I got a few questions regarding proof of funds and work
1- I collected from the bank the statements of the last 6 months- there aren’t in English though but quite easy to read. Do I need to translate them?
2- are bank statements enough or shall I ask my bank to give me a short letter of my savings ?
3-Is one work certificate signed and stamp by my former employer enough to show the CO justify the requirement? Or additional docs are necessary?
4-is health insurance in usa required prior to interview ?
5-is PCR test required before interview?

Dear Mr Britsimon, in your last YouTube Q&A from one of the last question I just realized that I made same mistake. I DS260 on question about highest level of education I answer university level, bachelor degree, as it is. On next question about number of educational institutions I answer 1, because I was thinking that is referring to my highest education (somebody have more than one Bachelor, Master or PHD). Now I realized that I made mistake. Obviously I should have to include High school and College. Tacking into consideration that I am DV 2021, also Iam plaintiff in Goodluck case (DS260 submitted on Jun 2020, requested for docs on January 2021, dosc sent on January 2021) my question is what I should do? If I cannot do anything (probably I don’t have enough time for unlocking DS260), can I avoid refusal during the interview if I bring both educational certificates, if I explain honestly? I also qualify based on working experience as marketing and sales manager in big multinational companies. Does this mistake cost me a life opportunity? Thanks in advance for your reply.

I have not mention my course of study (Bachelor in hospitality) in ds260.

It varies per case. And if they have a lot of DS260s they will start to prioritize based on case number.

I have completed senior high school education (13years) but I did not pass my english and science subjects at my senior high level.

1. The requirements for education vary by embassy – and I don’t track them, so I cannot tell you whether your fails in core subjects will be a problem or not.

In regards to documents translation, I translated all Arabic Documents to English by certified translator and I attached the original and the translated document in one PDF, Is this fine?

I contacted KCC last Friday 4th June, because I became Documentatily Qualified & KCC has already sent me email to confirm that way back in October 2020 (CN 2021AF46XX)
Apparently they have already responded to my email today and that was impressively Fast, tho’ its with what looks like a Standard pre-written mail as below…

KCC is aware of recent executive orders and is actively working on Diversity Visa (DV) Program cases. Please monitor travel.state.gov for general updates to the DV Program and related regulations. You should also check the information posted by the Embassy or Consulate you chose for the location of your interview for operations details. The process for scheduling DV appointments has not changed from previous years. Selectees will be asked to check the Entrant Status Check (ESC) website by an email sent to the address they provided as soon as an interview is scheduled. KCC cannot predict when individual cases will be scheduled for interview, and you are not asked to take any additional steps if you have already provided all your documents and information. 1. Well like you said, it’s a standard reply. It’s frustrating not to see the “current for interview” response. You should be getting that.
2. No its not true. The process has changed, the 2NL notifications are now not in two batches, and of course the capacity is dramatically different.
3. Yes absolutely. Email every week. Push for your case, your embassy is scheduling, you have a low case number. Be the squeaky wheel.

FYI, KCC had already sent me the email “Congratulations! Our records indicate that your case is ready to be scheduled for an interview….” way back on October 26th 2020 And also they sent the other email indicating “Your Case is Current for interview” back on 18th March 2021 (extract below)

I contacted my Embassy in Nairobi about my Case File, and they referred me back to KCC for followup of my interview scheduling. For sure my Embassy have NO problem interviewing me once they receive my Case File from KCC.
Question:-
Is it Ok to inform KCC that i got intouch with my Local Embassy and they confirmed that they are willing to interview me once my Case File is sent to them?

Another question;
Is it OK for me to go ahead and appeal / request KCC to schedule my Interview appointment, even though somewhere in their letter its indicated…… “Please remember that selection for participation in the DV Program is not a guarantee of a visa or of a visa interview.”???
and therein can i quote to them the 2 letters they have already sent me, concerning my Case File…
1st letter Indicating “Congratulations! Our records indicate that your case is ready to be scheduled for an interview….” sent on 26th October 2020
2nd letter Indicating “Your Case is Current for interview” sent on 18th March 2021

You have a good case if you wanna litigate (Writ of Mandamus). If you can afford it, do it individually.
Also, you can try asking your embassy, they have a dedicated liaison in KCC, apparently.

I’m DV2021AF51xxx with birth country as Benin (documented), but I have Nigeria nationality. However, my passport indicates my place of birth as a state in Nigeria based on my wife’s place of birth. Can this be a ground for visa denial at the interview? Once again, thanks a bunch.

You are telling me that your passport lists your place of birth in Nigeria because that is your wife’s place of birth.
You realize that sounds ridiculous – right? Your place of birth has nothing to do with your wife, or her place of birth, and presumably your birth took place many years before you even met your wife.
So yes – that could easily lead to denial, in my opinion.

I was helping a friend because authorities here refuse to speak English with foreigners. What a shame.
Brasilia is the capital of Brazil, but why they would know that so they listed a name of a different city as place of birth. Took a lot of effort to have it fixed.
Seems like a clerical error, try to get it fixed.
If it is some kind of a fraud, just man up and give up your place for people who are really eligible.

In your last response to me, you have advised me to wait a couple of weeks and then send the documents to KCC without them asking.
1. What happens if I send my police certificate in July this year and don’t get interviewed by July 2022, considering the fact my police cert would be expired?
Would it harm my case to send a renewed one (once the initial one has expired) before an actual interview?
2. I have dual citizenship, but I have lived in one country my whole life, so question regarding documents – do I send both passports, both birth certificates and both police certificates?

1. You would get a new one just prior to the interview and then show old and new at the interview.

I have read most of FAQs and comments. I am DV2022SA24xx, already submitted DS260 for me and my husband but I need to make some revisions in Both forms. Already sent two emails about this but only asking unlocking of my form because I thought this meant the unlocking of both forms, since I am the principal applicant.
1. Should I ask unlocking of both forms in another email??
2. Can my husband, who is a derivative, change a NO answer about military service by YES? (he was not sure he could get supporting documents about this so he answered no at the time of filling the form) Would this hurt the application or would it be better to leave it just like that?

2. You have to tell the truth. So he must correct that. You don’t make up answers based on what story you think you can prove.

Do i need to take a police clearance certificate from Saudi for her during the interview? I have read in reciprocity page that PCC is required only if one has completed 6 months in current location. Good day Brit. I am a DV2022 “winner” AF46xxx. I have 2 questions, if I may.
1. If i were to receive a job offer to present to the CO at the interview, would I also need to show that the business offering the job advertised the position within the US?
2. Do I complete the DS260 education part using the American equivalent to my Matric Certificate (Namibian Matric Certificate – 12 years of schooling which includes 5 years of high school) or do I select “other” and explain?

1. No, but just remember that it can damage your case if you “make up” some job offer. So if it is real – go ahead, but how will you explain some American company has interviewed you and you are so valuable to them they are prepared to wait for your arrival for almost a year from now. It sounds silly huh. Don’t make stuff up.
2. List all education from age 12. Again, don’t embellish, don’t answer what you think they want to hear. Just stick with facts.

Thank you for your response. I previously worked for the person in South Africa for a few years, so they know me very well. I was just unsure about the laws surrounding companies having to hire Americans or having to prove they advertised and were unable to fill the position within the US as it is not a job that is on any skills shortage list. From your response, it seems like all is good and I can go ahead and use the offer as a way to show I will not become a public charge as I do not have the required savings. Luckily I also have a sibling that is acting as a sponsor, but thought 2 ways to prove should help me at the interview. Here is to hoping we get lucky! Thank you for all you videos and advice; it has helped a whole lot in understanding the DV process.

If you don’t submit the documents very quickly you can kiss the DV win goodbye. But you are supposed to send all documents at once. I don’t understand why you have delayed doing this…

It is not how long you were at school, it is a matter of what level you have reached. The required level is the point at which you enter University.
However, it’s a slow process. If you enter in October, and if by some chance you are selected, you would not move to America until 2024.

Hi Simon. After I watched Mr.Kuck’s video today, I would like to confirm my understanding.
1, Goh and Goodluck are not likely be consolidated because final hearing date for Goh has already been scheduled on July 13th and Judge Mehta is fully booked after that. Also, Mr. Morrison does not have intention to consolidate two cases so far.
2, Government already asked KCC to list up all named Goh plaintiff’s case (intention to be ready for scheduling named plaintiff’s case?)
3, It is obvious that lawyers cannot guarantee “win” ; however, it seems like Mr. Kuck’s litigation team has some confidence about outcome and real problem is not win or lose but when and how court order process interviews. (probably you already mention that Goh is high possibility to win. correct me if I am wrong lol)
4, There are about 20 days at most for court actually order interview processing after final hearing. So, earliest date of interview processing is beginning of August? Mr. Kuck mentioned it should not take long time like Gomez case because Judge Mehta already knew about DV cases and its urgency.
5, Mr.Kuck also mentioned we have almost twice as much as times as Gomez case to process cases (last year there is only one months to process after court order?) we should have enough time to process most of named plaintiffs cases (depends on COVID and embassy tho.)
Please correct me if my understanding is wrong.

There is not any indication GOH plaintiffs are being scheduled. I think gov’t is getting ready to do something once their motion to dismiss is denied.
I think DV2020 got some kind of movement in September, and C.Kuck hopes this time we will see movements in August.

Frankly, do not bother unless you are a plaintiff.
Submit all documents in one email.
Old police certificates might be still valid, if you get them after you moved out of that place and you never moved back. Check reciprocity page.

Hello Brit.I got my 2NL and have been trying to schedule an appointment online on my embassy website,where i will put my courier details.However on the visa types there is no DV visa and i cannot the online appointment on my account.There is a message indicating that NVC has scheduled appointment but no further info..My question is that on the day of the interview will i be turned away just because i have not scheduled the online appointment on my account,reason being beyond my control for what i explained.?

My number 2021AS4xxx and am currently not in USA.I have contact a lawyer in Chicago and he told me that I can apply for AOS after 30 days and told him there is 90 days rule and he told me that this applicable for visas at state department.
What do you think about that ?!

It is somewhat correct – the 90 day rule is a DoS rule. However USCIS can use the waiting period as part of their assessment. At the end of the day you must decide whether to take the risk or not. You may not have much choice at this point.

A quick follow-up on your comment about me asking if dual citizens should submit both birth certificates.
Both countries issue their own birth certificate forms. Ofcourse the listed data is the same (birthplace, DoB, etc.) but country of issuance of the form is different.
My question was/still is should we send both countries forms?

To me, the document from the non birth country is not legitimate – but there is no harm in providing it if you wish.

Does the place of birth have to match in birthcertificate/citizenship and my form I485? I wrote the name of the town I was born in for the place of birth in my form i485 but my citizenship has just listed the name of district in place of birth section.(the town is inside the district) will that be a problem?

Documents are processed in numerical order, based on lottery rank number. Once KCC has processed your documents, we will let you know if anything is missing or if we have received everything needed.
Your forms have been received and are currently processing. Allow several weeks for processing. Interviews are scheduled numerically based on case numbers that have completed processing. Once the Kentucky Consular Center has finished processing your DS-260, you will receive an email from the Kentucky Consular Center giving you instructions to complete in order for your case to continue processing.

I submitted DS 260 Form on 16 May. Then later thought there need minor revision, so sent an email for ‘unlock request’ on 28 May. Till now, I have not heard anything from KCC. My case No. is 2022AS81XX
Should I send Follow Up email to KCC or should i wait, please advise.

Firstly thank you for all the work you do. Your knowledge and information on this site is invaluable for steering applicants through the DV process!
I am a DV2022 selectee- EU85XX and have a query regarding education and wok experience.
I went through the UK education system of GCSE’s and A levels way back in 1994. The two A levels I passed were at low grades (D & E)but they did enable me to go onto an undergraduate degree course which I later dropped out of.
Career wise, I am unable to find my job title but I can align my job to two careers on O* Net both of which are job zone 4 with a SVP 7.0 – <8.0 My job description highlights I require over two years experience to perform the job I do.
I know you advise to opt for the Education route as its more straightforward but my query is around my grades- are they sufficient to meet the high school requirement or should I focus on the career route?
Or would I be best to be prepared for both options at interview?

Am am DV 2021 winner I was once removed from the port of entry on Illinois Chicago on May 2018.
My case is a lower case number 2021AF7** from Kenya.
I was interviewed on 7th May 2021 and my visa was refused and I was given a Note with clause 212g (6) (c) (i ) and 9 (A )(i) .
I emailed embassy to provide for me the factual basis of the matter and they replied that I was found inadmissible by the time CBP therefore I can apply for waiver for them to proceed processing my application.
Do you thing it is possible to apply for a waiver with the remaining time.?

DV2021AS00020xxx here. Have been following you from the past 1 year and got couple of queries resolved.
Just to add on a lighter note I work for a US based healthcare company in technology in India and not even for a second our work was stopped due to the pandemic although we have stopped going to office.
We have continued our work by doing work remotely. So just wondering what is stopping KCC to work with full capacity when all the companies in IT sector have still continued working despite the pandemic.

Hello Simon – I submitted a question to the embassy in London who have a warning that they will only answer questions that are not addressed on their website. My question is whether the fees are paid on the day or ahead of the interview. I looked very carefully but could not find anything. This morning I did a search on “usa embassy london immigrant fees” which did return something although I am not sure it helps answer the question as I think DV visas don’t fit into either of these categories.
APPLICATION PROCESSED THROUGH NVC
If your application is being processed through the National Visa Center (NVC) the fee is paid before processing begins.
APPLICATION PROCESSED THROUGH EMBASSY LONDON
Immigrant Visa Applicants – pay the fee to the Embassy cashier on the day of the visa interview. Fees may be paid in cash – sterling or dollar equivalent; by International Money Order or Bankers Draft; Credit Card – Visa, MasterCard, Diners Club, Discover or American Express; or Debit Card with the Visa logo. The Embassy does not accept any other credit or debit cards, or personal checks.
I think on balance it has to be the latter. The only reason I was concerned about this is that I have encountered situations where only cash or a certified cheque was acceptable.
I am pretty sure I heard you respond to someone in your last Q&A session that DV cases did not go through NVC.
I am wrong could you please let me and the other London interviewees know.

Ignore this – the interview letter clearly states that payment should be made at the embassy or consulate. At least I have clarified that credit cards are accepted.

I am DV winner of 2022 and submitted DS 260 on May 16 2021. Later on, I realised that there is minor mistake and that requires revision. So I submitted ‘Unlock request’ on 28 May 2021. But till today i have not heard from KCC.

she is the particular woman i play with during the entry for DV 2021
and our marriage certificate is real and Authentic its a Muslim marriage.. and i register the certificate at the Registry and also i verify the certificate its there.. i have all the information we use for the entry for the DV2021 including the passport photo we use to play…. that why i want to involve a lawyer in my country to ask them why they said the marriage certificate is fraud and why they also said the woman i play with is not the one i come with on the interview date.. this happen at the US EMBASSY SIERRA LEONE. i kindly need your advice towards this

Hi there Simon,
I’m just wondering about timings in relation to the police certificates. As these are among the list of documents that need to be sent to KCC, I’ve already had those done for me and my husband. I was waiting to have everything together so I could go ahead and send all the documents to KCC.
(I submitted the DS260 around mid-May but not received any confirmation or being asked to send documents yet, so I’m just sending them in the meantime).
My question is between now and the time of the interview, there will obviously be a gap. Would we need to get another police certificate later on, or will the ones we are sending now be sufficient?
Also, I notice that you say it’s too early to tell in relation to case numbers, etc. When would be the time you expect to have more information in relation to these things?

I sent an unlock request email to KCC for ds260 application on 25th of May. And received an auto reply email from KCC written as “The Kentucky Consular Center (KCC) has received your email. Due to an increase in emails, it may take longer than normal to receive a response. We are reading and responding to every email, so please do not send duplicate inquiries.” Till now I did not receive any email from KCC that my application is unlocked. I don’t know what should I do? Should I write another email to KCC or wait for some more time?

What would happen if I can get the Dv 2021 visa let’s say in September. Then I am going on vacation in October to another country and I would lose my passport there. Could the visa be reissued so I could travel to the US and activate in November or not?
I know it’s is kind of hypothetical, but I am planning on going somewhere in October and I am afraid I could lose my passport and lose my with with it. (I never lost it, but just to know)

I want to plan a trip now (to countries some people perceive as less safe) I am tired of having my life on hold for something (the visa) that might not even work out. On the other hand I don’t want to get the visa and lose it completly if I were going to lose my passport. So question is, is it theoretically possible to have the visa reissued if it is still valid, but the fiscal year is over? Thank you

Really it is not a black and white answer. It is a gray area in the law because the operating manual says they only reissue within the fiscal year, but the law doesn’t justify that position). Then you have varying degrees of cooperation from embassies. So, for the last time of telling you I strongly suggest that you think about how to secure your passport once you enter that country.

I have been randomly selected for further processing in the Diversity Immigrant Visa Program for the fiscal year 2022.
I have one important question : When I apply for green card lottory 2022, I had one child and wife,and I put them in application. In the meantime my wife got pregnant and the child should be born on september 5th 2021. So I am wondering what to do with DS-260 form?
Should I wait to fill DS-260 form until our new child will be born, or to that before that?
I checked FAQ on your website, but I am not sure fi my case is SCENARIO 2?

Personally, I would wait for the birth and then submit the DS260, but you could also submit now and then correct it as soon as the child is born. The case number will not be current until 2022 anyway, so both ways are possible.

I am a DV 2022 selectee – EU62XX – and I have a question regarding police certificates.
In the travel.state.gov website, I am reading that selectees who are 16 yo+ are requested to submit police certificates from:
– the country of nationality if they resided there for more than 6 months;
– the country of current residence (if different from nationality) if they resided there for more than 6 months;
– any previous country or countries of residence if residing there for more than 12 months,
However, in different Embassy websites and internet sources, I read that selectees must submit a police certificate from the country or countries in which they have lived for six months or more after turning 16 years of age, regardless of their nationality.
Could you please clarify this please? I am asking because I lived abroad in different countries, for more than 6 months but less than 12 months every time.
Fyi, my current residency is in my country of nationality.
In the interests of time, it would be good to know how many police certificates I actually need.
