EU region born, but citizen of Iran.
I have Iranian birth certificate (shenasname) where is information about my place and country of birth, parents etc.. but my original birth certificate which was given in my mother land is unobtainable. question is, is my Iranian birth certificate is enough for interview?
On official government website is written that Iranian citizens needs birth certificate-shenasname.

Dear Brit,
in the DS-260 i have to write down my previous addresses and i am a little confused how i should handle “holes” in the addresses.
For example, i studied for 6 months at a US University and was living on campus, then i traveled for 1 month (stayed at hotels and campgrounds) and then returned home.
So my address history looks like this:
-January to July: US campus housing address
-August: no address at all (traveling the US, staying in hotels and campgrounds)
-September until now: My home country address again
Can i fill in the DS-260 like this? According to the information presented on the side of the DS-260 this should be fine but i am not sure if the information on the side considers a case like mine and is rather focused on cases there people still had a “home address” during the time of travel

Dear Brit,
for the previous employment section for the DS-260 i am confused on how to handle my self-employment.
I worked a 40 hour/week “normal job” and had a side hustle (registered as sole proprietor). I quit my job in the summer of 2020 and turned my side hustle into a 1 Million/year revenue business until i sold it recently.
So my working history looks like this:
2017: University student + part-time self employment
2018: Normal employment + part-time self employment
2019: Normal employment + part-time self employment
2020: Normal employment (quit mid-year) + part-time self employment (until mid year) / Full time Self Employment
2021: Full time Self Employment
If i interpret the DS-260 questions correctly KCC is not interested at all in my self-employment business at all (even through i did it full time and earned more money with this than my full time job all years combined)
Is this correct? Should i just fill in my full time job and should not mention my own business?
If KCCs googles my name all the “self-employment” stuff pops up, so i dont want them to think i am trying to hide something.
PS: If this fact is important for this questions. I will qualify through my Master Degree

Thanks for all your work and updates, your blog has been invaluable during this complicated and difficult time. I’m a DV2020 winner who had a visa processed last minute in September 2020 – however, being based in Australia, I haven’t been able to get a travel exemption granted to leave. To my understanding my visa remains active until August 24th(?), 6 months after the removal of PP10014 – but obviously, this date is fast approaching and I’m really struggling to see a way out. I’m seeking Australian legal assistance to prepare new travel exemptions but was curious as to whether you had any suggestions or additional info from the US side available relating to this, or whether there’d be even the slimmest chance of any further recourse here.

after multiple exchange of emails request to KCC about status of my documents (I submitted without request on March), today KCC replied to me with somehow different message as follow:
Thank you for your inquiry.
The Kentucky Consular Center has received your documents. Please allow time for processing of your documents. Documents are processed in numerical order, based on lottery rank number. Once KCC has processed your documents, we will let you know if anything is missing or if we have received everything needed.
in the previous emails they used to say:
“Your forms have been received and are currently processing. Allow several weeks for processing. Interviews are scheduled numerically based on case numbers that have completed processing. Once the Kentucky Consular Center has finished processing your DS-260, you will receive an email from the Kentucky Consular Center giving you instructions to complete in order for your case to continue processing.”
but now it seems like they’ve finished processing my ds-260 and started reviewing my support documents.
what do you think Simon? did I interpreted it correctly?

It might mean they finished with the DS260, but it does NOT mean they started your documents. That depends on your case number.

I have posted a question previously and thank you for the reply for that. I have another question. Please help to clarify this point.
1. I am planning to move to Canada for studies. I’m thinking of leaving my family (Husbands and 2 children) in Sri Lanka and apply visa for them later.
In case if Montreal office is open for DV interviews, can my family come to Canada with visitor visa to participate in the interview while I’m on student visa?
2. my case number is AS7XXX. I heard DV visa processing for DV2021 has been resumed in Sri Lanka now. If things continue as it is now, around what time I can expect to have my interview if I face interview from Sri Lanka?
3. I have requested to unlock 260 application but still no response from KCC. Should I submit documents before they request and before they unlock the application? Is there any advantage/disadvantage?

Canada is generous in a way that your derivative spouse can come with you and get a Canadian work permit.
Montreal has not interviewed one DV21 case …

Dear Simon,
I have been residing in Qatar since 2016, and from this date I’m living in same address when the first time I entered to Qatar.
The company issued an identification card with another address that was not a residence address, and from that date I did not decide to correct it
But when I found my self that I won lottery then I went to morocco embassy to renew my passport, but today when I receive it I noticed that they mentioned adresse same which is not my adresse residency.
What sould I do when will fill in the ds260?
Should I fill the address which mentioned in my new passport in ds 260 even I did not lived there . or not(I I fill it is means that I’m telling the truth, right ?) .
I’m living in adresse whixh is not mentioned in recently passport since 2017 (from first entered In Qatar).
Note: I changed my civil ID to the correct adresse today .

Simon, I think there are also higher CN in EU even much higher than 10k that have been processed (sent documents and DQ) during this year 2021 while lower CN who have sent the documents earlier are still waiting, why is that? embassy availability?

All case numbers are current, and therefore equal. They are scheduling interviews in order in which the cases became DQ.

You won’t get an interview unless you are already ready for scheduling. So – see what comes of the lawsuit, then if you get an interview you can update your marital status at the interview.

If a class was to be certified do you think that someone with 2021 EU39k number who has not received DQ by KCC would have a chance? It is an operating rather low selection consulate. Where the only problem is KCC.
After listening to the hearing Judge Mehta was somewhat focused on case numbers. I have a feeling he couldnโt incorporate that. What is your feeling?

I guess this email finds you well. My wife is a DV 2022 selectee from Uganda CN28K. During the initial entry we entered unmarried because we were not legally married but included our 5 year daughter. However, we had our civil marriage in Feb 2021 before the results were announced. She later added me as a derivative and we submitted our Ds 260 forms for the 3 of us. Below are our questions.
1. Do you think we did the right thing or it will mess up our case.
2. We also included the date we started living together in the DS 260 forms and its way back in Oct. 2014.Is it right or should we adjust to a little near date and year.
3. Should we attach the certified marriage certificate for the 2 of us or the main applicant is the only one to attach a copy.

i have a high CN for EU region for 2022. I was wondering what will happen if my CN dosent get current (or might get current) and no interview is ever scheduled due to Embassy or KCC working slowly.
Do you have any experience if i could still travel freely to the US with an ESTA for tourist purpose only?
I am concerned that i will demolish my freedom to travel with ESTA/Visa-Waiver-Program by submitting my DS-260.
I am hoping that you have some experience through people that already struggled with this in years where not all CN got current.

Completing a DS260 is an application for immigration. That can make future NON immigrant visa applications a little harder, but does not normally affect ESTA.

Recently KCC scheduled more interviews for Nepal up to CN 2200+ but many cases below that number are skipped. Mostly they are couple and family. Those cases have already got doc confirmation email from KCC on last July.
What may be the reason behind this?
Should those cases need to take any action to KCC or Consulate?

That is too vague, and based on hearsay. But there are LOTS of cases in Nepal waiting for interviews. The reality is most cases will lose their chance unless the lawsuits can help.

Hope all is well. I have a question and I would really appreciate if you can answer me.
I was selected for DV2021. My case number is 2021AS141XX. I have completed DS260 (In Sep-20) and sent all docs (in Nov-20). I still have not receive a 2NL. I received on July 1st 2021 an email (Congratulation! Our records indicate that your case is ready to be scheduled for an interview when your case number becomes current and appointments are available).
I realized that some higher cases in my country (Amman, Jordan) have been issued visas already.
I check my email everyday (including my junk and https://dvprogram.state.gov/) I am really excited about the possibility of this opportunity and hoping to see the light at the end of the tunnel.
Therefore, I would really appreciate if you can please let me know what is the reason my case is not scheduled yet? And do you expect I have a good chance to receive a 2NL before 30-Sep-21? Do I need to do anything else?

Your case wil not be scheduled because you became ready for scheduling quite late. The only chance you have is the lawsuit.

Do we compulsorily need to insert Mother’s Maiden Name(Surname at birth)
or Its fine as she didnt use maiden in any of her citizenship certificate or pasport or any legal documents.
– In DS260, I input Mother surname as per government document which is after her marriage.

Hello,
I am writing to you regarding an issue with submitting my spouse’s DS260 application. I have successfully signed and submitted my DS260 application (I’m the principle applicant), right afterwards I proceeded to submit my spouse’s DS260 application but at the “Sign and Submit” section after entering all the needed data and pressing the “Sign and submit application” nothing happens. The webpage is standing still and I don’t get transferred to another page, I can only go back or exit the page. I tried signed with both my and mine spouse’s passports, but it remains the same.

I am already in the US and I am moving states (I have not received yet my GC or SSN)
I updated my address on USCIS website and received an online confirmation so that I dont receive my GC in my old address.
How can I do the same for my SS card?

Hey Simon! Short question (Maybe a bit too little too late to ask, but still) – I’m a DV2021 selectee having an interview scheduled for next week (all documents and medical is done). I claimed the wrong country of chargeability (I listed Latvia (a place where I lived almost all of my life) instead of Russia (where I was born).
I know that normally in case of this kind of error if the country is from the same region, and there’s no additional benefit I’m extracting from this error, CO will usually let it pass. But on one other DV-related forum (Russian speaking) a few people mentioned that rules around this topic have changed. I couldn’t find any official or reliable source of information for that matter. Do you know if that’s the case? ๐ Got me stressed a bit..

dear brit. thanks for your amazing work. my husband is a winner of dv2022, we are from Cuba. We recently completed the ds-260 and we are concerned that Georgetown, Guyana appeared as an embassy suggestion on his form; but in mine appears Havana, Cuba. As you know, the embassy in Havana remains inactive, so I also chose Guyana.
1- Is it common for the derivative to show a different embassy than the main applicant or could this be a bad thing?
2- Did I do the right thing to change to Georgetown or should I have left Havana?
I wrote to both embassies, georgetown and havana, but the first does not answer my emails and the second only sends automated computer generated emails.

1. No. You interview together.
2. List all your work and education as asked by the form.
3. Be careful to list your name correctly. It might be “wrong” in the passport as they have lastname before the first and middle names. But you know your name!

First of all, big thanks for supporting us in this challenging process, especially in the current messy situation. Secondly, of course questions ?:
I am a DV2021 selectee with a case number EU 16k range. I received a request for the documents and submitted them to KCC on January 25th of this year. No further action from KCC. I have emailed two enquiries and got the standard template replies (but with a name of a human in the signature): โYour DS-260 has been processedโ and โApplications are processed in numerical orderโ. The embassy in Ukraine is actively scheduling interviews per my conversation with them a few days ago but looks like I have low chances to get an appointment for an interview.
I contacted Curtis Morisson to join a lawsuit and hope to get a reply from them.
1. What else should I do to make people from KCC transfer my case and documents to the Embassy for the interview to be appointed?
Should I attempt to put pressure on KCC through the Kiev Embassy, or a congress person of my relative in California? Inaction is frustrating but perhaps the only option left to me?
2. another question. My derivative applicant decided NOT to pursue the visa after all. (I know it sounds weird).
There is no way to remove a derivative applicant through the web site. I have indicated in my application that Iโm applying alone. I hope the presence of a derivative applicant who has decided not to pursue the visa is not slowing the processing of my application. Am I correct in thinking that?

Hi Brit,
I am a DV 2020 winner from Aus and thankfully have been granted an exemption to leave the country. My question is, I have all the support documentation but my only concern is if a new medical is required? I know you have mentioned some people have been asked at the border, the lawsuit doesnโt really specify on this topic. The only issue is half of the Aus is in lockdown, travelling to get one before I leave in mid August may be difficult. Could this be a big enough reason to be rejected entry into the USA by the CBP?

Hi Shanna, Jonathan here. I am in the same boat as yourself- I’ll be moving, finally, to the U.S. in a few days. I actually emailed the U.S. Consulate here in HK and was told there we do NOT need a new medical certificate.(We would need a referral letter from the Consulate before heading to the Clinic, so they would know). Simon mentioned in a previous email that some people have bee asked by Immigration officers at Point of Entry for a new one, but worst case scenario, according to Simon, we can be offered a parole and have in done in the U.S.

I have also emailed the embassy here and am awaiting their reply (at least to take some proof with me from the Embassy if they say itโs not required) . I also did read about the parole as a worst case scenario but wanted to try and have it organised before departure which I donโt think is going to be a possibility with the lockdowns. I would love to hear how you go when you do finally arrive in the States, what a crazy journey this has been, hey! I am planning to leave on the 19th and very much praying for a smooth journey. Hi again Shanna, thanks for the follow-up. I’ve been so busy packing and tying loose ends that I’m thankful that if need be, we could have an updated medical done in the U.S. I’m leaving for the U.S. in a few days. On that note, Jordan Cunnings from Innovation Law Lab mentioned an important point that our visas do not automatically have a 6-month extension from February 24th, but rather an extension period based on our visa’s initial validity period. In my case, it would be around 5 months and 20 days. Doing the math, I have until around August 13th to enter, so I’m taking no chances. I’ll bring along the State Department’s PP10014 Recession statement and the CBP statement, along with the U.S. Consulate’s email(they couldn’t offer me any additional documentation for verification)to the airport.
Packing has been a real puzzle- mostly books, files, and more books. Best of luck!

Why on earth have you booked the flight for the final day of the extension??? The order was granted on Feb 19 and gave 6 months additional validity from 1) the date the bans are rescinded; 2) 3/31 when the bans expire; or 3) the final judgment, whichever comes first.
So – the first day is Feb 19 and you are assuming 6 calendar months from then. So – you must enter on (or preferably before) August 19. Does you flight arrive on the 19th? What happens if the flight is delayed? Why on earth would you add that stress to travel on the very last day?

I based my flight off the final date of the extension being the 24th of August (6 months from the date PP10014 was rescinded) this is the information I have received from the USA Sydney embassy as well as the USA dep of state website.
This is the first time I have read that there was a sooner deadline to travel before the 19th of August (the date Mehta Issued his ruling 19th of Feb) otherwise I absolutely would have organised a sooner flight. Do you happen to have any information which highlights this?

Shanna – as Jonathan pointed out – you are fine. 24th is the main deadline. There is the issue of your original validity – but that is a nuance that a CBP officer might not understand anyway.

Hi Shanna- Simon already self-corrected himself. It’s 6months(or around thereof) from the cancellation of PP10014. Either ways, we’re cutting it close, especially for someone like myself, whose initial visa lasts around 5 months 20 days(Feb obviously only has 28 days, etc). I actually wanted to go back in March at least to activate my visa. However, as I have been the primary carer for my mother, I didn’t have enough time to find a temp carer, as I was also working towards a postgrad essay to be submitted. Anyways, I managed to find a carer this time, and my mum had Occupational Therapy training too. This time around, it may be a longer-term move(the shipping company Sevenseas collected my boxes yesterday- I had to upload tons of documents on their system to validate our visa, etc). This is personal, but too much stress and tension at home, feel disrespected by my father at home, in spite of my efforts to care for her. I think it’s time for a fresh start.

I successfully managed to get my boarding pass from Cathay Pacific and now waiting for my flight. I showed them all the relevant pertaining information as mentioned before. The Cathay airport staff had to phone CBP directly to confirm- CBP had to calculate the number of days I still had left, etc., then Cathay had to punch down some info, ESTA style apparently. Shanna, I still suggest you based your visa validity on how many days it was initially valid for, as it would be a safer option? Anyways, good luck to all- heading from HK to Los Angeles then onto Houston, Texas. Thanks.

They should not be asking for new medicals, but yes some people have been. They will still admit you, but my ask for a medical screening later. The court order says nothing about medicals, so don’t take any crap from a CBP officer.

Hello Simon, I am honoured to say that I made it through customs at the LAX airport and now am officially a U.S. Permanent Resident! After passing the documents to the first POE officer, I had to go to another room for visa verification. Lots of people waiting, and I had a 2 hour or so wait. Thankfully, the next Officer was very polite and understanding, and the only thing he needed to read was the verification email from the U.S Consulate in HK. And that was it- he didn’t even ask me to pass the medical report. I just arrived in Houston this afternoon, and now staying in a downtown hotel before taking the next steps. Seeing the Houston skyline for the 1st time is something I’ll never forget. Thank you again Simon, I would NOT be here if it were not for you. Blessings.

Thanks so much Shanna, blessings to you too. Houston is lovely- I don’t have access to a car, so thankful that the main places around the downtown is accessible by foot. Also, there is a fairly good rail system so should be able to get where I need to go- of course, there’s always Uber. Cost of things, especially taxi rides, not as low-cost as Hong Kong(even though a financial powerhouse city), so we gotta be careful. Also, foods here, even simple pastries are really high calorie, ha. By the ways, we should also mark which date our visa was initially issued as well as initial expiry, then calculate the exact number of days? Better to err on the safe side. Take care and Godspeed!

Not every number represents an actual case. There are plenty holes in between.

No predictions at this time – but you should learn about case numbers and so on. The 58000 number is in Africa – whereas the 55000 number is globally. But that in itself is not the way to consider her chances.

It was defaulted to no then – but you could have changed it. However, it’s not really a problem – you can change it at interview.

Just wanted to let everybody know that KCC finally unlocked my DS yesterday, 2.5 months after I asked them to unlock it on May 13th.
Since I originally submitted the form on may 8th (the announcment day), does this amendment (work history related stuff) make my application go all the way to the back of the line, or my form is still being processed based on the initial submission date?
