are ready for scheduling in Lagos US Consulate, since March this year.
1. What is the probability of scheduling for an interview? I am in a dilemma joining or not to join in a lawsuit. Is there any difference for us to join a lawsuit or not to join?
2. After joining curtismorrison lawsuit, can I quit the lawsuit if we receive email from KCC for scheduling?
3. Many applicants have been sending their documents to KCC more than one time to make sure that it has been received by KCC. So, does this cause a delay for us to receive our 2NL due to backlogs of received emails by KCC? As far as I know KCC reads and replies all emails they receive.
4. During the interview, do we have to have our residence permit with us though it is not among the required documents? Since the main applicant’s RP expires very soon, do we need to renew it?
5. Is there any case(s) issued in Lagos so far?

2. No. The lawsuit is aimed at getting that outcome, so if it happens they will have done their job.
3. For a long time I tried to “hold back” people from doing that to allow KCC to do their job. But for months now I have been saying send the documents. I don’t know what was best, but people can’t wait forever.

The people saying that don’t understand the numbers. In reality we don’t know how many selectees there are or what the max OC case number is, and therefore we don’t know the density of cases. So there could be 100 cases before your number or 1000. One of those would mean certain success and the other would be certain failure. So for now, just ignore their comments.

So by when we will actually get to know the max case number for each region and how many real cases there are since I have heard if a region has 1000 selectees there mayb be 100 cases which arent real people.

We learn stuff in drips, and we form opinions over that time.
Over the coming weeks, people will report their case numbers which gives “some clue” on the ranges.
Then, the selectee numbers will be published in one of the VBs either in June, July or August.
From that I can get pretty close to understanding the density, though not precise.
Then on January 1 we get the full precise case data, so then we know everything, at least about the data.
However, response rates can vary, Covid will have an impact and really you are only sure of your situation once your visa is in your hand.
Just as a last point, the density rate changed a couple of years ago – when they seemed to have implemented some new security screening that created more holes (holes are gaps between the numbers). So – up to then for a few years OC cutoffs were reliably in the 1400 to 1500 range. The new density rate means the cutoff should be higher than that (more holes = lower density = higher case number for same number of people). So – if they are still using the same strategy as the last two years, your number isn’t as bad as people have said.

I didn’t go outside my country even for a single day. Now my question is, do I need the Dubai Police Clearance Certificate or I don’t have to show it. Because it’s almost 12 yrs that I left that place and never been to that place again.

1. It is too early to know anything about DV2022. There is no advantage to submitting the DS260 for now, because of your number. You could wait a couple of months if you want, then submit.
2. OK – well I would suggest marrying sooner and including her on your case.
3. With you.
4. List the correct version of your name in the DS260 as the legal name and list the other name in the other names section. A new passport would be better, but keep a copy of the old one to submit to KCC and at interview.

Hello Simon,
I have been randomly selected in DV 2022 and am in a bit of predicament here. My question is very specific and I hope maybe you could help.
Country of chargeabilty is Egypt, case number in the late 30 thousands. I will apply based on my education due to the fact that I have not had a full-time job in over five years .I am a CELTA- certified teacher and did some freelance teaching,however, I do not have any records of any payment. I am not sure if my education is comparable to a US high school. I did eight GCSEs over 20 years ago and only passed six of them over four sittings. I went to two different schools, but the number of years add up to 11 not 12. I have the statement of results as proof in addition to the documents stating the number of years I was enrolled in both schools. I have not filled out my DS-260 yet; will do that later. Should I apply or I do not stand a chance?
I would highly appreciate it if you reply to this specific query.

The number of years is not what is important, it’s the LEVEL you reached. It should have been the level necessary to enter University.

thanks for all helpful info in your videos and blogs. I’m from Australia and was a selected entrant for 2022, with my case number being 2022OC000022XX. From what I gather watching your videos that’s a pretty high case number which means low chance of getting through, is that correct.
Would you recommend me doing the D260 application myself or getting a professional to do it. unfortunately could find much when I looked on google. I know your British, though you wouldn’t happen to have any recommendations on professionals to go to help complete the D260 here in Sydney, Australia.

I am currently selected for both DV2021 (secondary applicant) and DV2022 (primary applicant). Oceania region.
My husband and I submitted our DS-260s for DV2021 in June last year and since then I have discovered I also hold another nationality (Turkish)—I was not aware of this when I submitted the DS-260. My dad (who was Turkish) passed away when I was very young and neither my mum or I knew I had a Turkish ID number. I’ve never lived in Turkey, and have never held a Turkish passport etc. Both my parents are Australian Citizens and were when I was born (in Aus).
The DS-260 has already been processed and we are waiting for an interview so I am unable to unlock the application.
1. Does having a second nationality cause any issues in obtaining the green card?
2. What do you think is the best course of action regarding the DV2021 application that has already been processed by KCC/ ready for interview scheduling? Do you think I should present a written (legal) explanation as to why I did not note another nationality to the Consular Officer of some sort?
3. Regarding DV2022, I presume I should add to ‘other nationality’ and indicate Turkish nationality. If I submit the DV2022 DS-260 before an interview for DV2021 is scheduled, will KCC cross check with the DV2021 application and notice the discrepancy?
4. Would adding Turkey as ‘other nationality’ in for the DV2022 DS-260 create an issue with the DV2021 interview?

A question regarding address information in DS-260.
Throughout my entire life, I’ve been moving a lot, living at multiple addresses. I’ve legally lived, studied and worked in different countries. Even in my home country, I periodically rent a new place to live, every year or two. It’s a matter of lifestyle: I love changes. However, the only address I’ve been permanently registered at since my childhood and the only one officially stamped in my passport since my teenage years is my parental home address. So am I still supposed to list ALL the addresses I’ve ever stayed at for several months (and longer) since I was 16? During my studies, work and creative projects abroad I would sometimes stay with host families for many months, or rent a place for a few years, or stay at a flat provided by my sponsoring organisation for a year, etc. It’s a long list of addresses, some of which I might not even remember at this point. Should I mention them all? Or is the address information section in DS-260 only about the address I’ve been registered at?

Sorry for getting back to this question, Simon. Just want to add that, apart from the one address I am officially registered at, there is no written proof, no documentation regarding the places where I previously lived – overseas and/or in my country. It’s all been based on verbal agreements (staying with host families abroad, or using accommodation provided by a sponsoring organisation during a year-out project, or renting places in my home country, etc. – it’s always been done on a friend-to-friend basis). Am I still supposed to mention all of those addresses if I’ve got no supporting evidence? Do they normally require documentation in support of the address history?

1 – does judge Mehta during this time will review the content of the litigation or he will hear on 13 july about the content from the lawyers?

HI, Great job You do !!! Thank You for that. I do have one questionabout the Ds-260 application. There is a question if I was in the USA. When answering yes, they ask for the period when I was. I can see in the form if do not remember the exact period of stay, enter the approximate period – I do not see any problems here. However, in the next question they ask for when the visa was issued. I once had a work visa in Oman for a project. However, I did not stay there continuously, instead travelled back and forth from Sri Lanka in four different occasions. I had the visa for 8 months. But Maximum I stayed in one trip was 45 days. In that case, do I need to mention that in DS260? If I mention, do I need the police clearance from Oman?

No, DV2022 should NOT be thinking about a lawsuit yet.
Complete the DS260, wait a few weeks to be asked for documents and then (if you have a LOW case number) send your documents whether you have been asked or not.

whereas i left for another country after my High school diploma to study (university degree) and i have just got a police certificate from this country.

The number is quite low, so you might be able to get an early (October/November) interview if you submit your DS260 now. BUT the embassies are working slow – so there may be delays in scheduling still by the time you are ready for interview, so I cannot be sure about interview timing.
