Dear Simon,
I’m still confused about the DS260’s Permanent Address section. Your “Completing DS260” page states: “This is information about where you expect to stay in the USA OR the address of someone you can trust to receive your Green Card on your behalf.” However, I don’t seem to notice the OR on the actual DS260, as the form actually says “Provide the information on where you intend to live after arrival in the United States”. I’ve already found a friend in the USA who’s agreed to lend me a mailing address for my Green Card. Yet, as of this moment, I have no idea where I will be staying after my arrival. Is this something I need to figure out now? How am I supposed to complete the Permanent Address bit? Even if I find a place to stay, how is it possible to rent a flat or book a hotel room a year before my arrival? How does this work?

I wouldn’t bother unlocking her form. It doesn’t make any difference. You can just explain to the CO that you will sponsor her later, but again, as I have told you before, the process to bring her later is going to be more complex and more expensive.

1 question in DS 260 : were you previously employeed ? , should I reply this question YES or NO? While I am working for the first time in my life , and I will add it as my current job
I dont know the question means my current job or a job before it .
2 in my primary occupation I chosed business and in employer section I added (Habib zia company)
Which is a small local business and I am 50 % partner of it .
My question is : did I had to add a company name as my employer while I own its 50% myself ? Or I had to write self employeed ?
Do they want some documents to proof I am working now as partner or as employee ?

Your visa will expire 6 months after the day of your medical exams. So if you want to have a few more weeks on your visa you can move the medical. Otherwise leave it on the JUN10.

In the EDV application i was checked on Master’s degree on “highest education level” now i won for DV2022 AS17xxx. I failed to find the master’s certificate and it seems lost and now im filling ds260. Should i ignore to add the master’s degree in education part because i dont have a proof?

Had a question….does at nvc case no# mean they are real case no# right….as I was studying the charts for dv 2019 there were 40-50% cases at nvc for Oceania….does this means these selectee did not process…..or are they holes

A case that has at NVC is a real case. In DV2021 the OC holes rate is just over 50%, so that means those cases either didn’t respond, or they responded, but KCC did not schedule them yet. Roughly 60% of cases respond (meaning they want an interview).

Not very relevant if one studies the numbers. Some embassies have not scheduled a case in some time, some scheduled a hanful of people and adjudicated 1 or 2 cases so far.

Hi Simon.
I have a big wonder, my boyfriend got selected in the visa lottery (he’s from Venezuela). He is going to do all the paperwork and then the interview. If he won the green card, he is going to the US.
But he wants to give the green card too (I’m from Colombia), we don’t know if it is better that we get marry before he goes to the US(after the interview), and then he will be able to request me later, or we get marry after he goes to the US, I can travel to the US as a tourist (I have a tourist visa) and then after a month we get marry there?
We can’t get marry right now before he fills the DS-260. So we only have (I believe so) this 2 options, what do you think it is the best and be more effective and fast option?

Hi, I am a DV2022 winner and just found this fantastic website. I spoke with a lawyer before submitting the DS260 , and before finding this site, and I think he may not have given me great advice. I have a B1/B2 visa and work in the Bahamas and go back and forth to the states. He told me to come back to the states and apply for an AOS as I had a low number. However looking at the data it appears my number is not that low for my region: OC 21XX
he told me I would be able to apply for an AOS in October, but it seems to me like June next year would be more likely.
My I94 on next arrival would only likely be until November this year, and since I have now already submitted a DS260 it also seems I will not be able to apply for a new B1/B2 (which is difficult to do now anyway)
So my question is : is the lawyer correct and can I apply for an AOS on October 1st? If not, can I go in and out on an ESTA visa without it affecting my pending application? Thank you in advance!

Yeah, the lawyer you spoke to doesn’t know what he/she is talking about. You are correct, your number is not low, but it is too early to know how high it is. You should have waited to submit the DS260, it does you no good to have submitted this early, and yes it could impact future non immigrant visa applications. Also, the DS260 is optional for AOS cases.
Having said that if you only have a B1/B2 visa you might have a tough time adjusting from that status because of the timing. SO – you might want to consider Consular processing anyway.
Don’t use a lawyer for a normal AOS case. There is no need – and they tend to make things worse.

Unlock timing varies from a few days to 2 or 3 weeks.
Use your new passport, but when sending documents, show old and new.

1) Am I supposed to wait for the KCC’s email requesting documents in order for me to send them, or should I manually send them without them asking? (if so-when is the right time?)

The fact that low cases are more advanced in the progress make sense to me. They were current earlier in the bulletin. But then not one case in the middle range eu15k to 30k, but a few cases after that. Isn’t that strange prioritization? Do you have a guess how that came about?

I have explained that many times including on my live video yesterday. Case numbers are not important once all cases are current. Then it becomes a matter of which cases were processed first, which embassies are open and demand/capacity at those embassies.

My husband He studied at a vocational school. so we think he needs to submit the requirements of the profession we looked for his profession has a rating (06.07>) Is that the assessment required?
If the evaluation is adequate, it is required to prove that it works in this area or whether the documented certificate of expertise is sufficient.

Hi Simon! I know that at the interview you can update the address you want your GC sending to as well as the address you intend to live at once you arrive in the US.
The address I have given for our GCs is the one of a relative just to ensure that they’re in safe hands. My partner and I however are planning to live in a different state. If for some reason the address we intend to live at changes between the interview and the arrival, do we only need to inform the officers at the US border, or are there any other authorities we need to contact regarding this?

What I meant is, would I need to let them know if the address we intend to reside at changes? The GC will be going to an address ‘A’ in a different state, we will be staying at an address ‘B’ but in the meantime we need to change address ‘B’ to a new one due to change in circumstances.

I hope you are doing well. I am DV 2021 winner AS23XXX. I have noticed that Asia region cases which were sent 2NLs recently have sent in their documents in Oct 2019, and I have couple of questions with that regards.
1. Do you agree that Asia region cases which are sent 2NLs are only the ones who have submitted their documents in 2019? Does that indicate that they are operating in 8 months time lag in document processing?
2. I have submitted my documents in mid May; I have also sent an email to KCC a month later asking if they were satisfied wit my documents. However, I haven’t received any reply from them. Should I send them another email, resend my documents, or wait for their reply?
3. Any suggestions on how to improve my chances for the interview? I have sent my #bloody documents, and I am a plaintiff in Goh vs. Blinken lawsuit.

They couldn’t have sent their documents in October 2019 as that’s when DV 2021 winners submitted their entries for the lottery. The winners were then picked in June 6th 2020 so the earliest anyone could have sent their documents to KCC is June 2020.

I think your dates are confused. DV2021 winners were notified of selection in June 2020. The October 2019 date you see in CEAC is the DV lottery entry date.
1. Well as explained, you are a bit confused, but yes KCC seem to be applying some preference on low case number and date of processing.
2. Mid May was less than one month ago, so again, your date logic seems wacky.
3. No – you have done all you can – although it is a shame you submitted documents that late.

This month, a new set of 2NLs were sent and the weird thing is that some people with higher case number than mine are scheduled to interview but I am not. My case number is 2021AF12XXX and people with case number of 15K and 17K were scheduled for interviews in Riyadh embassy. I have noticed and other people are also speaking about this that Riyadh embassy is scheduling interviews for Singles. However, families like my case were skipped the scheduling. I would like to know if you have any idea of information about embassies skipping families and scheduling interview for singles only.

Had a question….so at the moment the embassy located at my country is closed and is not processing any visas….so my question is because the embassy is not scheduling any appointments so the lower case no# may not get their interview even though their no# goes current on the vb…..eg someone with case no# 2022oc200 did not get an interview cause the embassy was closed but the current vb cut off is at 2022oc1800….so will the kcc’s priority be the lower cases that were not schedule due to the embassy being closed or the cases which are current on the vb…..

If an embassy is closed the applicants from that country will ask to be interviewed elsewhere.

Hello Simon, I am DV2021. Is having Chlamydia can cause immigrant visa denial? Because in medical exam for K1 Visa, they have Chlamydia Trachomatis urine test. Chlamydia is one of STD but not on the list of communicable disease of public health significance in https://www.uscis.gov/policy-manual/volume-8-part-b-chapter-6. Thank you, Simon.

1. You have done all you can for now.
2. That could be risky because of the waiting period to file (depending on the visa type you hold).

the birth date i entered online on dv2022 and my passport birth date specified is differ so which can i fill in ds260 is that the birth date specified in my passport or the date i entered on line in case they are different

Your birthdate is established by the birth certificate, and the passport should agree with that date. If it doesn’t, correct the passport.
If you used the wrong birthdate in the entry you must correct that by entering it correctly in the DS260.

I received “ready for scheduling” mail on 5/11. I could not receive 2NL for July interview and expecting to receive 2NL for August interview which should be coming after next visa bulletin.
My questions are below
1, Is it possible to contact embassy to make them contact KCC to send my case to embassy?
My interview location is Tokyo, Japan and there are 5 people waiting as status “ready”.
In my opinion Japan is one of the most cooperative countries and there are many options to contact embassy (e-mail, phone and even skype).
2, Is being Goh plaintiff have advantage to be scheduled before final decision?

Received “documents requesting” mail on 2/26
Submitted documents on 3/8
Re-submitted all documents 3/29 (because I made mistake translating my birth certificate)
Received “ready for scheduling” mail on 5/11

1. You can try, but generally it doesn’t work like that. Until KCC schedules your case, your embassy know nothing about you.

Yes they should send you a document request, but I can’t guess when. However, you can begin to gather documents like the police certs, and send the documents proactively if you like.

Your website is invaluable in explaining the DV process so thank you. I do have a couple of queries though..
I am a DV2022 selectee EU85XX. I have a query regarding work experience/ qualifications.
For education I went through the UK school system (GCSE and A Levels) way back in 1994! I have two A level passes at low grades-D and E.
Job wise my exact job title isn’t listed but I can align my job to one/two with a qualifying careers on 0*NET ( job zone 4, SVP range 7.0-8.0) My job description also states I have to have over 2 years qualifying experience for the position.
My questions are:
1) Is producing examination certs to the CO sufficient to demonstrate I have achieved high school equivalence even though my grades are low?
2) should my focus be on the career route instead?
3)would you advise I cover both bases and prep documents for both options

1. Maybe, maybe not. Two low level passes at A level would not give enough UCAS points to get in to University (and that is theoretically the level required). So depending on the CO, they may or may not understand that.
2. Probably.
3. Yes of course. You go hoping to be approved based on education, but work on preparing evidence of professional experience, just in case.
