I am DV 2022 selectee from Ethiopia. I have been to South Africa from march 31, 2019 to march 13 2020, which is 12 days short of a full year. On the DS 260 it asks only the months without the dates, I filled it like march 2019 – march 2020, which may be confusing. I was wondering if I have to get police certificate from South Africa in preparation for submitting documents.

Of course you should get it. That is almost a year – so get the certificate to be safer.

Dear Simon, I watched your recent video on sending in documents – thank you.
1. If I send them in – and they get lost etc, you mentioned that I can follow up with them, but does the fact that they get lost cause potentially cause issues/impede the case, even if I follow up ie: they can’t find them or don’t end up requesting them again or just simply don’t reply to my follow ups etc?
What I mean is: In the video – you explained worst case is they get lost – but the remedy is you follow up – problem solved – is that really problem solved or are there other detriments and would you consider it a risk?

You have time to wait if you want, but you could also enter the DS260 using your passport for your son, and correct it later.

Hi Brit! I am DV2022 winner, case number EU13k. My wife and I are expecting a baby in November, should we go ahead and submit DS260 now and add the baby later on, or should we wait until the baby comes and then submit the DS260 for all of us?
Also what do you think winners from Russia should do? The embassy is effectively closed right now, and there are no updates from the department of state on where russians will have their interviews. Should I try to transfer my case or wait until someone (KCC, dep of state, etc) will transfer it for me?

Re baby – your choice. You certainly will find it easier to include the baby in your case, so I would personally wait for the birth.
It is too soon to be worrying about the embassy. See what changes over the coming months.

Have you sent documents? If so – that is all you can do. You should hope for visas to be preserved in the lawsuits. That is your only chance.

Hi Brit,
2022OC3xx. I have a minor mistake on my DS260. The country field for one of my educational institutions is incorrect. Everything else for this institution is correct and it is not my high school institution. The correct country is covered in other sections of the form (e.g. address, work history) and I have the Police Cert for the country so it should not change any of the checks that KCC do.
I am hoping for an early interview and have just collected all of my documents and was ready to submit when I noticed this. I do not want to get caught up in the lengthy unlocking if possible.
Do I need to unlock my DS260 and change this? Or can I submit my docs and do this later or mention it at the interview?

I sent my documents for the first time on august 28, 2020 it has been 8 Time now that I sent documents to kcc since August 28, 2021 until now without any response from KCC I use to write them each two weeks to know if they received my documents and if they are satisfied with them but they responding with a generic email saying that KCC received your documents allow several days for processing.
I would like to know
1 – sending documents 8 Time as I did cause delay to my case ?
2 does KCC don’t want to process my documents because I sent them many times ?

Maybe judge could order the government to publish case numbers processed each month. But we have that info from Ceac, right Simon?
We can then cross-reference the case numbers to visa bulletin and say e.g. this is the delay, 60% of adjudicated cases in June 2021 were current in Sept, Oct and Nov of 2020. Of course then there is a delay to people current in June 2021. Do you think this could help?

Hello Brits, thank you for your good work you are doing to make our dream become a reality. I submitted my Ds260 on the 5,of may 2021 and I didn’t get email from KCC for submission of documents so I decided to send my documents on May 21,2021. Since I submitted my documents I haven’t received documents qualifications from KCC. I’m a member of Goodluck Vs Biden lawsuit and I submitted my supporting documents without receiving email from KCC requesting for supporting documents. After I submitted my documents I received automatic email. My passport I used to play the DV got expired and I renewed it and filled the DS-260 form with the new one. I didn’t submitted the old passport when I was summiting my documents but I used the new one when I was submitted my documents. I’m waiting for KCC to schedule me,do you think when I carry the two passport on my interview there will be no problem ? Is the any problem that I didn’t submitted the old one? What happened I have contacted KCC twice but no response? Do you think when the lawsuit win I will get my Visa before September?

I would like to ask you something about the green card. I already have it. I am a DV2020 selectee and I was able to enter to the US in February.
I went three times this year since my first enter. All trips related to the green card management and stuff. I already have my bank account, credit card, proof of address and so on. I am still living in Spain and I plan to go there permanently in December/January.
During my last trip to the US (in July), I had “problems” at customs. The agent told me that I am not able to enter and leave the countries so many times (3 times this year so far). He told me that I could lose my green card. I told him that I am organising my new life there and closing things in Spain. He told me really serious and now, I am a bit worry.
I am planning to go in August for 2 weeks in order to visit areas and apartments, and to do interviews. But not sure if it’s a good idea to go this time. Maybe I should wait until December or January to go definitively. What do you think?
Based on Curtis’ response and some info that I looked into, I can enter and leave but it depends on the agent at customs. I don’t want to lose my green card so I am not sure what to do in August with my trip.
Would there be any option to get your email in order to talk a bit more about this? If not, I can understand.

I would have told that officer politely but firmly to mind his own business. Your trips were less than 6 months, and Americans and Greencard holders have the right to travel wherever they want.
Keep future trips less than 6 months absence and don’t be intimidated by a little man trying to flex his muscles.

Hi Brit….are 6 months counted in the total number of absence during a single year or in a row? Meaning ….every time you are back the count start from scratch? I remember someone explained me that they count if your presence is more or less than 183 days in a year. If the total amount of time spent outside the country, counting absence after absence, go over this count, than technically you don’t reside in US. Correct me if I am wrong please.

It depends for what reason you are trying to calculate. For simple absence, they count the time you are gone on each trip. If you are thinking about citizenship – then yes there is an evaluation of all the absences.

If I’m correct from the Judges last statements about making his life easy, I think he want order the government to adjudicate all RFS for August and September and then Reserve Visa on September 30th for a class action which probably will prioritize plaintiffs

I am DV 2021AF42xxx. Last month, I was unlocked my DS 260 to include my new baby born and I made a mistake in her surname.
1. Is it ok if I asked them to unlock my ds 260 again and correct it because the time for dv 2021 is running out or is it possible to correct it during the interview?
2. The other concern of mine is that KCC has changed my interview location up on my request but I didn’t change it in the DS 260 so is it necessary to change it in the DS 260 or can i change it when I get my 2NL?

You can’t withdraw your DS260, but you don’t have to send documents or attend the interview.

I have a question regarding POE.. I remember you made some explanations regarding this issue before, but I can not find those answers now.
If approved / granted principal applicant wants to finally reach US city B, but flying from Europe first has to make a flight transfer in US city A, what is his POE? City A or B?
In case your answer is “city A is his POE, because it is place where LPR is first entering US”, how long one should plan for transfer time at this place?
I hope you understand my question.. We are planing trip to US (family of four members), but have no direct flights from place where we now live in EU to town we want to live in the US .. So we have to make at least one transfer in the US before we reach our final destination… We do not want to get stuck at the wrong airport, and to make wrong decisions at the very start of out new life adventure ..

From my personal experience if you have one ticket with a stopover where you enter the US, the booking system will allow you to buy a ticket only with sufficient transfer times. In systems like Amadeus there are entries for each airport connection times. If you have indeed just one ticket and you miss your connecting flight because of delayed arrival or delayed inspection, airline should rebook you free of charge.
My very first US trip I got stuck for couple of days in EWR because of bad weather delays. Sometimes you plan and life happens 🙂

Hi GanDra, I worked as an airline check in agent – the POE will be city A, the first port in which you entered the country. This is where you will go through immigration processing before transferring to a domestic flight.

1.Does the embassy look into the loan payments, morgage and other types of debt payments regarding the sponsor also?
2.Or are they only looking if the annual income passes the federalpoverty line?

I sent our documents to KCC on February 17th (more than 5 months now) after KCC had requested them. Since then I cannot get any response from KCC except auto replies. I am pulling my hair already. What should I do?
Our Embassy (Turkmenistan) issued only 2 visas so far, 14 scheduled as of today. EU 12K, Goh plaintiff. What have I done wrong? Should I send the documents again?
PS: The reason I didn’t submit our documents earlier than February is because I had to gather police certificates from 4 countries, also sent certified English translations of all documents to make it easier for KCC to process. Took it very seriously. Never unlocked my DS260. Received autoreply confirmation that my documents were received.

I am German, but I also had to do military Service and I am still in the Army Reserves. Does that mean, that my background check will also take forever? My wife is the applicant, not me.

Hello Simon, regarding to that, my Husband (selectee 2022) served mandatory military service in Cuba, and he’s also part of the reserve. The problems between Cuba and the US are well known, specially now.
1- Can this be a cause for denial?
2- If yes, what do you sugest? We answer yes on the ds or no? I’m asking cause is very common here here that some people dont do the service for “medical issues” or pay for It. And also his cousin was a 2016 winner, and advice him to say no. Please help us

The USA is a totally different process.
Canada is not interviewing, and other embassies are only allowing “local” cases.

Hi Simon, I received my 2nls I have 4 children and I fill up all information of them according the rules of Ds260 but the first two boys don’t live with me because I ended my first marriage they live with their mom, the question is, if is compulsory go with all kids to the medical appointment and the embassy appointment? Or is only necessary that I explain my case in the embassy the reason why the 4 kids won’t go?
